Perceptions Of Individuals With Disabilities In The Justice Systemabout Their Transition Preparation, Justine Nicole Howarth
Perceptions Of Individuals With Disabilities In The Justice Systemabout Their Transition Preparation, Justine Nicole Howarth
Theses and Dissertations
This study gathered information about adults with disabilities who were served with special education services during high school and incarcerated after high school, on their job preparation plan and explored the effects of that preparation on the individual's perception of successful transition after high school. It also investigated what, if anything, could have been done in high school to prevent their entrance or continuation in the criminal justice system. Due to the difficulty in accessing this population, only three individuals were interviewed. However, the rich information provided from this study indicated that to help them live independently and successfully transition …

What Is The Future Of Transitional Justice?, Makau Wa Mutua
Journal Articles
This piece explores and critiques the project of transitional justice. It has been more than a quarter of a century since transitional justice burst onto the global stage. Over the years it has come to be billed as a panacea for addressing deeply embedded social and political dysfunction after periods of mass repression and violence. Many theorists and policy makers have argued that it is a key bridge to sustainable peace, democracy and human rights. But the historical record is not clear about a direct causal relationship between transitional justice mechanisms and specific outcomes in post-conflict societies. In some cases, …

The Relationship Between Age Of Onset Of Drug Use, Drug Dependence, Mental Disorders, And Offense Type And Severity, Kimberly Diane Gallo
Electronic Theses, Projects, and Dissertations
This study examines the relationship between age of onset of drug use and later drug dependence, and that of age of onset of drug use and current offense type/severity. In addition, it investigates the relationship between mental disorders, drug dependence, and current offense type/severity. Data from years 2007 to 2010 of the Arrestee Drug Abuse Monitoring Program II (ADAM II) were used. The analyses included cross tabulation and chi square. The results indicated that early onset marijuana users (those who began using at age fourteen or younger) were more likely to develop drug dependence than late onset users of marijuana. …

Should The Medium Affect The Message? Legal And Ethical Implications Of Prosecutors Reading Inmate-Attorney Email, Brandon P. Ruben
Should The Medium Affect The Message? Legal And Ethical Implications Of Prosecutors Reading Inmate-Attorney Email, Brandon P. Ruben
Fordham Law Review
The attorney-client privilege protects confidential legal communications between a party and her attorney from being used against her, thus encouraging full and frank attorney-client communication. It is a venerable evidentiary principle of American jurisprudence. Unsurprisingly, prosecutors may not eavesdrop on inmate-attorney visits or phone calls or read inmate-attorney postal mail. Courts are currently divided, however, as to whether or not they can forbid prosecutors from reading inmate- attorney email.
This Note explores the cases that address whether federal prosecutors may read inmates’ legal email. As courts have unanimously held, because inmates know that the Bureau of Prisons (BOP) monitors all …

Criminal Infliction Of Emotional Distress, Avlana K. Eisenberg
Criminal Infliction Of Emotional Distress, Avlana K. Eisenberg
Michigan Law Review
This Article identifies and critiques a trend to criminalize the infliction of emotional harm independent of any physical injury or threat. The Article defines a new category of criminal infliction of emotional distress (“CIED”) statutes, which include laws designed to combat behaviors such as harassing, stalking, and bullying. In contrast to tort liability for emotional harm, which is cabined by statutes and the common law, CIED statutes allow states to regulate and punish the infliction of emotional harm in an increasingly expansive way. In assessing harm and devising punishment, the law has always taken nonphysical harm seriously, but traditionally it …

Bullycide: An Exploration Of The Prevalence Of Potential Indicators Comparing Lgbtiq And Heterosexual Adults, Isai Valdez
Electronic Theses, Projects, and Dissertations
This investigative study explores bullycide. Bullycide is the act of committing suicide because of bullying. The primary objective of this research was to compare Lesbian, Gay, Bisexual, Transgender, Intersex, Queer (LGBTIQ) (n = 41) and heterosexual (n = 20) respondents and the prevalence of potential bullycide indicators. By surveying (N = 61) adults, a comparison was made among respondents and their coping mechanisms to bullying. The study found that both sub-groups face an equally high tendency of coping with anger over discomfort (.017). The study also found that both sub-groups demonstrate a high likelihood of responding to bullying by withdrawing …

Ethics are standards of right and wrong that prescribe what humans ought to do; principles such as veracity, courage, integrity, forthrightness, consistency, creativity, humility, altruism, quality, accountability, excellence, compassion, innovation, social justice, wisdom, kindness, trust, balance and fairness. Creating a mission statement offers one the opportunity to establish which principles are most important and helps reinforce them when tested.
Universal Jurisdiction, The Alien Tort Statute, And Transnational Public-Law Litigation After Kiobel, Ernest A. Young
Universal Jurisdiction, The Alien Tort Statute, And Transnational Public-Law Litigation After Kiobel, Ernest A. Young
Duke Law Journal
The Alien Tort Statute (ATS), enacted in 1789 as part of the first Judiciary Act, provides that “[t]he district courts shall have original jurisdiction of any civil action by an alien for a tort only, committed in violation of the law of nations . . . .” Although the statute lay dormant until the 1980s, the ATS has since become the font of transnational public-law litigation in American courts. This litigation, frequently involving largely foreign parties and events, is a form of civil-side universal jurisdiction. Like more traditional forms of universal jurisdiction, the ATS allows American courts to hear human-rights …

Staying Connected: Keeping Justice-Involved Youth “Close To Home” In New York City, Jeffrey A. Butts, Laura Negredo, Evan Elkin
Publications and Research
When justice-involved youth are supervised by local agencies and placed with locally operated programs rather than being sent away to state facilities, they are better able to maintain community ties. They stay connected with their families, and they are more likely to remain in local schools. Policy reforms that localize the justice system are often called “realignment.” New York’s “Close to Home” (or C2H) initiative is a prominent example of youth justice realignment. Launched in 2012, it is the latest chapter in a decade-long commitment by New York State and New York City to improve the justice system for young …

Foreign Precedents In Constitutional Adjudication By The Supreme Court Of Singapore, 1963-2013, Jack Tsen-Ta Lee
Foreign Precedents In Constitutional Adjudication By The Supreme Court Of Singapore, 1963-2013, Jack Tsen-Ta Lee
Research Collection Yong Pung How School Of Law
This article surveys the use of foreign precedents in constitutional adjudication by the Supreme Court of Singapore for over a half century during the terms of the first three Chief Justices—Wee Chong Jin (1963–1990), Yong Pung How (1990–2006), and Chan Sek Keong (2006–2012)—and the first year in office of the fourth Chief Justice, Sundaresh Menon (2012–2013). It concludes that while judges have always cited foreign case law, they have only actually applied foreign cases where the wording of the Constitution and the constitutional arrangements in Singapore are fairly analogous to the constitutional texts and arrangements upon which the cases were …

Using Principles From Cognitive Behavioral Therapy To Reduce Nervousness In Oral Argument Or Moot Court, Larry Cunningham
Nevada Law Journal
Sarah, a new attorney at a public defender’s office, is assigned to the appeals bureau. Ordinarily, Sarah spends her days researching and writing briefs, talking with clients, and brainstorming legal issues with colleagues. Today, however, she opened the mail to find a notice from the court setting a date for her first oral argument. She suffers the first of several anxiety attacks: rapid heart rate, racing thoughts, shortness of breath, sweaty palms, nausea, and feelings of panic and tension. As she reads the form letter, her hands tremble. This is the day she has dreaded. She loves to write and …

Gamified Digital Forensics Course Modules For Undergraduates, Yin Pan, David Schwartz, Sumita Mishra
Presentations and other scholarship
Cyber security and forensics are among the most critical areas of national importance with a rising demand for knowledgeable professionals. In response to the increasing need for advanced studies in forensics, we propose game-based modules using the game-based learning approach that enable first-year students to learn basic digital forensics concepts without pre-requisite knowledge. This paper focuses on the design and development of an interactive game framework and the educational digital forensics modules that will be plugged into the game framework in a real computing environment. In contrast to the traditional teaching approaches, this modular approach will use game-based learning and …
