From Burlesque To Grand Theft Auto: An Historical Analysis Of The Treatment Of The Media-Crime Relationship In Criminology Texts, Lisa Kort-Butler, Michael Killingsworth Apr 2015

From Burlesque To Grand Theft Auto: An Historical Analysis Of The Treatment Of The Media-Crime Relationship In Criminology Texts, Lisa Kort-Butler, Michael Killingsworth

Department of Sociology: Faculty Publications

The degree to which criminological scholarship on the mediacrime relationship has been subject to the tides of moral panics is not well-understood, although there are theoretical reasons to hypothesize about the role of scientists in moral panics. Textbooks are one location in which a discipline chronicles its scholarly history and speaks to the public, making texts an important site for understanding how scholars interpret the media-crime relationship. A content analysis of over 200 criminology texts, ranging in publication dates from 1880 to 2012, was conducted. Almost half the texts covered the media-crime relationship. These texts often appeared to be responding …

Deathscapes In Neoliberal Times: Prisonfare, Workfare And Resistance As Potential Outcomes For Black Youth, Ebony Rose Apr 2015

Deathscapes In Neoliberal Times: Prisonfare, Workfare And Resistance As Potential Outcomes For Black Youth, Ebony Rose

College of Education Theses and Dissertations

This paper defines and unpacks Loic Wacquant’s concepts of Workfare and Prisonfare, coupled with a discussion of Tendayi Sithole’s concept of Deathscapes and his appropriation of Achille Mbembe’s Necropolitics as to why urban schools are poverty storage facilities for black youth. I address the centrality of the states social and penal policies in the reconfiguration of urban schools under a death politic guided by the deployment of both a neoliberal-paternalism and antiblack racist methodology. I argue, through the creation of workfare and prisonfare those urban schools eradicate black existence by conditioning low-income black students for low-wage labor or the prison. …

Coase-Sandor Institute for Law & Economics Research Paper Series

Criminal law enforcement depends on the actions of public agents such as police officers, but there is no standard economic model of police as public agents. We seek to remedy this deficiency by offering an agency model of police behavior. We begin by exp

Six Overrulings, Andrew Koppelman Apr 2015

Six Overrulings, Andrew Koppelman

Michigan Law Review

John Paul Stevens, who retired in 2010 at the age of ninety after more than thirty-four years on the Supreme Court, has capped his astoundingly distinguished career by becoming an important public intellectual. He reviews books, gives high-profile interviews, wrote a memoir of the chief justices he has known, and has now written a second book. Six Amendments revisits half a dozen old, lost battles. Stevens appeals over the heads of his colleagues to a higher authority: the public. Now that he is off the Court, Stevens explains why six decisions in which he dissented should be overruled by constitutional …

The Attorney General As Lawyer (?): Confidentiality Upon Resignation From Cabinet, Andrew Flavelle Martin Apr 2015

The Attorney General As Lawyer (?): Confidentiality Upon Resignation From Cabinet, Andrew Flavelle Martin

Dalhousie Law Journal

The unique role of the attorney general raises several special issues oflegal ethics. This paper addresses one previously unaddressed: whether it is appropriate for the attorney general to publicly announce his or her reasons for resighing from Cabinet. Unlike other ministers, the attorney general is almost always a practicing lawyer and thus bound not only by Cabinet solidarity and Cabinet confidentiality, but also by the lawyer's professional duty of confidentiality and by solicitor-client privilege. The paper begins by canvassing a hierarchy ofreasons for a principled resignation and the rare historical examples where these have occurred. It then turns to the …

What Is Criminal Law About?, Guyora Binder, Robert Weisberg Apr 2015

What Is Criminal Law About?, Guyora Binder, Robert Weisberg

Journal Articles

In a recent critique, Jens Ohlin faults contemporary criminal law textbooks for emphasizing philosophy, history and social science at the expense of doctrinal training. In this response, we argue that the political importance of criminal law justifies including reflection about the justice of punishment in the professional education of lawyers. First, we argue that both understanding and evaluating criminal law doctrine requires consideration of political philosophy, legal history, and empirical research. Second, we argue that the indeterminacy of criminal law doctrine on some fundamental questions means that criminal lawyers often cannot avoid invoking normative theory in fashioning legal arguments. Finally, …

A History Of Antisocial Personality Disorder In The Diagnostic And Statistical Manual Of Mental Illness And Treatment From A Rehabilitation Perspective, Mallory Cole Houser

Research Papers

This paper researched publications and articles to understand the history of antisocial personality disorder in the DSM. Upon gaining information regarding the history and diagnostic criteria of the antisocial personality disorder in the DSM, the author of this paper sought to provide knowledge of counseling techniques to be used by rehabilitation counselors and other counseling professionals when treating antisocial personality disorder. Many people diagnosed with antisocial personality disorder find themselves in the criminal justice system and have many problems involving interactions and socialization with others in the community. Culturally Relevant Pedagogy In Public Education, Mariela Flores Apr 2015

Culturally Relevant Pedagogy In Public Education, Mariela Flores

Capstone Projects and Master's Theses

Current and projected demographics, as well as data reflecting high school completion rates across ethnic groups in the U.S. demand a reexamination of pedagogical approaches in public schools. Despite substantial research demonstrating the success that Culturally Relevant Pedagogy (CRP) has with students of color, it remains a widely underutilized approach. This paper investigates factors inhibiting the use of CRP with Latino students. The researcher interviewed two English teachers at an East Salinas high school with a 98% Latino student body. Teachers were asked how they feel about CRP, what are factors inhibiting its implementation and what could be done to …

Prisoners' Rights Lawyers' Strategies For Preserving The Role Of The Courts, Margo Schlanger Apr 2015

Prisoners' Rights Lawyers' Strategies For Preserving The Role Of The Courts, Margo Schlanger

Articles

This Article is part of the University of Miami Law Review’s Leading from Below Symposium. It canvasses prisoners’ lawyers’ strategies prompted by the 1996 Prison Litigation Reform Act (“PLRA”). The strategies comply with the statute’s limits yet also allow U.S. district courts to remain a forum for the vindication of the constitutional rights of at least some of the nation’s millions of prisoners. After Part I’s introduction, Part II summarizes in several charts the PLRA’s sharp impact on the prevalence and outcomes of prison litigation, but demonstrates that there are still many cases and situations in which courts continue to …

Advocating For Pregnant Women In Prison: Georgia Can Do Better, Nancy Webb, Madison Gates Apr 2015

Advocating For Pregnant Women In Prison: Georgia Can Do Better, Nancy Webb, Madison Gates

Journal of the Georgia Public Health Association

Background: Women are the fastest growing segment of the U.S. prison populace and approximately 1 in 25 were pregnant when they were incarcerated. However, women, including pregnant women, are receiving unacceptable health care in correctional systems. Further, many correctional systems lack policies to protect the best interest of incarcerated women, mothers and their children.

Methods: We reviewed the literature on pregnant women in prison and found that corrections has been slow in making changes and adapting facilities for women, especially related to pregnancy, parenting skills and nurseries. It has been suggested the parent-infant attachment and the involvement incarcerated parents have …

Ban The Box: A Call To The Federal Government To Recognize A New Form Of Employment Discrimination, Christina O'Connell Apr 2015

Ban The Box: A Call To The Federal Government To Recognize A New Form Of Employment Discrimination, Christina O'Connell

Fordham Law Review

As the number of Americans with criminal histories grows significantly, states and cities across the nation have reacted by adopting ban-the-box laws. Ban-the-box laws received their name because they ban the criminal history box on initial hiring documents. The goal of the ban-the-box movement is to promote job opportunities for persons with criminal records by limiting when an employer can conduct a background check during the hiring process and encouraging employers to take a holistic approach when assessing an applicant's fit for a position.

There is no federal ban-the-box law, but states have taken varying approaches to adopting ban-the-box statutes. …

An Exploration Of Negative Family Factors And Substance Use Amongst Adolescents: The Lasting Effects Of Family Substance Use, Parental Criminality, And Parental Corporal Punishment, Melissa Ann Murray

Masters Theses

Studies have shown that there is a connection between negative family influences and adolescent deviance. The purpose of this study was to investigate how negative family factors may lead to adolescent substance use. The study examines literature that suggests that negative family factors may trigger adolescent substance use. This study utilized secondary data from the 1995 National Survey of Adolescents in the United States (Kilpatrick and Saunders, 1995). A representative sample of adolescents (ages 12-17) and adult parents from the United States was analyzed (n = 4,023). This study examined the direct effects negative family factors have on adolescent alcohol …

The Depiction Of The Holocaust Within The Theme Of Escape In Michael Chabon's The Amazing Adventures Of Kavalier & Clay, Deirdre Toeller-Novak Apr 2015

The Depiction Of The Holocaust Within The Theme Of Escape In Michael Chabon's The Amazing Adventures Of Kavalier & Clay, Deirdre Toeller-Novak

Masters Theses

Escape sounds like a ram’s horn throughout Michael Chabon’s The Amazing Adventures of Kavalier and Clay, looming large in the lives of his mostly Jewish characters. Only one, Josef Kavalier, is intimately tied to and escapes the Holocaust which destroys his entire family. The horrors of the Holocaust, however, cast a shadow that hovers over nearly every chapter of Chabon’s 636-page novel. For most of the novel’s other characters, intent on plotting their own escapes, the events of the Holocaust remain 4,000 miles away. Americans, Jew and gentile, politically astute and clueless, laborer and capitalist, prefer to maintain a …

Wild West Campus: A Discussion On Concealed Weapons And The College Campus, Luke W. Mcminn

Senior Honors Theses

This thesis reviews the recent history of gun-related violence on college campuses in relation to gun control laws and argues whether college campuses should allow students and teachers with Carrying a Concealed Weapon permits to carry these weapons on campus, or if such a policy would merely exacerbate the issue at hand. The purpose of this thesis is to show that such a policy is effective, safe, and overall a benefit to the campus atmosphere and experience. Important points considered include the legal history of carrying concealed weapons, the current policies of universities concerning students carrying concealed weapons, the opinions …

Small Data Surveillance V. Big Data Cybersurveillance, Margaret Hu

Faculty Publications

This Article highlights some of the critical distinctions between small data surveillance and big data cybersurveillance as methods of intelligence gathering. Specifically, in the intelligence context, it appears that "collect-it-all" tools in a big data world can now potentially facilitate the construction, by the intelligence community, of other individuals' digital avatars. The digital avatar can be understood as a virtual representation of our digital selves and may serve as a potential proxy for an actual person. This construction may be enabled through processes such as the data fusion of biometric and biographic data, or the digital data fusion of the …

Body-Mounted Police Cameras: A Primer On Police Accountability Vs. Privacy, Kami Chavis Simmons

Faculty Publications

Immediately following the shooting death of Michael Brown in Ferguson, Missouri and the death of Eric Garner at the hands of a New York Police Department officer, criminal justice advocates called for greater measures to hold police officers accountable for their actions. For many observers, the failure to secure criminal indictments against the officers involved in each of these deaths of unarmed citizens suggested various shortcomings in the criminal justice system.

One of the most hotly contested reform proposals involves requiring police officers to wear body cameras. The NAACP, the ACLU, and The Lawyers' Committee for Civil Rights Under Law …

Solving Batson, Tania Tetlow Apr 2015

Solving Batson, Tania Tetlow

William & Mary Law Review

The Supreme Court faced an important ideological choice when it banned the racial use of peremptory challenges in Batson v. Kentucky. The Court could either ground the rule in equality rights designed to protect potential jurors from stereotyping, or it could base the rule on the defendant’s Sixth Amendment right to an “impartial jury” drawn from a “fair cross-section of the community.” By choosing the equal protection analysis, the Court turned away from the defendant and the fair functioning of the criminal justice system, and instead focused on protecting potential jurors. In doing so, the Court built a fatal error …

Griggs At Midlife, Deborah A. Widiss Apr 2015

Griggs At Midlife, Deborah A. Widiss

Michigan Law Review

Not all Supreme Court cases have a midlife crisis. But it is fair to say that Griggs v. Duke Power Co., which recently turned forty, has some serious symptoms. Griggs established a foundational proposition of employment discrimination law known as disparate impact liability: policies that significantly disadvantage racial minority or female employees can violate federal employment discrimination law, even if there is no evidence that the employer “intended” to discriminate. Griggs is frequently described as one of the most important decisions of the civil rights era, compared to Brown v. Board of Education for its “momentous social consequences.” In 1989, …
