Taser Time: Electroshock Injustice Coming Soon To Athens-Clarke County, Donald E. Wilkes Jr.
Taser Time: Electroshock Injustice Coming Soon To Athens-Clarke County, Donald E. Wilkes Jr.
Popular Media
On Sunday, Apr. 19, 2015, an article in the daily newspaper in Athens announced that Athens-Clarke County Police have already received a shipment of 145 tasers and will soon begin using them on the citizenry of this county.
Although taser electroshock devices are technically classified as nonlethal weapons, this means only that their purpose is to avoid fatalities, not that they are incapable of resulting in fatalities. Use of a nonlethal weapon may and sometimes does result in death or serious injury. In recent years, at least 600 Americans, perhaps as many as 1,000, have died suddenly, unexpectedly, or shortly …
Addressing Access To Justice Through New Legal Service Providers: Opportunities And Challenges, Alice Woolley, Trevor C. W. Farrow
Addressing Access To Justice Through New Legal Service Providers: Opportunities And Challenges, Alice Woolley, Trevor C. W. Farrow
Articles & Book Chapters
Most informed observers of the Canadian and American legal systems accept the existence of a significant crisis in access to justice. One possible solution is to permit paralegals, notaries or other licensed individuals with training more limited than that enjoyed by a licensed attorney to practice in certain areas of law. This paper supports these developments, arguing for a regulated and incremental introduction of new legal service providers into the legal services market. It considers the appropriate training and scope of practice for new legal service providers, and some of the associated opportunities and challenges.

Globalization And The Sex Trafficking Industry: Examination Of Effects On Regional Value Chain Operations, Mary R. Gilbertson
Globalization And The Sex Trafficking Industry: Examination Of Effects On Regional Value Chain Operations, Mary R. Gilbertson
Honors Theses, 1963-2015
The purpose of this paper is to examine sex trafficking as a profitable, international, and illegal industry. One goal of this paper is to explain what sex trafficking is and how it differs from other industries. Sex trafficking is an underground activity and its growth worldwide since the 1980s has had a destructive impact on global societies and economies. Beyond this, the study wants to show that, aside from moral and socio-cultural implications, that sex trafficking is indeed an industry, with a structure not so different from other industries. Understanding sex trafficking as an industry is critical to understanding how …
Constructing Victims In The International Criminal Court: A Critical Discourse Analysis, Valerie King
Constructing Victims In The International Criminal Court: A Critical Discourse Analysis, Valerie King
Pursuit - The Journal of Undergraduate Research at The University of Tennessee
The International Criminal Court (ICC) was established in 1998 to address serious crimes of concern to the international community, including genocide and crimes against humanity, among others. This paper examines the construction of victims in ICC proceedings. Through a critical discourse analysis of ICC web pages and other documents intended for victims, I argue that the ICC’s construction of victims reproduces criminal justice logics, which marginalize victims and denies them agency. Said marginalization occurs in an effort to balance retributive and restorative justice. Discourses concerning the role and agency of victims in the Court reproduce institutional neglect and disempowerment.

Mass incarceration. In recent years it’s become clear that the size of America’s prison population is unsustainable – and isn’t needed to protect public safety.
In this remarkable bipartisan collaboration, the country’s most prominent public figures and experts join together to propose ideas for change. In these original essays, many authors speak out for the first time on the issue. The vast majority agree that reducing our incarcerated population is a priority. Marking a clear political shift on crime and punishment in America, these sentiments are a far cry from politicians racing to be the most punitive in the 1980s …
Criminal Minds: The Relationship Between Sport And Off Field Violence, Danielle M. Falck
Criminal Minds: The Relationship Between Sport And Off Field Violence, Danielle M. Falck
Sport Management Undergraduate
The purpose of this study was to determine if a relationship existed between type of sports team and player convicted of a crime involving bodily harm off the playing field in the National Basketball League (NBA) and National Football League (NFL). This research was beneficial to the academic community because it further developed which professional sport participants were more engaged in violent acts out of the boundaries of their respective sports. This study allowed future researchers the opportunity to build off this study in hopes of building off of what is already known. This study was conducted with a cross …

The Effects Of Inclusion And Pull-Out Models: Emotionally, Socially And Academically, Ashley Bais
The Effects Of Inclusion And Pull-Out Models: Emotionally, Socially And Academically, Ashley Bais
Special Education Masters Program Theses
The purpose of this study was to explore whether the traditional pull-out method or the inclusion model was more effective for students with disabilities, both emotionally and academically. This study focused on the emotional effect that pull-out and inclusion models had on students with disabilities. It also compared the academic growth of elementary school-aged children with disabilities within the pull-out and inclusion classrooms. The results of this study indicated that children with disabilities are more likely to get bullied than their non-disabled peers. Bullying effects children’s incentive to do well in school. In addition to bullying, students are more likely …

Biology, during the last decade in particular, is making substantial headway into our social theories of business and behavior. While the social sciences rush to keep up with the advancement of knowledge, we highlight the need for an ethics discussion to also keep pace. Although the implications to theory are important, our focus is on how new knowledge has the capacity to alter the formulation and practice of business policy, which we believe is potentially profound. Furthermore, the ethicality of a set of issues can depend heavily on one’s perspective, and differing views may not always be compatible. With this …

Will Beijing Reconsider Its Maritime Strategy In The South China Sea Following The Melting Of The Arctic?, Nalanda Roy
Will Beijing Reconsider Its Maritime Strategy In The South China Sea Following The Melting Of The Arctic?, Nalanda Roy
Robert Ingram Strozier Lecture Series
China is asserting its territorial and maritime claims in the East and South China Sea. But as strategic questions are being raised about the SCS dispute, another issue of growing importance for China is the Arctic. China has become increasingly serious about the consequences of the melting Arctic as this would have a major impact on China’s future economy, and also open up more available routes with a lower risk of piracy. Interestingly, this research will analyze whether Beijing will learn how to share and bear, due to her increasing quest for natural resources in the Arctic thereby undermining its …

Confronting Cops In Immigration Court, Mary Holper
William & Mary Bill of Rights Journal
Part I of the Article outlines the police report problem by discussing the four situations in which police reports are used in immigration court, why police reports are unreliable, and the scope of the problem. Part II discusses criminal laws treatment of police reports, focusing on the Confrontation Clause of the Sixth Amendment, which provides the constitutional justification for excluding police reports in criminal cases. Part III discusses the use of hearsay evidence in immigration cases, where hearsay is allowed due to the characterization of removal proceedings as civil, not criminal. While there has been a trend to reject unreliable …
