Social Media Thoughtcrimes, Daniel S. Harawa
Social Media Thoughtcrimes, Daniel S. Harawa
Pace Law Review
As people live out their lives online, what is protected expression and what is criminal speech? This article begins to explore this fine distinction, and advocates for a shift in the way online speech is protected vis-à-vis the First Amendment. Part I provides examples of criminalized social media activity and explores why people seemingly treat online speech as private communications. Part II looks at existing jurisprudence regarding the criminalization of speech and First Amendment protections. And Part III attempts to determine where to draw the line by advocating for a return to simpler times in First Amendment jurisprudence.
Investigating Jurors On Social Media, Caren Myers Morrison
Investigating Jurors On Social Media, Caren Myers Morrison
Pace Law Review
This essay proceeds in three parts. First, it examines the current state of jury investigations, and how they differ from those conducted in the past. Then, it describes the evolving legal and ethical positions that are combining to encourage such investigations. Finally, it offers a note of caution–condoning such investigations while keeping them hidden from jurors may be perceived as unfair and exploitative, risking a possible backlash from outraged jurors. Instead, I propose a modest measure to provide notice and explanation to jurors that their online information is likely to be searched, and why.

#Snitches Get Stitches: Witness Intimidation In The Age Of Facebook And Twitter, John Browning
Pace Law Review
In order to better understand witness intimidation in the age of social media, one must examine both the forms it has taken as well as the response by law enforcement and the criminal justice system. As this article points out, the digital age has brought with it a host of new ways in which witnesses may be subjected to online harassment and intimidation across multiple platforms, and those means have been used to target not only victims and fact witnesses but even prosecutors and expert witnesses as well. The article will also examine potential responses to the problem of witness …

The 2014 Digital Forensics Research Experience for Undergraduates (REU) Program at the University of Alabama at Birmingham (UAB) focused its summer efforts on tracking criminal forums and Facebook groups. The UAB-REU Facebook team was provided with a list of about 60 known criminal groups on Facebook, with a goal to track illegal information posted in these groups and ultimately store the information in a searchable database for use by digital forensic analysts. Over the course of about eight weeks, the UAB-REU Facebook team created a database with over 400 Facebook groups conducting criminal activity along with over 100,000 unique users …

What Is Religious Liberty?, Donald Roth
What Is Religious Liberty?, Donald Roth
Faculty Work Comprehensive List
"So what is religious liberty? In looking at this question, we should parse the two questions that are embedded in the larger question, looking at religion and liberty for religion separately. From this, especially given the nature of religion, I hope to give some insight into what religious liberty should be, why that is so difficult to achieve, and why Christians have an abiding confidence despite this difficulty."

The Role Of Offender Perception In Treatment Outcome For Male Perpetrators Of Intimate Partner Violence With Co-Occurring Substance Dependency, Andrea Desisti
Theses
Background. This study was designed to address a possible interaction of distorted cognitive processes associated with substance dependency and intimate partner violence (IPV), and the affects on subsequent behavior. Objectives. The primary focus was to investigate the relationship between offender perception (i.e., perception of family problems [FP] and perception of need for treatment for family problems [FPTx]) and treatment outcome (i.e., substance use and violence), among a unique sample of substance dependent male offenders of intimate partner violence. Additional investigations included: (1) the change in perception from baseline to the end of treatment, and (2) treatment modality in relation to …

The International Market: Designing An E-Commerce Experience To Promote Different Cultures, Marina Minnikova
The International Market: Designing An E-Commerce Experience To Promote Different Cultures, Marina Minnikova
Theses
Learning different cultures and promoting international trade can be implemented through web design and marketing. Most e-commerce websites implement design and marketing strategies in an efficient way, however none of them implement the idea of exploring international cultures through purchasing experiences.
This thesis project implements a complex brand identity and determines how to effectively create an e-commerce website employing the ideas of shopping as an online trip (“out shopping”), providing several categories of products for particular user segments. A significant part of the project focuses on determining which graphic elements are applicable for a specific design situation.
Community Crime Mapping: Increasing Predictive Policing With Dynamic Symbol Sets, Michael Chaszczewski
Community Crime Mapping: Increasing Predictive Policing With Dynamic Symbol Sets, Michael Chaszczewski
Theses
Crime prevention is an important area of study in our society that plays an integral role in the lives of citizens and the local police who enlist the aid of strategic counter crime plans to tackle the urgency created everyday when crimes are committed. This mode of counter acting crime is termed “problem oriented policing” and is a policing approach where individual pieces of police data are critically examined with the hope that the findings learned will lead to discovering a new and more effective counter crime strategy. Crime mapping is one of these analyzed tools allowing officers to understand …

Crime, Institutions And Sector-Specific Fdi In Latin America, Luisa Blanco, Isabel Ruiz, W. Charles Sawyer, Rossitza Wooster
School of Public Policy Working Papers
In this article, we explore how crime and institutions affect the flow of capital in the form of foreign direct investment (FDI) to Latin American and Caribbean countries in the primary, secondary and tertiary sectors during the 1996-2010 period. We use three different variables related to violent crime: homicides, crime victimization, and an index of organized crime. We find that there is a correlation between the institutional and crime variables, where the significance of institutional variables tends to disappear when the crime variables are added to the model. We find that higher crime victimization and organized crime are associated with …
Corrections Reform In Kosovo: A Qualitative Study Of Canadian Corrections Advisers’ Experiences In A Post-Conflict Environment, Danielle Murdoch
Corrections Reform In Kosovo: A Qualitative Study Of Canadian Corrections Advisers’ Experiences In A Post-Conflict Environment, Danielle Murdoch
Criminal Justice Faculty Publications and Presentations
This case study of corrections reform in Kosovo contributes to the growing academic literature on corrections reform during peacebuilding missions in post-conflict environments. Fourteen Canadian corrections advisers who were deployed to Kosovo between 1999 and 2006 were interviewed about the dynamics and challenges they experienced abroad. Interview transcripts were coded and analysed using NVivo10. Five key themes emerged from the data: the importance of understanding the local context; the prevalence of corruption; the lack of attention and resources devoted to corrections reform in post-conflict Kosovo; the challenges of providing safe and secure confinement for prisoners detained in facilities staffed by …

The International Criminal Court In Crisis: Is Local Outreach The Route To Stability?, Taylor J. Kilpatrick
The International Criminal Court In Crisis: Is Local Outreach The Route To Stability?, Taylor J. Kilpatrick
Undergraduate Honors Theses
The International Criminal Court is at the forefront of the international transitional justice realm today. Despite its omnipresence, there is a seemingly ceaseless succession of arguments against the Court. As this disapproval abounds, it effectively obscures the specific issues at hand. The strain on the interaction between global and local levels of justice within the scope of the ICC arguably underscores the entire crisis situation. More specifically, there is a seemingly unbridgeable distance, both physical and cultural, between the entity of the ICC and the local communities it purportedly serves. This paper seeks to address the absence of local narratives …

Drug Violence And Public (In)Security: Mexico's Federal Police And Human Rights Abuse, Dominic Pera
Undergraduate Honors Theses
Violence in Mexico, with dramatic political, social, and economic consequences on both Mexican and US populations, has risen dramatically in the past decade. Research has shown that the Mexican military is largely responsible for human rights abuses in Mexico. This paper will seek to answer why there are so many human rights abuses committed by the Federal Police, as public security is a police role and its deterioration threatens lives, security, and the rule of law. This paper will look at what scholars have said about the causes of police violence and public insecurity. Some say that history is responsible, …

People In Alaska's Sex Trade: Their Lived Experiences And Policy Recommendations, Tara Burns
People In Alaska's Sex Trade: Their Lived Experiences And Policy Recommendations, Tara Burns
Communication
Much policy has been created in the last several years regarding people in Alaska's sex trade. Although researchers and government agencies have called attention to the need for evidence based policy about prostitution and sex trafficking, there had been no research about the characteristics of people in Alaska's sex trade or the effects of policy on those people. This research filled that hole. As action research, this study provided a means for the voices of a hidden, criminalized population to reach policy-makers. This research was grounded in a participatory worldview and triangulated data from surveys, interviews, and public records. Emergent …

A Phenomenological Investigation Of The Reporting Experience For Female Survivors Of Sexual Assault On College Campuses, Candace N. Park
LSU New Orleans Theses and Dissertations
A qualitative phenomenological design was used to explore the lived experiences of college women who reported sexual assault to law enforcement officials. Utilizing a feminist conceptual framework, the purpose of the present study was to identify the essence of the reporting experience for college women who experienced a sexual assault. Six college women agreed to participate in the study. Semi-structured interviews were conducted with open-ended questions to better understand the experience of the phenomenon under investigation. The Modification of the Stevick-Colaizzi-Keen Method of Analysis of Phenomenological Data (Moustakas, 1994) was utilized for analysis of the data collected in order to …
