Another Casualty Of The War . . . Vagrancy Laws Target The Fourth Amendment, T. Leigh Anenson
Akron Law Review
This Comment will review the origins of the vagrancy law and its traditional abuses. It will then examine decisions discussing the vagrancy law's constitutionality under the Due Process clause void-for-vagueness doctrine and the courts' attempted remedy of explicit standards as to place, scope, or purpose. The remainder of this Comment will discuss the constitutionality of these revised vagrancy laws under the Fourth Amendment's prohibition of unreasonable seizures.

Immigrant Residential Concentration And Ethnic Economy As Correlates Of Violent Crime Rates: Can Ethnic Enclave Theory Help Solve The Immigrant Paradox?, Feodor Alexeiivitch Gostjev
Open Access Dissertations
A large number of studies show that immigrant residential concentration is associated with lower crime rates. These findings challenge public opinion which consistently links immigration with higher crime rates and the predictions made by some social scientists regarding the life chances of immigrants in America. The negative association between immigration and crime is often referred to as the immigrant paradox. Recently, immigrant enclave theory has emerged as the key explanation of the immigrant paradox. This theory was originally developed by sociology of immigration scholars. In this dissertation I argue that criminologists have failed to properly integrate immigrant enclave theory into …

Is Ohio Juvenile Justice Still Serving Its Purpose?, Susan A. Burns
Akron Law Review
This Comment begins with an introduction to the history and purpose of the juvenile justice system, and the procedure for transferring juveniles to adult courts. Part II discusses the United States Supreme Court cases that began eroding the original purpose of the juvenile court by affording juveniles some of the same constitutional rights enjoyed by adult offenders. Part III focuses on Ohio's present juvenile transfer procedure to adult court, discussing the broad discretionary power given to juvenile court judges in electing to do so. Part IV describes the criteria Ohio juvenile court judges use to determine whether to transfer juveniles, …
Punishment By Family And Community In Katherine Anne Porter's Noon Wine, Robert Batey
Punishment By Family And Community In Katherine Anne Porter's Noon Wine, Robert Batey
Akron Law Review
So crime and death permeate Noon Wine, but the novel is also a story of family and community. With evocative detail, Porter portrays the lives and relationships of the defendant Royal Earle Thompson, his wife Ellie, and their sons Arthur and Herbert, who mature from childhood to adolescence during the story. As the novel focuses on the young boys' propensity to play with the prized possessions of the farmhand Olaf Helton, his harmonicas, the reader learns how father, mother, and farmhand (for Helton grows to be "'one of the family"') participate in the trying task of childrearing.

Justice Blackmun And Criminal Justice: A Modest Overview, Stephen L. Wasby
Justice Blackmun And Criminal Justice: A Modest Overview, Stephen L. Wasby
Akron Law Review
Justice Harry A. Blackmun was nominated for a position on the Supreme Court in 1970 by President Richard M. Nixon after the Senate rejected Nixon's nominations of Judges Clement Haynsworth and G. Harrold Carswell. Blackmun, as a judge of the U.S. Court of Appeals for the Eighth Circuit for eleven years, had written opinions that reflected "judicial restraint, an appreciation for the limits of judicial authority and deference to state and legislative prerogatives" as well as conservatism on defendants' rights and civil liberties issues. These strains of thought made him attractive to a president looking for someone supporting the "war …
Imagery, Politics, And Jury Reform, Christopher E. Smith
Imagery, Politics, And Jury Reform, Christopher E. Smith
Akron Law Review
The Rodney King cases focused a public spotlight on the role and consequences of jury decisions at a moment in history when juries have become the objects of politically-motivated reform efforts. The juxtaposition of political reactions to the King cases and contemporary efforts to reform the power of juries provides an enlightening illustration of underlying issues about both the jury's proper role in the American governing system and the political interests pushing for jury reform.
Unanimity On The Rehnquist Court, Thomas R. Hensley, Scott P. Johnson
Unanimity On The Rehnquist Court, Thomas R. Hensley, Scott P. Johnson
Akron Law Review
The unanimous decision making process is an intriguing phenomenon. However, the process of justices with different backgrounds, attitudes, and perceptions uniting on a decision raises many difficult questions for judicial scholars. Despite these challenges, the limited amount of knowledge in the area of unanimous decision making is troubling because such decisions constitute a sizable portion of judicial decisions. For example, nearly one-half of the Court's decisions were unanimous during the 1996-1997 term. Given the Court's penchant for unanimity, it is obvious that research into this area can contribute substantially toward explaining the behavior of the Justices on the Court. Thus, …

Part II provides the reader with a general overview of the events leading up to the adoption of the guidelines and the manner in which they operate.10 Part III discusses the effect of the guidelines' quantity-based approach to criminal investigations. Part IV describes the role of the traditional "entrapment" defense, and Part V details the development of the "sentence entrapment" defense. Part VI analyzes the viability of the sentence entrapment defense, suggesting possible successful methods for raising the defense, and discusses the harms caused by the …
Neo-Federalism, Popular Sovereignity, And The Criminal Law, Terrance M. Messonnier
Neo-Federalism, Popular Sovereignity, And The Criminal Law, Terrance M. Messonnier
Akron Law Review
The first area is the substantive criminal law, especially at the federal level. In the following pages, this Article will discuss, from a Neo-Federalist perspective, the wide variety of laws found mostly in Title 18 of the United States Code that form our federal criminal law. This Article will suggest that there are both constitutional and pragmatic needs to reexamine what behavior should be punished on a federal level.
The second area is the law regarding criminal procedures. This Article will suggest, from the perspective of Popular Sovereignty, that the current trend to jealously guard jurisdictional prerogatives is not constitutionally …

Scalia, Property, And Dolan V. Tigard: The Emergence Of A Post-Carolene Products Jurisprudence, David Schultz
Akron Law Review
This Article proposes an analysis of Scalia's views on property rights and shows how the Justice has been important to, if not the leader in, the current rethinking of takings and land use jurisprudence." Also, this Article will engage in a more comprehensive reevaluation of the jurisprudence of the Carolene Products Era that is transpiring both off and on the Court. While previous works have examined Rehnquist's and his Court's views on property, as well as Scalia's views on expressive freedoms criminal due process, and church/state issues, there is no comprehensive discussion addressing Scalia's views on property rights. To accomplish …
Can Soldiers Be Peace Officers? The Waco Disaster And The Militarization Of American Law Enforcement, David B. Kopel, Paul M. Blackman
Can Soldiers Be Peace Officers? The Waco Disaster And The Militarization Of American Law Enforcement, David B. Kopel, Paul M. Blackman
Akron Law Review
One of the most significant trends of federal law enforcement in the last fifteen years has been its militarization. The logical, perhaps inevitable, consequence of that militarization was seen in the disaster at Waco, Texas, resulting in the deaths of four federal agents, and seventy-six other men, women, and children. In this article, we use the Waco tragedy as a starting point to examine the militarization of federal law enforcement, and similar trends at the state and local level.
Part Two of this article sets forth the details and rationale of the Posse Comitatus Act--the 1878 law forbidding use of …
The Impact Of New Justices: The U.S. Supreme Court And Criminal Justice Policy, Christopher E. Smith
The Impact Of New Justices: The U.S. Supreme Court And Criminal Justice Policy, Christopher E. Smith
Akron Law Review
The Supreme Court is an important policy-making institution. In criminal justice, for example, the high court issues decisions affecting institutions, actors, and processes throughout the justice system, from police investigations through corrections and parole. The Court's policy decisions affecting criminal justice are produced by the votes of the nine justices who select, hear, decide, and issue opinions in cases. It is widely recognized, and probably axiomatic, that the Supreme Court's decision-making patterns are determined by the Court's membership at any given moment in history. When five or more justices support a specific outcome in a case, they can form a …

The Shift Of The Balance Of Advantage In Criminal Litigation: The Case Of Mr. Simpson, David Robinson Jr.
Akron Law Review
The intense public interest in the extraordinary trial and acquittal of Mr. O.J. Simpson provides an appropriate occasion to look at the criminal justice system more generally, to note where we have been in the balance of advantage between prosecution and defense, where we are now, and where, perhaps, we should be.

Fleeing Cuba: A Comparative Piece Focused On Toro And The Options Victims Of Domestic Violence Have In Seeking Citizenship In The United States And Canada, Kiersten M. Schramek
Pace International Law Review
The United States Court of Appeals for the Eleventh Circuit decided a case on February 4, 2013 that has undoubted international implications. Toro v. Sec’y dealt with the language of the Cuban Refugee Adjustment Act of 1966 (CAA) and the provisions of the Violence Against Women Act (VAWA).
This article focuses on how and why the court reached its decision. It analyzes the conflict between the “plain language” of the CAA and its statutory construction to rebut the court’s assertion that the VAWA self-petition was irrelevant in this case, and ultimately, offer an alternative analysis to this case.

Representation By Counsel Or Access To Defense Resources: Utah’S Single Source Approach To Indigent Defense, John P. Gross
Representation By Counsel Or Access To Defense Resources: Utah’S Single Source Approach To Indigent Defense, John P. Gross
Washington and Lee Law Review Online
The State of Utah has a unique way of providing representation in criminal cases to defendants who are too poor to hire an attorney. In Utah, there is no statewide funding or supervision of indigent defense. Each county, city, or town is responsible for creating and funding their own indigent defense delivery system. Utah is one of only two states in the United States—Pennsylvania is the other—that fails to provide state funding or oversight of indigent defense. But what makes Utah truly unique is the way in which counties and municipalities are required to structure their indigent defense delivery systems. …

Banks
Reversals Of Precedent And Judicial Policy-Making: How Judicial Conceptions Of Stare Decisis In The U.S. Supreme Court Influence Social Change, Christopher P. Banks
Akron Law Review
This article analyzes if Justice Marshall is correct in castigating the Rehnquist Court and asserting that it is destroying the rule of law through its stare decisis jurisprudence. It concludes that Justice Marshall is only partially correct. While the ideological direction of its jurisprudence has shifted to the right, the Court’s behavior in reversing itself is normal and does not endanger the Court’s legitimacy or its faithful adherence to law. A fair assessment of the Rehnquist Court’s precedent cases indicates that they are reversals which were decided in times of natural court instability and rapid membership change. As a result, …
