An Examination Of A Self-Determination Strategy On Academic Engagement For Students With Emotional Support Needs At Risk Of Dropout, Edward Sczesniak Jan 2016

An Examination Of A Self-Determination Strategy On Academic Engagement For Students With Emotional Support Needs At Risk Of Dropout, Edward Sczesniak

Graduate Theses & Dissertations

A multiple baseline across teacher design was used to examine the effectiveness of a self-determination self-regulation intervention to address the academic engagement and performance of students with emotional disabilities. The intervention, Plan, Work, Evaluate, Adjust, was introduced into secondary emotional support classrooms in the following order: Science, English, Social Studies, and Math. Dependent variables were on-task behavior, work completion, and redirections.
There were four female participants in either tenth or eleventh grade. All received instruction in emotional support classrooms for core content instruction.
Results using the multiple baseline design were mixed for the four participants with trends toward increases in …

Incentivizing Private Scientific Companies To Go Public, Kyle Landrigan Jan 2016

Incentivizing Private Scientific Companies To Go Public, Kyle Landrigan

Emory Business Law Review Perspectives

In the wake of a private company, Moon Express, being approved for a lunar landing by the US government it begs the question, 'what is to follow?' Companies in this field are in the planning phases of projects that would significantly advance society; however, the inability to raise capital through private sources slows development. Funding for projects would be easier raised through the public sector. The SEC should incentivize private companies to go public by relaxing reporting requirements. The relaxed requirements would allow the company to focus more on developing technology and less on preparing reports that will reflect that …

Securitizing American Justice, Kevin Engelberg Jan 2016

Securitizing American Justice, Kevin Engelberg

Emory Business Law Review Perspectives

Federal, State, and local governments currently securitize critical infrastructure projects and government contracts. This is an effective tool governments can use to raise funds without having to spend taxpayer dollars. Looking at private-sector involvement in America's justice system, Kevin Engelberg argues America is close to securitizing prisons and legal claims. Engelberg warns that securitizing aspects of the justice system risks creating the image that the justice system is owned or beholden to the private sector. A recent survey has found the public feels the American Justice system is largely ineffective. Engelberg worries securitization will greatly weaken the already cynical public …

A Rose By Any Other Name: Regulating Law Enforcement Bulk Metadata Collection, Stephen E. Henderson Jan 2016

A Rose By Any Other Name: Regulating Law Enforcement Bulk Metadata Collection, Stephen E. Henderson

Faculty Articles

In Other People’s Papers, Jane Bambauer argues for careful reform of the Fourth Amendment’s third party doctrine, providing an important contribution to an increasingly rich field of scholarship, judicial opinion, statute, and law reform. Bambauer is especially concerned with access to bodies of third-party data that can be filtered and mined, as they can be privacy invasive but also effective and less subject to traditional investigative prejudices and limitations. Although her article provocatively overclaims in trying to set itself apart from existing proposals, by analyzing existing constitutional and statutory law—including what I have termed a “limited” third party doctrine—and comparing …

Equality Before The Law? Evaluating Criminal Case Outcomes In Canada, Michael Trebilcock, Albert Yoon Jan 2016

Equality Before The Law? Evaluating Criminal Case Outcomes In Canada, Michael Trebilcock, Albert Yoon

Osgoode Hall Law Journal

One of our most strongly held ideals is that individuals receive equal treatment under the law. Incidents of wrongful conviction or wide disparities in sentencing, however, challenge this premise. While legal scholars have recently examined this premise, our understanding remains largely normative or anecdotal. Scholars have begun to identify factors that influence legal outcomes, yet this question has remained largely unexplored in Canada. This article seeks to advance this inquiry. Using unique data from both the Ontario courts and Legal Aid Ontario during 2007–2013, we find that outcomes in routine criminal cases vary in ways not summarily explained by differences …

Importance Of State Law In Police Reform, Roger L. Goldman Jan 2016

Importance Of State Law In Police Reform, Roger L. Goldman

All Faculty Scholarship

Most articles on police reform concern the role of federal courts in enforcing constitutional rights under the fourth, fifth and sixth amendments through application of the exclusionary rule, criminal prosecution of law enforcement officers and pattern and practice suits brought against police departments. Additionally, much has been written about the need for civilian review of departmental discipline at the local level. In contrast, the focus of this article is on state law. On the one hand, state criminal prosecution of officers involved in shootings of unarmed, Black suspects has been shown to be ineffective because of the unwillingness of prosecutors …

Criminals Behind The Veil: Political Philosophy And Punishment, Chad Flanders Jan 2016

Criminals Behind The Veil: Political Philosophy And Punishment, Chad Flanders

All Faculty Scholarship

There is evidence everywhere that our criminal justice system is undergoing a crisis of practice. Increased police violence and the concomitant distrust of police in many communities, fear of aggressive enforcement tactics more generally, worries about widespread governmental surveillance and, above all, a concern with overcriminalization and mass incarceration-these are the dreary and familiar stuff of daily headlines. But, this crisis of practice in tum reflects a deeper crisis of how we theorize about criminal law. We lack, for the most part, any worked-out theory of what the policing and processing of crime should look like. Nor do we have …

Ps V Ontario: Rethinking The Role Of The Charter In Civil Commitment, Isabel Grant, Peter J. Carver Jan 2016

Ps V Ontario: Rethinking The Role Of The Charter In Civil Commitment, Isabel Grant, Peter J. Carver

Osgoode Hall Law Journal

In PS v Ontario, the Ontario Court of Appeal held that section 7 of the Charter requires that persons who are civilly committed for six months or more must have access to meaningful review over the conditions of their detention. In this paper, the authors argue that the decision has broad implications for provincial civil commitment regimes across the country. In particular, the Court’s analogy to the Criminal Code Review Board jurisprudence opens the door to a fuller recognition of the profound deprivation of liberty involved in civil commitments. An expanded role for civil review tribunals may be required, including …

#Sayhername Captured: Using Video To Challenge Law Enforcement Violence Against Women, Amber Baylor Jan 2016

#Sayhername Captured: Using Video To Challenge Law Enforcement Violence Against Women, Amber Baylor

Faculty Scholarship

Recorded encounters between women of color and police officers have been invaluable in bringing the reality of these interactions into the living rooms of otherwise unknowing Americans. The recordings are instrumental pieces of documentation and evidence, with the power to impact verdicts and galvanize the domestic struggle for human rights outside of the courtroom. They also are fraught with ethical issues that must be addressed by attorneys and activists hoping they effect change. Complexities such as implicit biases, editing and sourcing of videos, anonymity for those attacked and bystanders, and vicarious trauma on affected communities complicate use of violent police …

Leveling The Playing Field: Sport And Resistance In Low-Wealth Communities, Danielle Jo Thomas Jan 2016

Leveling The Playing Field: Sport And Resistance In Low-Wealth Communities, Danielle Jo Thomas

LSU Doctoral Dissertations

A consequence of systemic racism in the United States is low-wealth minority neighborhoods that are segregated from the rest of society and whose residents have less opportunities for social mobility than the general population. These neighborhoods often become the target of post-racial neoliberal projects of community development that emphasize individual development and achievement, or assisting residents with “escaping” their community as a means of achieving social mobility. One of the major forms of development is sport for development, aimed at youth in low-wealth minority neighborhoods. Here I call for a new narrative of community development that is critical, taking into …
