The Alleged “Ferguson Effect” And Police Willingness To Engage In Community Partnership, Scott E. Wolfe, Justin Nix Jan 2016

The Alleged “Ferguson Effect” And Police Willingness To Engage In Community Partnership, Scott E. Wolfe, Justin Nix

Criminology and Criminal Justice Faculty Publications

In response to increasing violent crime rates in several U.S. cities over the past year, some have pointed the finger of blame at de-policing, a result of the so-called “Ferguson Effect.” Although the Ferguson Effect on crime rates remains an open question, there may also be a Ferguson Effect on other aspects of police officers’ jobs, such as willingness to partner with community members. This study used data from a cross-sectional survey of 567 deputies at an agency in the southeastern U.S. to accomplish 2 objectives: (a) to determine whether the Ferguson Effect is associated with de-policing in the form …

How Cognitive Genetic Factors Influence Fertility Outcomes: A Mediational Sem Analysis, Michael A. Woodley Of Menie, Joesph A. Schwartz, Kevin M. Beaver Jan 2016

How Cognitive Genetic Factors Influence Fertility Outcomes: A Mediational Sem Analysis, Michael A. Woodley Of Menie, Joesph A. Schwartz, Kevin M. Beaver

Criminology and Criminal Justice Faculty Publications

Utilizing a newly released cognitive Polygenic Score (PGS) from Wave IV of Add Health (n = 1,886), structural equation models (SEMs) examining the relationship between PGS and fertility (which is approximately 50% complete in the present sample), employing measures of verbal IQ and educational attainment as potential mediators, were estimated. The results of indirect pathway models revealed that verbal IQ mediates the positive relationship between PGS and educational attainment, and educational attainment in turn mediates the negative relationship between verbal IQ and a latent fertility measure. The direct path from PGS to fertility was non-significant. The model was robust to …

Nebraska Juvenile Diversion Programs 2012 To 2015, Lindsey Wylie, Anne M. Hobbs, Juvenile Justice Institute, University Of Nebraska At Omaha Jan 2016

Nebraska Juvenile Diversion Programs 2012 To 2015, Lindsey Wylie, Anne M. Hobbs, Juvenile Justice Institute, University Of Nebraska At Omaha

Reports

In Nebraska, approximately 4,000 youth are referred to a juvenile diversion program annually. From 2012 to 2015, the majority of cases (87.0%) referred to juvenile diversion programs involved a law violation. Data from juvenile diversion programs indicates that Black youth are referred to diversion at twice the rate at which they appear in the population, whereas Asian and Native American youth are under-represented in juvenile diversion. Ideally we would examine how this compares to juveniles stopped by law enforcement for law violations, but this data is not consistently available in Nebraska. Without access to law enforcement stops, the underlying reasons …

Gaining Understanding Of Human Services Professionals: A Survey Of Nohs Membership, Narketta Sparkman-Key, Alyssa Reiter Jan 2016

Gaining Understanding Of Human Services Professionals: A Survey Of Nohs Membership, Narketta Sparkman-Key, Alyssa Reiter

Counseling & Human Services Faculty Publications

Through a survey of the National Organization for Human Services (NOHS), this article examines the demographics, credentials, and interest in becoming involved in the human services profession as well as in advocacy efforts for human services issues. It is hoped that the findings will be used to further define the nature of the human services professional, to expand recruitment efforts by NOHS, to assist in conference planning, and to help define curriculum standards within human services accreditation.

Inclusion Of "Human Service Professional" In The Standard Classification Occupation System, Narketta Sparkman-Key, Edward S. Neukrug

Counseling & Human Services Faculty Publications

The human services field has continued to grow, and today, it is considered one of the major social services professions. Despite its establishment, the Standard Occupational Classification (SOC) continues to exclude the term “human service professional” from its classification system. This manuscript encourages advocacy for such inclusion.

"State Inaction," Equal Protection, And Religious Resistance To Lgbt Rights, James M. Oleske, Jr. Jan 2016

"State Inaction," Equal Protection, And Religious Resistance To Lgbt Rights, James M. Oleske, Jr.

University of Colorado Law Review

Now that the Supreme Court has held that states must recognize same-sex marriages, a new issue looms on the horizon: Must states also protect against sexual-orientation discrimination in the private marketplace? This Article contends that the answer under the Equal Protection Clause is "yes" for the forty-five-plus states that protect against marketplace discrimination on the basis of race, religion, national origin, and sex.

In the course of reaching that conclusion, this Article offers much-needed clarification of the Court's unsettled "state inaction" doctrine. Under that doctrine, a state's failure to act may be immunized from challenge on the ground that the …

Wtf Is #Modelminoritymutiny?: Solidarity, Embodiment, And Practice In Subverting Ascribed Asian American Racial Positioning, Pamela Ng Jan 2016

Wtf Is #Modelminoritymutiny?: Solidarity, Embodiment, And Practice In Subverting Ascribed Asian American Racial Positioning, Pamela Ng

Scripps Senior Theses

In 2014, in the wake of #BlackLivesMatter, a call to action was made for Asian Americans to actively engage with and unlearn the age old model minority myth and join the movement for racial justice. This thesis seeks to understand and complicate what it means to subvert this ideology in the way of #modelminoritymutiny. It is divided into three primary sections: first, a theoretical framework and of the model minority myth throughout time as a tool for positioning Asian Americans; second, an application of this framework into the recent Peter Liang and Akai Gurley case this past year; and third, …

The Influence Of Economic Ideologies On U.S. K-12 Education Policy: Testing, Markets, And Competition, Corinna M. Svarlien Jan 2016

The Influence Of Economic Ideologies On U.S. K-12 Education Policy: Testing, Markets, And Competition, Corinna M. Svarlien

Scripps Senior Theses

The Elementary and Secondary Education Act (ESEA) was first passed in 1965 and has since been reauthorized several times, including as No Child Left Behind in 2001 and the Every Student Succeeds Act of 2015. The ESEA seeks to address the needs of low-income students; however, decades of reform efforts and government reports documenting inequality have done little to close gaps in educational resources or outcomes for marginalized groups. Accountability systems based on standardized testing are seen by policymakers on the Left and Right as the best way to improve education for marginalized groups, improve students’ economic preparedness, hold schools …

“Why Can’T Run ‘Like A Girl’ Also Mean Win The Race?”: Commodity Feminism And Participatory Branding As Forms Of Self-Therapy In The Neoliberal Advertising Space, Katherine B. Marcus Reker Jan 2016

“Why Can’T Run ‘Like A Girl’ Also Mean Win The Race?”: Commodity Feminism And Participatory Branding As Forms Of Self-Therapy In The Neoliberal Advertising Space, Katherine B. Marcus Reker

Scripps Senior Theses

This thesis proposes a critical study of the techniques and motives behind modern commodity feminist advertising, focusing on the appropriation of the “young girl” as a symbol of the feminist cause. This evolving trend in advertising, building upon new movements of empowerment and the recent proliferation of the online feminist space, is shifting the logics of consumption by marketing feminist ideology and activism through consumer purchasing power. By prompting consumers to believe that their purchases can make a significant change, companies are developing brand loyalty in their key marketing demographics by using the image and rhetoric of the “young girl” …

Imprisonment Inertia And Public Attitudes Toward "Truth In Sentencing", Michael M. O'Hear, Darren Wheelock Jan 2016

Imprisonment Inertia And Public Attitudes Toward "Truth In Sentencing", Michael M. O'Hear, Darren Wheelock

Social and Cultural Sciences Faculty Research and Publications

In the space of a few short years in the 1990s, forty-two states adopted truth in sentencing (“TIS”) laws, which eliminated or greatly curtailed opportunities for criminal defendants to obtain parole release from prison. In the following decade, the pendulum seemingly swung in the opposite direction, with thirty-six states adopting new early release opportunities for prisoners. However, few of these initiatives had much impact, and prison populations continued to rise. The TIS ideal remained strong. In the hope of developing a better understanding of these trends and of the prospects for more robust early release reforms in the future, the …

Alcohol Outlet Density And Intimate Partner Violence In A Nonmetropolitan College Town: Accounting For Neighborhood Characteristics And Alcohol Outlet Types, Aleksandra J. Snowden Jan 2016

Alcohol Outlet Density And Intimate Partner Violence In A Nonmetropolitan College Town: Accounting For Neighborhood Characteristics And Alcohol Outlet Types, Aleksandra J. Snowden

Social and Cultural Sciences Faculty Research and Publications

There is a growing evidence of an ecological association between alcohol outlet density and intimate partner violence. It is reasonable to assume, however, that not all types of alcohol outlets contribute equally to criminal behavior, and to date, most ecological studies have been of large urban cities. Using Bloomington, Indiana, block groups as units of analysis and controlling for several structural characteristics associated with violence rates, I estimated spatially lagged regression models to determine if the variation in alcohol outlet density, including total outlets and disaggregating by on- and off-premise outlets, is related to intimate partner violence density. Results suggested …

Perceptions Of Stalking: The Influence Of Perpetrator Mental Disorder Diagnosis, Target-Perpetrator Gender, And Perpetrator Persistence, Ebonnie Landwehr Jan 2016

Perceptions Of Stalking: The Influence Of Perpetrator Mental Disorder Diagnosis, Target-Perpetrator Gender, And Perpetrator Persistence, Ebonnie Landwehr

Theses: Doctorates and Masters

Stalking is a complex phenomenon that results in significant harm to victims. For this reason, it is vital that knowledge and understanding of the behaviour be continually advanced. The aim of the present study was to investigate the influence of perpetrator mental disorder diagnosis, target-perpetrator gender, and persistence on perceptions of stalking. Although psychiatric diagnoses are prevalent among clinical stalker populations, little is known about how the presence of a perpetrator mental disorder may influence perceptions of stalking. Both target-perpetrator gender and persistence have been found to have an effect on perceptions of stalking, however it is not understood if …

In Memory Of Monroe Freedman: The Hardest Question For A Prosecutor, Bennett L. Gershman Jan 2016

In Memory Of Monroe Freedman: The Hardest Question For A Prosecutor, Bennett L. Gershman

Elisabeth Haub School of Law Faculty Publications

I’ve chosen to honor Monroe Freedman’s iconic essay on the hardest questions for a criminal defense attorney by posing the same question for prosecutors. What is the hardest question for a prosecutor? This in itself is a hard question. The thousands of federal, state, and local prosecutors in the country would likely give widely varying responses – discretionary charging, immunity grants, bargained pleas, unreliable witnesses, police testimony, and disclosure duties, for starters. Too, prosecutors are not a generic group. Just as some defense lawyers might recoil or be indifferent to Freedman’s provocative thesis, so might many prosecutors reject or be …

The Prosecutor’S Duty Of Silence, Bennett L. Gershman Jan 2016

The Prosecutor’S Duty Of Silence, Bennett L. Gershman

Elisabeth Haub School of Law Faculty Publications

Prosecutors enjoy broad opportunities to communicate with the public outside the courtroom. Justice Holmes’s famous dictum -- “The theory of our system is that conclusions to be reached in a case will be induced only by evidence and argument in open court, and not by any outside influence, whether of private talk or public print” – is just that – a “theory.” The reality is otherwise. Prosecutors, and defense lawyers too, engage in extrajudicial speech frequently, and often irresponsibly. But in contrast to other lawyers, prosecutors have a higher “special” duty to serve justice rather than a private client. And …

Anomie In The Oil Patch? An Examination Of Durkheim’S Anomie Theory Through A Case Study Of The Bakken Region, Fred Matthew Jones Jan 2016

Anomie In The Oil Patch? An Examination Of Durkheim’S Anomie Theory Through A Case Study Of The Bakken Region, Fred Matthew Jones

Theses and Dissertations

Emile Durkheim serves as one of the seminal contributors to the field of sociology; his contributions to criminology are numerous as well. Many authors consider Durkheim’s concept of anomie to be his most important contribution to the field of criminology (Lunden, 1972). Durkheim’s anomie theory has been subject to extensive empirical examination, these efforts have resulted in disparate findings. Graeff and Mehlkop (2007) insist this lack of coherence is due to improper operationalization of Durkheim’s anomie by some researchers. In particular, it is the utilization of cross sectional data in these previous studies which contributes to these disparate results. The …

Public Opinion About Police Use Of Body-Worn Cameras, Deanne Paulsen Jan 2016

Public Opinion About Police Use Of Body-Worn Cameras, Deanne Paulsen

Theses and Dissertations

There has been a significant increase in media attention about encounters between police officers and the public which have ended badly, sometimes in injury or death. These events have increased public concern about police conduct. Because of these events and the adverse publicity they have generated, many police departments have begun using body-worn cameras. The police use of body-worn cameras raises many important issues such as their effects on privacy and police-community relations. Because police departments have just recently begun using body cameras, there has been limited research on them. Consequently, the current study examined whether the public favors the …
