Prosecutorial Discretion And Environmental Crime Redux: Charging Trends, Aggravating Factors, And Individual Outcome Data For 2005-2014, David M. Uhlmann May 2019

Prosecutorial Discretion And Environmental Crime Redux: Charging Trends, Aggravating Factors, And Individual Outcome Data For 2005-2014, David M. Uhlmann

Law & Economics Working Papers

In a 2014 article entitled “Prosecutorial Discretion and Environmental Crime,” I presented empirical data developed by student researchers participating in the Environmental Crimes Project at the University of Michigan Law School. My 2014 article reported that 96 percent of defendants investigated by the United States Environmental Protection Agency and charged with federal environmental crimes from 2005 through 2010 engaged in conduct that involved at least one of the aggravating factors identified in my previous scholarship, namely significant harm, deceptive or misleading conduct, operating outside the regulatory system, and repetitive violations. On that basis, I concluded that prosecutors charged violations that …

Effect Of Pretrial Detention In Oregon: Testimony To The Senate And House Judiciary Committees, Christopher M. Campbell, Ryan M. Labrecque May 2019

Effect Of Pretrial Detention In Oregon: Testimony To The Senate And House Judiciary Committees, Christopher M. Campbell, Ryan M. Labrecque

Criminology and Criminal Justice Faculty Publications and Presentations

What is the relationship between pretrial detention and sentencing outcomes in Oregon? This presentation examines the effect of being detained through disposition, and the effect of days spent in detention. The data shows that, controlling for all other measures, fully detained defendants are over twice as likely to be incarcerated. This probability increases the longer a person is detained. The authors believe this means that counties should continue to explore ways to reduce pretrial detention, be more selective in holding defendants over 30 days, and should examine different pretrial risk assessments.

Stop, Question, And Frisk: A Tool Of Racial Control In New York City, Justice D. Evans May 2019

Stop, Question, And Frisk: A Tool Of Racial Control In New York City, Justice D. Evans

Student Theses

Broken Windows policing through the utilization of Stop, Question, and Frisk has been widely used by the New York City Police Department (NYPD) since the 1990s, as guaranteed by landmark Supreme Court Case Terry v. Ohio (1968). As a result, hundreds of minority citizens have been the victim of routine stops for minor offenses through this aggressive police tactic. This study utilizes 2017 NYPD Stop, Question, and Frisk Data to determine whether broken windows policing, through stop, question, and frisk, operates as a mode of racial control for African Americans in New York City. Through the utilization of chi-square analyses, …

Examining The Impact Of Victimization On Girls’ Delinquency: A Study Of Direct And Indirect Effects, Johanna Peterson, Dana D. Dehart, Emily Wright May 2019

Examining The Impact Of Victimization On Girls’ Delinquency: A Study Of Direct And Indirect Effects, Johanna Peterson, Dana D. Dehart, Emily Wright

Faculty and Staff Publications

Previous research has acknowledged that there is a relationship between victimization and later delinquency, but the specific attributes of this relationship are unclear because measures of both direct and indirect victimization are rarely explored in a single study. We included both indirect and direct victimization to examine which form of victimization was a stronger predictor of substance use, fighting, running away, and sex work among girls committed to a juvenile justice facility. Findings indicated that direct victimization was typically a more salient predictor of delinquency than indirect forms of victimization. Further, running away and sex work appear to be unique …

How Schools Encourage Incarceration: The School-To-Prison Pipeline And How It Fails Our Children, Madeline S. Buss May 2019

How Schools Encourage Incarceration: The School-To-Prison Pipeline And How It Fails Our Children, Madeline S. Buss

University Honors Theses

In the United States, mass incarceration is a way of life. In this literature review, the link between harsh policies in schools, punishment, and later odds of incarceration are explored- with a special interest on the disproportionate impact for students of color. Through literature reviews and analysis, I will examine the primary causes of the school-to-prison pipeline (STPP). The researchers examined spanned many disciplines (education, to criminology, to psychology) and methodological approaches, including qualitative, quantitative, and mixed-method. The findings were near unanimous; policies in schools that sought to punish or enforce zero-tolerance were disproportionately punitive toward students of color, most …

Havelian Presidency: A Study In Theory & Practice, Chelsea Johnson May 2019

Havelian Presidency: A Study In Theory & Practice, Chelsea Johnson

Undergraduate Honors Theses

Despite former dissident and Czech president Václav Havel’s widespread influence, his presidency has not been seriously considered as a framework for how one should head a government. A reasoned and thorough examination of Havel’s presidency is conspicuously absent in the existing literature. Havel is known for and evaluated most in terms of his sweeping moral principles and philosophical treatises, but I wish to know whether his 13-year presidency passes the test of ideal world leadership that he provides so clearly in his written works and speeches. Specifically, I develop a set of ideal traits for world leadership and then examine …

May Issue Vs. Shall Issue Concealed Carry Laws: An Exploration Of The Breakdown Of Crime, Victim Relationship And Location, Patrick R. Mazzella, Christopher Carey

University Honors Theses

This thesis takes an exploratory look at shall issue and may issue concealed carry laws using a comparative study with a sample of may issue states and shall issue states. The comparison is done over 3 sections: general crime rate, location of incidents and victim relationship to the offender. While the study found some patterns significant within the data, the lack of sufficient sample size severely limits the weight of anything found. Within the data, however, the study found a possible relationship between shall issue states and a higher percentage of romantic partner offenders, and a higher percentage of offenses …

Immigration and Human Rights Law Review

Article 1 section 8 of the United States Constitution give the U.S. government enumerated powers to establish a uniform rule on Naturalization. To carry out these duties, 8 U.S. Code § 1227 gives the government the power to initiate removal proceedings against non citizens who are undocumented or may have lost their status in the U.S. However, before removal proceedings commence, the government per 8 U.S. Code § 1229 has to send a Notice to Appear (NTA) to the non-citizen. An NTA is a written notice given to the non-citizen about the nature of proceedings against the non-citizen, the legal …

Individualized Sentencing, William W. Berry May 2019

Individualized Sentencing, William W. Berry

Washington and Lee Law Review

In Woodson v. North Carolina, the Supreme Court proscribed the use of mandatory death sentences. One year later, in Lockett v. Ohio, the Court expanded this principle to hold that defendants in capital cases were entitled to “individualized sentencing determinations.” The Court’s reasoning in both cases centered on the seriousness of the death penalty. Because the death penalty is “different” in its seriousness and irrevocability, the Court required the sentencing court, whether judge or jury, to assess the individualized characteristics of the offender and the offense before imposing a sentence. In 2012, the Court expanded this Eighth Amendment concept …

Equitable Academia For Students With Disabilities, Mia Cremer

University Honors Theses

Higher education has been historically ableist based on the exclusivity of academia. This qualitative study describes how the identity of students with disabilities changes through academia. The study included semi-structured interviews with four students with disabilities who are registered with the Disability Resource Center at PSU University. Narrative inquiry revealed how the students’ experience in academia revealed the infrastructure, ableism, accessibility, and classroom climate. The social model of disability provided the theoretical framework throughout the study. The social model of disability identifies how the environmental, social factors, and attitudes towards a person with an impairment prevents them from achieving equity. …

"Not Tea And Crumpets": The 1976 Louisiana Governor's Conference On Women And The Formation Of A New Women's Platform, 1972-1982, Vickie A. Lacoste

LSU New Orleans Theses and Dissertations

The success of three Louisiana feminists in the 1970s, Fran Bussie, Clarence Marie Collier, and Pat Evans stemmed from their professional expertise in labor rights, education, and politics, respectively. By joining and maintaining memberships in a variety of social, civic, and activists groups, these feminist leaders via the 1976 Louisiana Governor’s Conference on Women created a unique network that allowed for the formation of a new women’s platform. This conference advanced women’s rights, established a working platform for reform, and helped usher in second-wave feminism in Louisiana. Using conference booklets, archived video and audio interviews, and newspaper articles, this thesis …
