Exploring Ways To Bring Culturally Relevant Pedagogy Into Rehabilitative Programs, Reginold P. Daniels
Exploring Ways To Bring Culturally Relevant Pedagogy Into Rehabilitative Programs, Reginold P. Daniels
Doctoral Dissertations
The present study analyzes the effectiveness of a culturally relevant prison rehabilitation program carried out with 41 inmates at a California jail. The aspect of prison rehabilitation has not received enough attention by researchers previously. In this case, the author conducted an in-depth quantitative analysis on a survey with participants that he was teaching. Regression analysis was used to explore the data. The results of the regression indicated that the culturally-relevant instructor significantly enhanced violence prevention (r (37) = .410, p < 0.05). Furthermore, the study also found that cultural relevance significantly impacted communication and relationship skills (r (37) = .423, p < 0.05).

The Role Of Hospitable And Inhospitable States In The Process Of Refugee Resettlement In The United States, Claire Nolasco, Daniel Braaten
Criminology and Criminal Justice Faculty Publications (Archived)
Although the resettlement of refugees is always politically contentious in host countries, the current global refugee crisis has only magnified those contentions. In the United States and in many European countries there has been a strong backlash against the resettlement of refugees particularly those from Muslim majority countries. However, within countries such as the U.S. there are areas of the country that are more anti-refugee than others. The purpose of this paper is to explore the variation in refugee resettlement across the fifty U.S. states from 2002-2010. Refugee resettlement in the U.S. is done in conjunction with the federal government, …

Construing The Legality Of Solitary Confinement: Analysis Of United States Federal Court Jurisprudence, Claire Nolasco, Michael S. Vaughn
Criminology and Criminal Justice Faculty Publications (Archived)
This article analyzes the constitutional parameters of solitary confinement, administrative segregation, and/or punitive isolation within correctional facilities in the United States. After briefly discussing the harmful effects of isolation and the number of inmates subject to this type of confinement, it explains the U.S. Supreme Court’s “atypical and significant hardship” standard for assessing the legality of segregation. Evaluation of 68 cases decided by the 12 U.S. Circuit Courts of Appeals reveals how each Circuit decides when conditions of segregation amount to an “atypical and significant hardship” for the inmate, creating a liberty interest protected by the Fourteenth Amendment Due Process …

“Un Sistema Abandonado”: Una Investigación Sobre El Acceso A Servicios De Salud Sexual Integral Para Mujeres Privadas De La Libertad En Argentina. / “An Abandoned System”: An Investigation Into The Access Of Comprehensive Sexual Health Services For Incarcerated Women In Argentina., Erica Harp
Independent Study Project (ISP) Collection

Black Americans account for 61% of those who have been released from prison through DNA exoneration. In the present study, we explored the influence of race on perceptions of wrongfully convicted individuals who have been exonerated. Participants (N = 121) were randomly assigned to read a fictional newspaper article about a Black or White individual who was wrongfully convicted due to a false confession and then report their perceptions of the exoneree’s guilt, warmth, competence and aggression, how deserving the exoneree was of government assistance and the likelihood that once released, the exoneree would commit a crime resulting in …

Aristotle And Habituation: Is Virtue Really Attainable Without God's Help, Roy Michael Mattson
Aristotle And Habituation: Is Virtue Really Attainable Without God's Help, Roy Michael Mattson
Doctoral Dissertations and Projects
We are by nature moral beings who desire virtue. This fact is borne out by innumerable studies. Aristotle’s Nicomachean Ethics and Eudemian Ethics remain among the most influential works on ethics and human moral psychology. Aristotle claims that human beings can develop good character traits and achieve virtue with the appropriate upbringing (what Aristotle called habituation). Much of what Aristotle says about character traits, virtue, and habituation is accepted today and inspires character education. Yet recent results in experimental psychology challenge the notion of character traits and virtue as understood by Aristotle. The challenge is the abundance of evidence showing …
Pastoral Counseling And The African American Churches Of Metro Atlanta: Breaking The Stigma Associated With Asking For Help, Lasonja Chanta Richardson
Pastoral Counseling And The African American Churches Of Metro Atlanta: Breaking The Stigma Associated With Asking For Help, Lasonja Chanta Richardson
Doctoral Dissertations and Projects
A stigma exists in the African American Christian community that seeking counseling services displays a lack of faith and therefore is unspiritual; however, as a new generation emerges with more liberal views on counseling and the role of the church, an opportunity to define pastoral counseling as an acceptable practice is emerging. The current lack of pastoral counseling in the African American church is negatively affecting the spiritual health of the church but offering counseling services will increase spiritual maturity. African American churches must re-evaluate their stance on pastoral counseling and begin to emphasize pastoral counseling as not only acceptable, …

Universal Representation: Systemic Benefits And The Path Ahead, Lindsay Nash

At a time when politics, financial considerations, and a push for expediency put pressure on the US immigration system, it can be difficult to have faith in the adjudicatory process. Case resolution quotas, directives that constrain courts’ ability to render justice in individual cases, and executive decisions that contract immigration judges’ discretion contribute to an immigration system that looks less and less like judicial adjudication of some of the highest-stakes cases in our legal system and more like a ministerial claims-processing scheme. A ray of hope exists, however, in the proliferation of public defender–style systems that offer universal representation to …

The Internet and electronic communications have revolutionized how consumers obtain legal information and assistance. The availability of legal forms and services has developed at lightning speed and countless consumers are using these forms, rather than consulting attorneys. At the same time, many regulators of the legal profession appear to be frozen in time. Some take the position that the provision of interactive forms amounts to the unauthorized practice of law and others question arrangements that appear to involve the sharing of legal fees with non-lawyers. Even for those interested in regulating the provision of on-line services, one complication to doing …

The police is the first and main gate in the process of law enforcement. Crime victims will report or complain about the criminal incident they experienced to the police. For reports or complaints of victims, the police will conduct an investigation to find and even that is suspected of being a criminal offense in order to determine whether or not an investigation can be conducted. In the process of investigation, victims are often treated as witnesses, or even reported. Victims are given entrapment questions and the attitude of the police treat victims not as victims. The increasing of tax evasion and tax avoidance, due to lack of taxpayer’s liability regulation in tax legislation, has been very detrimental to state revenues. Based on normative juridical research with descriptive-comparative-prescriptive approach which has been done, it is concluded that the regulation of strict liability of taxpayers of Indonesia can: 1) fulfill the sense of justice in terms of equality and or fairness as long as it meets the condition that reflects of material justice and formal justice which must be regulated explicitly in tax legislation; and 2) provide public benefit to the state in handling the social welfare …

New Textualism And The Thirteenth Amendment, Leah Litman
New Textualism And The Thirteenth Amendment, Leah Litman
Articles
Michele Goodwin’s piece raises important questions about whether troubling modern-day labor practices in jails and prisons are consistent with the Thirteenth Amendment. In Goodwin’s telling, the ratification of the Thirteenth Amendment formally ended the institution of slavery, but the Amendment allowed practices resembling slavery to continue, perhaps reflecting the extant stereotypes and racism that formally amending the Constitution cannot root out. Indeed, Goodwin excavates historical materials that suggest the people who drafted and ratified the Amendment understood and expected that it would allow the perpetuation of slavery in another form. As Goodwin explains, most historians have argued that the Thirteenth …

A Comparison Of Appalachian And Non-Appalachian Kentucky Dui Offenders, Megan F. Dickson, Megan Kissel, J. Matthew Webster
Journal of Appalachian Health
Background: Driving under the influence has been an overlooked consequence of the opioid epidemic. Although recent reports have highlighted the increased prevalence of DUI in rural communities and the extensive mental health problems and criminal and drug use histories among rural Appalachian DUI offenders, it is unclear how Appalachian DUI populations compare to DUI offenders in other regions.
Purpose: To help fill this void in the literature, the current study uses a statewide sample to examine how Appalachian DUI offenders differ from non-Appalachian DUI offenders in a predominantly rural state.
Methods: Assessment records were examined for 11,640 Kentucky DUI offenders …
