Crime And Greenspace: Extending The Analysis Across Cities, Samuel Scott Ogletree Dec 2019

Crime And Greenspace: Extending The Analysis Across Cities, Samuel Scott Ogletree

All Dissertations

The role of greenspace in urban areas has become a focus of research as municipalities seek to increase the quality of life in cities. Multiple benefits are found to be associated with greenspace, but disservices such as crime are often overlooked. Studies investigating the link between crime and greenspace have revealed mixed results and been limited in geographic scope. This dissertation sought to examine the crime and greenspace relationship, extending the analysis to multiple cities in order to describe how the relationship may vary in different contexts. Additionally, one possible cause of crime, increased temperatures, was investigated to determine how …

Investigating Administrators’ Resistance To Implementing Restorative Practices, Beri Deister Dec 2019

Investigating Administrators’ Resistance To Implementing Restorative Practices, Beri Deister

Electronic Theses and Dissertations

In this case study, the researcher investigated the barriers to school administrators’ implementation of restorative practices as a management approach to student behavior. Based on the claim that restorative practices is a promising alternative to exclusionary disciplinary placements for changing behavior, the researcher used an emergent explanatory mixed methods design to better understand administrators’ resistance to change despite overwhelming evidence that exclusionary disciplinary practices are the primary contributors to national trends in disciplinary disproportionality and institutional discrimination. The researcher identified and analyzed barriers to create recommendations for addressing administrators’ resistance through organizational change strategies using systems theory.

From Decarceration To E-Carceration, Chaz Arnett Dec 2019

From Decarceration To E-Carceration, Chaz Arnett

Cardozo Law Review

Each year, millions of Americans experience criminal justice surveillance through electronic ankle monitors. These devices have fundamentally altered our understanding of incarceration, punishment, and the extent of the carceral state, as they are increasingly offered as moderate penal sanctions and viable solutions to the problem of mass incarceration. They purportedly enable decarceration, albeit with enhanced surveillance in the community as the compromise. Proponents of the devices tout the public safety and cost benefits while stressing the importance of depopulating prisons and returning individuals to theircommunities. In recent years, an oppositional movement has developed, focused on highlighting the social harms of …

Racial Prejudice In The Criminal Justice System, Tori Cooper Dec 2019

Racial Prejudice In The Criminal Justice System, Tori Cooper

Jessie O'Kelly Freshman Essay Award

Racial prejudice against African Americans has been the leading cause of high incarceration rates amongst the African American community. Within the United States, the census reported that African Americans make up about 17.9 percent of the population, with one-third of the people making up the incarcerated population in America. The disparity in those numbers highlights the current situation that is plaguing the nation. Blatant cases of racial profiling that have received media attention are a true testament of the broken law enforcement system from coast to coast. Racial prejudice cases have affected the black American community since the beginning of …

Perceptions Of Just Deserts In The Context Of Type Of Offense, Kyle Gamache, Matt Zaitchik, Judith Platania

Arts & Sciences Faculty Publications

Preventive detention laws are intended to protect the community while providing continuing offender rehabilitation. The concept of preventive detention frequently challenges the notion of ‘just desert’. With respect to civil commitment, defendants are held involuntarily for treatment beyond their sentencing. In a criminal context, defendants may be held in lieu of a criminal conviction. In the current study, we assessed the public’s level of tolerance for preventive detention. We were interested in evaluating whether and to what extent a “crime hierarchy” exists for preventive detention; i.e., a perception that certain crimes are deserving of preventive detention compared to others. The …

From Exclusion To Restoration: Implementation Successes And Barriers, Chris White

Electronic Theses and Dissertations

Exclusionary suspensions have been used extensively to handle student discipline and promote a perception of a safer environment in schools. However, an increasing number of school administrators have begun seeking alternative methods, such as restorative practices, in an effort to change the approach towards handling misbehaviors, conflict, and damaged relationships. This study occurred in a Grade 9 campus in northern Texas. The goal of the researcher was to better understand the challenges and successes of implementing restorative practices at the school during the 2018–2019 school year from multiple perspectives. Utilizing the principles of a program evaluation approach—deliberatively democratic evaluation—the researcher …

Cops And Cars: How The Automobile Drove Fourth Amendment Law, Tracey Maclin Dec 2019

Cops And Cars: How The Automobile Drove Fourth Amendment Law, Tracey Maclin

Faculty Scholarship

This is an essay on Professor Sarah A. Seo’s new book, Policing the Open Road: How Cars Transformed American Freedom (Harvard Univ. Press 2019). I focus on Professor Seo’s analysis of Carroll v. United States, 267 U.S. 132 (1925) and Brinegar v. United States, 338 U.S. 160 (1949). Carroll is important not only because it was the Court’s first car case. Understanding Carroll (and Brinegar, which solidified and expanded Carroll’s holding) is essential because, nearly one hundred years later, its logic continues to direct how the modern Court resolves Fourth Amendment claims of motorists. Put simply, a majority of today’s …

Eradicating Recidivism: Evangelism For African American Men Impacted By Mass Incarceration, Anthony Mark Berry Dec 2019

Eradicating Recidivism: Evangelism For African American Men Impacted By Mass Incarceration, Anthony Mark Berry

Doctoral Dissertations and Projects

The Prison Industrial Complex impacts 2.3 million people, affects the poor, and the nation's minority family's ability to retain a sense of unity. These data impact community health with the absence of the father figures, lack of power to gain viable income, and in some cases, the right to vote. The issue decimates African American young men. This topic is needed because the research suggests a cyclic nature of excavation of human capital by incarceration and is depleting communities of capital by jailing wage earners from the Black community. Voting capital is dwindling in some states where felony crimes remove …

Tracing The History Of Racial Injustice In Policing And Working Towards Justice Through Data Analysis, Emily Gollub Dec 2019

Tracing The History Of Racial Injustice In Policing And Working Towards Justice Through Data Analysis, Emily Gollub

Theses

There is an extensive history of racial disparity in the criminal justice system that has influenced the issue of racial bias in policing which continues to be a prominent issue even up to this day. The Sentencing Project (2008) explains that racial disparity “exists when the proportion of a racial or ethnic group within the control of the system is greater than the proportion of such groups in the general population” (1). It is important to note that there is a difference between the modern use of “disparity” and the historic subjugation and control. Back in the 1600s to the …

Graduate Doctoral Dissertations

The federal Trafficking Victims Protection Act of 2000 (TVPA) includes children (anyone under 18) who are sexually exploited for commercial purposes in its definition of human trafficking victims. However, most states currently arrest and/or prosecute sex trafficked children for prostitution. From 2008 to 2017, six states neither arrested nor prosecuted sexually exploited children for prostitution; eight retained the right to arrest, but not prosecute minors for prostitution; and 36 states both arrested and prosecuted this population for prostitution. All 50 states passed their first human trafficking laws between 2003 and 2013. Washington passed the first in 2003 and Wyoming was …

Black Family Engagement Through Communication Technology: A Phenomenological Study From The Perspective Of Urban Public High Schools Parents In The Greater Boston Area, Mariette Bien-Aime Ayala

Graduate Doctoral Dissertations

Black family engagement is the key to improving the life outcomes of young Black students (Clark, 2015; Mestry & Grobler, 2007). Recently, as a response to a need for better family engagement in K-12 education, new technologies have emerged. As educators, it is important to study the effectiveness of these new communication technologies, as well as how Black families are experiencing opportunities for engagement through them. Guided by critical race theory and capital theory, I ask: How do Black families experience opportunities for engagement with their children’s high schools through the use of communication technologies? To find this answer, in …

Integrated Perspective Of Low Self-Control And Lifestyle-Exposure: Gender Differences In Victimization Risk Among South Korean Youth, Hyounggon Kwak Nov 2019

Integrated Perspective Of Low Self-Control And Lifestyle-Exposure: Gender Differences In Victimization Risk Among South Korean Youth, Hyounggon Kwak

Theses and Dissertations

This dissertation examined the link between low self-control, risky lifestyles, and victimization, using data from 1,057 South Korean adolescents included in the Study on Childhood Delinquency. Specifically, this study explores a full mediation model to test whether risky lifestyles (unstructured activity, association with deviant peers, and delinquency) account for the effect of low self-control on victimization. The results indicated that low self-control only had an indirect effect on victimization primarily through unstructured time and one’s own delinquency. In addition, this study explored whether variations in the adolescent routine activities foster engagement in delinquency via association with deviant peers. Advancing prior …
