Lgbtq+ Civil Rights: Local Government Efforts In A Volatile Era, Nicole M. Elias Jan 2020

Lgbtq+ Civil Rights: Local Government Efforts In A Volatile Era, Nicole M. Elias

Publications and Research

LGBTQ+ issues at the local level pose some of the most pressing civil rights challenges in the current U.S.context. This analysis provides insight into what is taking place in major municipalities and how these efforts can be improved to bolster equity and civil rights for LGBTQ+ populations. At a time when identity, language, and public sector values are inherently intertwined and constantly changing, the following question is ripe for analysis: how are major U.S. municipalities addressing the civil rights needs of the LGBTQ+ population? To answer this question, an analysis of government websites from the top 10 U.S. cities by …

A Third Option: Understanding And Assessing Non-Binary Gender Policies In The United States, Nicole M. Elias, Roddrick Colvin Jan 2020

A Third Option: Understanding And Assessing Non-Binary Gender Policies In The United States, Nicole M. Elias, Roddrick Colvin

Publications and Research

Our fundamental understandings and treatments of gender and gender identity within the United States are evolving. Recently, a few countries and several U.S. states have moved away from the binary categories of male and female to include a non-binary gender option for official state documents. This third, gender-neutral option, is usually represented as "X" where "M" for male and "F" for female traditionally appeared. The purpose of this study is twofold; first, to utilize Iris Marion Young's theory of oppression to help contextualize the historical oppression of non-binary gender identity recognition by the State, and second, to analyze recent efforts …

Popular Culture Informing Public Administration: Messages And Prospects For Social Equity, Sean Mccandless, Nicole M. Elias Jan 2020

Popular Culture Informing Public Administration: Messages And Prospects For Social Equity, Sean Mccandless, Nicole M. Elias

Publications and Research

In the discipline of public administration, popular culture remains under-examined in scholarship and under-utilized in pedagogy. However, the field would benefit from greater integration of popular culture to expand understandings of governance, especially in that it provides important representations of and messaging about some of today's most pressing social equity issues. To contextualize popular culture in public administration, we use critical discourse analysis as a frame to demonstrate how popular culture can inform public administration, especially regarding social equity. We argue that popular culture should be more extensively covered in public administration, because it offers a lens for better understanding …

Examining Public Opinion About Abortion: A Mixed-Methods Systematic Review Of Research Over The Last 15 Years, Amy Adamczyk, Chunrye Kim, Leevia Dillon Jan 2020

Examining Public Opinion About Abortion: A Mixed-Methods Systematic Review Of Research Over The Last 15 Years, Amy Adamczyk, Chunrye Kim, Leevia Dillon

Publications and Research

Although abortion became legal four decades ago, Americans remain staunchly divided over its acceptability. While researchers have been interested in the factors shaping abortion attitudes, there are almost no reviews of this work. We examine the factors shaping Americans’ abortion attitudes and assess the state of published peer-reviewed articles in this area over the last 15 years. Using a mixed-methods systematic review, we analyze and critique the findings from 116 journal articles that have examined attitudes about abortion between 2001 and 2016. Amongst the many predictors and outcomes examined, we show that religion is by far the most utilized statistically …

Policy And Procedure Recommendations For The Collection And Preservation Of Eyewitness Identification Evidence, Gary L. Wells, Margaret Bull Kovera, Amy Bradfield Douglass, Neil Brewer, Christian A. Meissner, John T. Wixted

Publications and Research

Objective: The Executive Committee of the American Psychology-Law Society (Division 41 of the American Psychological Association) appointed a subcommittee to update the influential 1998 scientific review paper on guidelines for eyewitness identification procedures. Method: This was a collaborative effort by six senior eyewitness researchers, who all participated in the writing process. Feedback from members of AP-LS and the legal communities was solicited over an 18-month period. Results: The results yielded nine recommendations for planning, designing, and conducting eyewitness identification procedures. Four of the recommendations were from the 1998 article and concerned the selection of lineup fillers, prelineup …

Brief Of Amici Curiae Scholars Of The Constitutional Rights And Interests Of Children In Support Of Respondents, Angela Onwuachi-Willig, Catherine E. Smith, Tanya Washington Hicks, Lauren Fontana, Jessica Dixon Weaver, Cary Martin Shelby Jan 2020

Brief Of Amici Curiae Scholars Of The Constitutional Rights And Interests Of Children In Support Of Respondents, Angela Onwuachi-Willig, Catherine E. Smith, Tanya Washington Hicks, Lauren Fontana, Jessica Dixon Weaver, Cary Martin Shelby

Faculty Scholarship

This Brief of Amici Curiae Scholars of the Constitutional Rights and Interests of Children in Support of Respondents filed in Fulton v. City of Philadelphia makes two points. First, a categorical exemption, based on religious beliefs rather than foster children’s needs, does not serve the best interests of children and violates the government’s duty to foster youth. Such an exemption needlessly restricts the pool of prospective foster parents, increasing the risk of a greater number of children being confined to long-term, institutional care. The reduction of same-sex foster parents would also have a disproportionate impact on “special needs” and LGBT …

Equality Is A Brokered Idea, Robert L. Tsai Jan 2020

Equality Is A Brokered Idea, Robert L. Tsai

Faculty Scholarship

This essay examines the Supreme Court's stunning decision in the census case, Department of Commerce v. New York. I characterize Chief Justice John Roberts' decision to side with the liberals as an example of pursuing the ends of equality by other means – this time, through the rule of reason. Although the appeal was limited in scope, the stakes for political and racial equality were sky high. In blocking the administration from adding a citizenship question to the 2020 Census, 5 members of the Court found the justification the administration gave to be a pretext. In this instance, that lie …

“The Police Don’T Do Anything. Even When They Get Told About These Creeps”: An Exploration Of How Vigilantes Attempt To Gain Legitimacy As Leaders Of Status Degradation Ceremonies, Hannah Eggett Jan 2020

“The Police Don’T Do Anything. Even When They Get Told About These Creeps”: An Exploration Of How Vigilantes Attempt To Gain Legitimacy As Leaders Of Status Degradation Ceremonies, Hannah Eggett

Theses and Dissertations (Comprehensive)

Status degradation ceremonies are a process through which a denouncer(s) and members of a community shift an individual’s status within their social group to a lower position (Garfinkel, 1956). Current status degradation ceremony literature primarily focuses on ceremonies that are carried out by formal officials as well as the impacts of these ceremonies on the denounced individuals. This research provides insights into ceremonies led by “pseudo-officials,” individuals or groups who hold no formally recognised position but claim to act in the public interest in the same manner as formally appointed officials are expected to. This exploratory case study focuses on …

More Than Just A Rapper: Mainstream And Alternative Media’S Depiction Of Nipsey Hussle, Jonathan Hazlewood Jan 2020

More Than Just A Rapper: Mainstream And Alternative Media’S Depiction Of Nipsey Hussle, Jonathan Hazlewood

Theses and Dissertations (Comprehensive)

Mainstream and alternative media depict individuals differently from one another. In stories covering African American rappers and homicide victims, mainstream and alternative stories use images, phrases, and people to portray certain ideas to their audience. In terms of mainstream news outlets, stories associate criminality onto African American homicide victims and rappers through labeling them as brutes, focusing on the crimes they commit, and highlighting criminal associations (Aquil, 2018; Cochran, 2015; Dukes & Gaither 2018; Wright & Washington, 2019). While alternative outlets have offered sympathetic and well-rounded representations that depict the life, personal accomplishments, and good deeds of an African American …

After Ice: A New Humane & Effective Immigration Enforcement Paradigm, Peter L. Markowitz Jan 2020

After Ice: A New Humane & Effective Immigration Enforcement Paradigm, Peter L. Markowitz

Articles

In recent years, as the U.S. Immigration and Customs Enforcement Agency's ("ICE') brutal tactics have devasted communities across the nation, a growing chorus of activists and policymakers have begun calling for the agency to be abolished. Abolish ICE advocates have made a compelling case for the irredeemable deficiencies of ICE; they have exposed the core injustices that lay at the heart of our current enforcement scheme, and they have proposed specific and thoughtful changes that are both defensible and achievable. However, these changes tend to focus on a negative vision of what we need to eliminate in our current enforcement …

Judicial Drift, Elizabeth Nevins-Saunders Jan 2020

Judicial Drift, Elizabeth Nevins-Saunders

Hofstra Law Faculty Scholarship

Although there is broad consensus on what constitutes procedural due process in criminal cases, in courtrooms around the country, those ideals are often disregarded. In the wake of rising public attention to misdemeanors, be it through marijuana decriminalization or concern over unduly punitive fees and surcharges, a few scholars have pointed to theories explaining the gulf between rights and reality for low-level defendants. Yet none have expressly considered the impact of administrative rules made (or not made) at the courthouse level. This Article analogizes the courthouse to an administrative agency and borrows the doctrine of “bureaucratic drift” to explain how …

The Dichotomy Between Overcriminalization And Underregulation, Ellen S. Podgor Jan 2020

The Dichotomy Between Overcriminalization And Underregulation, Ellen S. Podgor

American University Law Review

The U.S. Securities and Exchange Commission (SEC) failed to properly investigate Bernard Madoff’s multi-billion-dollar Ponzi scheme for over ten years. Many individuals and charities suffered devastating financial consequences from this criminal conduct, and when eventually charged and convicted, Madoff received a sentence of 150 years in prison. Improper regulatory oversight was also faulted in the investigation following the Deepwater Horizon tragedy. Employees of the company lost their lives, and individuals were charged with criminal offenses. These are just two of the many examples of agency failures to properly enforce and provide regulatory oversight, with eventual criminal prosecutions resulting from the …

A Correlation Study Of Parental Involvement And Student Outcomes In A Georgia School District, Courtney T. Flournoy Jan 2020

A Correlation Study Of Parental Involvement And Student Outcomes In A Georgia School District, Courtney T. Flournoy

Theses and Dissertations

The purpose of this study was to determine if a statistically significant association existed between the responses of parents of middle school students in a Georgia public school district on a parental involvement survey and three variables: eligibility of students to receive free or reduced-price lunch parental marital status, and parental education level.

This study was initiated because of a persistent problem of low academic achievement of the middle school students. There is extensive research related to the importance of parental involvement and the effect of this involvement on student achievement. However, prior to the implementation of this study little …

The Teacher’S Role In Increasing Student Engagement In High School Social Studies Courses, Quarnitra L. Price

Theses and Dissertations

This qualitative case study explored (a) how teaching practices of high school teachers influence student engagement levels and performance in social studies classes, (b) how teachers might deliver more student relatable social studies content, (c) how teachers might help students relate to and become more engaged with important social studies concepts, and (d) how teachers can motivate students to become well-informed and fully engaged citizens. This study also examined existing barriers that prevent students from learning or engaging in social studies coursework.

Research findings suggest teachers play essential roles in how students perceive social studies content and respond to lessons …

Unsolvable? Assessing The Accuracy Of Missing Person Case Data, Scott Duncan Jan 2020

Unsolvable? Assessing The Accuracy Of Missing Person Case Data, Scott Duncan

Theses and Dissertations

Annually, about 100,000 individuals are reported missing to authorities in the US. Fortunately, the majority of these investigations are resolved quickly with the persons being accounted for and reunited with loved ones. Conversely, the number of cases that remain open represent dilemmas for police as the incidents could be connected to unsolved homicides, other violent crimes, or endangered persons. Despite the commonality of missing persons, research on the topic is scant. Predominantly, published studies on missing persons focus on investigations from European countries. In 2008, the US Department of Justice launched the National Missing and Unidentified Person System (NamUs), a …

An Exploration Of Barriers And Supports Of High School Equivalency Diploma (Hsed) Graduates Transitioning To Postsecondary Education, Chanell Butler Morello

Theses and Dissertations

This applied dissertation was designed to explore the perceived barriers and supports of High School Equivalency Diploma (HSED) graduates upon their consideration of attaining a higher education degree at a community college in North Carolina. Other areas explored in this qualitative study included the way completing the HSED program changes a student’s perception of learning and/or increases his or her motivation to continue their studies.

A primary objective of the Basic Skills programs, also known as College and Career Readiness programs, is to transition as many students as possible to postsecondary education and employment. In spite of such goals, North …

Law Enforcement Officers As Victims Of Felonious Killings And Assaults: An Analysis Of The Predictors Of Lethality And The Likelihood Of Officer Assault Or Death, Gabriella Mercado Jan 2020

Law Enforcement Officers As Victims Of Felonious Killings And Assaults: An Analysis Of The Predictors Of Lethality And The Likelihood Of Officer Assault Or Death, Gabriella Mercado

Theses and Dissertations

This study was designed to explore the predictors of lethality for the outcome of police officer assault with injury and felonious death. Recent news has focused on police brutality and their excessive use of force. Conversely, the inverse relationship has not received much focus. To explore the aforementioned relationship, data from the LEOKA program on 1,375 officers who were feloniously killed or assaulted with serious injury between the years of 2008 and 2017 were examined to determine the statistical significance between several predictor variables and the outcome variable.

Binary logistic regression was used to answer the research questions posed by …
