วิทยานิพนธ์ฉบับนี้มีวัตถุประสงค์เพื่อศึกษาความเป็นไปได้และความเหมาะสมในการกำหนดความรับผิดทางอาญาเกี่ยวกับการกระทำต่อภาพส่วนบุคคลของผู้อื่น ได้แก่ การแอบบันทึกภาพ การติดตั้งอุปกรณ์บันทึกภาพ การครอบครองภาพ การเผยแพร่ภาพ และการข่มขู่ว่าจะเผยแพร่ภาพ โดยได้ทำการศึกษาความหมายของภาพส่วนบุคคล จากนั้นจึงศึกษาแนวคิดเกี่ยวกับสิทธิส่วนบุคคล และทฤษฎีในการกำหนดความรับผิดและโทษทางอาญา รวมทั้งสำรวจบทบัญญัติแห่งกฎหมายไทยและต่างประเทศที่เกี่ยวข้องเพื่อวิเคราะห์แสวงหาแนวทางที่เหมาะสมในการพัฒนากฎหมายไทยให้ตอบสนองต่อปัญหาดังกล่าวได้อย่างมีประสิทธิภาพ จากการศึกษาพบว่า ราชอาณาจักรไทยยังไม่มีบทบัญญัติใดที่กำหนดความรับผิดทางอาญาเกี่ยวกับภาพส่วนบุคคลไว้ในลักษณะที่กล่าวแล้วโดยตรง จึงต้องนำฐานความผิดที่มีอยู่ในประมวลกฎหมายอาญาและพระราชบัญญัติอื่นมาปรับใช้เพื่อคุ้มครองเหยื่อ ซึ่งไม่ครอบคลุมในทุกลักษณะของการกระทำ ทั้งอัตราโทษไม่ได้สัดส่วนกับการกระทำความผิด ในขณะที่กฎหมายของสหรัฐอเมริกา มลรัฐนิวยอร์ก มลรัฐอิลลินอยส์ อังกฤษ แคนาดา และสาธารณรัฐสิงคโปร์ ได้มีฐานความผิดที่ได้กระทำต่อภาพส่วนบุคคล ซึ่งครอบคลุมในทุกลักษณะของการกระทำที่เกี่ยวข้อง ด้วยเหตุที่กล่าวมาข้างต้น ผู้เขียนจึงเสนอให้คุ้มครองสิทธิส่วนบุคคลของเหยื่อด้วยการกำหนดให้การกระทำต่อภาพส่วนบุคคลเป็นความผิดอาญา โดยนำประเด็นที่กฎหมายต่างประเทศได้กำหนดไว้มาเป็นแนวทางในการปรับใช้ให้เหมาะสมกับบริบทของสังคมไทย อันจะเกิดประโยชน์ในการพัฒนากฎหมายและเป็นการป้องปรามการกระทำความผิดที่เกิดขึ้นอย่างเหมาะสม

วิทยานิพนธ์ฉบับนี้มีวัตถุประสงค์เพื่อศึกษาความเป็นมาและความเหมาะสมของเหตุฉกรรจ์ในความผิดฐานยักยอกตามประมวลกฎหมายอาญาของประเทศไทย ซึ่งจะได้ศึกษาแนวคิดและทฤษฎีเกี่ยวกับการกำหนดโทษและการกำหนดเหตุฉกรรจ์ และนำไปวิเคราะห์เปรียบเทียบกับเหตุฉกรรจ์ในความผิดฐานยักยอกตามประมวลกฎหมายอาญาของต่างประเทศ เพื่อให้ได้มาซึ่งแนวทางที่เหมาะสมในการแก้ไขเพิ่มเติมเหตุฉกรรจ์ในความผิดฐานยักยอกตามประมวลกฎหมายอาญาของประเทศไทย จากการศึกษาพบว่า ปัจจัยที่นำมาใช้ในการกำหนดเหตุฉกรรจ์ในความผิดอาญานั้นมีอยู่ด้วยกัน 5 ประการ ได้แก่ ปัจจัยที่เกี่ยวกับผู้กระทำ ลักษณะการกระทำ พฤติการณ์แวดล้อม มูลเหตุจูงใจ และผู้เสียหาย ซึ่งปัจจัยต่าง ๆ เหล่านี้ถูกนำมากำหนดให้เป็นเหตุฉกรรจ์ในความผิดฐานยักยอกตามประมวลกฎหมายอาญาของต่างประเทศ อันได้แก่ ประมวลกฎหมายอาญาของมลรัฐมิชิแกน(สหรัฐอเมริกา) สาธารณรัฐสิงคโปร์ สหพันธ์สาธารณรัฐเยอรมนี และสาธารณรัฐฝรั่งเศส ในขณะที่เหตุฉกรรจ์ตามประมวลกฎหมายอาญาของประเทศไทยตามมาตรา 354 กำหนดจากปัจจัยด้านผู้กระทำเท่านั้น ส่งผลทำให้การลงโทษผู้กระทำความผิดไม่เป็นไปตามหลักความได้สัดส่วน ตลอดจนไม่สอดคล้องกับความร้ายแรงของการกระทำที่เปลี่ยนแปลงไปตามสภาพสังคมและเศรษฐกิจ ดังนั้น ผู้ศึกษาจึงขอเสนอให้มีการแก้ไขเหตุฉกรรจ์ในความผิดฐานยักยอกตามมาตรา 354 แห่งประมวลกฎหมายอาญาของประเทศไทยให้เป็นความผิดอาญาแผ่นดินและเพิ่มเติมเหตุฉกรรจ์ในกรณีดังต่อไปนี้ การยักยอกที่กระทำโดยลูกจ้าง โดยผู้ที่ได้รับความไว้วางใจ โดยร่วมกันตั้งแต่สองคนขึ้นไป การยักยอกสวัสดิการของลูกจ้าง การยักยอกเพื่อค้ากำไร การยักยอกเป็นเหตุให้ผู้อื่นได้รับความยากลำบากทางการเงิน การยักยอกที่กระทำต่อผู้เปราะบาง และการยักยอกที่กระทำต่อองค์กรการกุศล

พยานบุคคลนั้นเป็นปัจจัยสำคัญในการพิสูจน์ความจริงในคดีอาญา เพราะคำเบิกความของพยานบุคคลถือว่าเป็นพยานหลักฐานที่มีน้ำหนักและน่าเชื่อถือที่สุดในคดีอาญา และในคดีอาญานั้น โจทก์จะต้องนำสืบพยานเพื่อให้ศาลเห็นว่าจำเลยเป็นผู้กระทำความผิดจริงในระดับที่ปราศจากข้อสงสัยตามสมควร ดังนั้น รัฐจึงต้องป้องกันและปราบปรามไม่ให้เกิดการแทรกแซงการเบิกความของพยานบุคคล อย่างไรก็ดี สำหรับประเทศไทยนั้น ยังปรากฏปัญหาที่พยานบุคคลนั้นถูกแทรกแซงการเบิกความด้วยวิธีต่างๆ ซึ่งส่งผลกระทบต่อกระบวนยุติธรรม ไม่ว่าจะเป็นการข่มขู่ คุกคาม การให้ประโยชน์ รวมถึงการนำความผิดฐานหมิ่นประมาทมาใช้กดดันพยานบุคคลในระหว่างการพิจารณาคดี ทำให้พยานบุคคลนั้นเกิดความเกรงกลัวและไม่กล้ามาเบิกความหรือมาเบิกความเท็จในกระบวนการดำเนินคดีอาญา ซึ่งส่งผลให้ผู้กระทำความผิดไม่ได้รับการลงโทษและลอยนวลเป็นภัยสังคมต่อไปในที่สุด ด้วยเหตุดังกล่าว วิทยาพนธ์ฉบับนี้จึงมุ่งศึกษามาตรการทางกฎหมายและมาตรการสนับสนุนอื่นๆ ที่สามารถช่วยให้พยานบุคคลมาเบิกความตรงความจริง โดยวิเคราะห์เปรียบเทียบกับมาตรการในต่างประเทศ เพื่อหาแนวทางการแก้ไขปัญหาดังกล่าวให้มีความเหมาะสมและสอดคล้องกับหลักการและสภาพปัญหาของประเทศไทย จากการศึกษาพบว่า วิธีการแก้ไขปัญหาที่มีประสิทธิภาพคือประเทศไทยควรบัญญัติความผิดฐานแทรกแซงพยานบุคคลเป็นฐานความผิดเฉพาะตามประมวลกฎหมายอาญา และกำหนดให้ความผิดฐานฆ่าและความผิดฐานทำร้ายพยานบุคคลตามประมวลกฎหมายอาญาเป็นเหตุฉกรรจ์ เพื่อป้องกันและปราบปรามการกระทำความผิดและสามารถลงโทษผู้กระทำความผิดได้อย่างเหมาะสม ประกอบกับการกำหนดบทยกเว้นความผิดฐานหมิ่นประมาทตามประมวลกฎหมายอาญาให้แก่พยานบุคคลที่ได้เบิกความโดยสุจริต เพื่อให้พยานบุคคลกล้าเบิกความมากขึ้น นอกจากนี้ ยังเสนอให้นำมาตรการสนับสนุนอื่นๆ มาปรับใช้ ได้แก่ การกำหนดค่าป่วยการของพยานบุคคลในลักษณะของค่าขาดรายได้หรือค่าเสียโอกาส และการจัดทำคู่มือประชาชนให้แก่พยานบุคคล เพื่อสร้างแรงจูงใจให้แก่พยานบุคคลและทำให้พยานบุคคลคุ้นเคยกับกระบวนการยุติธรรมทางอาญามากยิ่งขึ้น

วิทยานิพนธ์ฉบับนี้มีวัตถุประสงค์เพื่อศึกษาหลักการและทฤษฎีสิทธิของบุคคลข้ามเพศในกระบวนการค้นตัวและการคุมขังในคดีอาญา รวมถึงแนวคิดในการกำหนดแนวทางการค้นตัวและการคุมขังบุคคลข้ามเพศของต่างประเทศ เพื่อนำมาวิเคราะห์เปรียบเทียบหาแนวทางแก้ไขปรุงกฎหมายการค้นตัวและการคุมขังบุคคลข้ามเพศในประเทศไทย จากการศึกษาพบว่า กฎหมายไทยไม่มีแนวทางการปฏิบัติต่อบุคคลข้ามเพศในกระบวนการค้นตัวและการคุมขัง ในทางปฏิบัติเจ้าหน้าที่ตำรวจจะใช้เกณฑ์เพศกำเนิดในการจำแนกบุคคลข้ามเพศและปฏิบัติต่อบุคคลข้ามเพศตามดุลพินิจ ซึ่งเมื่อผู้ศึกษาได้ศึกษากระบวนการค้นตัวและการคุมขังตามกฎหมายต่างประเทศ ได้แก่ อังกฤษ สหรัฐอเมริกา และออสเตรเลีย พบว่าประเทศดังกล่าวได้กำหนดแนวทางและรายละเอียดการค้นตัวและคุมขังบุคคลข้ามเพศไว้โดยเฉพาะ ส่วนประเทศเยอรมนีไม่ปรากฏหลักเกณฑ์การปฏิบัติสำหรับบุคคลข้ามเพศเช่นเดียวกับประเทศไทย ดังนั้น ผู้ศึกษาเสนอแนะให้นำแนวคิดการปฏิบัติต่อบุคคลข้ามเพศในกระบวนการค้นตัวและการคุมขังของต่างประเทศมาปรับใช้กับประมวลกฎหมายวิธีพิจารณาความอาญาของไทย โดยกำหนดให้การค้นตัวต้องดำเนินการโดยบุคคลที่มีเพศเหมาะสม และจัดสรรห้องขังแยกเฉพาะสำหรับผู้ต้องหาข้ามเพศ ตรวจสอบให้แน่ใจว่าผู้ต้องหาข้ามเพศมีส่วนร่วมในการตัดสินใจเกี่ยวกับห้องคุมขังที่เหมาะสมกับเพศและอัตลักษณ์ทางเพศ

Using a youth-led participatory action inquiry and photovoice methodology, this study investigated the self-perceptions of Black girls in a suburban area of Northern California. The objective of the project was to explore the perspectives and lives of Black girls. Following water-related deaths, soft tissue on victims’ remains may be entirely absent after a temperature dependent period of time. Due to their physical and chemical components, which protect them from environmental deterioration and biological attack, bones preserve DNA for longer periods of time. Therefore, the ability to both identify an individual and estimate the postmortem submersion interval (PMSI) may depend on DNA obtained from skeletal remains. Opioid Use Disorder (OUD) is one of the major national threats to human health and economic system. Since the opiate substances produce their pharmacological effects mainly at the Mu Opioid Receptor (MOR), the development of potent MOR selective antagonists is imperative. By application of the message-address concept, the novel selective MOR antagonist, NAP was synthesized in our group. This study examined the extent to which supportive services funded through the federal John H. Chafee Foster Care Independence Program (CFCP) are associated with academic success and employment in foster care youth. Studies suggest that this group experiences poorer employment outcomes (Gypen, Vanderfaeillie, De Maeyer, Belenger, & Van Holen, 2017; Okpych & Courtney, 2014) and earn less money annually (Gypen et al., 2017; Okpych & Courtney, 2014; Pecora, 2012). Despite a 29.4-billion-dollar annual budget for foster care services, individuals with a foster care history struggle after they transition out of care.

Significant research has demonstrated how public service motivation (PSM) predicts individual outcomes, such as job satisfaction, organizational commitment, and choice of employment sector. Other research has demonstrated how PSM serves as an outcome variable. Between these two strands of PSM research, there is a knowledge gap concerning how PSM acts as a mediator. The COVID-19 pandemic and resulting shutdowns are affecting every aspect of society. The legal profession and the justice system have been profoundly disrupted at precisely the time when there is an unprecedented need for legal services to deal with a host of legal issues generated by the pandemic, including disaster relief, health law, insurance, labor law, criminal justice, domestic violence, and civil rights. The novel coronavirus COVID-19 has profoundly disrupted life in the United States. Among other challenges, jurisdictions are unlikely to be able to administer the July 2020 bar exam in the usual manner. It is essential, however, to continue licensing new lawyers. Those lawyers are necessary to meet current needs in the legal system. Equally important, the demand for legal services will skyrocket during and after this pandemic. We cannot close doors to the profession at a time when client demand will reach an all-time high.

The Nineteenth Amendment and the history of the women’s suffrage movement can offer a compelling argument against felony disenfranchisement laws. These laws leave approximately six million citizens unable to vote, often for crimes wholly unrelated to the political process. They also increasingly threaten gains in female enfranchisement.

Today’s arguments in support of felony disenfranchisement laws bear striking similarities to the arguments of anti-suffragists more than a century earlier. Both suggest that a traditionally subordinated class of citizens is inherently incapable of bearing the responsibility that the right to vote entails, and that their votes are somehow less worthy than others. …

Drastic changes in Supreme Court doctrine require citizens to reorder their affairs rapidly, undermining their trust in the judiciary. Stare decisis has traditionally limited the pace of such change on the Court. It is a bulwark against wholesale jurisprudential reversals. But, in recent years, the stare decisis doctrine has come under threat.

With little public or scholarly notice, the Supreme Court has radically weakened stare decisis in two ways. First, the Court has reversed its long-standing view that a precedent, regardless of the quality of its reasoning, should stand unless there is some special, practical justification to overrule it. Federal parity laws, and their state equivalents, have been shown to increase access to substance use disorder (SUD) treatment, by decreasing the cost of SUD treatment borne by the insured, and has resulted in little increase in health plan costs. Despite these improvements, the effects of parity on access to SUD treatment have been lower than expected. Recent reports suggest that states have varied in their enforcement parity, failures which may explain why persons surveyed still report having inadequate insurance coverage for SUD treatment despite the parity legislation. In response to mounting wicked environmental problems and an outdated U.S. educational system, this dissertation investigates transformative place-based education as an adaptive boundary system that connects individual learning to positive social-ecological change. The research approaches learning through a systems lens through a novel framework of Social-ecological Systems, Place-based Education, and Transformative Learning Theories. A three-part mixed methods approach, including content analysis of the literature, phenomenological interviews with experts in place-based education, and fuzzy-logic cognitive mapping with educators at three schools practicing the principles of place-based education, is used to examine transformative place-based education from the perspectives of current U.S. place-based …

“Wandering officers” are law-enforcement officers fired by one department, sometimes for serious misconduct, who then find work at another agency. Policing experts hold disparate views about the extent and character of the wandering-officer phenomenon. Some insist that wandering officers are everywhere—possibly increasingly so—and that they’re dangerous. Others, however, maintain that critics cherry-pick rare and egregious anecdotes that distort broader realities. In the absence of systematic data, we simply do not know how common wandering officers are or how much of a threat they pose, nor can we know whether and how to address the issue through policy reform.

This study investigated the effects of a method to support higher levels of independent performance and generalization of skills using a structured work system with a visual schedule when teaching online task completion skills to high school students with ASD and intellectual disabilities. Students with ASD and intellectual disabilities are typically deficient in independent skills. They often struggle to initiate and complete tasks on their own. The purpose of this qualitative case study is designed to explore teachers’ perspectives on the implementation and sustainability of Universal Design for Learning (UDL) in the classroom at a local rural Title I elementary school. The rural elementary Title I school classroom presents a unique dynamic in comparison to its surrounding rural elementary school counterparts. The most significant difference is the students residing in poverty and the circumstances associated with poverty. The social and emotional learning skills of children play an important role in their development. These skills include persistence, self-control, and social competence. The lack of these skills can often be a predictor of future criminality and antisocial behavior. Aggressiveness in youth plays a key role in violence among juveniles. The research questions focused on students’ perceptions of how the school’s resources influenced students’ benefits from community service. This research is designed to provide information that identifies factors that affect students’ perceived benefits from their mandatory or credit merit community service work based on high schools varying approaches to implementing a mandatory community as a graduation requirement or awards credit toward graduation for students’ community service work in states without a statewide high school service requirement; credit toward graduation for service-learning or community service; or explicitly permits districts to adopt a service requirement for high school graduation.
