Interdisciplinary Cybersecurity For Resilient Cyberdefense, Rachid Ait Maalem Lahcen
Interdisciplinary Cybersecurity For Resilient Cyberdefense, Rachid Ait Maalem Lahcen
Electronic Theses and Dissertations, 2020-2023
Cybersecurity's role is to protect confidentiality, integrity, and availability of enterprise assets. Confidentiality secures data from theft, integrity mitigates modification of data in a malicious way, and availability assures continuation of systems' access and services. However, achieving these goals is difficult due to the mushrooming of various cyber attackers that come from individuals or state actors with motives ranging from ideological, financial, state-sponsored espionage, revenge, or simple curiosity and boredom. The difficulty also lies in the complexity of the cyber layers that are not well studied. Layers that interconnect and require effective communication and collaboration. This effectiveness is still lacking …

They Have Names, Too: A Case Study On The First Five Victims Of The Green River Killer: Examining The Construction Of Society And Its Creation Of Victim Availability, Natalie V. Castillo
Women, Gender, and Sexuality Studies Undergraduate Honors Theses
This case study follows the example of Rubenhold (2019) to examine the lives of the first five women killed by the Green River Killer, to give the victims a voice to tell their stories that Ridgway robbed from them, and to identify the social constructs that influence victim availability. To explore this issue, the study analyzed multiple sources of information: archival sources, monographs, articles, websites, and newspapers. In analyzing the effects of their upbringing—family history, educational backgrounds, and personal lives—this research will clarify the role that these factors played regarding where they spent their last day alive.

Information Security Compliance In A Healthcare Setting: A User Behavior Pilot Study, Carla T. Panattoni
Master of Arts in Criminal Justice Theses
Human behavior is known to be one of the weakest links to information security and a likely cause of incidents that may lead or contribute to the loss or compromise of sensitive information (Ahmad, & Ismail, 2010; Akhunzada, Kam, 2015; Aloul, 2012; Cain, Edwards, & Still, 2018; Long, 2013; Narayana, Sookhak, & Anuar, 2015; Pike, 2011; Seidenberger, 2016). The Health Insurance Portability and Accountability Act (1996) requires healthcare organizations to comply with national standards to reduce the likelihood of a privacy breach. Online stolen data markets, where cybercriminals operate in the dark web, advertise, sell, share, and trade sensitive personally …
Addressing Racial Disproportionality In The Juvenile Justice System: An Evaluation Of The King County Juvenile Court 180-Program, Stephanie Jones
Addressing Racial Disproportionality In The Juvenile Justice System: An Evaluation Of The King County Juvenile Court 180-Program, Stephanie Jones
Master of Arts in Criminal Justice Theses
Restorative justice programs are frequently designed to divert youth from the criminal justice system and to decrease recidivism. In 2011, King County established a restorative justice program, the 180-program, to decrease new referrals and to decrease racial disproportionality in the juvenile court. While previous studies have found lower overall new referral rates for youth who completed the 180-program, gaps remain. The program has not been measured for likelihood of recidivism and completion rates based on race. The 180-program has been compared to other juvenile justice programs but has not been analyzed for its individual success and effectiveness. Informed by self-concept …

In Defense Of The Special Tribunal For Lebanon And Thecase For International Corporate Accountability, Osama Alkhawaja
In Defense Of The Special Tribunal For Lebanon And Thecase For International Corporate Accountability, Osama Alkhawaja
Chicago Journal of International Law
In 2014, the Special Tribunal for Lebanon (“STL”) examined evolving international standards of corporate accountability and held that legal entities can be found liable for criminal conduct as a general principle of international law. Prior to this decision, and in stark contrast to trends in domestic legal regimes, no legal entity had ever been prosecuted, convicted, or sentenced in an international court. Although this marked a watershed moment in global corporate accountability mechanisms, it has had little precedential effect; scholars have argued it is because the decision lacked a valid legal basis and is limited in scope. This Comment addresses …
Toward National Criminal Bar Admission In U.S. District Courts, Gabriel J. Chin
Toward National Criminal Bar Admission In U.S. District Courts, Gabriel J. Chin
Fordham Law Review
In the extensive litigation over bar admission in federal district courts, courts have upheld state bar membership requirements. Nevertheless, the changes to legal practice flowing from the COVID-19 pandemic—the disconnection between workplace and residence, the ability to meet and to hold court proceedings by video, and the unjustifiability of charging clients time and travel for brief, perfunctory in-person meetings and conferences that could be handled effectively and expeditiously online—will make these questions ever more serious
Integrating Yoga Into A Medication Assisted Treatment Program To Improve Retention, Linda Davidson
Integrating Yoga Into A Medication Assisted Treatment Program To Improve Retention, Linda Davidson
DNP Scholarly Projects
Background: In 2017, Health and Human Services declared the opioid epidemic a public health emergency (US Department of Health & Human Services, 2017). As a response, access to medication assisted treatment (MAT) programs was encouraged. In 2016, a community health center in Western North Carolina started a MAT program integrating buprenorphine treatment with behavioral health (BH) services. Data from May 2018 through May 2019 demonstrated retention in the MAT program ranged from 65-75% at a given time with behavioral health attendance under 50%.
Aims: The aim of this quality improvement project was to examine if integrating yoga, an …

Use Of Force Citizen Complaints, Use Of Force Violations, And Early Intervention, Drema Ann Hymon
Walden Dissertations and Doctoral Studies
Abstract
Mounting public protests, increasing expensive payouts, and shootings of unarmed victims by police is a call to reexamine options to problem solving, service recovery, and preventing police misconduct as it pertains to the use of force. The purpose of this quantitative study was to examine the correlation between early intervention system data
(a) use of force, citizens' complaints (race and gender), and use of force violations (race, gender, and years of service for officers). The disruptive theoretical framework provided an innovative lens to examine police misconduct of a large midwestern large law enforcement agency. This secondary data study did …

The novel coronavirus COVID-19 has profoundly disrupted life in the United States. Among other challenges, jurisdictions are unlikely to be able to administer the July 2020 bar exam in the usual manner. It is essential, however, to continue licensing new lawyers. Those lawyers are necessary to meet current needs in the legal system. Equally important, the demand for legal services will skyrocket during and after this pandemic. We cannot close doors to the profession at a time when client demand will reach an all-time high.
In this brief policy paper, we outline six licensing options for jurisdictions to consider for …

The United States is in a religion-friendly mood-or at least its three branches of government are. The Supreme Court is turning away from its Free Exercise Clause analysis that currently holds that every religious person must obey the law. At the same time, the Court is rejecting its old Establishment Clause analysis that the government cannot practice or support religion. The old model of separation of church and state is gone, replaced by an ever-growing unity between church and state. This Article examines how much union of church and state this Court might establish.

The COVID-19 pandemic and resulting shutdowns are affecting every aspect of society. The legal profession and the justice system have been profoundly disrupted at precisely the time when there is an unprecedented need for legal services to deal with a host of legal issues generated by the pandemic, including disaster relief, health law, insurance, labor law, criminal justice, domestic violence, and civil rights. The need for lawyers to address these issues is great but the prospect of licensing new lawyers is challenging due to the serious health consequences of administering the bar examination during the pandemic.

As science fiction has become reality, we should consider the implications of our new technologies for our system of justice. In addition to DNA, we are now regularly using cameras, geo-tracking, facial recognition software, brain scans, computers, and much more to discern and record our physical and mental surroundings. Existing technology and more we cannot yet imagine will increasingly take the place of often unreliable evidence, such as that provided by eyewitnesses. Yet, we have given far too little thought as to how these advances should impact our civil and criminal dispute resolution systems.
Historically, many justice systems have emphasized …

Bridging Divides In Divisive Times: Revisiting The Massie-Fortescue Affair, Stewart Chang
Scholarly Works
This Article revisits the infamous Massie-Fortescue rape and murder cases that occurred in Hawai'i during the 1930s, in order to challenge the methods by which race scholars have previously analyzed the case by relying on gender hierarchies. Thalia Massie, a white woman, accused five "Hawaiians" of gang raping her, even though they were of various Asian Pacific ethnic identities. The rape case ended in a hung jury, and so her relatives resorted to vigilante murder of one of the defendants. The subsequent murder trial resulted in convictions, but the 10- year prison sentences for the white defendants were commuted to …

The federal income tax system does not exist for statutes, regulations, codes, enforcement, assessments, collection, redistribution, procedures, publications, liens, levies, refunds, liabilities, litigation, compliance, or even revenue. At its core, the federal income tax system exists for people. People like you, me, and all our loved ones including spouses, partners, parents, kids, brothers, sisters, nieces, nephews, grandparents, grandkids, friends, and neighbors. The people who eat at our tables and sleep under our roofs. The tax system is about current and future generations who live …

Papercuts: Hierarchical Microaggressions In Law Schools, Nantiya Ruan

The Article investigates law schools as locations of workplace fairness by examining its hierarchical structure and the power dynamics at work. Others have researched and written on the myriad ways in which “legal skills faculty” are treated unfairly as compared to those that primarily teach non-skills (or doctrinal classes) because of the subject matter that they teach and the assumptions that are made about their credentials and ability to contribute to the law school mission. Likewise, other scholars have critically examined the discrimination experienced by law school faculty members based on race, gender, sexual orientation, and other identities. What has …

"Practicing criminal law as a woman is like playing tackle football in a dress." Andrea George, Executive Director of the Federal Public Defender for Eastern Washington and Idaho, began her testimony to the American Bar Association's Women in Criminal Justice Task Force with that powerful observation. In the wake of the #MeToo movement, the ABA has focused on ways to enhance gender equity in the profession and in the justice system. The Criminal Justice Section of the ABA has invested significant resources in the creation of the Women in Criminal Justice Task Force (WCJ TF), which launched its work in …

This Article offers the first comprehensive assessment of how domestic and international law limits the U.S. government’s ability to separate foreign children from the adults accompanying them when they seek to enter the United States. As early as March 6, 2017, then-Secretary of Homeland Security John Kelly told CNN’s Wolf Blitzer that he was considering separating families at the border as a deterrent to illegal immigration as part of a “zero tolerance” policy whereby the Trump administration intended the strictest enforcement of immigration law against those migrants coming to the U.S. southern border . Kelly did not say upon what …

International Law And Theories Of Global Justice, Steven Ratner, David Luban, Carmen Pavel, Jiewuh Song, James Stewart
Georgetown Law Faculty Publications and Other Works
International law informs, and is informed by, concerns for global justice. Yet the two fields that engage most with prescribing the normative structure of the world order – international law and the philosophy of global justice – have tended to work on parallel tracks. Many international lawyers, with their commitment to formal sources, regard considerations of substantive (and not merely procedural) justice as ultra vires for much of their work. Philosophers of global justice, in turn, tend to explore the moral commitments of international actors without grappling with the international legal doctrine or institutions. In recent years, however, both disciplines …

"The issue of atrocity prevention has taken something of a beating in the last few years, a victim perhaps of the transactional approach to security and other foreign policy issues that seem to be engulfing us. Yet this is an issue that cannot go away. Its staying power is a testament to its deep moral roots. The horrors of the Holocaust and the knowledge of the capacity of man for cruelty to his fellow man will haunt the world forever. The experience of our modern history– in Yugoslavia, Rwanda, Sudan, South Sudan, the Central African Republic and elsewhere – leave …

This article identifies the key issues that would need to be resolved if Congress decided to create an exception along these lines. The remainder of this article consists of three parts. The first part explains why removal of immunity from civil liability is an appropriate mechanism to help prevent use of social media to incite or induce commission of mass atrocity crimes. The second part contends that the exception to section 230 immunity …

There has been plenty of commentary about this transformation in terms of the challenges and opportunities that the evidence itself brings. But less attention has been given to what these technology-driven developments have done to expand the range of actors …
