The "Matthew Effect" In Punishment: : Do Previous Sanctions Foster More Sanctions In The Future?, Yinzhi Shen

Legacy Theses & Dissertations (2009 - 2024)

Societal response to crime is a topic at the heart of criminology. In contrast to a vast literature on the hidden social consequences of formal sanctions on individuals, family and communities, few studies have examined the ramifications of a formal sanction on future interactions with the criminal justice system over the individual life course. Applying a cumulative disadvantage (CDA) perspective, my dissertation contributes to the understanding of whether and how a prior punishment affects an individual’s trajectory of future punishments over the life course. Theoretically, I elaborated two conceptualizations of CDA processes and highlighted the overlooked value of applying CDA …

The Effects Of A Proactive Policy-Driven Migration On Neighborhood Crime, Tyler Scott Bellick Jan 2020

The Effects Of A Proactive Policy-Driven Migration On Neighborhood Crime, Tyler Scott Bellick

Legacy Theses & Dissertations (2009 - 2024)

The immigrant crime-relationship is one of the most vigorously debated and contentious public policy concerns in present society. The majority of scholarship investigating this link demonstrates that immigrants are no more crime prone than the native-born population, and in fact, may even suppress levels of neighborhood crime. A limitation of this body of scholarship is that it tends focus on immigration, overall, or specifically Latino immigration, failing to account of potentially important between-group differences in offending. The present study addresses this gap by examining the effects of a government-driven Guyanese migration on neighborhood crime rates at five cross-sections. Exploratory analyses …

Victim Impact Statements At Canadian Corporate Sentencing, Erin L. Sheley Jan 2020

Victim Impact Statements At Canadian Corporate Sentencing, Erin L. Sheley

Faculty Scholarship

The recent SNC-Lavalin scandal and its political fallout have drawn
public attention to an existing culture of impunity enjoyed by corporate
criminal wrongdoers, despite the 2004 changes to the Criminal Code of
Canada that intended to make corporate prosecutions easier. In this article,
I argue that the conceptual problems with corporate criminal liability may
lie in the criminal justice system’s general misapprehension of the nature of
corporate crime; especially of the distinct nature of the harm experienced
by white collar victims. I further argue that, therefore, part of the solution
to under-enforcement may be evidentiary: the Crown and courts should, …

Off On A Technicality: The Proper Remedy For Improper Venue, Chris Thomson Jan 2020

Off On A Technicality: The Proper Remedy For Improper Venue, Chris Thomson

SMU Law Review

Since its introduction to the public discourse, lawyers have admonished the pejorative phrase, “off on a technicality”—and rightfully so. However, the phrase may rightfully find application to the law’s present treatment of criminal defendants who have been convicted in improper venues. Although venue is a constitutionally necessary component of all criminal prosecutions, it does not speak to the factual guilt or innocence of a defendant. Nevertheless, in the Fifth and Eighth Circuits, defendants whose convictions stem from improper venue may be acquitted despite a jury’s finding that they committed each substantive element of the underlying offense. By contrast, the Sixth …

The Debate Over The Permissibility Of Selective Privilege Waiver Orders Under Federal Rule Of Evidence 502(D): The Crucial Scope Issues, Edward J. Imwinkelried Jan 2020

The Debate Over The Permissibility Of Selective Privilege Waiver Orders Under Federal Rule Of Evidence 502(D): The Crucial Scope Issues, Edward J. Imwinkelried

SMU Law Review

In the past, most common-law courts developed an intense antipathy to privileges because they perceived privileges as obstructing the search for truth. To begin with, the courts made it difficult for claimants to assert privileges by prescribing rigorous foundational requirements for privilege claims. Moreover, the courts made it easy to find a waiver. As some commentators observed, many courts took an absolutist approach and demanded that holders guard their privileges like crown jewels. For example, the courts announced that even inadvertent production of privileged material could effect a waiver, a waiver as to any privileged communication automatically extends to any …

Accountability For Sexual Assault Aboard Airplanes: An Analysis Of The Need For Reporting Requirements At 35,000 Feet, Madison L. George Jan 2020

Accountability For Sexual Assault Aboard Airplanes: An Analysis Of The Need For Reporting Requirements At 35,000 Feet, Madison L. George

Journal of Air Law and Commerce

Currently, airlines have no legal duty to report an in-flight sexual assault to law enforcement. This lack of a duty to report hinders investigations, prevents victims from receiving closure, and imposes additional liability on air carriers. This Comment suggests imposing a mandatory and uniform reporting requirement on commercial airlines. This requirement would better assist travelers and help limit airlines’ liability for in-flight sexual assault.

By examining the purposes and policies of other mandated reporting laws, it is apparent that the airline industry is an apt place to instill a duty to report. Requiring airlines to report in- flight sexual assault …

O Brother Where Art Thou? The Struggles Of African American Men In The Global Economy Of The Information Age, Kenneth G. Dau-Schmidt Jan 2020

O Brother Where Art Thou? The Struggles Of African American Men In The Global Economy Of The Information Age, Kenneth G. Dau-Schmidt

Indiana Journal of Law and Social Equality

As early as the late 1980’s, William Wilson argued that widespread economic transitions had altered the socioeconomic structure of American inner cities to the detriment of African Americans. Wilson identified declines in manufacturing work and its replacement with poorly compensated service sector work as driving racial segregation and leaving African Americans jobless, poor and alienated from American society. These transitions were particularly problematic for African American men since manufacturing work was their primary gateway to middle-class employment while African American women had already focused more on service work.

Since the initial exposition of Wilson’s theory of deindustrialization, Wilson’s framework of …

Capital Punishment, Vanessa Mosqueda Ramirez Jan 2020

Capital Punishment, Vanessa Mosqueda Ramirez

Nebraska College Preparatory Academy: Senior Capstone Projects

Capital punishment: one of the most debated topics in the United States criminal justice policy. A system that has been called arbitrary many a time due to prejudice, discrimination, and innocence in death row. Some critics argue that the death penalty is applied in somewhat of an erratic fashion; two different offenders who commit the same crime may receive immensely different sentences like life imprisonment or death. There have been executions of innocent people, and there are people who managed to get free because they were wrongfully convicted.

Understanding Community Members’ Perception Of Opioid Treatment Programs For Women In Westchester County, Erika Jean Pichardo Jan 2020

Understanding Community Members’ Perception Of Opioid Treatment Programs For Women In Westchester County, Erika Jean Pichardo

Walden Dissertations and Doctoral Studies

Research shows a significant rise in opioid abuse that has led to an opioid epidemic. Although research has shown the importance and effectiveness of treatment programs for opioid users, there is a lack of research on understanding community members’ perception and role of such programs and their perception of women who are opioid abusers and enter programs. The purpose of this study was to understand community members’ perception of opioid treatment programs for women in New York State’s Westchester County, using the theoretical framework of Becker’s social labeling theory. The study employed a phenomenological design using interviews. Results of the …

Juvenile Recidivism After Release From A Juvenile Detention Center In Atlanta, Georgia, Jacquelyn Monique Nelson Jan 2020

Juvenile Recidivism After Release From A Juvenile Detention Center In Atlanta, Georgia, Jacquelyn Monique Nelson

Walden Dissertations and Doctoral Studies

After undergoing a form of rehabilitation (i.e., youth detention centers in Georgia), statistics show that juveniles have a 65% chance of reoffending within 3 years after being released. The Georgia Juvenile Justice System’s $300 million annual budget raises concerns about the acts of juvenile recidivism. The purpose of this research was to understand why juveniles reoffend after being in a juvenile detention center in Atlanta, Georgia. The conceptual framework for this study was centered on the alternative to youth detention centers. The research question addressed factors that led juvenile delinquents to reoffend after receiving an alternative treatment. This study had …

Perceptions Of Stress And Coping In The First Year Of Police Work, Scott David Eaton

Walden Dissertations and Doctoral Studies

The pressures associated with a career in law enforcement are considerable and often result in significant detriment to an officer's personality, behavior, and overall mental health, ultimately impacting job performance and work engagement. Although there is extensive research on the influence of stress encountered in police work, an understanding of those stressors and ways of coping in the first year of police work has yet to be fully explored. Examining Experiences Of Sex Offender Program Professionals Working In Civil Commitment Programs, William Donald King Jan 2020

Examining Experiences Of Sex Offender Program Professionals Working In Civil Commitment Programs, William Donald King

Walden Dissertations and Doctoral Studies

Criminal justice systems have attempted to include psychiatric history as a component for consideration when it comes to punishment and rehabilitation. Criminal justice systems have created various programs to address the psychological components of some behaviors to address specific actions. These programs are intended to consider an individual’s psychological history and address the underlying causes to eliminate future criminal behavior. This study focused on professionals working in civil commitment programs for sexually violent predators. The purpose of this phenomenological study was to explore the lived experiences of professionals working in these programs and gain an understanding of their attitudes, perspectives, …

Exile From Main Street, Deborah N. Archer Jan 2020

Exile From Main Street, Deborah N. Archer

Faculty Articles

There is a growing web of policing-based housing policies that prohibit people who have had contact with the criminal legal system from living in public, subsidized, or private rental housing. This web of restrictions is consistent with America’s broader embrace of exile in response to perceived threats and is rapidly expanding against a backdrop of mass criminalization. While individual policing-based housing policies have received some scholarly attention, little has been written about their cumulative impact and the central role that mass criminalization plays in locking people out of housing. When the full array of restrictions on public and private housing …
