Social Learning Theory And Digital Piracy: Explaining Uploading Behaviors Of Digital Pirates, Cydney J. Lowenstein Jan 2020

Social Learning Theory And Digital Piracy: Explaining Uploading Behaviors Of Digital Pirates, Cydney J. Lowenstein

Theses and Dissertations

Digital piracy has received significant attention in criminological research but almost no studies have explored illegal uploading and how it may differ from illegal downloading. It is important to examine what theories can explain illegal uploading behaviors and their related factors to develop more effective policies to address digital piracy. This dissertation examined whether Akers’ (1998) social learning theory could explain engagement in digital piracy, both illegal downloading and uploading behavior. Additionally, this research examined the relationship between reciprocity and digital piracy. Questionnaires were administered to 398 university students and 315 visitors to several online communities using a combination of …

Transforming Trauma: Performing The Works Of William Shakespeare As Rehabilitation For Incarcerated Individuals, Elyssa Mersdorf Jan 2020

Transforming Trauma: Performing The Works Of William Shakespeare As Rehabilitation For Incarcerated Individuals, Elyssa Mersdorf

Theses and Dissertations

This paper is the summation of my research and exploration into the history, social ramifications, and individual psychological impact of incarceration and the use of theatre as a vehicle of rehabilitation. Throughout my studies, I encountered evidence in the forms of personal accounts from theatre practitioners, scholarly articles, inmate testimonials, and historical journals regarding the success of such carceral theatre programs in the reformation of the prisoners they serve. How have past prison procedures and strategies hindered or helped inmates in their preparation for their transition from life in a penitentiary to reintroduction into larger society? What are the financial …

Analysis Of Stigmatic Content In State Mental Health Legislative Proposals, David L. Conley Jan 2020

Analysis Of Stigmatic Content In State Mental Health Legislative Proposals, David L. Conley

Theses and Dissertations

Despite the proven effectiveness of mental health interventions, services remain limited across the country. Social workers have repeatedly advocated for increased funding, but mental healthcare gaps persist. Disparities could be addressed through the policy process, but critical proposals often do not pass. One of the biggest barriers is the concept of stigma, which could extend into legislatures and influence mental health-related policy outcomes as a form of structural stigma. Factors that influence legislator voting behavior are found in the literature, but studies have not explicitly focused on structural stigma or mental health-specific policy outcomes. Thus, the present study aimed to …

Can School Be A Source Of Trauma? Assessing Academic Traumatic Stress As A Mechanism Underlying The Health Outcomes Of Black Undergraduate Students, Ebony A. Lambert Jan 2020

Can School Be A Source Of Trauma? Assessing Academic Traumatic Stress As A Mechanism Underlying The Health Outcomes Of Black Undergraduate Students, Ebony A. Lambert

Theses and Dissertations

Research examining Black students’ school experiences demonstrates that exposure to oppressive power dynamics in schools may lead to adverse physiological and psychological consequences. Recent conceptualizations in public discourse further posit that traumatic educational experiences, operationalized here as academic trauma or the cumulative toll of adverse and oppressive experiences in academic settings, may influence Black students’ wellbeing even after they have graduated. However, academic trauma has yet to be investigated empirically, and the health contributions of such educational harm remain unstudied. Moreover, little is known about how culturally-relevant personal characteristics (e.g., emotion regulation strategies) influence Black students’ reactivity to academic trauma. …

Into The Weeds: Modern Discrimination Law, Sandra F. Sperino Jan 2020

Into The Weeds: Modern Discrimination Law, Sandra F. Sperino

Faculty Publications

Modern discrimination law is the law of minutiae. Judicial energy is not primarily focused on large questions about why workplace inequality exists or how to prevent it. It is not even focused on whether the plaintiff in a particular case was treated differently because of a protected trait. Instead, judicial energy centers on interpreting and applying an ever-growing phalanx of complicated court-created ancillary doctrines.

Since the 1970s, the federal courts have created a number of frameworks to analyze discrimination claims. Each framework provides a roadmap for proving a certain theory of discrimination. Over time, the courts have added bells and …

Evaluation Of System Improvement Funding Fy 2019-2020, Anne M. Hobbs

Reports

The U.S. Office of Juvenile Justice and Delinquency Prevention (OJJDP) has long held that strong communities are a salient factor in reducing delinquency (1995). They specifically note, “community planning teams that include a partnership of agency and lay participants can help create a consensus on priorities and services to be provided. They also build support for a comprehensive approach that draws on all sectors of the community for participation, such as the criminal justice and juvenile justice systems” (National Juvenile Justice Plan, 1996). Prior research has noted that successful collaborations seem to tap into the group’s potential using a specific …

Is The Emperor Still Far Away? Centralization, Professionalization, And Uniformity In China's Intellectual Property Reforms, 19 Uic Rev. Intell. Prop. L. 145 (2020), William Weightman

UIC Review of Intellectual Property Law

As China’s rapid economic growth continues to slow, the Chinese Communist Party now seeks to promote innovation as the engine of future development. With this new economic agenda, reforms to China’s intellectual property rights (IPR) regime have emerged as a key policy domain as China attempts to build market-supporting institutions and improve law enforcement capabilities. By reviewing the legal frameworks supporting specific judicial reforms and through non-randomized, semistructured field interviews with lawyers, IP officials, and industry representatives, this article analyzes how China’s evolving legal institutions are increasing central control in the IP adjudication process, building judicial professionalism, and ensuring uniformity …

Three Conceptions Of Corporate Crime (And One Avenue For Reform), Miriam H. Baer Jan 2020

Three Conceptions Of Corporate Crime (And One Avenue For Reform), Miriam H. Baer

Faculty Scholarship

One of corporate criminal law’s most enduring mysteries is the persistence of the deferred prosecution agreement (DPA), the means by which federal prosecutors often dispose of corporate prosecutions. This extra-judicial settlement device attracts near-universal criticism. Progressives complain that DPA settlements are too weak and allow corporate managers to treat enforcement as just another cost of doing business. Good-government advocates worry that the process that generates these agreements is often too opaque. And corporate defenders claim that they impose unnecessary and inefficient costs on legitimate operations. Despite these criticisms, DPAs have remained one of the federal prosecutor’s key tools for addressing …

Rehabilitating Our Immigration System With The Rehabilitation Act: Rejecting Video Teleconferencing And Presumptively Requiring In-Person Court Appearances As A Reasonable Accommodation For Mentally Incompetent Detainees, Cassandra H. Chee Jan 2020

Rehabilitating Our Immigration System With The Rehabilitation Act: Rejecting Video Teleconferencing And Presumptively Requiring In-Person Court Appearances As A Reasonable Accommodation For Mentally Incompetent Detainees, Cassandra H. Chee

American University Law Review

In recent years, the Executive Office for Immigration Review (EOIR), the office of the U.S. Department of Justice (DOJ) responsible for adjudicating immigration cases, has increasingly relied on the use of video teleconferencing (VTC) in immigration court proceedings, as opposed to in-person court appearances. Citing VTC as an efficient and effective way to conduct hearings and manage its large docket backlog, EOIR has installed VTC units at its headquarters and at nearly all immigration courts, and the agency’s use of VTC has risen exponentially under the Trump Administration. Yet, VTC has been proven to harm immigration judges’ abilities to assess …

Illiberalism And Authoritarianism In The American States, James A. Gardner Jan 2020

Illiberalism And Authoritarianism In The American States, James A. Gardner

American University Law Review

Federalism contemplates subnational variation, but in the United States, the nature and significance of that variation has long been contested. In light of the recent turn, globally and nationally, toward authoritarianism, and the concurrent sharp decline in public support not merely for democracy but also for the philosophical liberalism on which democracy rests, it is necessary to discard or to substantially revise prior accounts of the nature of state-to-state variation in the United States. All such accounts implicitly presuppose a common commitment, across the political spectrum, to the core tenets of democratic liberalism, and consequently assume that subnational variations in …

Adolescent Substance Abuse Screening, Wesley W. Lynch Jan 2020

Adolescent Substance Abuse Screening, Wesley W. Lynch

Walden Dissertations and Doctoral Studies

Adolescent substance use is a key public health problem in rural Ohio. Primary care nurses lack substance use screening knowledge and skills. Early screening and detection of possible substance use issues aids in directing patients to appropriate health services. This project involved the implementation of an educational intervention on the CRAFFT screening tool for primary care nurses in rural Ohio. Guided by Kurt Lewin's 3-step model to emphasize prevalence of substance use and need for screening among adolescents, the purpose of this project was to provide training on the CRAFFT screening approach and share guidelines to implement routine substance abuse …

Relationships Among Patterns Of Criminal Thinking Styles And Recidivism In Non-Violent Offenders On Probation, Dr. Louise Mitsianis Jan 2020

Relationships Among Patterns Of Criminal Thinking Styles And Recidivism In Non-Violent Offenders On Probation, Dr. Louise Mitsianis

Walden Dissertations and Doctoral Studies

The 3-year rate of recidivism in the United States is around 43%, costing taxpayers millions of dollars every year. The purpose of this study was to investigate the relationship between criminal thinking styles and self-reported recidivism, which included crimes committed that were not reported to authorities. According to Ellis' Rational-Emotive Behavior Therapy theory, behavior is a direct result of cognitive activity. The research question asked what relationship existed between criminal thinking styles and recidivism for post-release non-violent offenders on probation. Using the Psychological Inventory of Criminal Thinking Styles, this study used a non-experimental survey approach, correlating scores from this measure …

An Examination Into Fusion Centers Impact On Information Sharing Post 9/11, Racquel Nicola Palmer

Walden Dissertations and Doctoral Studies

The aftermath of the 9/11 attacks on the United States resulted in the introduction of the National Fusion Center Network. This effort seeks to empower National Security by effectively sharing information between various law enforcement organizations. Since the establishment of the Network, information that addresses the Networks' standard operating procedures and existing barriers to share information effectively has been lacking. This caused many criticisms as to whether the network is in fact effective in fulfilling its mandate to effectively share information between the various law enforcement agencies. Utilizing Bandura's cognitive theory of behavioral change, this phenomenological study identifies the strategies …

Experiences Of Police Officers Who Have Received Crisis Intervention Team Training, Ashley D. Yinger Jan 2020

Experiences Of Police Officers Who Have Received Crisis Intervention Team Training, Ashley D. Yinger

Walden Dissertations and Doctoral Studies

Police officers are often the frontline responders to calls involving people in mental distress. The lack of specialized mental health training can influence stigmatization and criminalization of people with a serious mental illness (SMI). Crisis intervention team (CIT) training is a tool to provide law enforcement with specialized mental health training to enhance their skills and comfort level when responding to crisis calls. There is a gap in the research examining officers' experiences with CIT training and how they apply that training when encountering people who have a SMI. The purpose of this qualitative case study was to explore a …

Human Trafficking Definitions To Eradication In Virginia: A Legislative Analysis, Hannah Kay Byrum Jan 2020

Human Trafficking Definitions To Eradication In Virginia: A Legislative Analysis, Hannah Kay Byrum

Undergraduate Honors Theses

The gap between the reality of human trafficking in Virginia and the necessary legislative systems, remedies, and support afforded to victims, is wide. My research arose from my experience navigating this incongruity in Virginia law and its impacts, through a delegate’s office, the office of a United States Senator, and a government relations firm. This research articulates the significant, material legislative initiatives required in Virginia’s human trafficking legislative landscape. In surveying this landscape, this research articulates where incongruences ex-unified language and legislative definitions, exist in key areas. This research addresses the need for expansion on the parameters to which victims …

Help-Seeking Stigma And Attitudes In College Students And Parents, Samantha Sperling Jan 2020

Help-Seeking Stigma And Attitudes In College Students And Parents, Samantha Sperling

Senior Honors Theses

Help-seeking stigma is a hindrance to obtaining treatment for mental illness and is related to people’s attitudes toward seeking help. Therefore, learning about the various types of stigma and gaining predictive knowledge of the constructs has value. Self-stigma and perceived stigma of others, as well as the attitudes people hold towards seeking help, were compared in college students and their parents. A sample of college students at a private Christian university and their parents were surveyed using the Self-Stigma of Seeking Help (SSOSH) scale, the Perception of Stigmatization by Others for Seeking Help (PSOSH) scale, and a short form of …
