Doctors And "Dopefiends": Perspectives On The U.S Opiate Crisis, 21st Century, John C. Foerster
Doctors And "Dopefiends": Perspectives On The U.S Opiate Crisis, 21st Century, John C. Foerster
Honors Undergraduate Theses
This article examines the socio-political intricacies of the United States Opiate Crisis. By first addressing the pharmaceutical origins of Oxycontin and its pain relief benefits within the United States, I construct a framework by which a conversation about substance abuse can move forward. Within the first chapter I provide background into the arguments for medicalization against personal responsibility as it relates to opiate withdrawal and seeking treatment for the prior. Furthermore, I include subheadings to further provide insight into Medically Assisted Treatment Centers and their function on the local level. I contrast these modern treatment models with the Reagan War …

Parenting From Prison: Perceptions Of Incarcerated Parents' Ability And Influence, Gabrielle Hadorn
Parenting From Prison: Perceptions Of Incarcerated Parents' Ability And Influence, Gabrielle Hadorn
Theses and Dissertations--Family Sciences
Incarcerated parents are at a substantially higher risk for losing their legal right to parent than the general public. This study assessed implicit perceptions and biases that may play a role in these legal decisions, specifically the perceptions of incarcerated parents’ ability to parent and influence their children’s lives. Court appointed special advocate (CASA) volunteers’ (N = 242) perceptions of incarcerated parents based on the parents’ personal characteristics, characteristics of their children, and characteristics of their criminal activity were assessed through a true-experiment design. Ordinal regression analyses revealed that age of child, level of violence in the crime committed, and …

Purpose: Over the past several months, the coronavirus has infected more than six million Americans and killed nearly 200,000. Governors have issued stay-at-home orders, and prosecutors have filed criminal charges against individuals for defying those orders. And yet many Americans have still refused to keep their distance from their fellow citizens, even if they had symptoms of infection. The authors explore the underlying causes for those who intend to defy these norms.
Methods: Using national-level data from a March 2020 survey of 989 Americans, the authors explore intentions to defy social distancing norms by testing an interactionist theory of foundation-based …

Anti-Lgbtq Hate: An Analysis Of Situational Variables, Jill Kehoe
Anti-Lgbtq Hate: An Analysis Of Situational Variables, Jill Kehoe
Publications and Research
The current study aimed to augment the scant body of literature on anti-LGBTQ hate by providing an in-depth examination of anti-LGBTQ hate incident situational characteristics including offender substance use, number of offenders, crime location, and victim-offender relationship. Analysis of situational dynamic variables provided support for the notion that anti-LGBTQ hate is a distinct type of criminal incident. Significantly increased levels of offender substance use, crimes perpetrated by multiple offenders, crimes perpetrated by acquaintances, and crimes taking place in open spaces substantiates the theory that anti-LGBTQ hate is qualitatively unique, typified by different characteristics than other forms of crime. The data …

Servant-Leadership In Turbulent Times: A Conversation With Larry C. Spears, Jiying Song
International Journal of Servant-Leadership
The year of 2020 has been most challenging to many people all over the world. The COVID-19 pandemic has left almost no one’s life untouched. Robert Greenleaf’s best test says, “Do those served grow as persons? Do they, while being served, become healthier, wiser, freer, more autonomous, more likely themselves to become servants? And, what is the effect on the least privileged in society; will they benefit, or at least, not be further deprived?” During this pandemic, the least privileged in society suffer the most, and various groups of vulnerable people have been marginalized, or pushed further into poverty. Is …
Victim Impact Statements And Corporate Sex Crimes, Erin L. Sheley
Victim Impact Statements And Corporate Sex Crimes, Erin L. Sheley
Faculty Scholarship
This Article argues that more frequently including victim impact statements during the sentencing phase of corporate criminal trials would help lay foundation for legislative reforms geared towards punishing corporations on the occasions where genuinely corporate misconduct, such as that of USAG and the Weinstein Company, can be said to have caused sexual offenses. The Article proceeds in three Parts. First, I argue that criminal enforcement against corporations is generally untethered from harm to victims, and that this thwarts one of the most coherent justifications for the existence of corporate criminal liability. Next, I argue that a focus on victim narratives …
An Intersection Of Gender, Race, And Sports: Guidelines For Universities Determining Whether Athletes Accused Of Title Ix Violations Should Be Removed From Their Teams, David A. Grenardo
An Intersection Of Gender, Race, And Sports: Guidelines For Universities Determining Whether Athletes Accused Of Title Ix Violations Should Be Removed From Their Teams, David A. Grenardo
Faculty Articles
Sexual assault on college campuses remains an epidemic. As universities attempt to handle Title IX complaints regarding sexual misconduct, they must protect the academic environment and integrity of their schools. Since athletes are three times more likely to be accused of sexual assault than non-athletes, and schools have historically mishandled complaints against athletes, the proposed guidelines in this Article provide an equitable approach for determining when an athlete should be removed from his team based on accusations of a Title IX violation. The guidelines are based on the newly implemented Title IX regulations and take into account the interests and …
Rural Veterans Of Texas And Their Accessibility To Mental Health Care Services, Jeremy Buchanan
Rural Veterans Of Texas And Their Accessibility To Mental Health Care Services, Jeremy Buchanan
West Chester University Doctoral Projects
After their service commitment has concluded, United States servicemembers are evaluated to what medical ailments and afflictions, both mental and physical, are attributed to their military service. The Department of Veterans Affairs is the government agency that is specifically tasked with the treatment and care of that exam and continuously works on this overwhelming endeavor as military members transfer out from their respective branch of service. One area that is outside of the VA’s control is where veterans will reside upon their separation from the military. When it comes to rural areas, the access to resources, primarily for this study, …

Mandatory, Fast, And Fair: Case Outcomes And Procedural Justice In A Family Drug Court, Melanie Fessinger, Katherine Hazen, Jamie Bahm, Jennie Cole-Mossman, Roger Heideman, Eve Brank
Center on Children, Families, and the Law: Faculty Publications
Objectives: Problem-solving courts are traditionally voluntary in nature to promote procedural justice and to advance therapeutic jurisprudence. The Family Treatment Drug Court (FTDC) in Lancaster County, Nebraska, is a mandatory dependency court for families with allegations of child abuse or neglect related to substance use. We conducted a program evaluation examining parents’ case outcomes and perceptions of procedural justice to examine whether a mandatory problem-solving court could replicate the positive outcomes of problem-solving courts. Methods: We employed a quasi-experimental design that compared FTDC parents to traditional dependency court parents (control parents). We examined court records to gather court orders, compliance …

Invisible Article Iii Delinquency: History, Mystery, And Concerns About "Federal Juvenile Courts", Mae C. Quinn, Levi T. Bradford
Journal Articles
This essay is the second in a two-part series focused on our nation’s invisible juvenile justice system—one that operates under the legal radar as part of the U.S. Constitution’s Article III federal district court system. The first publication, Article III Adultification of Kids: History, Mystery, and Troubling Implications of Federal Youth Transfers, examined the little-known practice of prosecuting children as adults in federal courts. This paper will look at the related phenomenon of juvenile delinquency matters that are filed and pursued in our nation’s federal court system. To date, most scholarship evaluating youth prosecution has focused on our country’s juvenile …
A Starting Point For Disability Justice In Legal Education, Christina Payne-Tsoupros
A Starting Point For Disability Justice In Legal Education, Christina Payne-Tsoupros
Journal Articles
This article explores how a disability justice framework would provide greater access to law school and therefore the legal profession for disabled students of color; specifically, disabled Black, Indigenous, and Latinx students. Using DisCrit principles formulated by Subini Annamma, David Connor, and Beth Ferri (2013), this article provides suggestions for incorporating a disability justice lens to legal education. In doing so, this article specifically recognizes the work of three disability justice activist-attorney-scholars, Lydia X.Z. Brown, Talila “TL” Lewis, and Katherine Pérez, and considers lessons from their advocacy and leadership that can apply in the law school setting.
