Plea Bargaining, Reconciliation And Access To Justice In Zambia: Exploring The Invisible Link, O’Brien Kaaba, Tony Zhou Jan 2020

Plea Bargaining, Reconciliation And Access To Justice In Zambia: Exploring The Invisible Link, O’Brien Kaaba, Tony Zhou

Zambia Social Science Journal

This article looks at the criminal justice system in Zambia in relation to efficiency and plea bargaining. Using publicly available data, it demonstrates that the institutions under the criminal justice sector are struggling to cope with heavy caseloads. The majority of cases in this context are disposed of through plea bargaining, thereby avoiding full trial. Only a few proceed to full trial. In this respect, it can be seen that plea bargaining serves two ends: it enables deserving cases to have space for trial and it allows the rest of the cases to be disposed of efficiently, without resort to …

Normative Ignorance: A Critical Connection Between The Insanity And Mistake Of Law Defenses, Ken M. Levy Jan 2020

Normative Ignorance: A Critical Connection Between The Insanity And Mistake Of Law Defenses, Ken M. Levy

Florida State University Law Review

This Article falls into three general parts. The first part starts with an important question: is the insanity defense constitutionally required? The United States Supreme Court is currently considering this question in the case of Kahler v. Kansas. The Court actually refused to answer this question in 2012 when it denied certiorari to an appeal brought by John Joseph Delling, a severely mentally ill defendant who was sentenced to life in prison three years earlier for two murders. Delling never had the opportunity to plead the insanity defense because his home state, Idaho, had abolished it in 1982. By depriving …

Judicial Authority Under The First Step Act: What Congress Conferred Through Section 404, Sarah E. Ryan Jan 2020

Judicial Authority Under The First Step Act: What Congress Conferred Through Section 404, Sarah E. Ryan

Loyola University Chicago Law Journal

The First Step Act of 2018 promised relief to inmates serving disproportionately long sentences for cocaine base distribution. Section 404, the focus of this Article, seemed straightforward. But in the spring and summer of 2019, district judges began reviewing section 404 cases and reaching dissonant results. Appeals followed, focused on four questions of judicial authority: (1) Who may judges resentence?, (2) May judges engage in plenary resentencing or merely sentence reduction?, (3) May judges resentence all concurrent criminal convictions or only crack cocaine convictions?, and (4) Must judges adopt the operative drug quantity from the original sentencing? Today, the law …

Effects Of Different Types Of Forensic Evidence On Arrest Probability: Toward A New Typology Of Evidence, Morgan Steele Ph.D. Jan 2020

Effects Of Different Types Of Forensic Evidence On Arrest Probability: Toward A New Typology Of Evidence, Morgan Steele Ph.D.

Criminal Justice Faculty Publications

Forensic evidence is an important component in criminal justice decision - making. Yet, few studies have examined the effectiveness of the various macro - types of forensic evidence in facilitating arrest. This article analyzed over 4000 case files from five cities to determine how the collection and analysis of three macro - types of forensic evidence (Classification, Identification, and Progenitor) affect the probability of arrest across five different crime types. The results of several sets of logistic regression analyses suggest that forensic evidence affects the probability of arrest, but that the impact is not consistent across different types of crime …

Quantifying Reasonable Doubt, Daniel Pi, Francesco Parisi, Barbara Luppi Jan 2020

Quantifying Reasonable Doubt, Daniel Pi, Francesco Parisi, Barbara Luppi

Law Faculty Scholarship

This article contributes in three ways to the prior literature on the reasonable doubt standard. First, it synthesizes the insular strands of historical, economic, jurisprudential, and doctrinal scholarship on reasonable doubt. Second, it advances a conception of the criminal standard of proof designed to avoid the various problems affecting earlier attempts to devise meaningful definitions of reasonable doubt. The definition proposed is that “reasonable doubt” be the standard of proof which minimizes the aggregate subjective expected social cost of false conviction and false acquittal. Judicial pronouncements of Blackstonian ratios (for example, that it is better that ten guilty go free …

Foreword, Honorable Nathaniel R. Jones Jan 2020

Foreword, Honorable Nathaniel R. Jones

Freedom Center Journal

The articles in this issue of The Freedom Center Journal are timely challenges to the persistent efforts to undermine the American values enshrined in the Preamble of the Constitution and the body of the Constitution itself with its three Civil War Amendments.

The student editors of this volume intended the selected contributions to offer readers a nuanced view of our nation’s current identity crisis. The collection is offered in the hope that it will encourage further thinking and discussion about what it means to be part of the American experiment with democratic self-governance in an age of resurgent white supremacy.

A Candid Discussion About Social Justice: Iris Roley, The Black United Front, And The History Of Cincinnati’S Collaborative Agreement, Ashton Hood Jan 2020

A Candid Discussion About Social Justice: Iris Roley, The Black United Front, And The History Of Cincinnati’S Collaborative Agreement, Ashton Hood

Freedom Center Journal

In early April of 2001 I was growing up in the community of Glendale, a northern suburb of Cincinnati, Ohio. I vividly remember the media coverage of the civil unrest occurring downtown in response to the killing of Timothy Thomas.1 The following interview with Iris Roley, member of the Cincinnati Black United Front, attempts to shed light on the origins of the rage felt in the city during that time period. Proactive steps have been taken since Cincinnati was placed in a national spotlight for its embarrassing race relations. Much work still needs to be done to ensure equity, but …

The System Is Working The Way It Is Supposed To: The Limits Of Criminal Justice Reform, Paul Butler Jan 2020

The System Is Working The Way It Is Supposed To: The Limits Of Criminal Justice Reform, Paul Butler

Freedom Center Journal

Ferguson has come to symbolize a widespread sense that there is a crisis in American criminal justice. This Article describes various articulations of what the problems are and poses the question of whether law is capable of fixing these problems. I consider the question theoretically by looking at claims that critical race theorists have made about law and race. Using Supreme Court cases as examples, I demonstrate how some of the “problems” described in the U.S. Justice Department’s Ferguson report, like police violence and widespread arrests of African-Americans for petty offenses, are not only legal, but integral features of policing …

Sexual Assault Disclosure And Gender: Relationship Between Survivor Gender And Disclosure, Christian Thomas Clevenger Jan 2020

Sexual Assault Disclosure And Gender: Relationship Between Survivor Gender And Disclosure, Christian Thomas Clevenger

Honors Undergraduate Theses

The purpose of this thesis was to explore whether the gender of a sexual assault survivor influenced to whom they disclosed the sexual assault. Previous research indicates that barriers to disclosure could differ based both on the gender of a sexual assault survivor and characteristics of the disclosure recipient. Examining how disclosure is influenced by survivor gender could help better identify which groups could benefit most from educational resources. Participants (n = 160) were college students who experienced a sexual assault in adolescence or adulthood. Disclosure to a range of different formal and informal supports was assessed. Findings indicated that …

What Happens Next? A Grounded Theory Exploration Of The Psychological Impact Of Leaving The Gang, Alana C. Liskov Jan 2020

What Happens Next? A Grounded Theory Exploration Of The Psychological Impact Of Leaving The Gang, Alana C. Liskov

Electronic Theses and Dissertations

Very little research exists regarding the psychological impacts of gang membership and the mental health needs of gang members. Of the few studies that have been conducted, gang members were found to have increased rates of post-traumatic stress disorder (1.77 odds), current substance abuse (2.58 odds), oppositional defiant disorder, (1.24 odds) and conduct disorder (4.05 odds) (Harris, Elkins, Butler, Shelton, Robles, Kwok, Simpson, Young, Mayhew, Brown, & Sargent, 2013). Violent ruminative thinking, violent victimization and fear of further victimization were also significantly higher in gang members and believed to account for high levels of psychosis and anxiety disorder in gang …

Black Minds Matter: A Phenomenological Inquiry Examining The Prevalence Of Racial Trauma Among Black Doctoral Students, Jazmyne Markeeva Peters Jan 2020

Black Minds Matter: A Phenomenological Inquiry Examining The Prevalence Of Racial Trauma Among Black Doctoral Students, Jazmyne Markeeva Peters

Electronic Theses and Dissertations

Systemic and institutionalized racism is endemic to life in the United States and contributes to the daily marginalization of Black people. While the negative psychological and physiological effects of racism have been well-documented, the notion that racism can be experienced as a trauma is a newer theory. Racial trauma has been understudied and underappreciated, though it is a theory that clinicians should incorporate when working with Black clients and other clients of color. Exploring the ways in which Black doctoral students attending a predominantly White institution (PWI) have experienced racism is an essential contribution to the existing racial trauma literature. …

Disrupting Disparity: A Critical Race Transformative Mixed Methods Examination Of School Discipline, Ceema Samimi Jan 2020

Disrupting Disparity: A Critical Race Transformative Mixed Methods Examination Of School Discipline, Ceema Samimi

Electronic Theses and Dissertations

Racial disparities in school discipline are well-established in the United States’ public-school system. These disparities contribute to a phenomenon known as the school-to-prison pipeline. This phenomenon is a metaphor for the mechanisms that push students, especially students of color, out of school and into the justice system. While research has examined the causes and impacts racial disproportionality in discipline, no studies have focused on schools with no disparities. This study used Critical Race Transformative Mixed Methods to examine school-level quantitative data while employing phenomenological methods to interviews with 12 teachers using critical race theory as a lens. Findings revealed that …

Disabling Solitary: An Anti-Carceral Critique Of Canada's Solitary Confinement Litigation, Sheila Wildeman Jan 2020

Disabling Solitary: An Anti-Carceral Critique Of Canada's Solitary Confinement Litigation, Sheila Wildeman

Research Papers, Working Papers, Conference Papers

The title of this chapter signifies at least three things. The first is the disabling effects of solitary confinement. The second is recent efforts of prison justice advocates in Canada to use law, or specifically litigation, to disable the logic of solitary confinement: to disrupt that logic through the logic of human rights. The third, most oblique reference, and one I develop here, speaks to dangers presented by the path Canada’s solitary confinement litigation has taken: a path of isolating disability-based prison justice claims from the wider ambitions of intersectional substantive equality. My thesis is that this isolation of disability …

An Evaluation Of The Montgomery County Reentry Career Alliance Academy, Catherine Marliese Driver Jan 2020

An Evaluation Of The Montgomery County Reentry Career Alliance Academy, Catherine Marliese Driver

Browse all Theses and Dissertations

As a result of a deterrence and incapacitation focused criminal justice system in the United States, reentry programming has become integral to both reduce criminal justice spending and mass incarceration. Reentry programming assists those released from prison with reintegration into society to prevent recidivism and allow the returning citizen to become a productive member of society. This study evaluated one such reentry program in Montgomery County Ohio. The Reentry Career Alliance Academy (RCAA) is a career focused work readiness curriculum that also includes workshops with community stakeholders. Evaluation was completed through paired T Test analysis in pre- and post-questionnaire responses. …

Gchr 2020 - A Year Not To Be Forgotten, Leonard And Shirley Goldstein Center For Human Rights - University Of Nebraska At Omaha

GCHR Faculty Proceedings & Presentations

If there was ever a year to be dispatched early and forgotten, 2020 may be the one. Almost unimaginable twelve months ago, the novel coronavirus pandemic has transformed our lives. This “Year in Review” that I write to you as Executive Director of the Leonard and Shirley Goldstein Center for Human Rights, is soaked in human tragedy. Almost two million people are confirmed dead across the globe from Covid-19. In the United States we are approaching 350,000 deaths. As Wall Street soars, suffering disproportionally affects the most vulnerable amongst us – the elderly and the poor. Human Rights issues abound. …

Ace: A Recipe For Occupational Competence, Brittany J. Miller Jan 2020

Ace: A Recipe For Occupational Competence, Brittany J. Miller

Occupational Therapy Doctorate Capstone Projects

Adverse childhood experiences are increasing in society and the lack of knowledge surrounding the condition from the adults who frequently interact with them is concerning. This concern lays the foundation for the development of a targeted approach to pediatric intervention by occupational therapists. The problem this capstone project addresses is expanding the understanding of how adverse childhood experiences mirror other common conditions as well as the need for more competent and confident occupational therapists in identifying and treating children with adverse childhood experiences.
