Chiral Analysis Of Methamphetamine In Hair Samples, Kristen Payes May 2022

Chiral Analysis Of Methamphetamine In Hair Samples, Kristen Payes

Student Theses

Methamphetamine (MAMP) is a highly addictive illicit drug typically abused for its nervous system stimulating effects. Conversely, methamphetamine has therapeutic use treating attention deficit hyperactivity disorder, controlling appetite and assisting with weight loss, and is available as the pure l-isomer in over-the-counter (OTC) nasal inhalers due to its decongestant activity. Because l-methamphetamine (l-MAMP) is available in OTC form, forensic guidelines require a sample to contain greater than 20% d-methamphetamine (d-MAMP) when classifying results as consistent with illicit MAMP use. Chiral chromatographic analysis is capable of distinguishing between l-MAMP and d-MAMP. This …

Giving Meaning To The Apostrophe In Victim[’]S Rights, Margaret Garvin May 2022

Giving Meaning To The Apostrophe In Victim[’]S Rights, Margaret Garvin

Brooklyn Law Review

There is a lack of consistency in how courts interpret the use or placement of an apostrophe on “victim.” While this may seem like a minor grammatical or typological error, it has a tremendous effect on victim’s rights, as it virtually erases the victim due to the confusion over the ownership of said rights. This essay analyzes how the placement of the apostrophe, in cases dealing with subpoenas duces tecum, have led courts to interpret victim rights in multiple ways, but all with the same outcome—excluding the actual victim from consideration. This causes the actual victims, even when the court …

What Are Victim Impact Statements For?, Susan A. Bandes May 2022

What Are Victim Impact Statements For?, Susan A. Bandes

Brooklyn Law Review

In Payne v. Tennessee, the US Supreme Court upheld the admission of victim impact statements (VIS) on the ground that they provide valuable information to the sentencer. In the three decades since, two additional rationales for VIS have become ascendant: most prominently, a therapeutic rationale, and more recently, a public education rationale. In this article, I expand upon my critiques of the informational and therapeutic rationales in light of a growing body of empirical evidence about how VIS affect both sentencers and crime victims. Focusing on the powerful and viral VIS delivered at the Larry Nassar guilty plea hearings and …

Parole, Victim Impact Evidence, And Race, Alexis Karteron May 2022

Parole, Victim Impact Evidence, And Race, Alexis Karteron

Brooklyn Law Review

Parole offers the possibility of release for a substantial number of incarcerated people in the United States, the world’s largest jailer, but is seriously understudied. In particular, the role of victims and race in the parole decision-making process deserves attention. Decades of research has shown that the “race-of-victim effect” leads to more punitive sentences when white victimhood is at issue. In the parole context, the ubiquity of victim impact statements and the emotional responses they trigger raise the likelihood that the “race-of-victim effect” plagues parole decision-making as well. This essay calls for greater data collection and scrutiny into the role …

Double Classification Of Non-Consensual State Interventions: Magic Protection Or Pandora’S Box?, Pauline Lesaffre May 2022

Double Classification Of Non-Consensual State Interventions: Magic Protection Or Pandora’S Box?, Pauline Lesaffre

International Law Studies

The classification under international humanitarian law of certain cross-border armed conflicts against an organized armed group remains controversial. More specifically, cross-border armed conflicts resulting from a non-consensual State intervention, such as the United States’ intervention in Syria (without Syrian consent) against the Islamic State, still divide legal scholarship regarding their appropriate classification. One theory argues for a single classification of non-international armed conflict between the intervening State and the organized armed group; another theory relies on a double classification of non-consensual State interventions, adding to the non-international armed conflict an international armed conflict between the intervening State and the territorial …

Contextualizing The Impact Of Faculty-Led Short-Term Study Abroad On Students’ Global Competence: Characteristics Of Effective Programs, Colleen Fisher, Laurel Iverson Hitchcock, Ashley Neyer, Stacy C. Moak, Sarah Moore, Scott Marsalis May 2022

Contextualizing The Impact Of Faculty-Led Short-Term Study Abroad On Students’ Global Competence: Characteristics Of Effective Programs, Colleen Fisher, Laurel Iverson Hitchcock, Ashley Neyer, Stacy C. Moak, Sarah Moore, Scott Marsalis

Journal of Global Awareness

Short-term faculty-led study abroad programs are high-impact pedagogical practices designed to enhance students' global competency. However, there is a gap in our understanding regarding the specific educational components of short-term faculty-led study abroad programs that promote global competency. This systematic review examined nearly two decades of research on such programs (n=86) to assess the educational components associated with increases in students' global competencies using Steinberg's (2017) educational components as a framework. Results indicated that the educational components included in global competency-building education abroad courses varied substantially across programs and global regions. The components most strongly supporting enhanced global competency were …

Do Body-Worn Cameras Reduce Disparities In Police Behavior In Minority Communities? Evidence Of Nuanced Influences Across Black And Hispanic Neighborhoods, Jessica Huff May 2022

Do Body-Worn Cameras Reduce Disparities In Police Behavior In Minority Communities? Evidence Of Nuanced Influences Across Black And Hispanic Neighborhoods, Jessica Huff

Criminology and Criminal Justice Faculty Publications

Research Summary

The adoption of body-worn cameras (BWCs) is often promoted in response to contentious police use of force incidents involving minority civilians. BWCs are expected to improve policing outcomes by enhancing accountability, although researchers have yet to determine whether BWCs can reduce racial/ethnic disparities. I examine whether BWCs mitigate the influence of neighborhood racial/ethnic context on arrests and use of force using cross-classified logistic regression models to examine the outcomes of 900,000+ police–civilian contacts in Phoenix. Arrests were significantly more likely to occur in Hispanic and Black neighborhoods before and after BWC deployment, even accounting for situational, officer, and …

The Influence Of Parole Case Characteristics And Construal Level On Parole Decisions And Perceived Humanness, Yi Sin Goh May 2022

The Influence Of Parole Case Characteristics And Construal Level On Parole Decisions And Perceived Humanness, Yi Sin Goh

Student Theses

Despite the low rate of discretionary parole release in New York, much is still unknown about the processes underpinning parole decisions. The present paper delves into how aggravating and mitigating parole case characteristics (e.g. institutional behavior) relate to parole decisions and the perceived humanness of parole applicants. The paper also examines how construal level can moderate the above relationships. Finally, a moderated mediation model outlining the pattern of these relationships is posited and tested. 122 New York residents were recruited online and randomly assigned to read either an abstractly or concretely construed transcript for an interview with a parole applicant. …

A Comparative Content Analysis Of How Print Media Framed The Heroin Epidemic And The Opioid Crisis, Quincy Hodges May 2022

A Comparative Content Analysis Of How Print Media Framed The Heroin Epidemic And The Opioid Crisis, Quincy Hodges

LSU Doctoral Dissertations

This dissertation examined how the news media covered the Opioid Crisis of the 21st century compared to how the news media covered the Heroin Epidemic of the 1970s. A content analysis of six U.S. newspapers – the New York Times, the Washington Post, The Columbus Dispatch, The Detroit Free Press, The Atlanta Journal-Constitution, and the New Orleans Times-Picayune indicated that the print news media covered the Heroin Epidemic and the Opioid Crisis drastically different. The news media framed the Opioid Crisis as a public health issue, focusing coverage on rogue doctors and health professionals, and how unethical pharmaceutical companies took …

Female Sex Offenders: Double Standards, Sofia Enes May 2022

Female Sex Offenders: Double Standards, Sofia Enes

Kean Quest

This paper will discuss female pedophiles, rapists, and sex offenders, also known as female sex criminals, the double standards, of how they are viewed in the criminal justice system, how the medical fields view them, the psychological effects of their actions on their victims, and how the public views them. Unlike male pedophiles, rapists, and sex offenders of that gender; female pedophiles are not as readily identified as male pedophiles. Since female sex criminals do not always conform and fit the stereotypes that are more commonly found in male sex criminals, it is much more difficult for authorities to detain …

Done The Time, Still Being Punished For The Crime: The Irrationality Of Collateral Consequences In Occupational Licensing And Fourteenth Amendment Challenges, Mccarley Maddock May 2022

Done The Time, Still Being Punished For The Crime: The Irrationality Of Collateral Consequences In Occupational Licensing And Fourteenth Amendment Challenges, Mccarley Maddock

Duke Journal of Constitutional Law & Public Policy Sidebar

Traditionally, retributive models of criminal justice rely on incarceration as punishment for a crime. Under this theory, punishment should end when the offender is released from prison. Yet, a decentralized web of statutes across the United States undermines this commonsense notion and continues to punish formerly incarcerated persons by denying them access to basic services for re-entry into society such as housing, government benefits, and employment. Specifically, thousands of the formerly incarcerated individuals are barred from working in or pursuing a career of their choice based on state statutes that prohibit entry into a given profession based on criminal history. …

Universalizing Fraud, Parmida Enkeshafi May 2022

Universalizing Fraud, Parmida Enkeshafi

Duke Journal of Constitutional Law & Public Policy Sidebar

The criminal trial of Elizabeth Holmes has reanimated public interest in fraud. Holmes, once a Silicon Valley prodigy, was charged with two counts of conspiracy to commit wire fraud and eleven counts of wire fraud. A jury found Holmes guilty on four counts, potentially subjecting her to 80 years in prison. This Note uses the example of Elizabeth Holmes's case to examine more broadly the role of morality in fraud and argues for a new framework by which to articulate and prosecute fraud.

Criminal jurisprudence has struggled to construct a satisfactory definition of "white-collar crime" since sociologist Edwin H. Sutherland …

Helmets Off: An Exploratory Investigation Into The Philanthropic Activity Of Black Nfl Players, Eugena Anderson May 2022

Helmets Off: An Exploratory Investigation Into The Philanthropic Activity Of Black Nfl Players, Eugena Anderson

Dissertations

The term philanthropist typically conjures up images of older, wealthy White males. When taking account of a more diverse population, the term generosity provides a more inclusive framework to understanding the experiences of those marginalized from the study and practice of philanthropy. Using an interpretative phenomenological analysis (IPA) approach, this qualitative investigation explored one of several groups of individuals engaging in acts of generosity and brought the Black athlete experience into academic and philanthropic conversations. This research provided knowledge from real-life experiences of current and former Black NFL Players (BNPs) to inform various stakeholders who seek to support their activities. …

Issues Of Right To Legal Counsel In Immigrant Removal Proceedings: Due Process Framework And Applicability, Cambria A. Judd Babbitt May 2022

Issues Of Right To Legal Counsel In Immigrant Removal Proceedings: Due Process Framework And Applicability, Cambria A. Judd Babbitt

Honors Projects

Immigration removal proceedings suffer from a lack of procedural due process protections for non-citizens facing deportation charges. This research examines constitutional due process framework, what it entails, and how it is to be fairly applied to non-citizens in the United States. Special attention is paid to ways the immigration court system is subject to unjust and biased procedures that make it difficult for immigrants to succeed in their removal cases. The main focus of this study is on the importance of direct legal representation in removal proceedings to support non-citizens and keep courts accountable for upholding the due process of …

Creative And Expressive Arts Therapy In Motivational Interviewing, Mary Hunt May 2022

Creative And Expressive Arts Therapy In Motivational Interviewing, Mary Hunt

Expressive Therapies Capstone Theses

The practices of Creative Arts Therapies (CATs), Expressive Arts Therapy (EATs), and Motivational Interviewing (MI) are regarded as profoundly impactful for use in mental health professions. While there is extensive literature supporting the benefits of the practices individually, research to date on combining CATs or EATs with MI is limited. This Capstone investigates the combination of the fields, including research linking MI to the fields under the CATs umbrella of art, dance/movement, drama, and music therapies. The key elements of each practice are defined, and their overlapping similarities are identified, examples of complementary CATs interventions to the practice of MI …

Group Scriptwriting For Male Survivors Of Childhood Sexual Abuse: A Community Engagement Project, Anna Coleman

Expressive Therapies Capstone Theses

The objective of this community engagement project was to explore the experiences of a group of male survivors of childhood sexual abuse via a writing process through a drama therapy-based lens, which included the use of scaffolding sessions with projective writing techniques, the use of aesthetic distance, verbally sharing written works to the witnessing audience, and embodied feedback and response by the witnessing audience to the performer. The participants were part of a grant-funded male sexual abuse survivor support group at an American outpatient, in-office mental health counseling group practice. All sessions were held in audio-video telehealth sessions. There were …

The Role Of Dance/Movement Therapy On Inmates After Restrictive Housing – A Literature Review, Savannah Melo May 2022

The Role Of Dance/Movement Therapy On Inmates After Restrictive Housing – A Literature Review, Savannah Melo

Expressive Therapies Capstone Theses

The aim of this literature review is to highlight the impact dance/movement therapy has on individuals who have experienced segregated housing in a correctional facility and the mental health effects segregation may cause. The negative effects this housing may cause will be explored. This exploration will include related applications of dance/movement therapy (DMT), demonstrating how in past research it has been shown to improve different mental health symptoms. Though dance/movement therapy is not as readily available to the prison population, the intention of this thesis is to investigate expressive arts, specifically DMT, as a treatment modality for inmate mental health. …

Sexual violence is a common experience throughout the United States. The aftermath of this traumatic experience impacts the entire body, including the emotional, physical, and mental states of an individual. The distressing symptoms of sexual violence can last from weeks to years. The aftermath of sexual violence can make it difficult for victims to complete daily tasks and can lead to disorders such as Depression or Post Traumatic Stress Disorder. This literature review explores the current treatments used with survivors of sexual violence, which include trauma-focused cognitive behavioral therapy, Eye Movement Desensitization and Reprocessing, and other effective treatments. Expressive Therapies Capstone Theses

This capstone project ventures to develop a drama therapy method that may increase empathy, social skills, and communication skills in populations with substance use disorders. Particular attention has been paid to the efficacy of performance/talkback methods in increasing these factors. An attempt has been made to streamline the performance/talkback method for greater accessibility to such methods in clinical spaces. The literature shows a particular need in populations with substance use disorders for social skills, communication skills, and empathy training. There have been published drama therapy studies that aim to intervene in these areas, though few with this particular population. This …

Data Ethics: An Investigation Of Data, Algorithms, And Practice, Gabrialla S. Cockerell May 2022

Data Ethics: An Investigation Of Data, Algorithms, And Practice, Gabrialla S. Cockerell

Honors Projects

This paper encompasses an examination of defective data collection, algorithms, and practices that continue to be cycled through society under the illusion that all information is processed uniformly, and technological innovation consistently parallels societal betterment. However, vulnerable communities, typically the impoverished and racially discriminated, get ensnared in these harmful cycles due to their disadvantages. Their hindrances are reflected in their information due to the interconnectedness of data, such as race being highly correlated to wealth, education, and location. However, their information continues to be analyzed with the same measures as populations who are not significantly affected by racial bias. Not …

The International Criminal Court And Civil Resistance, Anne E. Yamamoto May 2022

The International Criminal Court And Civil Resistance, Anne E. Yamamoto

Master's Theses

There has long been work and research on international criminal justice in the face of great and tragic atrocities. One mechanism established to confront these atrocities and create international criminal justice is the International Criminal Court. Since its inception the court has drawn criticism both for its infringement on state sovereignty and its focus on Africa. My research looks at how the International Criminal Court can best work to address these critiques and continue to provide international criminal justice. I believe one facet of this can be found in the adoption of the normative framework of a Right to Assist …
