Civil Resistance: The Dictates Of Conscience And International Law Versus The American Judiciary, Matthew Lippman
Civil Resistance: The Dictates Of Conscience And International Law Versus The American Judiciary, Matthew Lippman
Florida Journal of International Law
This essay traces the evolution of civil resistance in the United States and argues for judicial recognition of the applicability of the necessity defense for civil resisters. Initially, the history of civil disobedience in the United States and the theory of Gandhian civil disobedience are outlined. The response of courts in rejecting attempts to justify such protest activities is then described; and American courts’ rejection of the necessity defense to justify formally illegal acts of protest is criticized.
Silence Is No Longer Golden: The Criminal Evidence Order (Northern Ireland) 1988, John C. Hamlin
Silence Is No Longer Golden: The Criminal Evidence Order (Northern Ireland) 1988, John C. Hamlin
Florida Journal of International Law
This comment will assess the nature and probable impact of the Northern Ireland Criminal Evidence Order. Critics claim that the Order has diminished personal freedom while proponents point to the abuse of the “right to silence” by guilty defendants. Consequently, the Order’s impact on civil rights and its effectiveness as a tool against terrorism will be examined.

Government Sponsored Summary And Arbitrary Executions, Matthew Lippman
Florida Journal of International Law
This article sketches the contemporary practice of summary or arbitrary executions and reviews the findings of the Special Rapporteur. It is argued that such practices violate international law and that a convention prohibiting and punishing summary or arbitrary executions is required.
Legislative Procedures And Perceptions Of Legitimacy, Megan Elizabeth Cox
Legislative Procedures And Perceptions Of Legitimacy, Megan Elizabeth Cox
Dissertations and Theses
While mechanisms of legitimacy development have been extensively studied in governments as a cohesive whole, procedural legitimation of the legislative branch has not been explored. Using a procedural justice framework to identify indicators of openness in legislative rules, this paper theorizes that the presence or absence of these indicators will be the key factor in public perceptions of legitimacy of the legislature. This paper hypothesizes that where more indicators are present, a legislature will be viewed as more legitimate by its citizens as compared to a legislature with fewer indicators.

A Critical Discourse Analysis Of How Youth In Care Describe Social Support, Jared Israel Best
A Critical Discourse Analysis Of How Youth In Care Describe Social Support, Jared Israel Best
Dissertations and Theses
There are nearly 422,000 youth in foster care in the United States with 20,000 aging out each year. Youth who age out of care demonstrate worse outcomes in all areas (education, employment, homelessness, justice system involvement, and social support) compared to the general population. These outcomes represent an ideological production, or a production of knowledge regarding the discursive youth in care. Thus, dominant discourses of youth are informed and constitutive of these problematic outcomes. Similarly, youthhood is dominantly defined by risk and informed by peer groups and social relationships. This study presents findings from interviews with 22 youth preparing to …

DRS Biennial Conference Series
This project explores Indigenous-led arts and material practice workshops as a form of cultural safety education by fostering dialogue between non-Indigenous healthcare students and Indigenous students in the Lheidli T’enneh Territory (Prince George, Canada). Uniquely, this project is led by an art and design university, and combines Indigenous and designerly ways of knowing to consider an approach to cultural safety education that is not solely focused on the healthcare student or practitioner as the learner, but includes the community as key contributors to the learning experience. Core to the workshop model is the combination of sharing Indigenous histories and the …

Pragmatism, Design And Public Sector Innovation: Reflections On Action, Rodger Watson, Kees Dorst
DRS Biennial Conference Series
This reflective paper explores the intersection of Pragmatism, Design Research and Public Sector Innovation through the lens of a body of work undertaken at a public sector innovation, design research center between 2010-2018. This center drew explicitly on the work of Donald Schön and Charles Sanders Peirce in the development of its research methodology and practice. The paper includes an illustrative case study that demonstrates the application of Peirce’s model of Innovative Abduction, draws on recent interview data that demonstrates engagement with Deweyan Analysis of Reflective Thinking and reflects on the possibilities that may come from further engagement with the …

The Uniform Child Custody Jurisdiction Act And Its Effect On The International Kidnapping Of Children, Lori A. Balona
The Uniform Child Custody Jurisdiction Act And Its Effect On The International Kidnapping Of Children, Lori A. Balona
Florida Journal of International Law
When the late Brigitte M. Bodenheimer wrote her important work on the international kidnapping of children in 1977, only eight states had adopted the Uniform Child Custody Jurisdiction Act (UCCJA or Act). By adopting the UCCJA, these states were attempting to deter interstate and international abductions undertaken to obtain favorable custody awards. In 1977 UCCJA case law was sparse and Professor Bodenheimer could do little more than voice her concerns for today and her predictions for tomorrow. She stated that further study would indicate whether the early cases signified a trend toward growing judicial rationality on the international kidnapping scene. …

Disrupting The School To Prison Pipeline: Using Culturally Responsive Classroom Practices To Support Black Students, Latory Jacobs, Kelly Brown, Kathryn Washington, Johnny Oconnor, Meredith Lundin
School Leadership Review
The school to prison pipeline is a social phenomenon in which students become formally involved with the criminal justice system due to behavior issues being addressed with law enforcement consequences rather than school-imposed consequences (Owens, 2015). Culturally responsive practices can also support educators' understanding of the unique abilities and untapped assets in students of color while encouraging a more appropriate response to their behavior (Quigley, 2014). This qualitative study was conducted to determine if culturally responsive practices can disrupt the school to prison pipeline for Black students. The study included campuses across five school districts in southeast Texas. The purpose …

The emphasis is to examine the critical ideas which led to the study of natural law and civil society, focusing on freedom, equality, reason, and law. This review will provide social science students the foundational knowledge to understand the goals of human progress as expounded by classic liberal philosophers, as well as understanding reason as inextricable to democracy and the advancement of knowledge. Articles & Book Chapters
This article offers an empirical examination of policies on the publication of refugee law decisions in Canada’s Federal Court. In 2015, the Court issued a notice describing the Court’s general practice of publishing written reasons in cases that the deciding judge considers as having precedential value and of issuing unpublished judgments in cases that the deciding judge does not view as precedential. In 2018, the Court reversed course and issued a new notice. This time, the Court indicated that all final decisions on the merits will be published.

Review Of Cannabis Use Among Aboriginal And Torres Strait Islander People, Julia Butt, Mandy Wilson, Jocelyn Jones, Simon Lenton
Review Of Cannabis Use Among Aboriginal And Torres Strait Islander People, Julia Butt, Mandy Wilson, Jocelyn Jones, Simon Lenton
Journal of the Australian Indigenous HealthInfoNet
The health effects of cannabis use may not always be seen as a high priority for Aboriginal and Torres Strait Islander communities. However, the impact of cannabis use on physical and mental health can have significant consequences. It is known that the use of high potency cannabis has increased over the last two decades, with a corresponding increased risk to health. In particular, young people are at increased risk of experiencing harms to mental health. Physical harms to health include effects on the respiratory system, cardiovascular system, an increased risk of cancer, and in-utero effects from maternal use. The review …

The core question raised by this case is whether a federal prisoner serving an unconstitutional sentence can be foreclosed from post-conviction habeas relief by the gatekeeping provisions of § 2255. The Constitution answers that question in the negative through the Suspension Clause. “[F]reedom from unlawful restraint [i]s a fundamental precept of liberty,” and the writ of habeas corpus “a vital instrument to secure that freedom.” Boumediene, 553 U.S. at 739. The importance of the common law writ was such that the Framers specified that it could be suspended only in the most exigent circumstances. U.S. Const. art. I, § …

Publications and Research
The use of technology in policing seeks to improve the efficiency and effectiveness of the daily duties police officers may encounter. However, there is mixed empirical data on the use of technology and if it is really contributing to the institutional goals of the security sector, or, if it is contributing to other factors. This report provides an exploratory approach to understanding what information technology is being used in Mexico at the state level, in order to compare where broader application of information technology could make impactful contributions to the security situation in the country.

Responding To Pope Francis’ Call For A Global Compact On Education: Insights From Interviews By The Global Catholic Education Project, Quentin Wodon
Journal of Global Catholicism
In September 2019, Pope Francis suggested the need for a Global Compact on Education to renew our passion for a more open and inclusive education. He called for a broad alliance “to form mature individuals capable of overcoming division and antagonism, and to restore the fabric of relationships for the sake of a more fraternal humanity.” The Pope called for seven commitments: (1) to make human persons the center; (2) to listen to the voices of children and young people; (3) to advance the women; (4) to empower the family; (5) to welcome; (6) to find new ways of understanding …

A Dog's Bark To Act As A Nark, Bailey R. Geller
Arkansas Law Review
This Comment therefore advocates for systemic reconsideration of dog scent lineups at trial. It will not claim that all dog scent lineups are flawless, particularly given the slipshod manner in which many are performed. But dog scent identifications are increasingly more valuable than our legal system currently acknowledges when they are properly conducted. They should be admissible.

Vengeance Is Mine How Religious Southern White Supremacy Shaped The Prison Industrial Complex, Kristen Davis
Venture: The University of Mississippi Undergraduate Research Journal
White supremacy and the prison industrial complex have a long history of reinforcing one and other. Throughout this history Southern white religious groups have co-opted Christianity to inform their beliefs on crime and punishment. As a result, social, political, and economic efforts to maintain religious white supremacist ideals have bled into and shaped the criminal justice system. This research explores the evolution of these groups’ impact starting with American slavery and ending with the present day by assessing the strategic integration of Christianity, white supremacy, and the politics of crime. This chronological analysis reveals historical foundations as well as modern …

Burl Cain, Angola, And Parchman: The National Institution Of Slavery, Cameron Dougherty
Venture: The University of Mississippi Undergraduate Research Journal
Former warden of the Louisiana State Penitentiary and current commissioner of the Mississippi Department of Corrections Burl Cain’s career has drawn national attention for his supposed heraldry of penal reform. Having declared himself to be fulfilling a divinely mandated mission, Cain has frequently cited his criteria of a “good prison: good playing, good praying, good food and good medicine.”1 This article seeks to critically examine these criteria as they relate to Cain’s tenures in both Louisiana and Mississippi while answering the following question: what is the human impact of Burl Cain’s approach to wardency? Despite his focus on the provision …
