Educator Perceptions Of The Working Environment In Tennessee Elementary Schools That Actively Employ Positive Behavior Supports And Restorative Practices, Scott Thomas Lamie
Electronic Theses and Dissertations
This phenomenological study captured the experiences of elementary educators with the purpose of gathering their perceptions of the use of restorative practices and positive behavior supports in their schools with a particular focus on how these programs influenced school climate, their professional efficacy, and their job satisfaction. Results of interviews lead to the emergence of seven major themes, which were the importance of understanding the underlying causes of student behavior, change, common practices of positive behavior supports and restorative practices, benefits for students, benefits for educators, struggles with implementation, and suggestions for implementation. These findings led to the identification of …

Measuring Judicial Collegiality Through Dissent, Jonathan Remy Nash
Measuring Judicial Collegiality Through Dissent, Jonathan Remy Nash
Buffalo Law Review
While scholars frequently offer ideology as a primary explanation for judicial behavior, judges, and some scholars, emphasize the importance of collegiality on multimember courts. But there is disagreement over how to determine when collegiality is at work, and what type of multimember court is more likely to exhibit collegiality among its judges. Resolving these competing claims calls for a valid measure of collegiality.
This Article develops novel measures of collegiality based on dissenting judges’ expressions of collegiality towards judges in the majority. It uses judge-level and court-level databases to validate these measures by showing that the novel measures correlate with …
The White Supremacist Constitution, Ruth Colker
The White Supremacist Constitution, Ruth Colker
Utah Law Review
The United States Constitution is a document that, during every era, has helped further white supremacy. White supremacy constitutes a “political, economic and cultural system in which whites overwhelmingly control power and material resources, conscious and unconscious ideas of white superiority and entitlement are widespread, and relations of white dominance and non-white subordination are daily reenacted across a broad array of institutions and social settings.”1 Rather than understand the Constitution as a force for progressive structural change, we should understand it as a barrier to change.
From its inception, the Constitution enshrined slavery and the degradation of Black people by …
The Reimagination Of The School Safety Concept: A Phenomenological Narrative Study Of School Leaders’ Perceptions Of School Safety Pertaining To The Effects Of The Removal Of School Safety Personnel From Public Schools, Tyron Pope
Education Doctoral
This qualitative phenomenological narrative study examined the leadership experiences of 12 principals and assistant principals from a suburban New York school district. The study was based on school leaders' perceptions of the New York State Police Reform and Reinvention Collaborative Plan and the removal of school safety personnel. School leaders shared their perspectives in semi-structured interviews. All interviews were transcribed, coded, and reviewed. The study sought to optimize participant information and find new views on school safety personnel.
For this study, physical safety, school climate, and student conduct were identified as criteria as modeled in the theoretical approach of the …

Not Only Black Or Only A Woman, A Black Woman: Gendered Racial Microaggressions, Colorism And Hair On Trauma Symptoms., Maame-Safowaa Geary
Electronic Theses and Dissertations
The intersectionality of racism and sexism of Black women has the possibility of leading to mental health symptoms due to the consistent and persistent experience of insidious trauma, specifically gendered racial microaggressions (GRM). In this study, we examined the relations between gendered racial microaggressions (GRM) and trauma/PTSD symptoms, depressive symptoms, and anxiety symptoms among Black women. Additionally, skin tone and hair style/texture were explored as moderating variables. We hypothesized a positive relation between GRM and symptoms of trauma/PTSD, depression, and anxiety. We also hypothesized that darker skin tones and more Afrocentric hairstyles would moderate GRM and the described mental health …
Limiting The Use Of The Categorical Approach And Setting A Statute Of Limitations For Deportation, Viridiana Ordonez
Limiting The Use Of The Categorical Approach And Setting A Statute Of Limitations For Deportation, Viridiana Ordonez
UC Law Journal
The United States relies, in part, on certain criminal convictions to determine which noncitizens are deportable. The specific types of criminal convictions subjecting an individual to deportation proceedings are found in the Immigration and Nationality Act (INA). However, the INA only lists categories and types of crimes that trigger deportation. It is the courts’ responsibility to compare the state criminal statute grounding the conviction with the list provided under the INA. This process is done using the “categorical approach,” which allows courts to make a comparison and determine if a state criminal conviction matches a crime listed in the INA, …

Together Or Apart? The Effects A Parent's Relationship Dynamic Has On Their Child(Ren)'S Romantic Relationship, Kailee Delos Santos
Together Or Apart? The Effects A Parent's Relationship Dynamic Has On Their Child(Ren)'S Romantic Relationship, Kailee Delos Santos
University Honors Theses
The relationship between parents is considered one of the most influential interactions a child will experience; as it is usually the first relationship a child witnesses where personal values and interests develop (Stanger, 2019). Nonetheless, it is a consistently understudied population in family research and, when studied, children are primarily examined during adolescence and often only in the context of conflict and rivalry. Additionally, much of this research does not examine the effects of a child's romantic relationship on the larger family system. This thesis seeks to address this gap in the literature by understanding how the relationship of a …

Prevalence And Predictors Of Polypharmacy In Adolescents Who Have Engaged In Sexually Abusive Behaviors, Rebecca Gilley
Electronic Theses and Dissertations
Polypharmacy, or the concurrent use of multiple medications, is associated with detrimental outcomes for patients and has gathered increasing attention within the scientific clinical literature. Pediatric populations warrant special consideration for the practice of polypharmacy, as medication effects are more pronounced in youth and adverse effects may have a lasting impact on development. This dissertation study examined psychotropic prescribing practices in a sample of adolescents who have engaged in sexually abusive behaviors, a subset of justice-involved youth who are at risk for polypharmacy. General prescribing trends were examined, and a principle components analysis involving variables associated with risk of polypharmacy …

Repeating Patterns: Does Emotional Child Abuse Lead To Intimate Partner Abuse?, Kathryn R. Henry
UNLV Theses, Dissertations, Professional Papers, and Capstones
Childhood abuse and intimate partner abuse (IPA) are serious issues in the United States This study examines the correlation between emotional childhood abuse and IPA. Anyone regardless of gender, race, or socioeconomic status may be a victim of childhood abuse or IPA. One in seven children are victims of childhood abuse, which results in a lifetime cost of $428 billion. The costs of IPA are even higher and estimated by the CDC (2020) to be near $3.6 trillion as 25% of women and 20% of men have been victims of IPA. Previous research has found a connection between childhood maltreatment …

Cultural, Contextual, And Individual Determinants Of Mental Health Service Utilization Among Latinx Emerging Adults, Kenia Carrera Diaz
All Graduate Theses and Dissertations, Spring 1920 to Summer 2023
Despite being at an increased risk of experiencing mental health problems, Latinx emerging adults underutilize professional psychological services compared to other ethnic/racial groups. It is important for researchers to understand this mental health disparity to improve Latinx emerging adults’ use of quality mental health services (MHS). The current project investigated factors that might influence Latinx emerging adult’s use of MHS through two separate studies. In the first study, I systematically reviewed research published in the past decade that examined predictors of MHS use among Latinx emerging adults. A total of 9 studies were found and included in this review. This …

Crime Scene Behaviors Of Sexual Murderers With And Without A Criminal History Of Sexual Assault, Tirza Z. Ben Ari
Crime Scene Behaviors Of Sexual Murderers With And Without A Criminal History Of Sexual Assault, Tirza Z. Ben Ari
Student Theses
This exploratory study is intended to serve as a gateway to future research about the differences between sexual murderers with (HSAO) and without (N-HSAO) a recorded criminal history of sexual assault, on which there is little to no comparative literature. This study aims to extend our understanding of these groups by comparing their crime scene (and crime-related) behaviors and exploring their underlying psychological functioning. The results suggest that N-HSAO have a significantly higher tendency to murder friends or strangers, initially attack or abduct their victims from the victim’s residence, use more than one killing method in the murder, attack their …

A Tale Of Two Gentrifications: Reconceptualizing Gentrification Using Third Places, Demolition And Hierarchical Linear Modeling, Kylil R. Martin
Sociology & Criminal Justice Theses & Dissertations
A growing body of research points out that communities in the most need of assistance are often the ones established by racially biased processes and have not been invested in for generations – with little to no attention ever positively directed toward these spaces. Instead, because of policies and tactics used to label areas as problematic and divest from them, public actors are reluctant to consider the lived-lives, both good and bad, of the residents of these communities when discussing needed changes. Criminologists have long been interested in neighborhood change and its relationship with crime. There has also been theoretical …

Alternative Education Programs: An Exploration Of Programs And Supports To Reduce Juvenile Recidivism Among At-Risk Youth, Sarah Elizabeth Vanrensselaer
Dissertations
An exploration of alternative education programs and their relationship to juvenile recidivism was the focus of this narrative analysis. A constructivist epistemology and an interpretivist paradigm formed the conceptual framework, both of which aligned with the theoretical framework of Zimmerman’s (2008) self-regulated learning theory. The research questions focused on how alternative education programs impacted juvenile recidivism with a focus on 10 alternative education participants in Southeast, Wyoming, who have participated in the juvenile justice system. The use of multiple cases, coding, and collaboration between the researcher and the participants were used to ensure trustworthiness of this research. Results indicated the …

Formal And Informal Labeling Of Adolescents: The Consequences Of Cumulative Disadvantage On Deviance During Emerging Adulthood, Chijioke Onyekonwu
Electronic Theses, Projects, and Dissertations
Despite the recent developments in labeling theory, there are still a lot of gaps in research on this theory. To begin with, studies continue to attach too much attention to the effects of formal labeling to the neglect of informal labeling. Secondly, prior research has not paid full attention to a variety of mediating factors involved in the relationship between informal labeling, formal labeling and delinquency.
This study seeks to address these limitations by investigating the overall effects that formal and informal labeling has on young people while considering the differential impact of mediating variables. The data for the study …

Court Actor Decision-Making: The Influence Of Victim Characteristics On Legal Outcomes In Cases Of Bias Homicide, Taylor June
Graduate Theses and Dissertations
While most states in America have passed laws permitting harsher punishments for those convicted of hate (or bias) crimes, there has been no research to date on the adjudication of these defendants, including how legal and extralegal attributes of bias crime shape prosecutorial and judicial decision-making. This gap in research is likely due in part to the limitations of official data on bias crimes. Fortunately, new data on legal outcomes for bias homicide offenders who target victims because of their race, ethnicity, nationality, religion, sexual orientation, gender identity or homed status have become available from the open-source database known as …
