Coercive Control And Trauma-Coerced Attachment In Commercial Sexual Exploitation: A Mixed-Method Examination, Kendra Doychak
Coercive Control And Trauma-Coerced Attachment In Commercial Sexual Exploitation: A Mixed-Method Examination, Kendra Doychak
Dissertations, Theses, and Capstone Projects
Commercial sexual exploitation (i.e., sex trafficking) can lead to myriad negative consequences for its victims, including exposure to coercive control and the development of trauma-coerced attachments. Scholars have offered theoretical conceptualizations of the relation between coercive environments and traumatic attachments, but this relationship is rarely empirically examined. The current study used data from 68 semi-structured interviews with former victims of sex trafficking to first, formally identify coercive control and second, empirically classify trauma-coerced attachment in this population. Mixed-method analysis were used to identify associations between coercive control and TCA in order to better explain how this abuse dynamic leads to …
International Drug Law And The Sustainable Development Goals: A Sober Assessment Of Compatability, Aidan Peter O'Callaghan
International Drug Law And The Sustainable Development Goals: A Sober Assessment Of Compatability, Aidan Peter O'Callaghan
Denver Journal of International Law & Policy
The regulation of drugs under international law is underpinned by a framework largely unchanged since the 1961 Single Convention on Narcotic Drugs. Sixty years later, this framework continues to inform and restrain domestic drug laws, requiring countries to criminally sanction the possession and trade in specified substances, including those which may otherwise be considered mild or commercially useful. Comparing this framework with the United Nations' "Agenda 2030" Sustainable Development Goals reveals that the international community's ambitions, at least insofar as health, economics, and justice are concerned, are undermined by the Single Convention framework. This is because the prohibitionist approach which …

Beyond The Classroom: The Broader Effects Of Public Preschool Expansion On Children’S Early Educational Experiences And Early Literacy Skills, Michah Rothbart, Taryn Morrissey
Center for Policy Research
While previous research documents direct benefits of preschool for those who attend, less is known about how targeted expansions of public preschool to low-income households affects children’s early educational experiences, preschool attendance patterns, and school readiness in a broader community. This study uses administrative data from Virginia of first-time kindergarteners from 2011 to 2019 (about 630,000 students) and a discrete increase in targeted public pre-K (VPI+) to better understand the effects of expanding means-tested public preschool on patterns of prekindergarten participation and school readiness throughout the community. We find decreased probability that children in expansion districts spend no time in …

#Includetheirstories: Rethinking, Reimagining, And Reshaping Legal Education, Leslie P. Culver, Elizabeth A. Kronk Warner
Utah Law Review
This symposium gathered scholars and practitioners who have been deeply engaged in the work to examine historical roots of the legal profession and discuss best practices for exploring ethnic, gender, and related inequities alongside our law students. It is well established that the legal profession and legal education neither reflect the community they serve nor swiftly respond to the social shifts within the broader society.3 As 2020 grossly revealed, ethnic partiality and division are aches we have yet to really confront and bear. For example, the casebook method format of legal education continues to model Christopher Langdell’s Gilded Age curriculum, …

A Brown Buffalo’S Observations On Color (Blindness), Legal History, And Racial Justice In The Rocky Mountain West, Tom I. Romero Ii
Utah Law Review
This Essay is a series of observations about interrogating and complicating the meaning of color for all of us who call the Rocky Mountain West home. These observations are divided into three sections. First, in Part II, I explore what has long been the defining feature of race relations in the Rocky Mountain West—the persistent tension between the region as a racial utopia free from de jure racial inequities and the legacy of state-sanctioned racial violence and deep-rooted nurturing of White supremacy. Trekking through some of the legalscapes of property, state constitutional, civil rights, and martial law, this section spotlights …
Filing While Black: The Casual Racism Of The Tax Law, Steven A. Dean
Filing While Black: The Casual Racism Of The Tax Law, Steven A. Dean
Utah Law Review
The tax law’s race-blind approach produces bad tax policy. This essay uses three very different examples to show how failing to openly and honestly address race generates bias, and how devasting the results can be. Ignoring race does not solve problems; it creates them. ProPublica has shown, for example, that because of the perils of filing income taxes while Black, the five most heavily audited counties in the United States are Black and poor.
The racial bias long tolerated—and sometimes exploited—by tax scholars and policymakers affects all aspects of the tax law. In 1986, Sam Gilliam was denied tax deductions …
Teaching Cultural Competence In Law School Curricula: An Essential Step To Facilitate Diversity, Equity, & Inclusion In The Legal Profession, Phyllis Taite, Nicola "Nicky" Boothe
Teaching Cultural Competence In Law School Curricula: An Essential Step To Facilitate Diversity, Equity, & Inclusion In The Legal Profession, Phyllis Taite, Nicola "Nicky" Boothe
Utah Law Review
Law schools must recognize and seek to remove the barriers to teaching cultural competence and DEI and provide appropriate training and workshops for law professors. Providing law professors with the tools to integrate cultural competency into existing curricula is a first and crucial step to ensure that law professors are well-versed in both their own cultural competency, and in the ability to provide cultural competency training to their students. The culturally competent student will become a culturally competent lawyer with the skillset to make impactful contributions towards DEI in and beyond the practice of law.
Pivoting Under Pressure: Cultural Proficiency, Race, And Reforms, Anastasia M. Boles
Pivoting Under Pressure: Cultural Proficiency, Race, And Reforms, Anastasia M. Boles
Utah Law Review
There is a new conversation in legal education about a pernicious problem. As the COVID-19 pandemic raged in spring 2020, legal educators around the country had to pivot to remote teaching. At the same time, racial protests erupted in response to the brutal and successive killings of Ahmaud Arbery, Breonna Taylor, and George Floyd. As law schools grappled with the pressure of the latest racial reckoning, Black law faculty and students demanded cultural change within legal education in response to their devastation, desperation, battle fatigue, and frustration. Unwilling to accept the performative diversity efforts of the past, there was a …
Shelter Staff Perceptions Of Physicians Seeking Services For Intimate Partner Violence, Gabriela Bagnara
Shelter Staff Perceptions Of Physicians Seeking Services For Intimate Partner Violence, Gabriela Bagnara
Loma Linda University Electronic Theses, Dissertations & Projects
Research indicates there are a significant number of instances of intimate partner violence (IPV) in the United States, with current prevalence rates impacted by a substantial amount of underreporting due to stigma, difficulty disclosing, and complex love and fear of abusive partners (Breiding et al., 2014; Ellsberg & Heise, 2005; Overstreet & Quinn, 2013). A large body of IPV research exists more generally, but there is little understanding about the help-seeking behaviors of high socioeconomic status (SES) individuals within IPV shelter systems. While several studies have demonstrated the equal impact of abuse across demographic contexts (Satyen, Rogic, and Supol, 2018; …

From Perfect Victims To Collateral Damage: How Nigerian Women Are Implicated In And Impacted By Contemporary French Anti-Trafficking Policies And Discourse, Oladunni Patricia Oduyemi
Dissertations, Theses, and Capstone Projects
Although the Nordic Model has been embraced by the international anti-trafficking movement, recent studies, and closer examinations of France’s approach to the issue of sex trafficking reveal a strong anti-migrant and anti-sex work bias. In this thesis, I use studies of the impacts of France’s 2016 anti-trafficking bill on migrant sex workers, feminist critiques of neo-abolitionism and the Nordic Model, and examples of France’s hypocritical anti-migrant position, to explore how Nigerian women are harmed by the contemporary French fight against sex trafficking. The pervasive influence of anti-sex work radical feminism on anti-trafficking protocols which define the sex industry as analogous …

Aging On Parole: An Empirical Analysis Of Reentry, Reintegration, And Life Satisfaction, Angela Silletti Murolo
Dissertations, Theses, and Capstone Projects
As the prison population grays, so too does the people leaving prison. In New Jersey and New York, 35% and 26% of people on parole are over the age of 50 respectively. While older persons have lower recidivism rates compared to younger persons, there are physical, mental, and societal challenges that come with advancing age that can make reentry and reintegration a particularly difficult experience compared to younger persons. The aim of this dissertation is to explore the experiences of older adults on parole and the parole officers that assist them in their reentry and reintegration.
This study is unique …

In The Name Of “Justice”: Shiffra-Green Motions And Their Unintended Harms, Katharine A. Adler
Marquette Law Review
Sexual assault victims face many barriers to reporting the violence they have experienced. As few as one-third of sexual assaults are reported to the police and even fewer result in criminal charges. The criminal justice system can be grueling for sexual assault victims and carries with it the possibility of testifying at trial in front of their perpetrators, an experience that is daunting at best and terrifying at worst. Because of how few cases make it into the court system, along with how difficult the process can be for victims, any legal mechanisms that would create an unnecessary barrier to …

Shifting The Blame: Systemic Issue, Individual Responsibility, Rachel Thomson
Social Justice and Community Engagement Major Research Papers
Sexual violence continues to be a pervasive issue on university campuses. The introduction of Ontario’s Bill 132, which mandates that all Ontario universities maintain a policy on addressing sexual violence involving students, indicates an awareness of the need to confront this issue. However, the existing literature demonstrates a need to understand how universities are engaging in addressing sexual violence by identifying whether the policies address the systemic factors that legitimate sexual violence societally and how universities incorporate sexual violence prevention strategies into their policies. This paper employed Foucauldian-informed critical discourse analysis using an intersectional feminist and anti-colonial framework to analyze …

Impact Of Immigration Parent-Child Separation Policies On Children’S Attachment Experiences, Daisy Casasnovas
Impact Of Immigration Parent-Child Separation Policies On Children’S Attachment Experiences, Daisy Casasnovas
Dissertations
This critical literature review (CRP) project explores the consequences of child-parent separation by deportation laws. Considering the number of Latinx immigrant families immigrating to the United States, this review focused on how the unexpected separation by deportation impacted immigrant families and how these separations affect their children’s development, attachment style, and overall well-being. The review explored the short- and long-term consequences for immigrant children and their families, including children who are U.S.-born and remain in the country without their parents. Results from the review indicate an extensive and significant impact on attachment style and overall developmental impairments. The unexpected separation …

School of Social Work Faculty Publications and Presentations
Purpose: This scoping review aims to identify the evidence-based literature supporting Moral Reconation Therapy (MRT), a cognitive-behavioral treatment program created in 1987 and implemented in correctional-treatment settings across the US. Social work students and practitioners are among MRT’s facilitators.
Method: We analyze the reliability and validity of the most recent meta-analysis of MRT, covering studies published between 1988 and 2010. We then identify 669 potential publications on MRT published between 2011 and 2021.
Results: Our search across Google Scholar and eleven academic databases yielded zero peer-reviewed studies on MRT’s effectiveness or outcomes.
Prosecutorial Nonenforcement And Residual Criminalization, Justin Murray
Prosecutorial Nonenforcement And Residual Criminalization, Justin Murray
Articles & Chapters
In recent years a small but influential group of locally elected prosecutors committed to criminal justice reform have openly refused to enforce various criminal laws—laws prohibiting marijuana possession, sentence enhancements, laws authorizing the death penalty, and much more—because they see those laws as unjust and incompatible with core reform objectives. Condemned by many on the political right for allegedly usurping the legislature’s lawmaking role and praised by many on the left for bypassing dysfunctional state legislatures in favor of local solutions, these prosecutorial nonenforcement policies are commonly said to have the same effect as nullifying, or even repealing, the laws …

Department of Political Science: Faculty Publications
Trust is a key part of any political system. Given the very different experiences of Black people and White people in the United States, it is likely that the nature and contours of political trust varies widely from one racial group to the other. In this article, we take advantage of a specially commissioned 2018 survey to compare Black and White trust in American legislative institutions (Congress and the state legislatures). Thanks to an oversample, we also are able to zero in on variations across Black respondents, making it possible to identify the variables that push legislative trust up or …

A Method To Develop A Statewide Resource Guide, Needs Assessment, And Service Inventory To Respond To Human Trafficking, Andrea Nichols, Kathleen Preble
Dignity: A Journal of Analysis of Exploitation and Violence
The extant research literature indicates that human trafficking survivors have a myriad of service needs, including acute and long-term needs. A statewide resource guide, needs assessment, and service inventory were developed for Missouri through community action research involving a partnership with an anti-trafficking coalition, a consortium of funders, and a series of small research teams. This article details the evolution of a resource guide and describes the methods used to 1) develop a statewide resource guide for human trafficking survivors and the service providers who work with them, 2) evaluate the resource guide, 3) create a statewide/regional service inventory based …

The entire world was shaken by the events of 2020—a year that the historians will pen with infamy. Along with a global health pandemic that tested both human frailties and social infrastructures, the world witnessed the devastation of George Floyd, an African American man, dying under the knee of Derek Chauvin, a White male police officer. The nation erupted. As 2020 ended, many organizations and institutions clamored both to process ethnic divides and injustices, and to gain tools and skills to create meaningful change and lasting impact. Legal education was one such institution. During the summer and fall of 2020, …

Mitigating The Harm Of Public Mass Shooting Incidents Through Situational Crime Prevention, Emily Greene-Colozzi
Dissertations, Theses, and Capstone Projects
This dissertation used environmental theoretical frameworks to understand how public mass shooting incidents are impacted by aspects of the crime situation and opportunity. Predatory, public shootings perpetrated by individuals with evidence of mass intent were examined in the United States between 1966 and 2019. This project progressed in several distinct steps with discrete aims: (1) establish an open source database of public mass shooting incidents meeting definitional criteria; (2) perform statistical analysis, including latent class analysis, regression modeling, and structural equational modeling to assess research questions; and (3) perform comparative case studies and crime script analysis to assess situational crime …
