Does Brady Apply To Supervised Release Revocation Hearings?, Alex Breindel
Does Brady Apply To Supervised Release Revocation Hearings?, Alex Breindel
Fordham Law Review
Many federal offenders face a term of supervised release upon leaving prison. The successor to the federal parole system, supervised release places conditions upon individuals’ freedom. Violation of a condition may result in revocation of release and reimprisonment. To revoke release, the government must prove to a judge by a preponderance of the evidence that a violation occurred. At this proceeding, known as a “revocation hearing,” the individual may contest the alleged violation and present their own evidence.
Under Brady v. Maryland and its progeny, due process requires the government to disclose material exculpatory evidence to criminal defendants. This Note …

“The Hierarchy Is Your Constraint:” A Qualitative Investigation Of Social Workers’ Moral Distress Across A U.S. Health System, Sophia Fantus, Rebecca Cole, Lataya Hawkins
School of Social Work Faculty Publications
This paper reports findings from a qualitative study on the triggers of hospital social workers’ moral distress at a large southern U.S. health system. Moral distress occurs when ethical conflict cannot be resolved in a way that aligns with an individual’s personal and professional values and ethics. Participants indicated that moral distress derives from both individual interactions and the culture and climate of health systems. For example, participants expressed how sources of moral distress derived from client-centered decisions, such as end-of-life care and patient autonomy; interpersonal dynamics, including team or supervisory conflict; structural issues, such as insurance barriers or internal …
Examining Associations Between Servant Leadership, Job Burnout, And Job Satisfaction In The Iowa Probation And Parole Job Profession, Alfredo Rodriguez Ordaz
Examining Associations Between Servant Leadership, Job Burnout, And Job Satisfaction In The Iowa Probation And Parole Job Profession, Alfredo Rodriguez Ordaz
Doctoral Dissertations and Projects
The following research paper investigated the associations between servant leadership, job burnout, and job satisfaction in the Iowa probation and parole profession. There is extensive literature examining job burnout and job satisfaction in many disciplines, including the field of corrections. Leadership literature examining the servant leadership model remains limited. The leadership literature suggests that probation and parole agencies operate through a traditional paramilitary command and control hierarchy of strict adherence to rules, policies, and procedures. The importance and significance of this study are that it examined the extent to which probation and parole leaders practiced and engaged in servant leadership …

A Race Of Headsmen: The Life And Mind Of A Dynasty Of French Executioners, 1688-1847, Trevor Scott Rhodes
History Theses, Dissertations, and Student Creative Activity
This thesis examines the memoirs, letters, public records, and legal records of the Sanson dynasty of executioners to understand the patterns of thought and behavior of the early modern headsman. While recent historians have acknowledged the social and political pressures of the profession, few have attempted to catalog the words and actions of the executioners themselves. The Sanson family is unique in their longevity and historical role in the French Revolution. Furthermore, their memoirs provide in their own words a direct understanding of their state of mind. With recent scholarship dedicated to the analysis of the “Age of Spectacular Punishment,” …
Incarcerated Mothers And Their Children's Caregivers: How Their Relationship Impacts The Mother-Child Relationship, Jodi Simmons Ford
Incarcerated Mothers And Their Children's Caregivers: How Their Relationship Impacts The Mother-Child Relationship, Jodi Simmons Ford
Doctoral Dissertations and Projects
Mass incarceration has impacted much of the population in the United States over the last several decades. One of the most significantly impacted groups is women. Over half of incarcerated women are mothers. Mothers are typically the primary caregiver of their children at the time of their incarceration, and most want to maintain a relationship and have contact with their children throughout their incarceration. However, the children’s caregiver controls their relationship and contact with their incarcerated mother. The primary purpose of this research was to examine how the incarcerated mother’s relationship with her children’s caregiver impacts her relationship with her …

Green Crimes In The Empire State: Analyzing The Criminal Enforcement Of Environmental Law In New York, Joshua Ozymy, Melissa Jarrell Ozymy
Pace Environmental Law Review
Ensuring compliance with federal and state environmental laws and deterring future offenses can require the application of criminal enforcement tools. Yet we have a limited understanding of how the criminal enforcement of environmental laws has progressed historically in The Empire State. To explore this phenomenon, we undertake content analysis of federal prosecution summaries for all environmental crime prosecutions stemming from U.S. Environmental Protection Agency criminal investigations from 1983 to 2019. We explore which federal environmental laws were violated, determine which charging statutes were used, analyze sentencing patterns, and illustrate the broader themes that emerge in such prosecutions over 37 years. …
Decarceration's Inside Partners, Seema Tahir Saifee
Decarceration's Inside Partners, Seema Tahir Saifee
Fordham Law Review
This Article examines a hidden phenomenon in criminal punishment. People in prison, during their incarceration, have made important—and sometimes extraordinary—strides toward reducing prison populations. In fact, stakeholders in many corners, from policy makers to researchers to abolitionists, have harnessed legal and conceptual strategies generated inside the walls to pursue decarceral strategies outside the walls. Despite this outside use of inside moves, legal scholarship has directed little attention to theorizing the potential of looking to people on the inside as partners in the long-term project of meaningfully reducing prison populations, or “decarceration.”
Building on the change-making agency and revolutionary ideation inside …

Education Design Lab, through professional input and focus groups, developed eight badges that address the instruction of “soft skills” to postsecondary students. With the emergence of alternative credentialing and badging, Education Design Lab wanted to contribute to the evidence of student confidence differences as attributed to completing the badge content as expressed on their resume, interview, and through application or example. Postsecondary institutions were engaged in this evaluation across the nation and allowed for three differing viewpoints on badge importance and expression – student, instruction, and employer.

Students, Threat, Race, And Police: An Empirical Study, Jason P. Nance, Michael Heise
Students, Threat, Race, And Police: An Empirical Study, Jason P. Nance, Michael Heise
Florida State University Law Review
The presence of law enforcement officers in schools is more pronounced today than ever before, altering the educational experiences of students nationwide. Although the benefits of having police in schools are unclear, the legal and policy implications flowing into students' lives are more established. Empirical studies repeatedly have documented a strong connection between regular police contact with schools and the increased rate at which school officials report students to law enforcement for committing various offenses, including lower-level offenses that arguably could be handled internally. This Article provides the first in-depth empirical study of data spanning a decade that identifies characteristics …
Affirmatively Resisting, Ezra Rosser
Affirmatively Resisting, Ezra Rosser
Florida State University Law Review
This Article argues that administrative processes, in particular rulemaking's notice-and-comment requirement, enable local institutions to fight back against federal deregulatory efforts. Federalism all the way down means that state and local officials can dissent from within when challenging federal action. Drawing upon the ways in which localities, states, public housing authorities, and fair housing nonprofits resisted the Trump Administration's efforts to roll back federal fair housing enforcement, this Article shows how uncooperative federalism works in practice. Despite the fact that the 1968 Fair Housing Act requires that the federal government affirmatively further fair housing (AFFH), the requirement was largely ignored …

Citational Practices As A Site Of Resistance And Radical Pedagogy: Positioning The Multiply Marginalized And Underrepresented (Mmu) Scholar Database As An Infrastructural Intervention, Cana Uluak Itchuaqiyaq, Jordan Frith
Publications
Discursive infrastructures are forms of writing that remain mostly invisible but shape higher-level practices built upon their base. This article argues that citational practices are a form of discursive infrastructure that are bases that shape our work. Most importantly, we argue that the infrastructural base built through citation practices is in a moment of breakdown as increasing amounts of people call for more just citational practices that surface multiply marginalized and underrepresented (MMU) scholar voices. Consequently, this article both theorizes citations as infrastructure while also focusing on a case study of the MMU scholar database to help build a more …
