Damn The Torpedoes! An Unprincipled, Incorrect, And Lonely Approach To Compassionate Release, Christopher J. Merken, Barnett J. Harris

When Congress passed the First Step Act in 2018, it extended to federal prisoners the right to file their own motions for compassionate release under 18 U.S.C. § 3582(c)(1)(A). As COVID-19 ravaged prisons, sentencing courts received a massive influx of prisoner-filed compassionate-release motions. But because the United States Sentencing Guidelines and the relevant Application Note predated the First Step Act, and therefore made no mention of prisoner-filed compassionate-release motions, sentencing courts were unsure whether they had discretion to determine whether a prisoner presented “extraordinary and compelling circumstances” warranting compassionate release.

This Article documents the United States’ century-long efforts to humanize our borders. In the end, law has been insufficient to tame immigration law’s enforcement. How the United States enforces borders, however, can and should be more humane. Two important principles should guide this process. First, the United States should recognize that borders’ impacts are as severe as other forms of punishment, especially when the means to enforce the immigration power have become indistinguishable from criminal enforcement. Acid Attacks: An Overview Of Legal Measures And Motivation Trends In India, Pakistan, Bangladesh, Colombia, And Cambodia, Gaia Calcini

Dignity: A Journal of Analysis of Exploitation and Violence

Vitriolage is a form of widespread violence around the world. This research analyzed legislative measures against the practice adopted by India, Bangladesh, Pakistan, Colombia, and Cambodia. The strengths and weaknesses of the different legal systems were examined. Motivational trends on why the violence was committed were reviewed in the literature in these countries. It was found that acid attacks are a form of gender-based violence. Countries where the measures were adopted to prevent attacks but failed to achieve the goal did not consider the attacks as a part of a broader problem. The purpose of this qualitative case study was to examine middle school teachers’ perceptions of the influence that restorative practices have on the middle school classroom environment. For the purpose of this study, seven middle school teachers were selected who have implemented restorative practices in their middle school classrooms to provide feedback. Findings suggest that overall restorative practices have a positive influence on the classroom. The findings from this study can be used with teachers, administrators, counselors, parents, and school and district support staff to help create a positive campus culture between students and adults in middle school classrooms. In 1971, President Nixon vetoed legislation that would have created federal funding for the education of kids under age five. With the veto, President Nixon reaffirmed that, except for poor children, the education and care of the children is the responsibility of the family, not the government. Yet over 31 years later, 41 states and the District of Columbia provide state-funded preschool (Waxman, 2021). Preschool in the state of Michigan is not automatically provided as K-12 education is. This project fills a gap in the literature of law enforcement response to a visible tattoo on a racialized female arrestee. With the increase in popularity of tattoos and their inherited status as a proxy for deviance, the entanglement of both racialized female bodies and symbols of deviance at the place of entry into the criminal justice system is significant. The racialized female body does not move without carrying the history of violence and inequality on it. A Preliminary Exploration On The Views Of Terrorism Among Indian And U.S. College Students, Eric G. Lambert, Shanhe Jiang, N. Prabha Unnithan, Sudershan Pasupuleti

No corner of the world is completely safe from terrorist attacks. Both India and the United States have suffered horrific acts of terrorist-inspired violence. While views of terrorism vary for different reasons, culture certainly plays a role. A total of 918 undergraduate college students, composed of 434 Indian students and 484 U.S. students, were surveyed on their views of terrorism, responses to terrorism, and appropriate punishment of terrorists. Ordered ordinal regression results indicated a significant difference on 20 of the 26 items by nationality. Indian participants were more likely to express strong views on the problem of terrorism for society …

The history of linguistics is meager and splintered due to the subject’s interdisciplinary nature. In the postwar era, the discipline attempted to revive as a scientific one, spearheaded by Noam Chomsky and his theory of generative grammar. Linguistics consequently broke away from the predominant structuralist approach of the nineteenth century, returning to rationalist roots. But with the rise of computer technology, Chomsky’s critiques of empirical, applicational linguistic approaches have lost their force. The incarceration rates of Black women in America surpass even all other demographics. Yet, Black women are often not on the news when discussing prison rates in the United States. Rather we see Black men, Hispanic men, and so forth. While these people do make up large portions of the prison system they are seeing a decline in their incarceration rates. Black women are often pushed to the sidelines when discussing matters that can be seen as central to their livelihoods.

Exploring Perceptions Of Control Within Offender Cognition And Recidivism Paradigms, Anistasha H. Lightning, Danielle Polage

Elements of perceived control are associated with recidivism in offender populations. We investigated the application of locus of control to the frequency of personal involvement with the law and to beliefs surrounding the likelihood of future contact with the legal system. We hypothesized that, as the number of sentencings or legal experiences increased, locus of control would externalize. We also predicted that increased legal involvement would lead to greater belief in the likelihood of future involvement. A statistically significant path model suggests that locus of control appears to be a predictor of increased criminality, as opposed to the other way …

Purpose: Prior literature illustrates that sexual minority people (e.g., bisexual, gay, queer) are at increased vulnerability for sexual violence victimization compared to heterosexual peers, including while in college. However, the study of sexual violence perpetration in sexual minority populations, much less specifically sexual minority college men, has been neglected. This article reviews the literature and presents a secondary data analysis of a systematic review on college men’s sexual perpetration rates and associated methodology. We also conducted analyses to summarize available literature regarding publishing dates, authors, and data inclusivity. The Justice in Policing Act of 2020 propose mandatory body cameras for all uniformed federal officers in the United State. Advocates of this policy insist the practice will enhance police accountability and has the potential to also reduce police misconduct. Artificial intelligence and machine learning are both a blessing and a curse for governance. In theory, algorithmic governance makes government more efficient, more accurate, and more fair. But the emergence of automation in governance also rests on public-private collaborations that expand both public and private power, aggravate transparency and accountability gaps, and create significant obstacles for those seeking algorithmic justice. In response, a nascent body of law proposes technocratic policy changes to foster algorithmic accountability, ethics, and transparency.

This Article examines an alternative vision of algorithmic governance, one advanced primarily by social and labor movements instead of technocrats and firms. …

Black Americans At A Crossroads In American Politics: Electoral Participation, Protest, And Policy Change, Tenille-Rose Martin

This dissertation explores Black political participation in the United States. I argue there is a relationship between Black political participation and trust in government, political efficacy, group consciousness, linked fate, political knowledge, and desire to engage in social activism. This argument draws on research on political participation, group identity, and political behavior and attitudes within the Black community.

A mixed-method approach was used in the study. Data was collected from Blacks across the country via an original survey and interviews. The data analysis chapter determined some support for the theoretical framework, albeit aspects of the model were rejected. Results determined …
