Holding Government Officials Accountable By Applying The State-Created Danger Doctrine To Cases Of Suicide, Zoe Levine Jan 2023

Holding Government Officials Accountable By Applying The State-Created Danger Doctrine To Cases Of Suicide, Zoe Levine

Journal of Criminal Law and Criminology

Section 1983 of the Civil Rights Act provides a means for plaintiffs whose civil rights have been violated by government officials to sue for monetary compensation. However, the doctrine of qualified immunity hampers a plaintiff’s chances of success by blocking cases from going to trial and preventing government entities from paying monetary judgments on “insubstantial cases.” State-created danger doctrine is a judicially created exception that can overcome qualified immunity when a government official has caused or contributed to a danger that resulted in harm to that individual. The purpose of this doctrine is to hold officials accountable who were more …

Laid To Rust: Proposing Strict Liability In Tort For Prop Firearm Injuries Following The Alec Baldwin Shooting, Mark Edward Blankenship Jr., Joseph A. Ott Jan 2023

Laid To Rust: Proposing Strict Liability In Tort For Prop Firearm Injuries Following The Alec Baldwin Shooting, Mark Edward Blankenship Jr., Joseph A. Ott

Nevada Law Journal Forum

Prop gun safety standards are often a mixed bag. “Despite some industry reforms following previous tragedies, the federal workplace safety agency in the U.S. is silent on the issue of on-set gun safety.” Some states follow film labor union and movie studio guidelines. Other states have regulations on pyrotechnic devices, but not on prop guns. Thus, states should consider what successful legal course of action a wrongfully deceased heir can bring in the event that no criminal charges can be filed. This article proposes that the best regulatory approach and tort liability course of action is through (1) treating prop …

Unsung Heroes: The Jones County Drug Court, Elise Joelle Denoulet Jan 2023

Unsung Heroes: The Jones County Drug Court, Elise Joelle Denoulet

Electronic Theses and Dissertations

In Ellisville, Mississippi, some heroes do not wear capes. The Jones County Drug Court, located in rural Mississippi, fights drug and alcohol addiction daily. This drug court program, led by the tough but compassionate Consuelo Walley, supervises about 70 to 90 participants in their recovery journey. In recent years, this program has grown to be known as one of the most efficient in its region, and I made it my mission to uncover why that is. It turns out staff members are themselves recovering addicts, who utilize their own experience as a way to connect and relate to their participants. …

The Impact Of Demographic And Background Information On Public Perceptions Of Sex Offenders, Rylee D. Perez Jan 2023

The Impact Of Demographic And Background Information On Public Perceptions Of Sex Offenders, Rylee D. Perez

Master's Theses or Doctor of Nursing Practice

Many studies have examined the public’s perception of crime in the United State of America. As a whole, the public tends to favor harsh punishments and longer sentences for most crimes. In addition, the public tends to feel even more negatively toward sex offenders, often supporting punitive measures and restrictions when sex offenders are released, such as lifetime registration on the national sex offender registry. Although perceptions of crime, and sex offenses in general, appear to be negative among the general public, more recent research indicates that these perceptions can be influenced if information about the crime and offender is …

Mycelium, Minjoo Lee Jan 2023

Mycelium, Minjoo Lee

Master's Theses or Doctor of Nursing Practice

Mycelium (noun)

/mʌɪˈsiːlɪəm/

plural: mycelia

the vegetative, root-like part of a fungus, consisting of a network of fine white thread-like filaments (hyphae).

—————————

From as long as I can remember,

I’ve drawn inspiration from nature. I’ve always looked to create art and designs that contain the same visual elements and story-telling that is so present in nature.

In mycelia, I found inspiration in the fact that they are vital in terrestrial and aquatic ecosystems for their role in the decomposition of material. They give life to what has died, turning negative into positive.

An Intersectional Examination Of U.S. Civil Justice Problems, Kathryne M. Young, Katie Billings Jan 2023

An Intersectional Examination Of U.S. Civil Justice Problems, Kathryne M. Young, Katie Billings

GW Law Faculty Publications & Other Works

Millions of Americans face civil justice problems each year, and most of these problems never make it to court, let alone to a legal expert. Although research has established that race and class are associated with a person’s chance of experiencing a civil justice problem, detailed intersectional examinations of everyday people’s justice experiences are largely absent. A more in-depth empirical understanding of the access to justice crisis can equip lawyers, policymakers, and other designers of justice interventions to create higher-impact, more efficient, and better- targeted programs to meet the justice needs of everyday people.

This Article fills a critical gap …

The Carceral Home, Kate Weisburd Jan 2023

The Carceral Home, Kate Weisburd

GW Law Faculty Publications & Other Works

In virtually all areas of law, the home is the ultimate constitutionally protected area, at least in theory. In practice, a range of modern institutions that target private life—from public housing to child welfare—have turned the home into a routinely surveilled space. Indeed, for the 4.5 million people on criminal court supervision, their home is their prison, or what I call a “carceral home.” Often in the name of decarceration, prison walls are replaced with restrictive rules that govern every aspect of private life and invasive surveillance technology that continuously records intimate information. While prisons have always been treated in …

Community Pharmacy Provision Of Extended-Release Injectable Naltrexone In Kentucky: Perspective Of People Who Use Opioids, Anye Wamucho

Theses and Dissertations--Public Health (M.P.H. & Dr.P.H.)

Aim: To identify demographic, socio-economic, and other factors associated with likelihood of obtaining extended-release injectable naltrexone (EIN) if provided in a private space at a local pharmacy among people who use opioids (PWUO) in rural Appalachian Kentucky.

Methods: People who used opioids in the past 6 months in rural Appalachian Kentucky (n=170) completed interviewer-administered questionnaires eliciting demographic, socio-economic, and other characteristics. Participants were also asked about whether they will be more likely to obtain EIN if provided in a private space at a local pharmacy. Factors associated with increased likelihood to obtain pharmacy-provided EIN were assessed using unadjusted univariate and …

Mental Health Professionals’ Perception Of Medications For Opioid Use Disorder, Patrick M. Mullen Jan 2023

Mental Health Professionals’ Perception Of Medications For Opioid Use Disorder, Patrick M. Mullen

PCOM Psychology Dissertations

Despite the widespread attention and resources allocated to the current opioid crisis, the public health problem persists. A major target in the efforts to combat the opioid crisis is increased accessibility and utilization of medications for opioid use disorder (MOUD). A robust body of evidence supports the effectiveness of medications to treat opioid use disorder (OUD) in reducing overdose deaths and improving overall outcomes. Yet, MOUD continues to be underutilized at alarming rates. Studies have discovered that only one-third of substance use disorder (SUD) treatment sites offer any form of MOUD and approximately 30% of individuals with OUD receive any …

Additionally, there were no significant findings among age and support for harm …

Role-Reversibility, Ai, And Equitable Justice — Or: Why Mercy Cannot Be Automated, Kiel Brennan-Marquez Jan 2023

Role-Reversibility, Ai, And Equitable Justice — Or: Why Mercy Cannot Be Automated, Kiel Brennan-Marquez

Faculty Articles and Papers

A few years ago, we developed the concept of "role-reversibility" in Al governance: the idea that it matters whether a party exercising judgment is reciprocally vulnerable to the effects of judgment. This idea, we argued, supplies a deontic reason to maintain certain spheres of human judgment even if (or when) truly intelligent machines become demonstrably superior in every utilitarian sense. While computer science remains far from that holy grail, generative AI is raging through systems as diverse as healthcare, finance, advertising, law, and academe, making it imperative to further shore up our claim. We do so by situating role-reversibility within …

A Struggle So Beautiful: The Roses That Rise From Concrete: Exploring Transformative Ruptures In The Higher Education Journeys Of Formerly Incarcerated Latinx/A/O Students Through Relationships With Institutional Agents, Joe Louis Hernandez

CGU Theses & Dissertations

Formerly incarcerated Latinx/a/o students (FILS) are an under researched student population who are often ignored when Latinx/a/o issues are brought up. This study seeks to highlight the experiences of FILS in the higher education pipeline and their experiences in engaging in relationship with institutional agents. Using a critical qualitative race methodology, the research presents the findings from thirty-five one-on-one interviews with twenty student participants and fifteen institutional agents identified by the students as having an impact on their educational journeys. This study employed the Concrete Rose Framework to highlight the experiences of the FILS as they engaged in relationship with …

Meta-Analysis Of Scent Detection Canines And Potential Factors Influencing Their Success Rates, Molly Marie Jaskinia Jan 2023

Meta-Analysis Of Scent Detection Canines And Potential Factors Influencing Their Success Rates, Molly Marie Jaskinia

Graduate Student Theses, Dissertations, & Professional Papers

Objective: This is a meta-analysis focused on the success rates of scent detection canines and potential factors that could influence their accuracy. A series of statistical analyses were conducted to determine if certain demographic factors, such as the dog’s gender, age, and breed, have an effect on a scent dog’s accuracy during a search. Or if more circumstantial factors, like the dog’s level of experience in scent work, the type of target scent, and their handler’s awareness of the target’s location, affect the outcome of the search.

Materials and Methods: A dataset was created from 37 different articles consisting of …

A Commentary On Qualified Immunity In The Aftermath Of City Of Tahlequah V. Bond, Delores Jones-Brown, Paul Reck, Richard C. Helfers, Henry F. Fradella Jan 2023

A Commentary On Qualified Immunity In The Aftermath Of City Of Tahlequah V. Bond, Delores Jones-Brown, Paul Reck, Richard C. Helfers, Henry F. Fradella

Criminal Justice Faculty Publications and Presentations

In this Article, we argue that the Bond decision continues a line of judicial decisions that make it difficult for plaintiffs to seek civil redress against officers who cause serious injury or death to private citizens. We note that this judicial trend runs counter to public demand for police accountability and thwarts the legislative intent behind the enactment of 42 U.S.C.A. § 1983. We suggest that police practice, policy, standards and training-not judicial opinions should govern whether officers will be immune from the consequences of their actions, especially in areas where a substantial amount of empirical evidence exists to alert …

The Role Of Procedural Justice In Policing: A Qualtative Assessment Of African Americans' Perceptions And Experiences In A Large Us City, Daniel K. Pryce, Ingrid Phillips Whitaker Jan 2023

The Role Of Procedural Justice In Policing: A Qualtative Assessment Of African Americans' Perceptions And Experiences In A Large Us City, Daniel K. Pryce, Ingrid Phillips Whitaker

Sociology & Criminal Justice Faculty Publications

Empirical studies have pointed to the increasing importance of procedural justice as a tool for improving the relationship between the police and local communities. The mediating role of procedural justice continues to be embraced by scholars, practitioners, and community members; as a result, we examine in the present study African Americans’ attitudes toward the police via the interpretive lens of procedural justice policing. Using procedural justice questions found in the social-psychology literature, we interviewed seventy-seven African Americans in Durham, NC, to assess their views about the U.S. police. Our results point to the following for improving the relationship between the …

Crimes Of Suspicion, Lauryn P. Gouldin Jan 2023

Crimes Of Suspicion, Lauryn P. Gouldin

Emory Law Journal

Requiring that officers have suspicion of specific crimes before they seize people during stops or arrests is a fundamental rule-of-law limitation on government power. Until very recently, the Supreme Court studiously avoided saying whether reasonable suspicion for street and traffic stops must be crime specific, and lower courts are sharply divided as a result. Statements made in Kansas v. Glover that the Fourth Amendment requires reasonable suspicion of a “particular crime” or of “specific criminal activity” may reflect an effort to rehabilitate this foundational principle, but crime specificity was not the Court’s focus in Glover. Meanwhile, Fourth Amendment scholars, even …

How They Get Away With Murder: The Intersection Of Capital Punishment, Prosecutor Misconduct, And Systemic Injustice, Rushton Davis Pope Jan 2023

How They Get Away With Murder: The Intersection Of Capital Punishment, Prosecutor Misconduct, And Systemic Injustice, Rushton Davis Pope

Emory Law Journal

Black defendants are executed at a disproportionately high rate, an injustice quietly persisting in the shadow of America’s dark history of slavery and Jim Crow. While a variety of intersectional factors have perpetuated this injustice, the role of prosecutors who commit misconduct to secure a conviction is significant. Defendants are presumed innocent until proven guilty, but when the prosecutors who carry the burden of proving that guilt choose not to play by the rules, they wantonly and recklessly embrace the risk of convicting—even killing—an innocent person.

This Comment focuses on two primary forms of prosecutor misconduct: Batson violations that occur …

Voting Rights Federalism, Ruth M. Greenwood, Nicholas O. Stephanopoulos Jan 2023

Voting Rights Federalism, Ruth M. Greenwood, Nicholas O. Stephanopoulos

Emory Law Journal

It’s well-known that the federal Voting Rights Act is reeling. The Supreme Court nullified one of its two central provisions in 2013. The Court has also repeatedly weakened the bite of the statute’s other key section. Less familiar, though, is the recent rise of state voting rights acts (SVRAs): state-level enactments that provide more protection against racial discrimination in voting than does federal law. Eight states have passed SVRAs so far—five since 2018. Several more states are currently drafting SVRAs. Yet even though these measures are the most promising development in the voting rights field in decades, they have attracted …

Precious And Dear To Us Is Only This Place: The Transformative Potential Of Monumental Remnants, Zachary A. Bray Jan 2023

Precious And Dear To Us Is Only This Place: The Transformative Potential Of Monumental Remnants, Zachary A. Bray

Law Faculty Scholarly Articles

When monuments are torn down, what remains, and what should we do with the remains? In the United States as elsewhere, recent political and social conflicts have led to the destruction or relocation of many monuments—sometimes spontaneous, sometimes carefully planned. Much attention has been focused on these processes of removal and relocation, and the laws that hinder or advance these changes. On the other hand, relatively little attention has been paid to what remains behind after monuments are removed or destroyed: the vacant spaces, empty pedestals, fragments of statues, and so forth. Sometimes these remnants are protected by laws that …

Reading Legal Ethnographies To Re-Map Legal Pluralism: A Pospisilian Corrective To The Prevailing Dichotomous Description Of Afghanistan’S Legal Order, Tomas Ledvinka, James M. Donovan Jan 2023

Reading Legal Ethnographies To Re-Map Legal Pluralism: A Pospisilian Corrective To The Prevailing Dichotomous Description Of Afghanistan’S Legal Order, Tomas Ledvinka, James M. Donovan

Law Faculty Scholarly Articles

This article explores several ethnographies (both academic and para-academic) of Afghanistan’s traditional justice (jirgas and shuras) in order to illuminate contrasts of their conceptual approaches at different periods of the country’s history. In this genealogy we identify ethnographic observations of the levels at which various sociolegal authorities operate and which often elude standard international ontology. The article takes the legal ethnographies as signposts for a conceptual reframing of the legal situation in the country by drawing upon Pospisil’s legal-anthropological conceptual approach which offers an alternative to generic global legal models based on binary oppositions such as formal–informal, state–non-state or official–traditional. …

Fulfilling The Promise Of Applied Developmental Science: Is It Time To Reconsider Our Approach?, Steven J. Holochwost, W. Roger Mills-Koonce, Eleanor D. Brown

Psychology Faculty Publications

The promise of applied developmental science is that we can use scientific methods to promote positive human development and improve the lives of children and families. However, the present political environment in the United States makes the creation of research-informed federal policy difficult, even when the evidence supporting a given policy is unequivocal. In this essay, we hope to begin a conversation about how we, as applied developmental scientists, may modify our approach in order to best fulfill the promise of applied developmental science. To begin this conversation, we discuss the potential for establishing long-term partnerships with smaller entities, including …

Biological Versus Social Factors Of Juvenile Sex Offenders: A Meta-Analysis, Katherine M. Phillips Jan 2023

Biological Versus Social Factors Of Juvenile Sex Offenders: A Meta-Analysis, Katherine M. Phillips

Honors Undergraduate Theses

Juvenile sex offending is not a new phenomenon but is one of limited research, with only a slight increase in research in the past decade. This meta-analysis used 5 articles to determine which holds a greater influence on juvenile sex offenders, biological or social factors. Biological factors were divided into impulsiveness, psychosis/mental health diagnosis (excluding paraphilic disorders), and sexual deviance/paraphilia. Social factors were divided into antisocial behavior, prior criminal activity, prior exposure to sexual activities/pornography, and history of being sexually abused. This meta-analysis found that biological factors have a slightly greater effect on Juvenile sex offenders, but it was not …

A Spatiotemporal Examination Of Crime Site Selection For Commercial Burglary And Street Robbery, Devin Cowan

Electronic Theses and Dissertations, 2020-2023

The overall goal of this dissertation is to examine how the built and natural environment influences how potential criminals identify crime sites to offend within. Guided by the theoretical principles of crime site selection and crime pattern theory, this study specifically focuses on the crimes of street robbery and commercial burglary in three unique study locations—Atlanta, GA, Fayetteville, NC, and Rochester, NY. The data for this study were collected from multiple publicly available data repositories. Of these repositories, criminal incident data for the dependent variables were gathered from the National Policing Institute's Police Data Initiative. Data for the independent variables, …
