The Shadow Of Success: How International Criminal Law Has Come To Shape The Battlefield, Gabriella Blum
The Shadow Of Success: How International Criminal Law Has Come To Shape The Battlefield, Gabriella Blum
International Law Studies
The rise of international criminal law (ICL) has undoubtedly contributed to the development and enforcement of international humanitarian law (IHL). Yet, there are also important and oft-overlooked ways in which it has done the opposite. By labeling certain violations of the laws of war as “criminal” and setting up dedicated mechanisms for prosecution and punishment of offenders, the content, practice, and logic of ICL are displacing those of IHL. With its doctrinal precision, elaborate institutions, and the seemingly irresistible claim of political and moral priority, ICL is overshadowing the more diffuse, less institutionalized, and more difficult to enforce IHL.

The Dark Web And Human Trafficking, Jamie Kay Graham
The Dark Web And Human Trafficking, Jamie Kay Graham
Doctoral Dissertations and Projects
This is a quantitative-comparative analysis that focuses on Artificial Intelligence (AI) platforms that assist law enforcement agencies as they combat human trafficking. Human trafficking is a Transnational Organized Crime (TOC) which means it can impact every country in the world, and in doing so, impact every person in the world. AI uses machine-learning capabilities to identify clusters, odd and/or unusual font, words, numbers, and other markers in advertisements that promote the sale of human beings. Human trafficking affects males, females, and children of all ages and can include different types of trafficking such as sex and labor trafficking. By using …

How Has The Opioid Crisis Affected Health, Health Care Use, And Crime In The United States?, Johanna Catherine Maclean, Justine Mallatt, Christopher J. Ruhm, Kosali Simon
Population Health Research Brief Series
The U.S. opioid crisis is the deadliest drug crisis in the nation’s history and is not abating. This brief summarizes what is known about the relationships between opioid misuse, health, healthcare use, and crime. The authors show that the opioid crisis has led to worsening health, increased mortality, increased healthcare use, and modest increases in crime. In addition, the policies designed to curb opioid misuse and its associated harms have had only limited success.

The purpose of this quantitative, retrospective, causal comparative study was to determine if differences existed between opioid-addicted participants who successfully completed or failed to complete the Cumberland County Adult Treatment Court. The current study was formulated on the theoretical framework of therapeutic jurisprudence and structural ritualization. The research questions were developed to determine whether there were differences in the demographics (age, gender, and education level) and treatment services utilized between participants who successfully completed and failed to complete the program. The study sample comprised 105 opioid addicted participants including 55 who successfully completed and 50 who unsuccessfully completed the program …
The Impact Of Juvenile Drug Court On Recidivism, Mallory Noelle Watkins
The Impact Of Juvenile Drug Court On Recidivism, Mallory Noelle Watkins
Doctoral Dissertations and Projects
The number of youths entering the juvenile justice system is a viable concern throughout the United States. A gap in the existing literature surrounding juvenile justice is recidivism rates among young offenders who are incarcerated or sanctioned to a community-based level of supervision after committing a transgression of a law. Federal juvenile justice practitioners, such as the Office of Juvenile Justice and Delinquency Prevention (OJJDP), the National Council of Juvenile and Family Court Judges (NCJFCJ), the United States Department of Justice (DOJ), and others, in addition to individual states and localities throughout the United States, have taken various approaches to …
Prison Behavior And The Self: Exploring The Relationship Between Different Forms Of Identity And Prison Misconduct, Michael Rocque, Grant Duwe, Valerie A. Clark
Prison Behavior And The Self: Exploring The Relationship Between Different Forms Of Identity And Prison Misconduct, Michael Rocque, Grant Duwe, Valerie A. Clark
All Faculty Scholarship
Identity or self-concept has long been theorized to explain rule-violating behavior. Life-course criminology scholarship has incorporated identity as a core concept explaining desistance or disengagement from crime over time. Individuals who transform their identities from anti to prosocial or who are ready to move away from their past selves are more likely to desist from crime. However, the role of identity, particularly the forms of identity that have been theorized to influence desistance, has been understudied with respect to prison behavior. Understanding the ways in which identity relates to prison misconduct may help inform prison programming as well as theoretical …

Church Personnel Perceptions Of Disorderly Students: A Case Study Of Misconduct In Child Ministry Programs, Regina M. Davis
Doctoral Dissertations and Projects
The problem: undisciplined children in church settings disrupt biblical teachings and provide the impetus for other children to act inappropriately. Therefore, discipline issues must be addressed. Christian teachers have a unique responsibility to establish high moral and ethical standards in their classrooms based on God’s Word, thus, student discipline issues must be addressed for the wellbeing of all concerned.
The purpose of this Qualitative Case Study is to understand the student discipline issues experienced by teachers in child ministry programs and how they coped with these issues. Student discipline issues can be defined as incidents of disruptive behaviors exhibited by …

Examining Predictors Of Vicarious Posttraumatic Growth Among Sexual Assault Service Providers In Rape Crisis Centers, Anna Wegrzyn
Examining Predictors Of Vicarious Posttraumatic Growth Among Sexual Assault Service Providers In Rape Crisis Centers, Anna Wegrzyn
College of Science and Health Theses and Dissertations
Rape crisis centers (RCCs) rely on counselors and victim advocates to provide support to survivors of sexual assault via crisis intervention, advocacy, counseling, case management, and referrals. As a result of their direct service work, sexual assault service providers are frequently exposed to vicarious trauma. This may inhibit both service provision and provider well-being. Not all impacts of engaging in trauma work are negative, however; positive benefits have also been documented from engaging in trauma work. One such benefit is vicarious posttraumatic growth, which is understood as the positive psychological transformation undergone by trauma workers as a result of their …

Performance Evaluation And Promotion Criteria: Perceptions Of Faculty Evaluation In Promotion Decisions, Valerie Wallingford, Gyongyi Konyu-Fogel`, Mary B. Dubois
Journal of the North American Management Society
Performance evaluation and promotion of faculty can be difficult in higher education. The evaluation of faculty performance often creates confusion as the criteria for promotion are often poorly understood. Disagreements over effective, equitable performance evaluation tools and possible biases of how faculty may get promoted have been a concern in many institutions, possibly creating legal liabilities that underlines the need for designing promotion criteria that are effective and easily understood by administrators and faculty. The purpose of this paper is to evaluate the perceptions of faculty promotion practices and processes used in higher education institutions in the Midwest region of …

Patching The Patchwork: Moving The Civil Right To Counsel Forward With Key Data, Maria Roumiantseva
Journal of Civil Rights and Economic Development
(Excerpt)
While the pandemic has exposed many long-standing realities about the United States, the destructive everyday crisis of eviction is top of mind as moratoria have now expired and rental assistance funds dissipate with no anticipated replenishment. Therefore, though this piece addresses legal representation in civil legal proceedings more broadly, we will start with an eviction story.
It can be taken as fact that not too far from where you are reading this piece, a tenant is facing an eviction unrepresented. She cannot afford a private attorney. She is income eligible for legal aid, but the office near her home …
