Delegalization, Lauren Sudeall
Delegalization, Lauren Sudeall
Vanderbilt Law School Faculty Publications
The lack of resources available to assist low-income litigants as they navigate the legal system has been widely documented. In the civil context- where a majority of cases involve eviction, debt collection, and family matters--various solutions have been offered to address the problem. These include expanding the civil right to counsel; increasing funding for civil legal aid; providing for greater availability and accessibility of self-help services; adopting a more flexible approach to the provision of legal services (including, for example, unbundled and limited legal services options); scaling back unauthorized-practice-of-law regulation and allowing for higher utilization of other service providers; and …

Creating A People-First Court Data Framework, Lauren Sudeall, Charlotte S. Alexander
Vanderbilt Law School Faculty Publications
Most court data are maintained--and most empirical court research is conducted--from the institutional vantage point of the courts. Using the case as the common unit of measurement, data-driven court research typically focuses on metrics such as the size of court dockets, the speed of case processing, judicial decision-making within cases, and the frequency of case events occurring within or resulting from the court system.
This Article sets forth a methodological framework for reconceptualizing and restructuring court data as "people-first"-centered not on the perspective of courts as institutions but on the people who interact with the court system. We reorganize case-level …
Administrative Regulation Of Programmatic Policing: Why "Leaders Of A Beautiful Struggle" Is Both Right And Wrong, Christopher Slobogin
Administrative Regulation Of Programmatic Policing: Why "Leaders Of A Beautiful Struggle" Is Both Right And Wrong, Christopher Slobogin
Vanderbilt Law School Faculty Publications
In Leaders of a Beautiful Struggle v. Baltimore Police Department, the Fourth Circuit Court of Appeals held that Aerial Investigation Research (AIR), Baltimore's aerial surveillance program, violated the Fourth Amendment because it was not authorized by a warrant. AIR was constitutionaly problematic, but not for the reason given by the Fourth Circuit. AIR, like many other technologically-enhanced policing programs that rely on closed-circuit television (CCTV), automated license plate readers and the like, involves the collection and retention of information about huge numbers ofpeople. Because individualized suspicion does not exist with respect to any of these people's information, an individual-specific warrant …
The Competency To Stand Trial Process In Northern Minnesota And The Effect Time Has On Outcomes, Hannah E. Cornwell
The Competency To Stand Trial Process In Northern Minnesota And The Effect Time Has On Outcomes, Hannah E. Cornwell
Psychology and Counseling Theses
The current system that manages the competency to stand trial (CST) process in many states is in crisis (Callahan & Pinals, 2020). This is largely due to a significant increase in the amount of people needing competency related services in the last decade (Wik, Hollen, & Fisher, 2019). There have been many solutions proposed by researchers, which include but are not limited to, a screening process for competency to stand trial evaluations, along with shortening deadlines for qualified practitioners to complete evaluations (Gowensmith, 2019). This study examines the effectiveness and efficiency of implementing a screen into the CST process while …
Jurimetrics And Detention: Understanding The Supreme Court Through Detention Cases During The 1975 National Emergency, Nitish Rai Parwani
Jurimetrics And Detention: Understanding The Supreme Court Through Detention Cases During The 1975 National Emergency, Nitish Rai Parwani
Socio-Legal Review
This paper employs the lens of jurimetrics to empirically analyse patterns in decision-making by the Supreme Court while deciding cases concerning personal liberty between 1974-1977, with the 1975 National Emergency as the point of reference. The paper investigates and analyses the functioning of the Supreme Court in this period by examining the numerical trends in the number of reportable and unreportable judgments in preventive detention matters during the 1975 Emergency, by contrasting it with the period immediately before the proclamation and after the revocation of the Emergency. First, the paper introduces the period of study and delineates its methodology, along …
Deconstructing Police Discretion As Brahminism, Nikita Sonavane
Deconstructing Police Discretion As Brahminism, Nikita Sonavane
Socio-Legal Review
Police violence is cast as a graphic, brutal spectacle of power on the bodies of the poor. This popular understanding is only the most visible form of routinised arbitrary violence perpetrated by the police. In this article, we study the scope and forms of police discretion in ordinary policing tasks informed by Criminal Tribes Act, 1871 to argue that the police frame criminality not through evidence-gathering but through the power of language and distorted narratives that are passed off as discoverable truths derived from the institution of caste. Through a study focused on alcohol policing under the Madhya Pradesh Excise …
The Impact Of A Literacy Program On Summer Reading Setback: Providing Access To Books And Project-Based Learning, Tiffany Gayle Robles
The Impact Of A Literacy Program On Summer Reading Setback: Providing Access To Books And Project-Based Learning, Tiffany Gayle Robles
Theses and Dissertations
This action research study examined the impact of a summer literacy program on summer reading setback. Gaining Ground is a summer intervention program designed primarily for economically disadvantaged students in Grades K–5. By granting access to self-selected books and implementing project-based curriculum, Gaining Ground aims to improve reading proficiency during the summer break. Faucet theory illuminated the challenge of reaching and maintaining proficiency over break, and constructivism and self-determination theory framed the program’s efforts to resolve this problem.
As the curriculum director, I used mixed methods to assess Gaining Ground’s impact. Quantitative methods revealed maintenance, improvement, or decline in student …

Prosecutorial Discretion: District Attorneys, Public Opinion,And The Localized Rule Of Law, Yu-Hsien Sung
Prosecutorial Discretion: District Attorneys, Public Opinion,And The Localized Rule Of Law, Yu-Hsien Sung
Theses and Dissertations
This dissertation addresses three fundamental questions regarding the politics of prosecutorial behavior. Specifically, it examines how the selectors of prosecutors influence prosecutorial decision-making under different selection methods, including electionbased systems and appointment-based systems. By using a political responsiveness framework and utilizing empirical strategies, including an experiment and the construction of prosecutor policy position data, this study offers novel insights into the subject. First, I find that voters care about prosecutors’ issue positions and rely on various cues to identify candidates whose policy positions align with their preferences, even in low-information elections. Second, elections show promise as a mechanism for holding …

An Ml Based Digital Forensics Software For Triage Analysis Through Face Recognition, Gaurav Gogia, Parag H. Rughani
Journal of Digital Forensics, Security and Law
Since the past few years, the complexity and heterogeneity of digital crimes has increased exponentially, which has made the digital evidence & digital forensics paramount for both criminal investigation and civil litigation cases. Some of the routine digital forensic analysis tasks are cumbersome and can increase the number of pending cases especially when there is a shortage of domain experts. While the work is not very complex, the sheer scale can be taxing. With the current scenarios and future predictions, crimes are only going to become more complex and the precedent of collecting and examining digital evidence is only going …
Pretrial Release, Risk Assessment, And The Failing Movement Towards A Cashless Bail System: The Need To Target The Source, Brooke Hodgins
Pretrial Release, Risk Assessment, And The Failing Movement Towards A Cashless Bail System: The Need To Target The Source, Brooke Hodgins
Cardozo Journal of Equal Rights & Social Justice
The note argues that the cash bail system perpetuates economic and racial disparities, leading to unjust pretrial detention for many individuals. It advocates for a risk-based approach, highlighting New Jersey's bail reform as a model that reduces incarceration rates and disparities while maintaining public safety.

One Training Is Not Enough: The Effects Of A Cultural Humility Training On Mentors’ Verbal Behavior, Anna Flitner
One Training Is Not Enough: The Effects Of A Cultural Humility Training On Mentors’ Verbal Behavior, Anna Flitner
Theses and Dissertations
Youth mentoring has been used as a method of prevention and intervention related to social, psychological, and academic outcomes for youth and adolescents, many of whom come from minoritized or low SES backgrounds. Although more diverse than other helping professions, mentors in formal programs are often white which can lead to potential cultural incongruence. To help mentors understand their own identities and work with youth of diverse backgrounds, mentoring programs have begun implementing cultural humility trainings. The current study examines the effects of a cultural humility training in mentoring. Mentors were randomly assigned to the control or training condition in …
Comorbid Adhd And Pediatric Sickle Cell Disease: Prevalence And Risk Factors, Sarah Bills
Comorbid Adhd And Pediatric Sickle Cell Disease: Prevalence And Risk Factors, Sarah Bills
Theses and Dissertations
Objective: Sickle cell disease (SCD) is a genetic blood condition that places youth at increased risk for deficits in attention and executive functioning suggestive of increased rates of Attention Deficit/Hyperactivity Disorder (ADHD). There is pronounced inconsistency in reported prevalence rates for attention deficits and ADHD diagnoses among youth with SCD, which is due in part to variability in methodology of previous studies. The primary aim of the present study is to use systematic screening to identify the prevalence of inattentive ADHD symptoms and ADHD diagnoses in a pediatric SCD population seen at a large hematology clinic. A secondary aim is …

College of Nursing Faculty Research and Publications
Despite calls recognizing the need for culturally sensitive responses to minimize the occurrence of secondary victimization for African American women following an experience of sexual assault, few studies have focused on hearing from African American women survivors about their experiences receiving healthcare services in a hospital setting following sexual assault. Employing critical ethnography as our methodology and using intersectionality theory as a lens, we centered the voices of African American women survivors about their experiences receiving nursing care in urban acute care or hospital settings in the Upper Midwest of the United States following sexual assault. In this qualitative study, …

The Brave New World Of Third Party Location Data, Shelby Brennan, Stephen Coulthart, Brian Nussbaum
Journal of Strategic Security
The use of third-party location data (3PLD)—geospatial data captured by smart devices and sold by ‘data brokers’—for intelligence and investigations is increasing each year. This data source provides opportunities for analysts and decision makers to better understand as well as counter a host of security threats from common criminals to terrorists. However, and like other emerging and potent sources of intelligence like social media intelligence (SOCMINT), 3PLD must also be wielded legitimately by the government. We argue that the in the US context the legal framework surrounding these data is unclear. Due to the legal ambiguity as well as technological …

Cyber intimate partner violence (C-IPV) is a technology-mediated form of violence. It has been examined only in the last 10 years as a form of violence that can cause psychological damage to its victims. How this phenomenon connects to and differs from face-to-face IPV (F2F-IPV) has been, as yet, little studied. Research has not made clear whether sex differences may impact its use, particularly in light of the fact that no physical coercion is used in C-IPV. Thus, the current research aimed to investigate through a meta-analysis: differences between the average levels of different types of C-IPV victimization and perpetration; …

A Third Way: Title Ix’S Potential Beyond Criminal And Civil Law Paradigms, Gabriella Kamran
MC Law Review
A single occurrence of sexual violence on a college campus can lead to any of three major legal outcomes. The first is a traditional criminal prosecution of the alleged perpetrator. The second is a civil lawsuit against the school under Title IX, in which the victim alleges that the school’s disciplinary procedures failed to deliver an adequate response according to the body of law developed by courts interpreting Title IX. The third, which has become increasingly important and visible after a decade of student activism and initiatives by the Department of Education, is an administrative enforcement action by the Department’s …

Language is powerful. It can affect how we think about and treat groups of people. Poor language choices have a massive impact on immigration law, an area of the law that determines how groups of perceived “outsiders” are classified and regulated. Language and bias in judicial opinions have been studied, but less research has been done on poor language choices in immigration statutes.
This Comment focuses on the harmful effects of poor language choices in immigration statutes, including the criminal terminology “arrest” and “warrant” in civil immigration apprehension statutes 8 U.S.C. Sections 1226 and 1357. Two fundamental problems arise when …

This paper studies the impact of adult prosecution on recidivism and employment trajectories for adolescent, first-time felony defendants. We use extensive linked Criminal Justice Administrative Record System and socio-economic data from Wayne County, Michigan (Detroit). Using the discrete age of majority rule and a regression discontinuity design, we find that adult prosecution reduces future criminal charges over 5 years by 0.48 felony cases (↓ 20%) while also worsening labor market outcomes: 0.76 fewer employers (↓ 19%) and $674 fewer earnings (↓ 21%) per year. We develop a novel econometric framework that combines standard regression discontinuity methods with predictive machine learning …

Mandatory reporting of child abuse is a part of the civil legal system that can activate a policy cascade disproportionately criminalizing racialized and marginalized communities. While social work scholarship has explored ways to increase provider compliance with mandatory reporting laws, there is a dearth of research focused on how social work education guides future providers towards the praxis of mandatory reporting discourses. This article presents findings from a content analysis of social work textbook excerpts focused on mandatory reporting of child abuse in the U.S. We found that textbooks affirm social work’s loyalty to the State by approaching mandatory reporting …

A 42-year-old woman presented with drooling, slurred speech, inability to walk and talk, and a recent positive COVID-19 test. She had two prior hospital admissions within the past week for similar symptoms with inconclusive evaluation. MRI of the brain demonstrated multifocal white matter hyperintense lesions on fluid-attenuated inversion recovery (FLAIR)/diffusion with variable enhancement. These imaging findings have been described in recent literature and are associated with inflammatory demyelinating disease, such as acute disseminated encephalomyelitis. The patient subsequently underwent a brain biopsy with a final diagnosis of inflammatory demyelinating lesion. To our knowledge, this is the first radiologic-pathologic correlation of COVID-19-associated …
