This essay reflects on whether Crawford v. Washington, now in its third decade of life, matters to criminal justice. For all the talk of Crawford as “revolutionary,” that is, has it made any real difference to the world of crime and punishment? I’ve confronted the question before. In a 2021 essay, I argued that Crawford probably has modest real-world effects. Crawford articulated a right that criminal defendants can exercise only at trial. In an adjudicatory system bereft of trials, trial rights don’t count for much. They impact plea outcomes only when they confer bargaining power sufficient to offset prosecutors’ …

In the United States, law and policy have most frequently reflected dominant white Christian majority interests. Critical Race Theory (CRT) offers powerful tools for understanding our history and situation, including that of American Jews, and how the social positions and interests of American Blacks and Jews, real and perceived, have intersected, sometimes aligning, sometimes diverging, and sometimes conflicting. And yet, among other charges leveled against it, Critical Race Theory is frequently accused of being antisemitic.

While LGBTQ+ parented families are largely the same as their cis-het parent counterparts, they still experience unique factors exclusive to them. One such factor is access to the LGBTQ+ community. While research has emphasized the importance of community within the family system, the role the LGBTQ+ community can play for LGBTQ+ parented families is largely unexplored. Additionally, LGBTQ+ research examining parents of adolescents is similarly lacking. Utilizing a sample of LGBTQ+ parents with adolescent children, and informed by ecological systems theory, self-determination theory, and the parenting stress model, I examine the influence parent’s sense of LGBTQ+ community has on the …

The events of September 11th, 2001, prompted a global reckoning with the threat of international terrorism, leading to intensified awareness and policy responses worldwide. However, amidst this heightened global focus, the United States has faced a concerning rise in politically motivated violence on its soil. Against this backdrop, this thesis delves into the phenomenon of homegrown terrorism within the United States from 2000 to 2020. By employing advanced geospatial techniques, this study seeks to pinpoint areas nationwide with elevated rates of homegrown terrorist incidents. Despite the historical and perpetual trauma, racism, discrimination, socio-economical, and socio-political disparities they have experienced in the United States, Black men have consistently forged ways to demonstrate resilience and assert their own sense of autonomy and masculinity. Nevertheless, their ecological context of living in a country that has historically sought to dehumanize them and eradicate their manhood is cumbersome to their mental wellbeing. Furthermore, the tendency by researchers to pathologize Black males obfuscates the reality of their situation in the United States, minimizing their mental needs. Abstract: Elanor Moore: Sensing Freedom: An Occupational Therapy and Service User Perspective of Sensory Processing and Occupational Participation in Forensic Mental HealthBackground: Sensory processing is a universal dynamic mind-body process which all individuals experience. It is influenced by the environment and impacts participation in occupations. Occupational therapists in forensic mental health inpatient settings aim to facilitate occupationally enriching opportunities, to support service users’ safe community reintegration. Emerging evidence indicates links between sensory processing and mental health, but with limited guidance on how this translates into occupation-focused practice.Methodology: A scoping review identified both inconsistency in sensory processing terminology and a limited …

เอกัตศึกษาฉบับนี้เป็นการศึกษาการดำเนินการเกี่ยวกับทรัพย์สินที่มีความผันผวนสูงตามพระราชบัญญัติป้องกันและปราบปรามการฟอกเงิน พ.ศ.2542 โดยทรัพย์สินที่อาชญากรได้มาจากการกระทำความผิดที่ถูกยึดหรืออายัดนั้น ทรัพย์สินบางประเภทที่มีมูลค่าความผันผวนสูง มีราคาไม่แน่นอน หรืออาจเสื่อมสภาพได้ ทรัพย์สินบางประเภทมีมูลค่าที่เปลี่ยนแปลงอย่างรวดเร็วและยากต่อการประเมินมูลค่า การชดใช้คืนมูลค่าความเสียหายให้แก่ผู้เสียหายอาจไม่ครอบคลุมถึงมูลค่าความเสียหายที่แท้จริง เนื่องจากความแตกต่างระหว่างราคาทรัพย์สิน ณ เวลาที่ยึดหรืออายัด กับราคาทรัพย์สิน ณ เวลาที่จำหน่ายหรือชดเชย อาจทำให้เกิดช่องว่างในการคืนทรัพย์สินหรือมูลค่าให้แก่ผู้เสียหายเมื่อมีการบังคับคดีมูลค่าทรัพย์สินอาจต่ำกว่ามูลค่าตอนซื้อทรัพย์สิน การประเมินราคาทรัพย์สินเพื่อชดใช้คืนแก่ผู้เสียหายนั้นไม่ครอบคลุมถึงมูลค่าความเสียหายที่เกิดขึ้นจริง ทรัพย์สินที่ทำให้ผู้เสียหายได้รับการคืนทรัพย์สินและมูลค่าที่ไม่เต็มจำนวนกับมูลค่าที่เสียหายไป ดังนั้น จึงควรนำหลักมูลค่าตลาด (Market Value) ในการประเมินราคาทรัพย์สินรวมถึงควรมีการจัดตั้งกองทุนสำรองในจัดเก็บรายได้จากการขายทรัพย์สิน การบริหารจัดการเพื่อรองรับการจัดการทรัพย์สินที่มีความซับซ้อนและมูลค่าผันผวนเพื่อชดเชยความเสียหายให้แก่ผู้เสียหายในกรณีทรัพย์สินเสื่อมมูลค่าหรือไม่สามารถจำหน่ายได้ทันเวลา การกำหนดกรอบระยะเวลาที่เหมาะสมในการจำหน่าย และการใช้เทคโนโลยีเพื่อเพิ่มประสิทธิภาพในการบริหารจัดการทรัพย์สิน ช่วยให้การดำเนินการมีประสิทธิภาพมากขึ้น สามารถลดผลกระทบที่เกิดจากความผันผวนของมูลค่าทรัพย์สิน และช่วยให้ผู้เสียหายได้รับการเยียวยาในมูลค่าที่สอดคล้องกับความเสียหายที่แท้จริงกำหนดกรอบเวลาชัดเจนในการขายหรือชดเชยทรัพย์สิน ทำให้มาตรการการดำเนินการเกี่ยวกับทรัพย์สินที่มีความผันผวนสูงตามพระราชบัญญัติป้องกันและปราบปรามการฟอกเงิน พ.ศ.2542 เป็นไปอย่างมีประสิทธิภาพ สามารถเยียวยา และคืนมูลค่าให้แก่ผู้เสียหายได้อย่างเต็มจำนวนมูลค่าความเสียหายที่สูญเสียไป

ปัญหาความรุนแรงด้านอาวุธปืนของโลกในปัจจุบันที่มีแนวโน้มสูงขึ้นทุกปี โดยเฉพาะเหตุกราดยิงที่สามารถสร้างความเสียหายต่อการก่อเหตุหนึ่งครั้งได้อย่างรุนแรง ดังนั้น จึงได้นำมาสู่การศึกษาบริบทความรุนแรงของสถานการณ์กราดยิงและการควบคุมอาวุธปืน การศึกษาวิเคราะห์เปรียบเทียบมาตรการควบคุมอาวุธปืนหลังเหตุกราดยิง และการศึกษามาตรการควบคุมอาวุธปืนที่เหมาะสมกับไทย โดยการวิจัยเชิงคุณภาพ ด้วยการวิเคราะห์ข้อมูลเอกสาร กฎหมาย และมาตรการที่บังคับใช้ รวมถึงการสัมภาษณ์เชิงลึกกับผู้เชี่ยวชาญและผู้มีส่วนเกี่ยวข้อง โดยมีขอบเขตการศึกษาในประเทศไทย สหรัฐอเมริกา ออสเตรเลีย และนิวซีแลนด์ ผลการศึกษาพบว่า สถานการณ์กราดยิงในแต่ละประเทศมีความแตกต่างกันในด้านจำนวน ความรุนแรง และมูลเหตุจูงใจ ในประเทศไทยมีเหตุกราดยิงเกิดขึ้นจำนวนกว่าความเข้าใจของสังคมที่มาจากการรายงานของสื่อ แตกต่างจาก สหรัฐอเมริกาที่กราดยิงเกิดขึ้นบ่อยและรุนแรง ส่วนในออสเตรเลียและนิวซีแลนด์มีมาตรการควบคุมอาวุธปืนที่เข้มงวดหลังเหตุกราดยิง ซึ่งมีส่วนสนับสนุนให้จำนวนเหตุกราดยิงลดลง ขณะที่ประเทศไทยยังมีกฎหมายที่ล้าสมัยและขาดการบังคับใช้ที่มีประสิทธิภาพ ทำให้มาตรการควบคุมอาวุธปืนไม่สามารถลดความรุนแรงของเหตุการณ์ได้ โดยข้อเสนอแนวการควบคุมอาวุธปืนจะต้องปรับปรุงกฎหมายควบคุมอาวุธปืนให้ทันสมัยและเข้มงวด อาทิ การตรวจสอบประวัติและสุขภาพจิตของผู้ขอใบอนุญาต และการจัดเก็บอาวุธในตู้เซฟที่มีระบบล็อกอัตโนมัติ นอกจากนี้ ควรส่งเสริมการแจ้งเบาะแสจากประชาชน และสนับสนุนการวิจัยเกี่ยวกับปัญหาอาวุธปืนในประเทศไทย

การวิจัยเรื่อง “แนวทางการปรับปรุงกระบวนการยุติธรรมทางอาญาเพื่อคุ้มครองสิทธิผู้เสียหายคดีข่มขืนกระทำชำเรา” มีวัตถุประสงค์เพื่อศึกษาสภาพปัญหาในการปฏิบัติต่อผู้เสียหายในการดำเนินคดีข่มขืนกระทำชำเราในประเทศไทย และศึกษาแนวทางในการปรับปรุงกระบวนการยุติธรรมทางอาญาเพื่อคุ้มครองผู้เสียหายคดีข่มขืนกระทำชำเราในประเทศไทย โดยใช้การวิจัยเชิงคุณภาพ ด้านการวิจัยเอกสารและเทคนิคการสัมภาษณ์เชิงลึกผู้ให้ข้อมูลสำคัญ จำนวน 10 คน จากบุคลากรในกระบวนการยุติธรรม สหวิชาชีพที่เกี่ยวข้องกับกระบวนการยุติธรรม เครือข่ายภาคประชาสังคม และนักวิชาการกฎหมายและกระบวนการยุติธรรม ผลการศึกษาพบว่า สภาพปัญหาในการปฏิบัติต่อผู้เสียหายในการดำเนินคดีข่มขืนกระทำชำเราในประเทศไทย เกิดจากสภาพปัญหาหลัก 5 ด้าน คือ 1) ด้านผู้เสียหาย 2) ด้านสังคม 3) ด้านกฎหมาย 4) ด้านกระบวนการยุติธรรม 5) ด้านคุ้มครองสิทธิ ทั้งนี้ จากงานวิจัยค้นพบว่า กระบวนการยุติธรรมทางอาญาในปัจจุบันยังคุ้มครองสิทธิผู้เสียหายคดีข่มขืนกระทำชำเราไม่ครอบคลุมเพียงพอ จึงควรปรับปรุงกระบวนการยุติธรรมทางอาญา โดยเริ่มตั้งแต่การให้ความสำคัญต่อสิทธิผู้เสียหายคดีข่มขืนกระทำชำเราอย่างชัดเจน รับรองสิทธิผู้เสียหายคดีข่มขืนกระทำชำเราด้วยการบัญญัติกฎหมายไว้เป็นการเฉพาะ เพิ่มความเชื่อมโยงระหว่างหน่วยงานในกระบวนการยุติธรรมเพื่อลดขั้นตอนที่ทับซ้อน สร้างองค์ความรู้แก่บุคลากรในกระบวนการยุติธรรมด้วยการจัดทำคู่มือแนวทางการปฏิบัติงานเพื่อที่จะได้ปฏิบัติต่อผู้เสียหายคดีข่มขืนกระทำชำเราได้อย่างเหมาะสม ทำให้ผู้เสียหายคดีข่มขืนกระทำชำเราลดสภาวะการตกเป็นเหยื่ออีกครั้ง และเต็มใจให้ความร่วมมือกับกระบวนการยุติธรรมในการนำตัวผู้กระทำความผิดมาลงโทษสมดังเจตนารมณ์ของกฎหมาย

Federal court records have been available online for nearly a quarter century, yet they remain frustratingly inaccessible to the public. This is due to two primary barriers: (1) the federal government’s prohibitively high fees to access the records at scale and (2) the unwieldy state of the records themselves, which are mostly text documents scattered across numerous systems. Official datasets produced by the judiciary, as well as third-party data collection efforts, are incomplete, inaccurate, and similarly inaccessible to the public. This project aims to address the challenges faced by transitioning foster youth in California, including those with disabilities, by creating an accessible resource for transitioning foster youth. The introduction highlights the concerning statistics regarding foster youth outcomes and the lack of preparation they often have for adulthood. The literature review explores federal initiatives to improve outcomes for transitioning foster youth, efforts in California to support these youth, the specific challenges they face, and the educational disparities they experience. It also delves into the challenges faced by foster youth with disabilities.

Every day, thousands of humans and millions of nonhumans endure solitary confinement. Human prisoners held in this way are confined for twenty-two to twenty-four hours a day for weeks, months, or even years on end in cells the size of a parking space. For these humans, the experience is tortuous. Captive animals held in solitary confinement similarly spend much of their lives locked into tiny spaces, isolated, and deprived of the types of interactions and environment essential to their wellbeing. In the past two decades, police forces have come to rely on algorithm-based technologies for investigative leads. Several of these technologies are unreliable. They are prone to error, misidentifying suspects, and crimes. When relied upon, they lead to false arrests and unnecessary stop-and-frisks. Yet, there is no coercive mechanism, either regulatory or judicial, that meaningfully governs the use of these algorithmic technologies in law enforcement. As a result, law enforcement agencies are free to disregard potential errors and deploy emerging technologies against communities with little recourse.

This applied dissertation explored the interplay between collaboration within PLCs and classroom teacher perceptions of PLC implementation within a small, rural district. It examined how the involvement of different stakeholders in PLCs connects to overall perceptions of professional learning communities and how the participation of principals, administrators, and paraprofessionals shapes collaboration. The unique setting of a small and rural school district allowed the study to consider close interpersonal relationships that are common within these settings since these districts have limited human resources and individuals serve in various capacities within the organization. El propósito de esta investigación fue evaluar el nivel de satisfacción que poseen los estudiantes de la Licenciatura en Informática, que cursan asignaturas en modalidad virtual y semipresencial, con el Entorno Virtual de Aprendizaje (EVA) utilizado por una Universidad Pública de la República Dominicana. Se buscó determinar qué tan satisfechos se encuentran los estudiantes en su experiencia al utilizar la plataforma institucional, así como identificar buenas prácticas y oportunidades de mejora.

This study is a replication study of McGrath, Lasher, and Cumming's 2012 study. McGrath et al.'s population consisted of convicted Vermont sex offenders, while this replication study's population consisted of convicted Iowa sex offenders. Nearly 2,000 sex offenders are under the Iowa Department of Corrections community supervision (Daily Statistics-DOC Offender, 2023). Iowa uses SOTIPS, Static-99R, and the Iowa Risk Revised (IRR) to determine recidivism risk and supervision levels. The Static-99R was developed in Canada and has been validated in several jurisdictions, including Iowa (Statistical validation of the ISORA8 & Static-99 final report, 2010). This applied dissertation explored how 11th-grade students perceived the English A and B school-based assessment (SBA) and whether their portfolio experience impacted their sense of self-efficacy. Significant research has been conducted on the SBA exploring its benefits, impact, and relevance as well as the challenges and concerns encountered with implementation in various disciplines. Most of the research, however, has focused on teacher perspectives with minimal research exploring student perspectives and the assessment’s impact on them socially and academically.
This qualitative research study adopted an ethnographic approach with a realistic design to conduct this inquiry. This method was used because the …
