Language Barriers In The U.S. Legal System For Primarily Spanish Speakers: Attorney Perspectives And Potential Solutions For True Equal Access, Emma F. Kizer

Honors Program Theses

The U.S. legal system is difficult to navigate for anyone who is attempting to use it, but non-English-speaking individuals have a unique set of obstacles to overcome. Communicating and understanding legal jargon and processes can become increasingly strenuous when one does not speak English in a predominantly English system. This study is specifically focused on the barriers that Spanish-speaking clients face and potential ways to change the system in order to make the experiences of non-English speakers more accessible. By interviewing attorneys who work with both English and Spanish speaking clients, we gain insight into their perspective on issues they …

Gender Socialization And Social Media In College Students' Fear Of Crime, Ashlyn C. Miller Jan 2024

Gender Socialization And Social Media In College Students' Fear Of Crime, Ashlyn C. Miller

Honors Program Theses

The purpose of this study is to explore the relationship between gender (socialization), viewing crime related material on social media, and fear of crime experienced by college students. While violent crime rates have fallen, the majority of college students report levels of crime are increasing. Many individuals lack both knowledge and experience related to crime, leading media exposure to influence their levels of fear. Previous research has focused on television media related to fear of crime with little research on social media, the preferred media source of young adults. College students (n = 124) from a midwestern university completed a …

Information Provided By State Human Trafficking Websites: A Content Analysis, Brooklyn Dilley Jan 2024

Information Provided By State Human Trafficking Websites: A Content Analysis, Brooklyn Dilley

Honors Program Theses

Human trafficking evolved from the legal and regulated slavery of the past and has likely been in existence throughout human history. Slavery was abolished in the United States in 1865, and slavery and servitude were prohibited globally through the Universal Declaration of Human Rights in 1948 (United Nations General Assembly, 1948). Nevertheless, modern-day slavery has still thrived in the form of human trafficking. There have been many global and national efforts to combat human trafficking, including the UN Protocol to Prevent, Suppress, and Punish Trafficking in Persons and the Trafficking Victims Protection Act of 2000 (OMCTP). The Trafficking Victims Protection …

The Roads Less Traveled: A Metaresearch Analysis Of Local Histories In Racial Health Equity Research, Devin Trévion Brown Jan 2024

The Roads Less Traveled: A Metaresearch Analysis Of Local Histories In Racial Health Equity Research, Devin Trévion Brown

Public Health Theses

While it is important that racial health equity research receive growing attention in theUnited States, doing so must involve a thorough recognition and interrogation of the role that structural racism plays in creating different outcomes for Black communities. History aids in making clear the process through which race can become biology as structural racism is embodied by members of Black communities. Guided by Táíwò’s conceptualization of “resource distribution and accumulation” as well as Carter’s discussion of “racialized local biologies”, this cross-sectional meta-research analysis sought to investigate when and how racial health equity research after 2020 utilized local history to understand …

“I Don't Work For The Prison. I Don't Work For The Hospital Either. I’M Yours. Who Else Here Is Yours?” A Qualitative Analysis Of Facilitators And Barriers Of Launching Enhanced Perinatal Programs In Seven State Prisons, Karenna Thomas

Public Health Theses

The United States incarcerates women at the highest rate globally (Fair & Walmsley, 2022), while simultaneously failing to provide incarcerated individuals with adequate reproductive health care. Perinatal programs, including a combination of one-on-one and group prenatal and postpartum education, labor and birth support with a doula, separation support, and lactation care have been implemented as an alternative to standard care in around 21 states (Wilson et al., 2022). While the efficacy of these programs among incarcerated individuals has been established (Bard et al., 2016; Barkauskas et al., 2002; Schroeder & Bell, 2005; Shlafer et al., 2018; Shlafer, Saunders, Boraas, et …

Trauma-Informed Digital Health Interventions: A Scoping Review, Amelea Lowery

Public Health Theses

Background: Trauma exposure is a pervasive issue around the world and the impacts of trauma can be long lasting and detrimental to individual and population health outcomes. Trauma responses can influence and determine an individual or community’s approach in seeking supportive resources. Given the critical role of supportive resources and the prevalent use of technology and internet use, it is essential to understand how digital health interventions contribute to addressing trauma explicitly. This scoping review aims to explore the landscape of trauma-informed digital health interventions for adults, assess their outcomes, and identify their measurable impacts across various settings. Methods: A scoping …

Rap Rhyme, Prison Time: How Prosecutors Use Rap Evidence In Gang Cases, Charis Kubrin, Kyle Winnen, Rebecca Rogers Jan 2024

Rap Rhyme, Prison Time: How Prosecutors Use Rap Evidence In Gang Cases, Charis Kubrin, Kyle Winnen, Rebecca Rogers

Chapman Law Review

"In this Article, we call for greater nuance and careful treatment of rap-related evidence in the courtroom, which includes recognizing rap’s history, conventions, and practices generally, and acknowledging rap’s complicated and complex intersection with gangs specifically. Greater nuance and more careful treatment will enable courtroom members, including judges and jurors, to make better informed evaluations regarding whether rap evidence, despite being prejudicial, is sufficiently probative and if so, what relevance it may have to the case. We preface this argument with a review of punitive policies and practices associated with gangs in the criminal justice system, and with a discussion …

Rap On Trial: A Brief History, Jack Lerner Jan 2024

Rap On Trial: A Brief History, Jack Lerner

Chapman Law Review

In recent years, the prosecutorial tactic, often called “Rap on Trial”—in which rap lyrics and videos associated with a defendant are used as evidence of criminal activity—has exploded into national prominence. The widely-followed prosecution of Young Thug and his labelmates, along with other high-profile rappers, has generated intense interest in the issue, but even before the Young Thug indictment, legislators in California, Washington D.C., and other states had introduced legislation to curb the practice. The Rap on Trial tactic has been around since at least 1991; hundreds of courts have issued judicial opinions permitting the use of rap evidence, despite …

Policing With A Double-Edged Sword: The Associations Between Neighborhood Deprivation, Coping & Substance Use Among Black & Latiné Families, Neil M. Allicock Jan 2024

Policing With A Double-Edged Sword: The Associations Between Neighborhood Deprivation, Coping & Substance Use Among Black & Latiné Families, Neil M. Allicock

Dissertations and Theses

The COVID-19 pandemic has exacerbated systemic racial inequities among Black and Latiné communities, increasing daily stressors such as exposure to violence, racial discrimination, and negative perceptions of the police. Social constraints from quarantining and social distancing have weakened community relationships that previously provided relief from these stressors. Persistent poverty and racial discrimination further strain community ties and challenge the well-being of marginalized communities. Negative experiences with the police are unique stressors for Black and Latiné youth, potentially increasing their risk for substance use. The erosion of community ties may heighten psychological stress and lead to less adaptive coping methods, such …

Scale And Scope: Building Sotl Capacity Through Collaborative Library Partnerships, Laura Cruz, Ellysa Stern Cahoy Jan 2024

Scale And Scope: Building Sotl Capacity Through Collaborative Library Partnerships, Laura Cruz, Ellysa Stern Cahoy

International Journal for the Scholarship of Teaching & Learning

Centers for Teaching and Learning (CTLs) have long collaborated with academic librarians, especially around the Scholarship of Teaching and Learning, but full, reciprocal partnerships are relatively rare. This exploratory, interview- based study seeks to gain insight into how participants (n=4) experienced one such partnership, focused on building institutional capacity for engagement with scoping reviews in SoTL. Our findings reveal that these types of partnerships can have distinctive influences on participating faculty members that extend beyond a single program, service, or project. These insights illuminate the challenges and opportunities long-term partnerships present to both the institutionalization of SoTL and the evolving …

Reclaiming Democracy: Examining Disenfranchisement Laws And Policy Recommendations To Restore Voting Rights For Formerly Incarcerated People, Maeve Conte Jan 2024

Reclaiming Democracy: Examining Disenfranchisement Laws And Policy Recommendations To Restore Voting Rights For Formerly Incarcerated People, Maeve Conte

CMC Senior Theses

This paper examines the disenfranchisement of formerly incarcerated people and the steps by which they can participate in civic society again. It delves into the history of these laws, both in the United States and abroad, and the philosophies behind disenfranchisement. It then uses Florida’s Amendment 4 as a case study in current debates surrounding voting rights. After a literature review on voting, it assesses the voting population inside prisons in states that allow it and includes policy recommendations for these states. This thesis also applies interventions from the literature review to reduce the cost for formerly incarcerated people. Ultimately, …

Correcting Federal Rule Of Evidence 404 To Clarify The Inadmissibility Of Character Evidence, Hillel J. Bavli Jan 2024

Correcting Federal Rule Of Evidence 404 To Clarify The Inadmissibility Of Character Evidence, Hillel J. Bavli

Fordham Law Review

Courts misinterpret Federal Rule of Evidence 404(b)(2) as an exception to Rule 404(b)(1)’s prohibition on character evidence rather than a mere clarification that emphasizes the permissibility of other-acts evidence whose relevance does not rely on propensity reasoning. This misinterpretation turns the rule against character evidence on its head by effectively replacing Rule 404 with a Rule 403 balancing—and one that incorrectly treats character inferences as probative rather than prejudicial, thereby favoring admissibility rather than exclusion. Consequently, as currently interpreted, Rule 404(b)(2) generates substantial unpredictability and verdicts based on conduct not at issue in a case.

I therefore propose that the …

Eliminating Rule 609 To Provide A Fair Opportunity To Defend Against Criminal Charges: A Proposal To The Advisory Committee On The Federal Rules Of Evidence, Jeffrey Bellin Jan 2024

Eliminating Rule 609 To Provide A Fair Opportunity To Defend Against Criminal Charges: A Proposal To The Advisory Committee On The Federal Rules Of Evidence, Jeffrey Bellin

Fordham Law Review

Federal Rule of Evidence 609 authorizes the admission of prior convictions to impeach criminal defendants who testify. And in this important and uniquely damaging application, the [r]ule’s logic fails, distorting American trials and depriving defendants of a fair opportunity to defend against the charges. The Advisory Committee [on Evidence Rules (the “Advisory Committee”)] should propose the elimination of Rule 609 and prohibit cross-examination with specific instances of a criminal defendant’s past conduct when those instances are unrelated to the defendant’s testimony and unconnected to the case.

This short essay begins by setting out the proposed rule change alongside a proposed …

State Drug Laws, Mason Marks Jan 2024

State Drug Laws, Mason Marks

Fordham Law Review

States have long enacted drug laws that depart from federal laws and regulations. In the early twentieth century, several states prohibited marijuana while it remained federally unregulated. In the 1960s, states started criminalizing psychedelic substances. Shortly thereafter, in the early 1970s, they started reversing the trend to criminalize drugs by reducing or eliminating criminal penalties associated with personal marijuana use. State-level decriminalization accelerated in the 1990s and 2000s.

More recently, states have extended drug policy reforms to other substances, including psychedelics, stimulants, and opioids. Some states have eliminated criminal penalties while others have replaced criminal penalties with fines or diversion …

Right To Be Forgotten As A Legal Protection For The Victims Of Electronic Sexual Violence Cases, Putri Zaltina, Lidwina Inge Nurtjahyo Jan 2024

Right To Be Forgotten As A Legal Protection For The Victims Of Electronic Sexual Violence Cases, Putri Zaltina, Lidwina Inge Nurtjahyo

The Indonesian Journal of Socio-Legal Studies

The 2020 National Commission on Violence Against Women's Annual Records identified the rise of a new type of violence against gender in Indonesia, specifically electronic-based sexual violence (Kekerasan Seksual Berbasis Elektronik/KSBE) which is part of gender-based violence in the digital spaces or Online Gender-Based Violence (OGBV). In 2020, KSBE cases increased 300% compared to the previous year. So far, the arrangements for tackling KSBE perpetrators in Indonesia have been inadequate. Existing laws do not contain procedures that are sensitive to victims and lack a human rights and gender perspective. Currently, Indonesia has adopted a new regulation related to handling sexual …

Understanding Teacher Behavior And Its Influence On Student On-Task Behavior, Jennifer Birchler Jan 2024

Understanding Teacher Behavior And Its Influence On Student On-Task Behavior, Jennifer Birchler

Electronic Theses & Dissertations (2024 - present)

Student behavior in the classroom is a significant predictor of student outcomes and teacher satisfaction. But, teachers report classroom management to be challenging. Finding simple, cost-effective methods of improving student behavior in the classroom can vastly improve long-term success for students. This study seeks to better understand how class size relates to teacher praise and movement, and how these teacher behaviors relate to student on-task behavior. Previous research suggests on-task behavior improves with more teacher praise and movement in the classroom. The current study used data collected using the Bx Management Tool as part of the Osage County Fall 2019 …

Re/Descheduling Marijuana Through Administrative Action, Scott P. Bloomberg, Alexandra Harriman, Shane Pennington Jan 2024

Re/Descheduling Marijuana Through Administrative Action, Scott P. Bloomberg, Alexandra Harriman, Shane Pennington

Faculty Publications

In October 2022, President Biden requested that the Secretary of Health and Human Services and the Attorney General initiate a procedure to review how marijuana is scheduled under the federal Controlled Substances Act (“CSA”). The announcement was historic. After more than fifty years of federal prohibition, decades of advocacy and litigation from reform groups, and dozens of stalled efforts in Congress, a President finally decided to wield the Executive Power with an eye towards rescheduling or descheduling marijuana. But just how far does that power go? Given President Biden’s request, the question is in serious need of scholarly attention.
This …

Long Overdue: The Need For An Examination Of The Specter Of Racial Bias In The Federal Death Penalty System, John Nidiry, Ruth Friedman Jan 2024

Long Overdue: The Need For An Examination Of The Specter Of Racial Bias In The Federal Death Penalty System, John Nidiry, Ruth Friedman

Faculty Publications

The specter of racial bias in the federal government's administration of the death penalty over the past thirty-five years has been long apparent yet insufficiently scrutinized. Scholars have studied the racially disparate application of capital punishment at the state level and linked those disparities to a history of racialized violence. The federal death penalty, especially with regard to the impact of race, however, remains largely unexamined.
It is time to bridge this gap in the research on racial bias in the criminal justice system and in the implementation of the federal death penalty specifically. There are, as this Article sets …

School of Nursing & Midwifery, East Africa

As the COVID-19 pandemic spread across the world, immunocompromised individuals such as people with HIV (PWH) may have faced a disproportionate impact on their health and HIV outcomes, both from COVID-19 and from the strategies enacted to contain it. Based on the SPIRIT guidelines, we describe the protocol for an international multisite observational study being conducted by The International Nursing Network for HIV Research, with the Coordinating Center based at the University of California, San Francisco (UCSF) School of Nursing. Site Principal Investigators implement a standardized protocol to recruit PWH to complete the study online or in-person. Questions address demographics; …

A Phenomenological Exploration Of Intracommunity Attitudinal And Experiential Barriers To The Utilization Of Psychotherapeutic Services In Bipoc Populations, Jade Turner Jan 2024

A Phenomenological Exploration Of Intracommunity Attitudinal And Experiential Barriers To The Utilization Of Psychotherapeutic Services In Bipoc Populations, Jade Turner

Calvert Undergraduate Research Awards

This study used Interpretative Phenomenological Analysis to explore the role that intracommunity attitudes and beliefs and negative mental healthcare experiences play in determining treatment-seeking behavior in BIPOC communities. Through in-depth semistructured interviews, five participants shared their perspectives and experiences, providing rich and nuanced insight into the subjective landscape of mental healthcare avoidance among racial and ethnic minority populations. The analysis revealed five overarching themes (pray it away, isolated and invisible, fear, perceived importance of racial matching, and therapeutic experiences profoundly impact treatment-seeking) shedding light on the nuanced ways in which BIPOC individuals make sense of and navigate mental health within …
