As jurisdictions across the country grapple with the urgent need to redress the impact of mass incarceration, there has been renewed interest in reforms that reduce the harms punishment inflicts on women. These "gender-responsive" reforms aim to adapt traditional punishment practices that, proponents claim, were designed "for men." The push to change how we punish based on gender, while perhaps well intentioned, is misguided. As abolition feminist principles reveal, these gender-responsive practices not only reify traditional gender norms, but also strengthen the operation of the carceral state. From Suspension To Mass Incarceration: Punishment Of Student With Special Needs And The School-To-Prison Pipeline, Bailey Ellicott

Since their inception in the late 1980s, zero-tolerance policies have been a cornerstone of American school discipline. Passed by legislators with the intent of protecting school children, these policies have disparately upended the education of marginalized students. School discipline of vulnerable students often paves the way to juvenile incarceration, which in turn exponentially increases the likelihood of adult incarceration. Moreover, students with disabilities, especially students of color with learning disabilities, are often physically pushed out of their classrooms through suspensions and other harsh disciplinary policies. This is only made worse by the presence of law enforcement in schools, who treat …

The history of American civil rights is understood largely through the context of various mass movements. Most famously, the Civil Rights Movement of the 1950s and 1960s was a remarkable representation of collective action. The success of that movement becomes even more significant when considering the realities of life for Black Americans at the time. In the spirit of those movements, the 2010s and 2020s have brought about modern movements that continue to push against discrimination toward Black Americans and push for progress in the legal system. In the era of mass incarceration, it is vital to reexamine the prison system to identify not only its weaknesses, but its successes. Successes in correctional systems are often measured by a reduction in recidivism rates, and in states where restorative justice practices have been implemented in prisons, recidivism rates have exhibited a significant decrease, affirming the necessity of restorative justice practices in prisons. In 1994 the United States was faced with a domestic violence epidemic that led Congress to pass the Violence Against Women Act (VAWA). The Act was passed to respond to the needs of victims, particularly women, who are at the highest risk of victimization in crimes such as domestic violence and sexual assault. While domestic violence has been recognized as an important public health problem, most services provided are focused on after-the-fact interventions rather than prevention.
Many states, including Virginia, have since created domestic violence prevention programs, added preventative requirements to their state code, and tasked their respective Departments of …

In the early morning hours of February 21, 2022, a temporary detention order (“TDO”) was issued for a young girl from Giles County, Virginia, to admit her for psychiatric treatment during a mental health emergency. The minor, identified by the initials S.E., was staying at a residential treatment facility when Chesterfield County police officers drove her to Chippenham Hospital for an evaluation. S.E. was to be transported to the Commonwealth Center for Children and Adolescents in Staunton, Virginia, for treatment, but the center “asserted that it had no beds available and refused to accept S.E. as a patient.” Instead, S.E. …

Attention is given to civil liberties issues, which involve the procedural due process rights of criminally accused persons. Students undertake an intellectual journey through the criminal justice system to fortify their knowledge of the law and protections guaranteed under the Bill of Rights as they apply to the agencies that comprise the criminal justice system.

During the months of January through April 2, 2024, Department of Criminal Justice and Criminology (CJC) students from Salve Regina University in Newport, Rhode Island, conducted a survey on the performance of the Middletown Police Department (MPD) and its personnel. Of the 314 total responses received, 103 responses were received via online collection and 211 responses were received via survey letter response. Despite the foundational principle in the American criminal justice system that it is better to acquit the guilty than to convict the innocent, wrongful convictions remain a persistent issue. Wrongful convictions are sometimes caused by flawed evidence, such as eyewitness misidentifications and unreliable forensic techniques. Researchers and scholars have studied this problem of flawed evidence extensively, leading to many successful reform efforts to address this portion of the wrongful conviction problem. But there is another portion of the wrongful conviction problem that has yet to be the target of reform efforts—wrongful convictions caused by juror error. Implicit biases, forbidden assumptions, …

A Wolf In Sheep’S Attire: How Consent Enfeebles Our Fourth Amendment, Stephen E. Henderson, Guha Krishnamurthi

The Fourth Amendment is a mirage. On paper—in the rules studied by law students, analyzed by scholars, and proclaimed by jurists—its limitations are many and, oftentimes, significant. Yet the experience of large numbers of Americans is entirely to the contrary, thanks to the rights-annihilating, under-theorized exception of “consent.” Under its guise, law enforcement officers routinely conduct what would otherwise be constitutionally-restrained searches and seizures, and they do so without meaningful explanation or assent. Fortunately, change—whether legislative or (ideally) constitutional—could be straightforward. Thanks to other sufficient triggers, consent could be replaced by a narrow, rights-protective doctrine under which law enforcement could …

This essay sheds light on the systemic challenges faced by indigent, minority families within the child welfare system, using personal experiences from my time as a student at the University of Florida Levin College of Law as a lens. This essay aims to highlight the intersection of poverty, race, and the child welfare system, showing how these factors can hinder parents' ability to reunite with their children despite their best efforts. Public Accommodations Laws, Free Speech Challenges, And Limiting Principles In The Wake Of 303 Creative, Michael L. Smith

In 303 Creative LLC v. Elenis, the United States Supreme Court ruled that Colorado's Anti-Discrimination Act's prohibition of discrimination on the basis of sexual orientation violated the First Amendment rights of Lorie Smith, a website designer who refused to make wedding websites for same-sex couples. This Article argues that the Court's ruling rested on a vision of state control over speech that was divorced from the law before it. Using this framing of the law to conjure up inapplicable hypothetical scenarios of state-mandated expression, the Court found in Smith's favor. And yet, in responding to the dissent's concerns that the …

งานวิจัยเรื่อง “การตกเป็นเหยื่อของการสะกดรอยออนไลน์ในสังคมไทย” มีวัตถุประสงค์เพื่อศึกษาพฤติกรรมของผู้กระทำผิดและผู้ที่ตกเป็นเหยื่อการสะกดรอยออนไลน์ ศึกษาสภาพปัญหาของการตกเป็นเหยื่อและเสนอแนะแนวทางในการป้องกันการตกเป็นเหยื่อการสะกดรอยออนไลน์ในสังคมไทย เป็นงานวิจัยเชิงคุณภาพด้วยการศึกษาข้อมูลจากเอกสารและการสัมภาษณ์เชิงลึกผู้ที่ตกเป็นเหยื่อการสะกดรอยออนไลน์ จำนวน 4 คน และผู้เชี่ยวชาญที่มีความรู้ความสามารถเฉพาะทางและผู้ที่มีส่วนในการช่วยเหลือเหยื่อ จำนวน 8 คน ผลการศึกษา พบว่ารูปแบบพฤติกรรมของผู้กระทำผิด มี 3 ประการ ดังนี้ 1) การพยายามติดต่อสื่อสารอย่างต่อเนื่องและส่งข้อความที่ไม่พึงประสงค์ทางออนไลน์ 2) การนำข้อมูลของเหยื่อไปใช้ในทางที่มิชอบ และ 3) การนำข้อมูลที่เฝ้าติดตามทางออนไลน์ไปสะกดรอยในทางกายภาพ สาเหตุหรือแรงจูงใจที่นำไปสู่การกระทำความผิด ดังนี้ 1) ความสะดวกในการเข้าถึงข้อมูลส่วนบุคคลและการติดต่อเหยื่อได้โดยตรง 2) ความต้องการสร้างความสัมพันธ์บางประการ และ 3) ความโกรธแค้นเมื่อถูกปฏิเสธหรือความต้องการควบคุม พฤติกรรมของบุคคลที่นำไปสู่การตกเป็นเหยื่อการสะกดรอยออนไลน์ มี 2 ประการ ดังนี้ 1) การขาดความระมัดระวังในการเผยแพร่ข้อมูลบนสื่อสังคมออนไลน์ และ 2) ลักษณะทางกายภาพของเหยื่อ นอกจากนี้ผลการศึกษา สภาพปัญหาของการตกเป็นเหยื่อการสะกดรอยออนไลน์ มี 4 ประการ ดังนี้ 1) การขาดความตระหนักรู้ 2) สภาพของเทคโนโลยีและอินเทอร์เน็ต 3) การขาดกฎหมายหรือมาตรการเฉพาะที่ใช้กับการกระทำความผิด และ 4) ขาดบุคลากรที่มีความชำนาญเฉพาะทาง สำหรับแนวทางในการป้องกันการตกเป็นเหยื่อการสะกดรอยออนไลน์ ได้แก่ 1) การสอนมารยาทการใช้งานอินเทอร์เน็ต และสร้างความตระหนักรู้ในอันตรายจากการเผยแพร่ข้อมูลส่วนบุคคลแก่คนในสังคม 2) การเริ่มป้องกันจากตนเอง 3) การพัฒนาระบบกฎหมายและการบังคับใช้ และ 4) การพัฒนาบุคลากรให้มีความรู้ความชำนาญ และพัฒนาเครื่องมือทางเทคโนโลยีที่ช่วยสืบสวนการกระทำความผิดทางออนไลน์

การวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาสภาพปัญหาและสาเหตุการเล่นพนันคาสิโนออนไลน์ของเด็กและเยาวชนในพื้นที่กรุงเทพมหานคร การศึกษาวิจัยนี้เป็นการวิจัยเชิงคุณภาพ โดยดำเนินการเก็บข้อมูลจากเด็กและเยาวชน ในพื้นที่กรุงเทพมหานคร ที่เล่นพนันคาสิโนออนไลน์ จำนวน 15 คน ด้วยการสัมภาษณ์เชิงลึก รวมถึงการศึกษาจากเอกสาร และทำการวิเคราะห์ข้อมูลด้วยวิธีการวิเคราะห์สรุปอุปนัย ผลการวิจัยพบว่า 1.สภาพปัญหาการเล่นพนันคาสิโนออนไลน์ของเด็กและเยาวชนในพื้นที่กรุงเทพมหานครจำแนกได้เป็น 3 องค์ประกอบหลัก ได้แก่สาเหตุเรื่องของความล้าหลังและไม่ชัดเจนของกฎหมายที่ไม่ทันกับเทคโนโลยี รวมถึงการโฆษณาที่เข้าถึงเยาวชนได้ง่าย ทำให้ปัญหานี้ขยายตัวอย่างรวดเร็ว บริบทและสภาวะที่เกี่ยวข้องเกี่ยวกับความซับซ้อนทางวัฒนธรรม การทุจริตในระบบราชการ การพัฒนาเทคโนโลยี และวิถีชีวิตยุคใหม่ ล้วนส่งเสริมการเล่นพนัน และผลกระทบของปัญหานี้สร้างความเสียหายทั้งด้านการศึกษา จิตใจ สังคม และการเงินของเยาวชน การแก้ไขต้องอาศัยความร่วมมือจากครอบครัว โรงเรียน และสังคมในระยะยาว 2.สาเหตุการเล่นพนันคาสิโนออนไลน์ของเด็กและเยาวชนในกรุงเทพมหานครสามารถแบ่งเป็น 3 ปัจจัยหลัก ได้แก่ ปัจเจกบุคคล จิตวิทยา และสังคม พบว่าเยาวชนมักตัดสินใจเล่นพนันโดยประเมินความเสี่ยงและผลตอบแทนที่คาดว่าจะได้รับ โดยอาจได้รับอิทธิพลจากการเลียนแบบพฤติกรรมในสื่อออนไลน์หรือกลุ่มเพื่อน การโฆษณาที่ดึงดูด และการเสริมกำลังทั้งทางบวกและลบ นอกจากนี้ ปัจจัยทางสังคม เช่น ความสัมพันธ์ที่ไม่แข็งแรงกับครอบครัว การขาดกิจกรรมสร้างสรรค์ หรือความรู้สึกว่างเปล่าทางจิตใจ ล้วนมีส่วนผลักดันให้เยาวชนเข้าสู่วงจรการพนันออนไลน์มากขึ้น

การศึกษาเรื่อง กระบวนการยุติธรรมในการใช้มาตรการคุ้มครองสวัสดิภาพผู้ถูกกระทำด้วยความรุนแรงในครอบครัวต่อกลุ่มคนรุ่นใหม่ (Gen-Z) ของศาลเยาวชนและครอบครัวภายใต้บริบทสังคมไทย มีวัตถุประสงค์เพื่อศึกษาถึงทัศนะ มุมมอง ความเชื่อ ค่านิยม ของกลุ่มคนรุ่นใหม่ (Gen-Z) ต่อสถาบันครอบครัว และความรุนแรงในครอบครัว และศึกษาถึงทัศนะ มุมมอง ความเชื่อ ค่านิยม ของ บิดา มารดา ผู้ปกครอง ผู้กระทำความรุนแรง และผู้ถูกกระทำความรุนแรงที่เป็นกลุ่มคนรุ่นใหม่ (Gen-Z) ที่เข้าสู่กระบวนการคุ้มครองสวัสดิภาพของศาลเยาวชนและครอบครัว ตลอดจนศึกษาบทบาทการดำเนินงาน และปัญหาอุปสรรคของกระบวนการยุติธรรมของศาลเยาวชนและครอบครัวในการคุ้มครองสวัสดิภาพบุคคลที่ถูกกระทำด้วยความรุนแรงในครอบครัว เพื่อความเข้าใจและพัฒนาแนวทางแก้ไขป้องกันความรุนแรงในครอบครัว โดยวิธีการในการดำเนินการวิจัยเป็นแบบผสมผสาน คือการวิจัยเชิงปริมาณผ่านการสำรวจความคิดเห็นกลุ่มคนรุ่นใหม่ (Gen-Z) ที่กำลังศึกษาอยู่ในระดับมหาวิทยาลัย 400 คน และการวิจัยเชิงคุณภาพด้วยการวิเคราะห์และสังเคราะห์ข้อมูลจากการสัมภาษณ์เชิงลึก ผู้กระทำความรุนแรงในครอบครัวซึ่งเป็นบิดามารดาหรือผู้ปกครอง และ ผู้ถูกกระทำด้วยความรุนแรงในครอบครัวที่เป็นกลุ่มคนรุ่นใหม่ (Gen-Z) ซึ่งเป็นบุตรหรือผู้อยู่ภายใต้การปกครอง ตลอดจนผู้ที่เกี่ยวข้องในกระบวนการยุติธรรมในการใช้มาตรการคุ้มครองสวัสดิภาพของศาลเยาวชนและครอบครัวผลการศึกษาพบว่าทัศนะของกลุ่มคนรุ่นใหม่ Gen-Z ส่วนใหญ่มีพื้นฐานความเชื่อ ค่านิยมต่าง ๆ เกี่ยวกับครอบครัวคล้ายกับคนในยุคก่อน โดยยังเห็นว่าครอบครัวมีความสำคัญ แต่มีการรับรู้ถึงสิทธิมนุษยชนขั้นพื้นฐานในครอบครัวที่ไม่ควรมีการละเมิดทั้งทางร่างกายและจิตใจเด่นชัดขึ้น และส่วนหนึ่งมีมุมมองสะท้อนให้เห็นภาพสถาบันครอบครัวที่แตกต่างออกไป เช่น บ้านไม่ใช่พื้นที่ปลอดภัย พ่อแม่ไม่ควรคาดหวังให้ลูกมาดูแลในวัยชรา เป็นต้น ซึ่งเป็นมุมมองไปทางเดียวกันกับผู้ถูกกระทำความรุนแรงที่เข้าสู่กระบวนการคุ้มครองสวัสดิภาพของศาลเยาวชนและครอบครัวได้แสดงมุมมองต่อศาลหรือบุคคลในกระบวนการยุติธรรม สำหรับผู้กระทำความรุนแรงนั้น ส่วนใหญ่จะคิดว่าการกระทำของตนเองไม่เป็นความรุนแรง แต่เมื่อเข้าสู่กระบวนการและปฏิบัติตามคำสั่งศาลที่ออกเพื่อช่วยยับยั้งไม่ให้กระทำความรุนแรง และเพื่อแก้ไขบำบัดฟื้นฟูแล้ว ก็ยอมรับว่าช่วยให้สถานการณ์ในครอบครัวดีขึ้นสามารถเดินหน้าต่อไปได้ สะท้อนว่าบริบทของความรุนแรง ในครอบครัวได้เปลี่ยนแปลงไปตามแนวคิดใหม่ ซึ่งผู้ที่เกี่ยวข้องในกระบวนการยุติธรรมในเรื่องนี้ต้องทบทวนและตระหนักถึงบริบทที่แปรเปลี่ยนไปดังกล่าวเพื่อสร้างสมดุลและสันติภาพภายในบ้าน อีกทั้งในระดับ มหภาคเพื่อช่วยกันรณรงค์ หรือกำหนดนโยบาย หรือกฎหมาย เพื่อสร้างสรรค์สังคมที่สงบสุขไร้ความรุนแรงอย่างยั่งยืน

การวิจัยเรื่อง “แนวทางในการเพิ่มประสิทธิภาพการป้องกันการเปิดบัญชีม้าของเด็กและเยาวชน” มีวัตถุประสงค์ 1) เพื่อศึกษาสภาพปัญหา และสาเหตุการเปิดบัญชีม้าของเด็กและเยาวชน 2) เพื่อศึกษาปัญหาและอุปสรรคในการป้องกันปราบปรามการเปิดบัญชีม้าของเด็กและเยาวชน 3) เพื่อเสนอแนะแนวทางในการเพิ่มประสิทธิภาพการป้องกันการเปิดบัญชีม้าของเด็กและเยาวชน โดยอาศัยข้อมูลจากการวิจัยเชิงคุณภาพและใช้การสัมภาษณ์เชิงลึกกับผู้ให้ข้อมูลสำคัญจำนวน 15 คน โดยแบ่งออกเป็น 4 กลุ่ม ได้แก่ เจ้าหน้าที่รัฐที่มีหน้าที่ออกมาตรการทางกฎหมาย เจ้าหน้าที่บังคับใช้กฎหมาย พนักงานธนาคาร และผู้เชี่ยวชาญด้านเด็กและเยาวชน ผลการศึกษาพบว่า ปัจจัยที่ส่งผลให้เด็กและเยาวชนตกเป็นเหยื่อบัญชีม้า มีปัจจัยสำคัญ 3 ประการ ได้แก่ 1) การขาดความรู้ความเข้าใจเกี่ยวกับอาชญากรรมทางการเงินและผลกระทบของการเป็นบัญชีม้า 2) การขาดการดูแลและคำแนะนำจากครอบครัว ทำให้เยาวชนถูกชักจูงได้ง่าย และ 3) แรงจูงใจทางเศรษฐกิจที่เด็กและเยาวชนได้รับค่าตอบแทนเป็นที่น่าดึงดูด อย่างไรก็ตาม ผลการศึกษายังชี้ให้เห็นถึงความสำคัญของบทบาทผู้ปกครองและหน่วยงานรัฐในการให้ความรู้และการเสริมสร้างภูมิคุ้มกันให้แก่เด็กและเยาวชน รวมถึงการกำหนดนโยบายที่ชัดเจนและครอบคลุม เช่น การจำกัดการเปิดบัญชีใหม่เพื่อป้องกันการกระทำผิด การวิจัยนี้เสนอแนวทางป้องกันเด็กและเยาวชนจากการตกเป็นเหยื่อบัญชีม้า โดยการให้ความรู้เกี่ยวกับภัยที่อาจเกิดขึ้น รวมถึงการเสริมสร้างทักษะการคิดวิเคราะห์และการระวังภัยทางการเงินให้แก่เยาวชนอย่างเหมาะสมเพื่อเป็นการลดปัจจัยเสี่ยงและเสริมสร้างภูมิคุ้มกันให้เยาวชนไทย

การวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาและวิเคราะห์การนำเทคโนโลยีปัญญาประดิษฐ์ (AI) มาใช้ในการป้องกันอาชญากรรมบนท้องถนน (Street Crime) รวมถึงการระบุปัญหาและข้อจำกัดในการใช้งานเทคโนโลยีดังกล่าว เพื่อเสนอแนะแนวทางที่มีประสิทธิภาพสำหรับการป้องกันอาชญากรรมบนท้องถนนในบริบทของกองบัญชาการตำรวจนครบาล โดยเป็นการวิจัยเชิงคุณภาพ (Qualitative Research) ที่ใช้ทั้งการศึกษาข้อมูลจากเอกสาร (Documentary Research) และการสัมภาษณ์เชิงลึก (In-depth Interview) กลุ่มตัวอย่างที่ศึกษาเป็นกลุ่มเฉพาะเจาะจง (Purposive Sampling) ประกอบด้วยเจ้าหน้าที่ตำรวจผู้ปฏิบัติหน้าที่ นักอาชญาวิทยา นักพัฒนาเทคโนโลยี AI นักวิชาการเทคโนโลยี AI และนักกฎหมายด้านเทคโนโลยี AI รวมจำนวน 13 คน ผลการวิจัยพบว่า AI ไปใช้ในการป้องกันอาชญากรรมบนท้องถนน (Street crimes) ได้ 4 ประการ ดังนี้ 1. การวิเคราะห์ข้อมูล จากกล้องวงจรปิด (CCTV Analytics) 2. การจดจำใบหน้า (Facial Recognition) 3. การติดตามยานพาหนะ (Vehicle Tracking) 4.การยับยั้งและข่มขู่ผู้กระทำความผิดด้วย การติดตั้งกล้องวงจรปิด สำนักงานตำรวจแห่งชาติได้เริ่มนำ AI มาใช้ในพื้นที่นำร่องบางแห่งในกรุงเทพมหานคร แต่ยังไม่ได้ขยายการใช้งานให้ครอบคลุมทั่วประเทศ ประเทศไทยยังขาดความพร้อมในหลายด้านสำหรับการนำ AI มาใช้ในการป้องกันอาชญากรรม การทำงานร่วมกันระหว่างมนุษย์และ AI สามารถเพิ่มประสิทธิภาพในการป้องกันอาชญากรรมได้ดีกว่าการใช้อย่างใดอย่างหนึ่งเพียงลำพัง อีกทั้งการติดตั้งกล้องวงจรปิดที่ทำงานร่วมกับ AI ยังช่วยยับยั้งอาชญากรรมผ่านผลทางจิตวิทยาต่อผู้กระทำผิด อย่างไรก็ตาม การนำเทคโนโลยี AI มาใช้ยังมีปัญหาและข้อจำกัดสำคัญ เช่น ปัญหาอุปสรรคของการป้องกันอาชญากรรมโดยใช้เทคโนโลยีปัญญาประดิษฐ์ 1) ความแม่นยำของ AI 2) ด้านกฎหมาย งบประมาณในการติดตั้งระบบ AI และกล้องวงจรปิด การฝึกอบรมเจ้าหน้าที่ตำรวจให้สามารถใช้งานเทคโนโลยีนี้ได้อย่างมีประสิทธิภาพ ความเสี่ยงต่อการเกิดอคติ (bias) การวิจัยนี้จึงข้อเสนอแนะอาทิ สำนักงานตำรวจแห่งชาติกำหนดนโยบายในการวิเคราะห์สถิติการเกิดอาชญากรรมในแต่ละกองบังคับการตำรวจนครบาลและกำหนดพื้นที่ที่มีอัตราการเกิดอาชญากรรมสูงเพื่อทดลองใช้ AI ในการตรวจจับและป้องกันอาชญากรรม รวมทั้งการพัฒนาระบบ AI และการสร้างกรอบการทำงานที่เหมาะสมเพื่อสนับสนุนการใช้งานอย่างยั่งยืนและมีประสิทธิภาพในบริบทของการป้องกันอาชญากรรมในประเทศไทย

Over the course of a three-year, collaborative process that was open to the public, the Uniform Law Commission (ULC) and the American Law Institute (ALI) undertook a project to revise the Uniform Commercial Code (UCC) to account for the impact of emerging technologies on commercial transactions. The amendments, approved jointly by the ULC and ALI in July 2022, touch on aspects of the entire UCC, but one change has inspired ire and attracted national media attention: a proposed revision to the definition of “money.” The 2022 UCC Amendments alter the definition of “money” to account for the introduction of central …
