Barriers And Bridges To Well-Being For Latinx Immigrant Youth In A New Latinx Destination: A Digital Narrative Inquiry, Jenn M. Lilly Jan 2024

Barriers And Bridges To Well-Being For Latinx Immigrant Youth In A New Latinx Destination: A Digital Narrative Inquiry, Jenn M. Lilly

Social Service Faculty Publications

An increasing number of Latinx young people in the United States are facing unique challenges to attaining and maintaining well-being as residents of new Latinx destinations. This study analyzes the testimonios of 12 Latinx immigrant youth (aged 18–21) who participated in a digital narrative research project in New Orleans – a new Latinx destination in the US South. Findings are interpreted and discussed through the lens of the Phenomenological Variant of Ecological Systems Theory (PVEST), revealing Latinx young people’s perspectives on the barriers to experiencing well-being, the “bridges” that helped them to experience well-being despite those barriers, and the ways …

Assertive Community Treatment As An Alternative To Incarceration For American Pretrial Detainees, Brian Zampella, Simone Talton, Jonathan Lam, Anzalee Khan, Tuborah Bryant, Michal Kunz Jan 2024

Assertive Community Treatment As An Alternative To Incarceration For American Pretrial Detainees, Brian Zampella, Simone Talton, Jonathan Lam, Anzalee Khan, Tuborah Bryant, Michal Kunz

Social Service Faculty Publications

In the United States and elsewhere around the world, people with serious mental illness (SMI) are overrepresented in the criminal justice system. Clinical interventions to divert such individuals out of correctional settings, including Assertive Community Treatment (ACT), have been shown to reduce rates of criminal justice recidivism when modified to allow for the use of court sanctions to encourage treatment adherence. However, these interventions are noted to be underutilized as alternative to incarceration (ATI) programs. This paper summarizes the results of a retrospective cohort study conducted in a New York State forensic psychiatric hospital of 87 pretrial detainees admitted after …

Considering A Unified Model Of Artificial Intelligence Enhanced Social Work: A Systematic Review, Michael Garkish, Lauri Goldkind Jan 2024

Considering A Unified Model Of Artificial Intelligence Enhanced Social Work: A Systematic Review, Michael Garkish, Lauri Goldkind

Social Service Faculty Publications

Social work, as a human rights–based profession, is globally recognized as a profession committed to enhancing human well-being and helping meet the basic needs of all people, with a particular focus on those who are marginalized vulner- able, oppressed, or living in poverty. Artificial intelligence (AI), a sub-discipline of computer science, focuses on develop- ing computers with decision-making capacity. The impacts of these two disciplines on each other and the ecosystems that social work is most concerned with have considerable unrealized potential. This systematic review aims to map the research landscape of social work AI scholarship. The authors analyzed the …

From Serial To Subreddit: An Analysis Of Modern True Crime And Web Sleuths, Alyssa T. Compton Jan 2024

From Serial To Subreddit: An Analysis Of Modern True Crime And Web Sleuths, Alyssa T. Compton

English Dissertations - Archive

In this dissertation, I assert that the rise of the internet and social media has exacerbated the ethical concerns already present in true crime media. This dissertation argues that true crime web sleuths operate as an effective public, shaping the true crime archive and the genre itself. The aim of this project is to explore the lack of borders between the role of consumers, content creators, web sleuths, and media outlets. Via communication, affect, and archival theory I propose that modern true crime is dependent upon consumers ability to easily slip into the role of producer and vice versa. In …

Reports On The Cost Of Administration Of Criminal Justice In Omaha And Lincoln, Nebraska, 1933: A Facsimile Edition & Contextual Casebook., Hattie Plum Williams, Michael R. Hill, Mary Jo Deegan

Zea E-Books Collection

The professional life of Hattie Plum Williams (1878–1963) epitomized the first generation of professional women sociologists on the Great Plains. At the University of Nebraska, she became the first woman in the world known to hold a regular appointment as chair of a coeducational, doctoral department of sociology (1923–1928). Often characterized as a social worker, her professional allegiance remained to sociology. Williams’ unsung labors in the early 1930s on behalf of the National Commission on Law Observance and Enforcement (NCLOE) resulted in two detailed, typewritten accounts of crime and criminal justice in Omaha and Lincoln, Nebraska. Her data collection, along …

Wrongful Convictions, Wrongful Prosecutions And Wrongful Detentions In India, Kent Roach Jan 2024

Wrongful Convictions, Wrongful Prosecutions And Wrongful Detentions In India, Kent Roach

National Law School of India Review

The first part of this article examines wrongful convictions in India. In part because of the absence of a jury, appellate courts, including the apex court, are more willing to evaluate whether the evidence for a conviction is sufficient than appellate courts in other common law systems. From 2016 to 2022, the High Courts and the Supreme Court have acquitted over two hundred accused in death penalty cases alone. The willingness of appellate courts to acquit is a strength of the Indian system that should be maintained. At the same time, remedied wrongful convictions in India likely represent only the …

The Trials Of Bail: Pre-Trial Presumption Of Innocence Under The Unlawful Activities (Prevention) Act, 1967 And General Criminal Laws, Radhika Chitkara Jan 2024

The Trials Of Bail: Pre-Trial Presumption Of Innocence Under The Unlawful Activities (Prevention) Act, 1967 And General Criminal Laws, Radhika Chitkara

National Law School of India Review

The crisis of undertrial prisoners in India, constituting three-fourths of the total prison population, has occasioned a normative recognition of the relationship between bail and the presumption of innocence (‘PoI’). The same recognition, however, does not extend to special criminal laws such as the UAPA, where almost every single prisoner is an undertrial on account of provisions prohibiting grant of bail. With a focus either on outcomes (prison population) or exceptions (national security considerations), the jurisprudential relationship between bail and PoI per se remains underexplored under both the general and special criminal legal regimes. At issue is the ‘thin’ conception …

Universal Civil Jurisdiction And International Law: A Response To B.S. Chimni, Chimène Keitner Jan 2024

Universal Civil Jurisdiction And International Law: A Response To B.S. Chimni, Chimène Keitner

National Law School of India Review

The exercise of various forms of jurisdiction, and the delineation of a political entity’s jurisdictional reach over persons, places, and conduct, can sharpen and entrench inequities within and between states. One can thus aptly characterize certain exercises of jurisdiction, and particularly certain forms of extraterritorial jurisdiction, as assertions of imperial and/or hegemonic power. Importantly, however, jurisdiction can also be invoked to redress certain power inequities by providing access to judicial remedies for conduct that has evaded other forms of regulatory control. In addition, while certain assertions of extraterritorial prescriptive jurisdiction can represent overreaching by powerful states, the practice of disclaiming …

Colonialism, Jurisdiction, And Sovereignty In Palestine, Usha Natarajan Jan 2024

Colonialism, Jurisdiction, And Sovereignty In Palestine, Usha Natarajan

National Law School of India Review

Knowledge production is never neutral, and academia – much like international laws and institutions among other social structures – is a key conduit for the efficient operations of power. Israel’s longstanding occupation and settler colonialism in Palestine challenges mainstream accounts of the international laws of jurisdiction, whereas Chimni’s TWAIL analysis better accounts for and predicts the imperial operations of such laws and points to fruitful evolution towards fairness and justice.10 I elaborate by considering firstly the exercise of jurisdiction during occupation and settler colonialism, and secondly the exercise of universal jurisdiction by states. I conclude with some thoughts on jurisdiction …

Charting Extraterritoriality: Jurisdiction, Corporate Conduct, And Environmental Harm, Kalika Mehta Jan 2024

Charting Extraterritoriality: Jurisdiction, Corporate Conduct, And Environmental Harm, Kalika Mehta

National Law School of India Review

Chimni’s TWAIL critique of the principle of jurisdiction, the subject of this symposium, implicates its development with the evolution of capitalism. Against this backdrop, this paper uniquely focuses on international criminal law and the selective application of principle of extraterritorial jurisdiction, particularly its exclusion of corporate entities from prosecution for large-scale violence. Through an analysis that engages with Chimni’s critique, the paper illustrates how these extraterritorial prosecutions align with the mainstream liberal theory of jurisdiction, while also exposing gaps in corporate accountability. Further, the paper contributes to ongoing legal reform debates by exploring the proposed international crime of ecocide, a …

Ghost-Hunting In Al And The Law, Meghan J. Ryan

Faculty Journal Articles and Book Chapters

Generative AI is booming. This technology offers amazing opportunities for growth in various business sectors and creates the opportunity for swift progress on medical innovations, climate change, world hunger, and innumerable other areas. AI also poses a number of challenges, though, such as replacing human workers and exacerbating pernicious biases. Another major concern about generative AI is singularity-the idea that this technology could surpass human intelligence and subjugate us or render us extinct. Although some commentators discount this possibility, the fact that AI experts such as Geoffrey Hinton, Sam Altman, and Elon Musk share the singularity concern should at least …

A New Approach To Attorney Regulation, Jon J. Lee Jan 2024

A New Approach To Attorney Regulation, Jon J. Lee

Faculty Articles

For more than half a century, jurisdictions have relied on threats of disciplinary sanctions—sticks—to try to coerce attorneys to act in an ethical manner. In doing so, they have focused their efforts on establishing minimum standards of practice and sanctioning only those attorneys who fall well short of them. By crafting general rules that apply to all attorneys, however, jurisdictions have ignored the considerable differences that attorneys face as a result of their practice settings, years of experience, or individual identities. Furthermore, jurisdictions have struggled to establish clear standards to guide attorneys regarding their obligations—precisely because the settings in which …

The Common Political Foundations Of Originalism And Cost-Benefit Analysis, Jonathan S. Masur, Eric A. Posner Jan 2024

The Common Political Foundations Of Originalism And Cost-Benefit Analysis, Jonathan S. Masur, Eric A. Posner

Coase-Sandor Institute for Law & Economics Research Paper Series

Cost-benefit analysis (CBA) and originalism are rarely discussed together, and seem to belong to different worlds of legal scholarship. The two methods are used by different institutions in different spheres of law for different purposes; what could they have in common? Nothing, or so it would seem. Yet closer inspection reveals surprising commonalities—both in terms of structure and function, on the one hand, and in historical pedigree and political economy, on the other. CBA and originalism are what we will call midlevel legal methods. Midlevel legal methods are neither normative commitments nor legal doctrines, but recurrently used methodologies that are …

The New Outlawry, Darrell Miller, Jacob Charles Jan 2024

The New Outlawry, Darrell Miller, Jacob Charles

Articles

From subtle shifts in the procedural mechanics of self-defense doctrine to substantive expansions of justified lethal force, legislatures are delegating larger amounts of “violence work” to the private sphere. These regulatory innovations layer on top of existing rules that broadly authorize private violence—both defensive and offensive—for self- protection and the ostensible maintenance of law and order. Yet such significant authority for private violence, and the values it projects, can have tragic real-world consequences, especially for marginalized communities and people of color.

We argue that these expansions of private violence tap into an ancient form of social control—outlawry: the removal of …
