Eliminating Bias In The Courtroom? A Content Analysis Of Judges’ Opinions Regarding Implicit Bias Training, Teyah S. Giannetta, Audrey L. Cerfoglio, Monica K. Miller
Eliminating Bias In The Courtroom? A Content Analysis Of Judges’ Opinions Regarding Implicit Bias Training, Teyah S. Giannetta, Audrey L. Cerfoglio, Monica K. Miller
University of Memphis Law Review
The threat of implicit biases in people’s decision making is increasing. Unlike explicit biases, implicit biases are more covert and harder to identify. Research on implicit bias has increased substantially over the past few decades due to increasing disparities within the legal and criminal justice systems. Disparities result in minorities and underrepresented populations suffering due to the unjust decision-making of courtroom players. Previous research on implicit bias states that the more education a person receives about their biases, the less likely those biases will impact their decisions. To combat these disparities, we recommend implementing implicit bias training to reduce implicit …
The Construction Of Victimhood In Human Trafficking Intervention Courts, Lauren Moton
The Construction Of Victimhood In Human Trafficking Intervention Courts, Lauren Moton
Dissertations, Theses, and Capstone Projects
Human trafficking intervention courts (HTICs), specialty courts in the US designed to connect trafficking victims to services when they are arrested, require defendants to identify as victims of human trafficking in order to qualify for HTICs' services and other social supports. However, some defendants may be autonomously trading sex, thereby raising questions about the meaning of the term "victim" within HTICs. Therefore, my study asks the following: a) at the institutional level, how do HTICs’ rules, norms, procedures, and stakeholders implement and give meaning to the “victim” label, and why?; and b) at the individual level, how do people who …
Making Sense Of Making Parole In New York, Alexandra Mcglinchy
Making Sense Of Making Parole In New York, Alexandra Mcglinchy
Dissertations, Theses, and Capstone Projects
For many individuals incarcerated in New York, the initial step toward freedom begins with an interview with the Board of Parole. This process, however, is frequently a complex and challenging one, characterized by repeated denials and extended incarcerations. The disparity in outcomes – where one individual may receive over 20 denials and another is granted parole on their first attempt – highlights the ambiguity and inconsistency in the parole decision-making process. This project aims to clarify the factors that influence parole decisions by concentrating on measurable variables. These include age, race, duration of sentence served, proportion of sentence served, type …

Expanding Equality, Terry Skolnik
Expanding Equality, Terry Skolnik
Dalhousie Law Journal
Section 15 of the Canadian Charter provides a constitutional right to equality. But the Supreme Court of Canada has interpreted this right restrictively. Today, the Constitution fails to protect certain individuals and groups against obvious forms of direct and indirect discrimination. This article argues that s. 15 of the Charter is interpreted narrowly in three respects and advances proposals to expand the right to equality. First, the right to equality framework fails to protect marginalized persons and groups against direct discrimination. Second, courts overlook how individuals can suffer discrimination based on quasi-immutable traits, which are personal characteristics that are relatively …
Reimagining Public Safety: Defining “Community” In Participatory Research, Naomi Levy, Amy E. Lerman, Peter Dixon
Reimagining Public Safety: Defining “Community” In Participatory Research, Naomi Levy, Amy E. Lerman, Peter Dixon
Political Science
In the context of a national movement to defund police departments, many American cities are starting to reimagine public safety, as activists demand new practices that maintain safety while minimizing harm, as well as ensuring accountability when harms occur. Drawing on Everyday Peace Indicators methodologies, we argue that “community-centered” measurement, combined with researcher-practitioner partnerships, can help move both researchers and policymakers toward a more meaningful approach to policy design and evaluation. However, the application of community-centered measurement to the context of American policing raises important theoretical and practical concerns—in particular, the question of how community is defined, and who gets …
A State For Second Chances: Utah’S Clean Slate Legislation, Madelynn Woolf
A State For Second Chances: Utah’S Clean Slate Legislation, Madelynn Woolf
Utah Law Review
Utah’s Clean Slate Act and the wave of similar legislation across the country provide a much-needed change to the traditional method of expungements that left many still facing heavy collateral consequences. Utah’s first pass at this legislation struck a good balance, evidenced by bipartisan support. It does not eliminate responsibility for one’s actions, but “[t]hose who violate the law and then pay their debt to society should not be punished indefinitely for the rest of their lives.” This reflects the broader “vision of America, then and now . . . a land of second chances, where one could make a …
The Corporate Right To Bear Arms, Robert E. Wagner
The Corporate Right To Bear Arms, Robert E. Wagner
William & Mary Business Law Review
The ability of a corporation to exercise constitutional protections has been rife with uncertainty and change since the conception of corporate rights came into existence. The history and rapid development of the corporation, combined with the misapplied and misunderstood “corporate personhood” theory, have resulted in an almost unintelligible hodgepodge of corporate constitutional applications. Similarly, the concept of the right to bear arms has equally been muddled and applied very differently at varying times and locations since before the establishment of the Second Amendment. This Article attempts to clarify how an alternative to the “corporate personhood” theory, namely the “purpose” theory …

Intro: The high rates of gun violence in the United States are a recognized public health concern with increased attention since the 1990′s. The predominant studies used in gun violence research have been epidemiological approaches and quantitative analyses. This study, instead, examines lived experiences of gunshot wound survivors to better understand their situations. This study also compared the different census categories and their types of gunshot wound injuries. Ethnographic informed analyses may inform public health interventions to decrease firearm injuries. Methods: Data was collected through a series of semi-structured interviews at the emergency department of an urban, Level-1, academic trauma …

Urban life shapes the mental health of city dwellers, and although cities provide access to health, education and economic gain, urban environments are often detrimental to mental health1,2. Increasing urbanization over the next three decades will be accompanied by a growing population of children and adolescents living in cities3. Shaping the aspects of urban life that influence youth mental health could have an enormous impact on adolescent well-being and adult trajectories4. We invited a multidisciplinary, global group of researchers, practitioners, advocates and young people to complete sequential surveys to identify and prioritize the characteristics of a mental health-friendly city for …

Reimagining The Criminal Legal System To Create A More Equitable Society, The Benjamin L. Hooks Institute For Social Change
The Hooks Institute Policy Papers
The policy papers in this edition help us begin to answer Ruth Wilson Gilmore’s pertinent question: “Instead of asking whether anyone should be locked up or go free, why don’t we think about why we solve problems by repeating the kind of behavior that brought us the problem in the first place?” The series is arranged intentionally to engage with the criminal legal system from beginning to end—from its roots, to its policies and ideologies, to its lasting effects. Each paper focuses on one critical issue in the criminal legal system in the United States, and then presents a set …
Prospective Hires: Examining Ex-Offender Stigma Effects On Employment, Amanda Neff
Prospective Hires: Examining Ex-Offender Stigma Effects On Employment, Amanda Neff
Justice Studies Theses
Formerly incarcerated persons face many barriers upon being released from prison–one of which is gaining employment. Obtaining a job can be difficult due to employers’ perceived employability of those who have been involved in the justice system. Organizational and personal characteristics of employers have been found in previous research to impact how likely an employer is to hire formerly incarcerated individuals. This thesis examines how stigma surrounding formerly incarcerated persons is perceived by employers through quantitatively examining employer demographics and their willingness to hire these individuals. This study used a mixed-model randomized sampling method for surveying employers in Bristol, Central …
Preserving The Futures Of Young Offenders: A Proposal For Federal Juvenile Expungement Legislation, Amelia Tadanier
Preserving The Futures Of Young Offenders: A Proposal For Federal Juvenile Expungement Legislation, Amelia Tadanier
William & Mary Law Review
Picture a sixteen-year-old named Sam. Perhaps this person reminds you of yourself as a teenager. Now imagine that Sam has made a terrible mistake and is arrested for cocaine possession. Perhaps they got the drugs from another kid at school or from a family member. But now Sam has a federal criminal record, which is likely to stick with them for life.
[...]
This Note argues that federal courts should have the power to expunge juvenile records in cases like Sam’s. It advocates for legislation granting federal courts the power to expunge the criminal records of offenders who were under …

Bad Attempts, Andrew Jensen Kerr
Bad Attempts, Andrew Jensen Kerr
Emory Law Journal Online
We assume that legal concepts are generic and indifferent to facts. But bad attempts at crime (something always unlawful) and bad attempts at art (something almost always lawful) are potentially treated very differently in many U.S. jurisdictions. Surprisingly, the bad attempt at art might be more likely to result in punishment. I draw on notions of capacity and responsibility to suggest why the amateur rapper should be excused for genuine aesthetic attempts that are perceived as threatening. In doing so, I comment on form and formalism in public law, and how principles of criminal law can help to maintain the …

Research networks encourage team science and facilitate collaboration within and across research teams. While many analyses have examined the output of these collaborative networks (e.g., authorship networks, publications, grant applications), less attention has been paid to the formative phases of these initiatives. This article presents analyses of a whole-network survey of investigators participating in a new research initiative, and examines the development of collaborative ties over the network's first year. In particular, we examine the influence of research center affiliation, seniority, and prior network experience on the number and structure of collaborative ties, including participants' bridging and broker roles. Such …

The Criminal Justice System’S Impact On Marginalized Communities And Efforts To Promote Equity And Justice, Derek Moore
The Criminal Justice System’S Impact On Marginalized Communities And Efforts To Promote Equity And Justice, Derek Moore
Tampa Library Faculty and Staff Publications
This study examines the profound implications of criminal justice systems on marginalized communities. It also explores the numerous efforts to augment equity and justice within the systems. This paper critically analyzes the primary factors contributing to the disproportionate representation of marginalized persons within the criminal justice system, like system prejudices, racial categorization, and socio-economic inequities. The article accentuates the detrimental impacts of the disparities on marginalized populations, like perpetuating poverty cycles, stigmatization, and limited access to prospects. The paper examines the role played by mandatory minimum sentencing, cash bail, police militarization, and restorative justice. The article adopts a qualitative literature …
