Who Needs Freedom Of Religion?, James W. Nickel Jan 2005

Who Needs Freedom Of Religion?, James W. Nickel

Articles

This article proposes that we view freedom of religion as a specific application area of more general basic liberties such as freedoms of thought, expression, association, assembly, movement, privacy, political participation, and economic activity. Separate enumeration of freedom of religion in national and international bills of rights may be useful, but it is not indispensable. In this respect freedom of religion is more like scientific freedom or artistic freedom than like freedom of expression. Recognizing that separate enumeration of freedom of religion is dispensable has salutary consequences for how we conceive and justify freedom as it applies to religion. First, …

Grutter's First Amendment, Paul Horwitz Sep 2004

Grutter's First Amendment, Paul Horwitz

University of San Diego Public Law and Legal Theory Research Paper Series

Most of the reaction to the Supreme Court's decision affirming the law school affirmative action policy at issue in Grutter v. Bollinger has focused on its Fourteenth Amendment implications. But Grutter also raises significant First Amendment issues. By reaffirming a First Amendment value of "educational autonomy," the Grutter Court raised a host of questions with implications not only for the constitutional law of academic freedom, but for First Amendment jurisprudence generally. This article therefore puts the Fourteenth Amendment to one side and provides a detailed analysis of the First Amendment implications of Grutter.

Some of the consequences of the Court's …

Developing A Measuring Instrument To Determine The Level Of Discipleship Commitment Attained By Individual Christians, Henry D. Styron Mar 2004

Developing A Measuring Instrument To Determine The Level Of Discipleship Commitment Attained By Individual Christians, Henry D. Styron

Doctoral Dissertations and Projects

The writer’s personal experience, consultations with clergy and laity, and a review of current literature reveal a lack of genuine discipleship in the modern church. The purpose of the project is to develop a usable Biblical model of a disciple, and to develop a measuring instrument by which conformity to this model may be determined in the lives of individual Christians. The project details the creation of the model and the instrument, and then documents the field testing of the instrument in various churches and other venues, with resulting evaluation and improvement to the instrument.

Grutter's First Amendment, Paul Horwitz Jan 2004

Grutter's First Amendment, Paul Horwitz

Articles

In Grutter v. Bollinger, the Supreme Court noted that universi ties "occupy a special niche" in the First Amendment, and suggested that they are entitled to a substantial degree of institutional autonomy. This Article evaluates the First Amendment implications of this ruling. It explores three possible First Amendment readings of Grutter. First, Grutter may be viewed as a charter of institutional autonomy for universities. That reading carries a variety of implications, not all of which may be equally pleasing to Grutters supporters. Second, Grutter may be read as advancing a substantive view of academic freedom based on its value to …

The Spirit-Filled Christian Life, Curtis Wayne Brown May 2003

The Spirit-Filled Christian Life, Curtis Wayne Brown

Doctoral Dissertations and Projects

The Scriptures teach that Christians are to be "filled or controlled" by God, the Holy Spirit. This thesis will define what the Bible teaches regarding how the Holy Spirit comes to dwell within a person, what is involved in continually submitting the heart to the Holy Spirit's filling or control, and what are the behavioral and attitude manifestations in a Christian when controlled by the Holy Spirit. The filling of the Holy Spirit will be discussed in the life of the individual Christian, his family and the local church as seen in Ephesians 5:18- 6:17, Galatians 5:22-23, Romans, I Corinthians …

Parental Influence Factors Affecting Christian Faith Maturity Of Children Through Adolescence, James W. Anderson May 2000

Parental Influence Factors Affecting Christian Faith Maturity Of Children Through Adolescence, James W. Anderson

Theses and Graduate Projects

The role that parents play in the faith formation of their children is and has been historically significant. Modeling their religious beliefs as well as verbalizing them play an important part in the child's view of God. It has also been found as this paper will articulate, that participation in the church life of the congregation and service projects are also an integral part of the development of the child's faith development into the adolescent years. This paper will review the importance of the parents as the primary participants of their own child's faith destiny and give applicable results for …
