ขอบเขตการบังคับใช้กฎหมายการแข่งขันทางการค้ากับธุรกิจการแข่งขันกีฬาฟุตบอลอาชีพ: ศึกษากรณีการบังคับใช้กฎการจำกัดค่าใช้จ่ายเพื่อการแข่งขันที่เป็นธรรม (Financial Fair Play) ระหว่างผู้ประกอบธุรกิจกีฬาฟุตบอลอาชีพ, ธีรักษ์ ทองรักษ์

กฎการจำกัดค่าใช้จ่ายเพื่อการแข่งขันที่เป็นธรรม (Financial Fair Play) เป็นกฎที่ยูฟ่านำมาใช้เพื่อแก้ปัญหาทางด้านการเงินที่เกิดขึ้นจากสภาวะหนี้สินสะสมอย่างต่อเนื่องของสโมสรกีฬาฟุตบอลในยุโรป โดยการกำหนดให้สโมสรใช้จ่ายได้เท่าที่ไม่เกินรายรับจากการประกอบธุรกิจเท่านั้น แต่อย่างไรก็ตาม เมื่อพิจารณาจากหลักเกณฑ์และแนวทางในการบังคับใช้กฎหมายต่อกฎเกณฑ์การแข่งขันกีฬาของคณะกรรมาธิการและศาลยุติธรรมยุโรปแล้วกฎดังกล่าว มีวัตถุประสงค์อันชอบธรรมเพื่อที่จะรักษาความมั่นคงทางด้านการเงินและส่งเสริมให้เกิดการลงทุนพัฒนารากฐานในด้านต่าง ๆ ของสโมสรกีฬาฟุตบอลให้ดียิ่งขึ้น ถึงแม้ว่ากฎดังกล่าวนั้น จะเกิดผลกระทบตามมาทำให้สโมสรต้องจำกัดค่าใช้จ่ายในด้านต่าง ๆ แต่ก็เป็นผลกระทบที่เกิดขึ้นโดยปกติวิสัยเพื่อที่จะบรรลุวัตถุประสงค์ในการรักษาความมั่นคงทางด้านการเงินดังกล่าว และเป็นผลกระทบที่ได้สัดส่วนต่อการบรรลุวัตถุประสงค์แล้ว ดังนั้น กฎดังกล่าวจึงเป็นกฎการแข่งขันกีฬาที่มีวัตถุประสงค์อันชอบธรรม และไม่ขัดต่อกฎหมายการแข่งขันทางการค้า สำหรับในประเทศไทย ขอบเขตการบังคับใช้กฎหมายการแข่งขันทางการค้าต่อการบังคับใช้กฎการจำกัดค่าใช้จ่ายเพื่อการแข่งขันที่เป็นธรรมซึ่งอาจนำมาบังคับใช้เพื่อแก้ไขปัญหาทางด้านการเงินของสโมสรกีฬาฟุตบอลอาชีพในอนาคตนั้น ยังคงมีความไม่ชัดเจนหลายประการ ทั้งขอบเขตการบังคับใช้กฎหมายต่อสมาคมกีฬาฟุตบอลตามพระราชบัญญัติการแข่งขันทางการค้า พ.ศ. 2560 รวมถึงปัญหาการบังคับใช้กฎการจำกัดค่าใช้จ่ายว่า จะเป็นพฤติกรรมเป็นการร่วมมือกันกำหนดเงื่อนไขในการประกอบธุรกิจของสโมสรกีฬาฟุตบอลอันเป็นการจำกัดการแข่งขันระหว่างผู้ประกอบธุรกิจซึ่งขัดต่อมาตรา 55(4) หรือไม่ ดังนั้น ผู้เขียนจึงเสนอให้ปรับใช้กฎหมายการแข่งขันทางการค้าต่อสมาคมกีฬาฟุตบอลแห่งประเทศไทยในฐานะผู้ประกอบธุรกิจด้วยโดยไม่ได้รับการยกเว้นตามมาตรา 4 ของพระราชบัญญัติ เนื่องจากสมาคมกีฬาฟุตบอลนั้นเป็นผู้ประกอบธุรกิจซึ่งมีรายได้มากมายจากการประกอบธุรกิจจัดการแข่งขันฟุตบอลอาชีพเช่นกัน และอาจทำข้อตกลงหรือออกกฎเกณฑ์ใด ๆ ซึ่งอาจเป็นการจำกัดการแข่งขันทางการค้าได้ และเสนอให้นำหลักเกณฑ์การพิจารณากฎหมายการแข่งขันทางการค้าต่อกฎเกณฑ์ของกีฬาในทวีปยุโรปมาใช้เป็นแนวทาง โดยการพิจารณาองค์ประกอบของการจำกัดการแข่งขันทางการค้าในมาตรา 55 นั้น จะต้องคำนึงถึงวัตถุประสงค์และผลกระทบของพฤติกรรมความร่วมมือกันดังกล่าวด้วย ดังนั้น กฎการจำกัดค่าใช้จ่ายดังกล่าวซึ่งมีวัตถุประสงค์อันชอบธรรมและไม่มีลักษณะเป็นการจำกัดการแข่งขันระหว่างผู้ประกอบธุรกิจ จึงไม่ขัดต่อมาตรา 55(4) ของพระราชบัญญัติ

The use of nostalgia has become a feature in baseball ballparks in recent years, with research showcasing the prevalence of nostalgic stimuli including bricks, steel beams, and old-fashioned scoreboards popular in the past. The impact of such stimuli on spectators’ emotions and behavior had yet to be explored, though. วัตถุประสงค์ เพื่อศึกษาความสัมพันธ์ระหว่างวัฒนธรรมองค์กรและพลังเสริมสร้างอำนาจด้านจิตใจในนักฟุตบอลอาชีพไทย รวมถึงเพื่อศึกษาความแตกต่างของระดับพลังเสริมสร้างอำนาจด้านจิตใจในนักฟุตบอลอาชีพไทยโดยจำแนกตามอายุงานของนักฟุตบอลอาชีพ วิธีดำเนินการวิจัย ผู้วิจัยใช้วิธีวิจัยเชิงสำรวจ กลุ่มตัวอย่างนักฟุตบอลอาชีพไทยในไทยลีก ฤดูกาล 2017 จำนวน 246 คน ทำการเก็บรวบรวมข้อมูลโดยใช้แบบสอบถามจากงานวิจัยที่ผ่านมาและผ่านการตรวจสอบจากผู้เชี่ยวชาญ การวิเคราะห์การถดถอยพหุคูณและการทดสอบความแตกต่าง ANOVA ถูกนำมาใช้ในการวิเคราะห์สมมติฐานในการวิจัย ผลการวิจัย พบว่าวัฒนธรรมองค์กรมีความสัมพันธ์เชิงบวกกับพลังเสริมสร้างอำนาจด้านจิตใจอย่างมีนัยสำคัญ และสามารถอธิบายความแปรปรวนของพลังเสริงสร้างอำนาจด้านจิตใจได้ร้อยละ 63.3 (R2 = 0.633) เป็นไปตามสมมติฐานการวิจัยที่ว่า วัฒนธรรมองค์กรมีความสัมพันธ์เชิงบวกกับพลังเสริมสร้างอำนาจด้านจิตใจ เมื่อวิเคราะห์ลงไปในแต่แบบของวัฒนธรรมองค์กร พบว่าวัฒนธรรมองค์กรแบบปรับตัว วัฒนธรรมองค์กรแบบมุ่งผลสำเร็จ และวัฒนธรรมองค์กรแบบเครือญาติ มีความสัมพันธ์ทางบวกกับพลังเสริมสร้างอำนาจด้านจิตใจในนักฟุตบอลอาชีพไทย อย่างไรก็ตาม ผลการวิจัยพบว่าระดับของพลังเสริมสร้างอำนาจด้านจิตใจในนักฟุตบอลอาชีพไทยโดยจำแนกตามอายุงานไม่มีความแตกต่างกันอย่างมีนัยสำคัญ ซึ่งไม่เป็นไปตามสมมุติฐานการวิจัยที่ว่าอายุงานแตกต่างกันส่งผลต่อระดับพลังเสริมสร้างอำนาจด้านจิตใจแตกต่างกัน เนื่องจากนักฟุตบอลอาชีพมีพลังเสริมสร้างอำนาจด้านจิตใจอยู่ในระดับที่สูงมากทุกคน สรุปผลการวิจัย วัฒนธรรมองค์กรมีความสัมพันธ์เชิงบวกกับพลังเสริมสร้างอำนาจด้านจิตใจของนักฟุตบอลอาชีพไทย โดยแบบวัฒนธรรมองค์กรที่เหมาะสมกับพลังเสริมสร้างอำนาจด้านจิตใจของนักฟุตบอลอาชีพไทย เรียงตามความสัมพันธ์ คือ วัฒนธรรมองค์กรแบบปรับตัว วัฒนธรรมองค์กรแบบมุ่งผลสำเร็จ และวัฒนธรรมองค์กรแบบเครือญาติ นอกจากนั้นระดับของพลังเสริมสร้างอำนาจทางด้านจิตใจของนักฟุตบอลอาชีพไม่สามารถอธิบายได้โดยอายุงานในสโมสร

ปัจจัยส่วนประสมทางการตลาดที่ส่งผลต่อการตัดสินใจเข้าชมบาสเกตบอลไทยแลนด์ลีก 2016, อธิปวัฒน์ ฉัตรกมลธรรม

การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อศึกษาส่วนประสมทางการตลาดที่ส่งผลต่อการตัดสินใจเข้าชมการแข่งขันบาสเกตบอลไทยแลนด์ลีก 2016 และเพื่อเปรียบเทียบลักษณะประชากรศาสตร์ของผู้เข้าชมบาสเกตบอลที่มีผลต่อการตัดสินใจเข้าชมบาสเกตบอลไทยแลนด์ลีก 2016 กลุ่มตัวอย่างจำนวน 402 คน ซึ่งเก็บข้อมูลโดยใช้แบบสอบถาม ซึ่งมีค่าความความตรงตามเนื้อหาเท่ากับ 0.87 และค่าความเชื่อมั่นสัมประสิทธ์แอลฟาของครอนบาล เท่ากับ 0.94 จากผู้เข้าชมการแข่งขันบาสเกตบอลไทยแลนด์ลีก 2016 จากนั้นนำผลที่ได้มาทำการวิเคราะห์ทางสถิติโดยหาร้อยละค่าเฉลี่ย ( x̄ ) และค่าส่วนเบี่ยงเบนมาตรฐาน (S.D.) และทดสอบเพื่อเปรียบเทียบส่วนประสมทางการตลาดที่ส่งผลต่อการตัดสินใจเข้าชมการแข่งขันบาสเกตบอลไทยแลนด์ลีก 2016 จำแนกตาม เพศ โดยการนำมาทดสอบค่า"ที" (t-test) จำแนกตามอายุ ระดับ การศึกษา อาชีพ และรายได้ โดยการวิเคราะห์ความแปรปรวนแบบทางเดียว (One - way ANOVA) ด้วยการทดสอบค่า "เอฟ" (F-test) ในกรณีที่พบความแตกต่าง ใช้การวิเคราะห์รายคู่ด้วยวิธีของ เชฟเฟ่ (Scheffe Method) และความสัมพันธ์ระหว่างส่วนประสมทางการตลาดที่ส่งผลต่อการตัดสินใจเข้าชมการแข่งขันบาสเกตบอลไทยแลนด์ลีก 2016 โดยใช้วิธีวิเคราะห์ถดถอยพหุคูณ (Multiple Regression Analysis) ผลการวิจัย 1. ด้านข้อมูลทั่วไปเกี่ยวกับผู้เข้าชมการแข่งขันบาสเกตบอลไทยแลนด์ลีก 2016 ของกลุ่มตัวอย่างที่ตอบแบบสอบถามในการวิจัยครั้งนี้เป็นเพศชายและเพศหญิงในสัดส่วนที่เท่ากันส่วนใหญ่มีอายุ 23 - 30 ปี การศึกษาระดับปริญญาตรี ส่วนใหญ่ประกอบอาชีพส่วนตัว และมีรายได้เฉลี่ยต่อเดือนอยู่ในช่วง 15,001 – 30,000 บาท 2. ข้อมูลเกี่ยวกับพฤติกรรมของผู้สอบถามต่อกีฬาบาสเกตบอล พบว่า ส่วนใหญ่ผู้เข้าชมบาสเกตบอลไทยแลนด์ลีก 2016 มีชื่นชอบกีฬาบาสเกตบอลอยู่แล้ว ซึ่งจะมาชมการแข่งขันบาสเกตบอลเฉพาะรายการที่สำคัญและน่าสนใจไปกับกลุ่มเพื่อนที่เล่นบาสเกตบอลเป็นประจำ ซึ่งที่มีทักษะกีฬาบาสเกตบอลอยู่ในระดับปานกลาง (เล่นได้สนุก) โดยมีการติดตามข่าวสารผ่านสื่ออินเตอร์เน็ต เว็บไซต์ เดินทางด้วยรถยนต์ส่วนตัวไปชมการแข่งขัน เพราะมีความชื่นชอบกีฬาบาสเกตบอลอยู่ในระดับมากและเป็นการได้เข้าสังคมหรือกลุ่มเพื่อนที่ชื่นชอบนักกีฬา และกีฬาบาสเกตบอลเหมือนกัน และในการแข่งขันลีกปี 2016 มีการเข้าชมการแข่งขันมากกว่า 5 ครั้งขึ้นไป หากไม่สามารถเข้าชมการแข่งขันในสนามได้จะมีการติดตามชมการแข่งขันผ่านโทรทัศน์ Youtube และราคาบัตรที่ซื้อเข้าชมการแข่งขันมีความเหมาะสมด้วย 3. ส่วนประสมทางการตลาดมีผลต่อการตัดสินใจต่อการเข้าชมการแข่งขันบาสเกตบอลไทยแลนด์ลีก 2016 โดยรวมอยู่ในระดับมาก และในรายด้านทุกด้านอยู่ในระดับมากด้วยเช่นเดียวกัน 4. ผลการเปรียบเทียบปัจจัยส่วนประสมทางการตลาดที่มีผลต่อการตัดสินใจเข้าชมการแข่งขันบาสเกตบอลไทยแลนด์ลีก 2016 ตามเพศ อายุ ระดับการศึกษา …

การพัฒนารูปแบบการจัดการเรียนรู้พลศึกษาตามอุดมการณ์โอลิมปิกเพื่อสร้างเสริมการอยู่ร่วมกันอย่างสันติสำหรับนักเรียนระดับชั้นมัธยมศึกษาตอนต้น, ปิยภูมิ กลมเกลียว

การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อพัฒนาและประเมินประสิทธิผลของรูปแบบการจัดการเรียนรู้พลศึกษาตามอุดมการณ์โอลิมปิกเพื่อสร้างเสริมการอยู่ร่วมกันอย่างสันติสำหรับนักเรียนระดับชั้นมัธยมศึกษาตอนต้น กลุ่มตัวอย่างในงานวิจัยนี้ คือ นักเรียนชั้นมัธยมศึกษาปีที่ 1 จำนวน 32 คน ได้มาโดยการสุ่มตัวอย่างแบบเจาะจง จับสลากแบ่งเป็นกลุ่มทดลอง 16 คน และกลุ่มควบคุม 16 คน วิธีการดำเนินการวิจัยแบ่งออกเป็น 2 ขั้นตอน คือ 1) ขั้นตอนพัฒนารูปแบบการจัดการเรียนรู้พลศึกษาตามอุดมการณ์โอลิมปิกตรวจสอบคุณภาพโดยผู้ทรงคุณวุฒิ มีค่าดัชนีความสอดคล้องเท่ากับ 1.00 และขั้นตอนที่ 2 การประเมินประสิทธิผลของรูปแบบการจัดการเรียนรู้พลศึกษาตามอุดมการณ์โอลิมปิก ทำการทดลองเป็นเวลา 8 สัปดาห์ และเก็บข้อมูลจำนวน 3 ครั้ง คือ 1) ระยะก่อนการทดลอง 2) เมื่อสิ้นสุดการทดลองในสัปดาห์ที่ 8 และ 3) การติดตามผลหลังสิ้นสุดการทดลอง 2 สัปดาห์ โดยเครื่องมือที่ใช้ในการเก็บรวบรวมข้อมูลประกอบด้วย (1) แบบทดสอบวัดความรู้วิชาพลศึกษาที่มีค่าความเที่ยงตรงเชิงเนื้อหาเท่ากับ .80 (2) แบบทดสอบสมรรถภาพทางกายมีค่าดัชนีความสอดคล้องเท่ากับ 1.00 (3) แบบประเมินพฤติกรรมที่ส่งเสริมอุดมการณ์โอลิมปิกในด้านความมีมิตรภาพ และ (4) แบบประเมินพฤติกรรมที่ส่งเสริมอุดมการณ์โอลิมปิกในด้านความเคารพให้เกียรติซึ่งกันและกัน มีค่าความเที่ยงตรง เท่ากับ .90 และ .83 ตามลำดับ วิเคราะห์ข้อมูลโดยใช้สถิติพื้นฐานและสถิติวิเคราะห์ความแปรปรวนแบบวัดซ้ำ ทดสอบด้วยสถิติ ที ที่ระดับความมีนัยสำคัญทางสถิติ .05 ผลการวิจัย พบว่า 1. รูปแบบการจัดการเรียนรู้พลศึกษาตามอุดมการณ์โอลิมปิกที่ผู้วิจัยพัฒนาขึ้นมีองค์ประกอบ คือ (1) หลักการ แนวคิดและอุดมการณ์โอลิมปิกโดยเชื่อมโยงระหว่างหลักการเรียนรู้พลศึกษา (2) วัตถุประสงค์ของรูปแบบ (3) เนื้อหา (4) ขั้นตอนการเรียนการสอน และ (5) การประเมินผล ซึ่งประกอบด้วย 8 แผนการเรียนรู้ ได้แก่ 1) การวิ่งระยะสั้น 2) การวิ่งผลัด 3) พุ่งแหลน 4) ขว้างจักร และ 5) ทุ่มน้ำหนัก 6) กระโดดสูง …

The theory of planned behavior was used to investigate recruitment messages for student engagement opportunities. Participants (N = 194) completed a survey of their attitudes, subjective norms, perceived behavioral control, and behavioral intentions to become more engaged in the campus community. Additionally, participants were asked to create a recruitment message for a fraternity or sorority, intramural athletic, or employment opportunity. The results of the study indicated support for the theory in the context of student engagement; both attitudes and subject norms predicted behavioral intentions. The aim of this paper is to contribute to the body of knowledge that exists in the area of ethical production by examining factors that influence purchase intention of ethically produced fashion products. The findings of this study provide a further understanding of ethical production by providing answers to the objectives. These results will also provide insight to firms wanting to effectively convey pro-environmental efforts to consumers. The findings may also assist marketers in understanding the consumers’ attitudes toward ethical manufacturing practices and their motivations for wearing their ethics and purchasing ethically produced fashion products.

Introduction: Match outcome has been linked to running performance in many sports; however, the association has not yet been examined in Gaelic football. Methods: GPS technologies (4-Hz, VX Sport, Lower Hutt, New Zealand) were used with 5 elite Gaelic football teams over a period of 5 years (2012–2016), amounting to 95 matches. In total, 780 full match data sets were collected. Game movements were divided into total distance and high-speed distance (≥17 km h−1). Objectives: To examine variation in clustered metabolic risk (cMetS) in adolescents classified as not overweight/active (NOA), not overweight/not active (NONA), overweight/active (OA), and overweight/not active (ONA).

Background: While studies to date have shown that children and adolescents who meet the current physical activity (PA) recommendations and maintain a healthy body weight demonstrate significantly lower cardiometabolic risk, there are some studies that suggest the relationship between PA and metabolic risk may be mediated by adiposity.

Methods: The sample included adolescent participants (n=875; 12-17 years) of the 2007-2012 National Health and Nutrition Examination Survey (NHANES). The cMetS score included triglycerides, high-density lipoprotein …
