Rule Or Reason? The Role Of Balancing In Antitrust Law, Michael A. Carrier, Mark A. Lemley

Notre Dame Law Review Reflection

In this Essay, we argue that the proper test for antitrust’s rule of reason is a four-step, burden-shifting framework that ends with a balancing of the likely harms and benefits of particular conduct. One reason balancing has become rare even in circuits that permit it is that it seems hard. Antitrust is shot through with economic theory and evidence, and courts aren’t experts in economics. So they tend to look for shortcuts that allow them to resolve the case without having to apply that economic evidence to assess the likely net effect of a defendant’s conduct. With the success of programs like Vanderbilt and Georgia Tech in the early 1900s, college football quickly became means of establishing Southern superiority over the northern U.S. Their success continued into the 20th and 21st centuries with the creation and rise of the Southeastern Conference (SEC). During and prior to the existence of the SEC, rivalries, traditions, and pageantry developed and thrived in communities across the southeast. To this date, there has been a rise in the professionalism of youth sports, which has increased the competitiveness and likelihood of early specialization in young athletes. While this allows youth athletes to have recognition at a young age, many athletes experience negative effects that inhibit their ability to make it to the elite level at a later age. Sports specialization can be defined as the participation and/or training of one sport year-round, typically excluding participation in all other sports. This research aimed to identify the reality of AI applications in sports clubs in Bahrain by measuring the extent to which employees in sports clubs understand the concept and importance of AI and its uses in the sports field, as well as identifying the reality of AI systems application in these clubs and the main obstacles they face in this area. Navigating Leadership: A Qualitative Exploration Of Challenges And Coping Strategies For Women In Sport Management Education, Rachel Silverman, Shanon Kempt, Nita Unruh

Abstract

Women remain significantly underrepresented in senior leadership roles in higher education, a disparity that is particularly pronounced in male-dominated disciplines, such as sport management (Chance, 2023; Lozano et al., 2023). This qualitative study examines the challenges faced by women in leadership positions within sport management education and the strategies they employ to overcome these barriers. Thirteen semi-structured interviews were conducted with biological females holding leadership roles at both teaching- and research-focused institutions. Participants ranged in age from 32 to 74 and had between one and twenty-four years of leadership experience. Using thematic analysis, key challenges identified included male-dominated work …

Responsible Gambling (RG) includes prevention messages aimed at mitigating harms. Research examining the experiences of college students who sports bet is lacking, hindering efforts to tailor messaging to college students. This qualitative study explored how college men who sports bet perceive and respond to existing RG messages, gathering their feedback on the characteristics of messages they find effective. Online focus groups were conducted with college men who sports bet (N = 12) using a semi-structured interview guide. Artificial Intelligence, Age, And Dynamic Ticket Pricing: A Mixed-Methods Study In Professional Sports, Joshua Greer, Nicholas Zoroya

Abstract

This study investigates how age moderates fan perceptions of artificial intelligence (AI) and dynamic ticket pricing (DTP) in professional sports. Using a mixed-method design, data was collected from a self-administered online survey (N = 57) and triangulated with secondary sources, including industry reports and academic literature. Survey participants were divided into four generational cohorts and responses were analyzed across three constructs: perceived fairness, accessibility, and willingness to pay. A one-way ANOVA revealed a statistically significant difference in willingness to pay across age groups, F(3, 53) = 3.41, p = .015, with the most pronounced disparity between the youngest and …

Recent criticisms of higher education include a lack of relevance and alignment with what employers are seeking in new hires. A lecture-based approach to teaching has proved less effective than other active learning strategies and does not adequately mimic the working environment sport professionals face. Pre-tenure faculty integrating service-learning into their professional roles are often uncertain about its position in the faculty reward system. This study gathered data from administrators at five institutions of higher education in Indiana to learn if and how service-learning is credited toward tenure and promotion at their institutions. The results point to the need for junior faculty members and administrators to be cautious when implementing and evaluating service-learning initiatives.

This study examined the mental health challenges faced by female Division I collegiate athletes. The problem addressed was the issue of poor psychological health among Division I female collegiate athletes. The 2017 law known as the Tax Cuts and Jobs Act (TCJA) enacted a tax on private, non-profit college and university endowments for the first time. Institutions with at least 500 tuition-paying students and endowments of $500,000 or greater per student now have to pay a 1.4% tax on their endowments. But like all taxpayers, colleges and universities may be tax averse or seek reductions in their tax burdens. That is, colleges and universities may try to avoid the tax through taking action to ensure they do not meet the threshold. Such actions include increasing the size of their student …

This manuscript reviews the book The Sports Revolution: How Texas Changed the Culture of American Athletics by Frank Guridy. The book dives into the state of Texas’s role in changing the sports landscape through the 1960s and 1980s. Football Spending For Success: Analyzing Investment And Team Performance In Ncaa Fbs Programs, Keunsu Han, Jin Dong Park, Kyungeun (Karry) Kwon

Journal of Applied Sport Management

This study examines the relationship between financial investment and team performance in NCAA Division I Football Bowl Subdivision (FBS) football programs from 2010 to 2023. Key variables include total football spending, head coach salaries and bonuses, and win-loss records. Ordinary Least Squares (OLS) regression models were used to examine these associations, controlling for conference affiliation by distinguishing between the so-called power and non-power conferences. The results indicate that greater investment in football operations and coaching compensation is significantly associated with higher win percentages, particularly within power conference programs.
