Fordham University School Of Law: A Case Study Of Legal Education In Twentieth-Century America, Robert J. Kaczorowski Dec 2018

Fordham University School Of Law: A Case Study Of Legal Education In Twentieth-Century America, Robert J. Kaczorowski

Fordham Law Review

This paper focuses on three themes that shaped legal education in twentieth-century America and roughly organizes the topics of this conference. These themes emerged when I was researching and writing the history of Fordham University School of Law. Consequently, I will discuss Fordham’s history as a case study focused on the following themes: 1. The importance of university relations and funding to enhancing the quality of a law school; 2. The importance of scholarship and the changing nature of scholarship in legal education; and 3. The importance of diversity and the changing nature of diversity in legal education.

Subsidiarity And Federalism: The Relationship Between Law Schools And Their Universities, John Sexton Dec 2018

Subsidiarity And Federalism: The Relationship Between Law Schools And Their Universities, John Sexton

Fordham Law Review

In his book on the history of Fordham University School of Law, Bob Kaczorowski does not take an explicit position on how decision-making authority on matters ranging from resource utilization to curriculum development should be allocated between a law school and its university. Rather, he offers in detail a story and extensive evidence that tends to reflect and support the view traditionally taken by the American Bar Association (ABA), the vast majority of law faculty, and most law school deans on the subject: listen, you folks over there at the university—we know what we are doing, so just leave us …

Race-Evasiveness Among Camp Staff, S. Cole Perry Dec 2018

Race-Evasiveness Among Camp Staff, S. Cole Perry

Journal of Youth Development

Camp staff have hope that summer camp plays a role in helping youth bridge differences. Educational research, though, raises concerns about preparing youth workers to combat racism (Jupp, Berry, & Lensmire, 2016). This study draws on prior school research and critical Whiteness studies to examine race-evasiveness among camp staff. Grounded theory analysis resulted in two major thematic categories of discursive strategies by which camp staff evaded critical engagement with antiracist discussion. First, camp staff upheld dominant racial understandings by invoking discourses of colorblindness and humanist caring. Second, they prioritized White comfort by neglecting youth of color and employing self-protective emotional …

Privacy Spaces, Bert-Jaap Koops Dec 2018

Privacy Spaces, Bert-Jaap Koops

West Virginia Law Review

Privacy literature contains conceptualizations of privacy in relation to role-playing and identity construction, and in relation to access control and boundary-management. In this paper, I combine both strands to introduce the concept of privacy spaces: spaces in which you can play, in your own way, the relevant role(s) you have in social life. Drawing from privacy conceptions in legal scholarship, philosophy, sociology, anthropology, human geography, and psychology, a systematic overview of traditional privacy spaces is offered, including mental bubbles, the body, personal space, personal writings, the home, private conversation space, cars, stalls, intimacy bubbles, professional black boxes, coffee house spaces, …

Race, Social Class, And Child Abuse: Content And Strength Of Medical Professionals’ Stereotypes, Cynthia J. Najdowski, Kimberly M. Bernstein Dec 2018

Race, Social Class, And Child Abuse: Content And Strength Of Medical Professionals’ Stereotypes, Cynthia J. Najdowski, Kimberly M. Bernstein

Psychology Faculty Scholarship

Black and poor children are overrepresented at every stage of the child welfare system, from suspicion of abuse to substantiation. Focusing on stereotypes as a source of bias that leads to these disparities, the current study examines the content and strength of stereotypes relating race and social class to child abuse as viewed by medical professionals. Doctors, nurses, and other medical professionals (Study 1: N = 53; Study 2: N = 40) were recruited in local hospitals and online through snowball sampling. Study 1 identified stereotype content by asking participants to list words associated with the stereotype that …

Art Brut & Bricolage: Manifesting Alternate Imaginaries Of The Waste Cataclysm, Dominic Alan Chequer Dec 2018

Art Brut & Bricolage: Manifesting Alternate Imaginaries Of The Waste Cataclysm, Dominic Alan Chequer

Communication Studies

Living within a consumer society that boasts increased sustainable consumption as the panacea to large-scale environmental degradation, the social avoidance of waste becomes an interesting psychological battleground in developing an environmentally sustainable future. In light of this situation, I used my participation in the design of a music festival to create a social critique by design. Using artistic techniques of bricolage and aesthetic upcycling, under the visage of art brut. The paper blends theory and practice, ideas with tangible outputs.

Online Child’S Health Assessment Tool For Obesity Prevention Programming, Laura Palmer, Kimberly Mccarthy, Daniel Perkins, Lynne Borden Dec 2018

Online Child’S Health Assessment Tool For Obesity Prevention Programming, Laura Palmer, Kimberly Mccarthy, Daniel Perkins, Lynne Borden

Journal of Youth Development

To optimize public health in the next decade, prevention of childhood obesity will remain a central focus. To impact behavioral change, data must be linked to continuous quality improvements within existing nutrition and physical activity programming. The Children, Youth, and Families At-Risk Professional Development and Technical Assistance Center has developed a picture-based, online survey tool, the CYFAR Health Assessment Tool (CHAT), to assess health behaviors in youth ages 6 to18 years of age. Used for continuous program improvement, aggregate data results are coupled with tailored health recommendations in 4 domains (behavior and environmental modifications, education, and direct strategies) and evidence-informed …

Snowboot: Bootstrap Methods For Network Inference, Yuzhou Chen, Yulia R. Gel, Vyacheslav Lyubchich, Kusha Nezafati

The R Journal

Complex networks are used to describe a broad range of disparate social systems and natural phenomena, from power grids to customer segmentation to human brain connectome. Challenges of parametric model specification and validation inspire a search for more data-driven and flexible nonparametric approaches for inference of complex networks. In this paper we discuss methodology and R implementation of two bootstrap procedures on random networks, that is, patchwork bootstrap of Thompson et al. (2016) and Gel et al. (2017) and vertex bootstrap of Snijders and Borgatti (1999). To our knowledge, the new R package snowboot is the first implementation of the …

Consistency Cubes: A Fast, Efficient Method For Exact Boolean Minimization, Adrian Dusa Dec 2018

Consistency Cubes: A Fast, Efficient Method For Exact Boolean Minimization, Adrian Dusa

The R Journal

A lot of effort has been spent over the past few decades in the QCA methodology field, to develop efficient Boolean minimization algorithms to derive an exact, and more importantly complete list of minimal prime implicants that explain the initial, observed positive configurations.

As the complexity grows exponentially with every new condition, the required computer memory goes past the current computer resources and the polynomial time required to solve this problem quickly grows towards infinity.

This paper introduces a new alternative to the existing non-polynomial attempts. It completely solves the memory problem, and preliminary tests show it is exponentially hundreds of …

The Politeness Package: Detecting Politeness In Natural Language, Michael Yeomans, Alejandro Kantor, Dustin Tingley Dec 2018

The Politeness Package: Detecting Politeness In Natural Language, Michael Yeomans, Alejandro Kantor, Dustin Tingley

The R Journal

This package provides tools to extract politeness markers in English natural language. It also allows researchers to easily visualize and quantify politeness between groups of documents. This package combines and extends prior research on the linguistic markers of politeness (Brown and Levinson, 1987; Danescu-Niculescu-Mizil et al., 2013; Voigt et al., 2017). We demonstrate two applications for detecting politeness in natural language during consequential social interactions— distributive negotiations, and speed dating.

Criminology, Anthropology, & Sociology Faculty Publications

One of the current and biggest problems in the system of emergency care for the drug overdose epidemic is the failure of information delivery on nearby treatment facilities. Even though some initiatives have tried to solve this issue, they either failed in delivering the information or in providing good usability. This paper presents the design and development of a web application that we refer to as DrugHelp.Care. This application delivers highly accurate, easy-to-understand, and targeted information in a timely manner for substance users and their well-wishers. It also provides an ecosystem for the treatment facilities with an easy-to-use interface to …

Father Involvement: Conceptualizing, Synthesizing, And Testing The Effects On Children’S Behavioral, Socioemotional, And Educational Outcomes At Middle Childhood, Jamel T. Slaughter

Social Work Dissertations - Archive

A systematic search was conducted across eight databases using the keywords: “measure*, scale*, father* or paternal*, and involve*. A final sample of 17 studies were identified for a systematic review. A total of eleven (five child-reported and six father-reported) father involvement scales were used in the studies. Guided by a heuristic contextual model of father involvement, secondary data from Waves 5 and 9 of the Fragile Families and Child Wellbeing Study were analyzed to assess the effects of father involvement (mother and father report of father involvement) at five years of age on children’s internalizing, externalizing, and delinquency behaviors and …

Motivators Of Prostitution Desistance, Shawn Nicole Guy Dec 2018

Motivators Of Prostitution Desistance, Shawn Nicole Guy

Criminology & Criminal Justice Theses - Archive

The intent of this thesis was to determine the factors that lead to desistance from street prostitution in the form of motivators and how to shape recommendations to courts, social services, and policy-makers based off of identified themes. Additionally, various theories are discussed, supporting the presence of identified motivators and themes, that could be used by interventionsists as guiding principles when working on strategies for prostitution desistance modifications. Without isolating and stratifying motivators and themes, prostitutes who desire to desist may not receive appropiate treatments and interventions and may continue to recidivate with prostitution-related criminal charges. Statements obtained through qualitative …

“Tie The Flags Together”: Migration, Nativism, And The Orange Order In The United States, 1840-1930, Cory D. Wells

History Dissertations - Archive

“Tie the Flags Together”: Migration, Nativism, and the Orange Order in the United States, 1840-1930 Cory Wells Throughout the nineteenth century, tens of thousands of Irish Protestants who migrated to the United States joined the Orange Order in their newly adopted country. Formed in Ulster in the 1790s, the Loyal Orange Institution existed to maintain Protestant hegemony in Ireland. It quickly spread throughout the anglophone Atlantic, especially to Britain and Canada. As the number of Irish Catholics immigrating to America steadily rose, reaching new heights during the Famine, so did the anti-immigrant rhetoric that culminated in the American nativist movement. …

Secrecy And Conspiracy, Matthew R.X. Dentith, Martin Orr Dec 2018

Secrecy And Conspiracy, Matthew R.X. Dentith, Martin Orr

Sociology Faculty Publications and Presentations

In the literature on conspiracy theories, the least contentious part of the academic discourse would appear to be what we mean by a “conspiracy”: a secretive plot between two or more people toward some end. Yet what, exactly, is the connection between something being a conspiracy and it being secret? Is it possible to conspire without also engaging in secretive behavior? To dissect the role of secrecy in conspiracies—and thus contribute to the larger debate on the epistemology of conspiracy theories—we define the concepts of “conspiracy,” “conspirator,” and “secret,” and argue that while conspirators might typically be thought to commit …

Success For Every Child: The Impact Of Teacher Perceptions On Student Achievement, Sarah K. Pease Dec 2018

Success For Every Child: The Impact Of Teacher Perceptions On Student Achievement, Sarah K. Pease

Counselor Education Capstones

The way a teacher perceives students may affect how they treat them. This may stem from biases that teachers may or may not be aware of. Every human has biases against certain people (Johnson, 2013). These biased perceptions might stem from past experiences, uncertainty, physical appearance, or other reasons. Because perception influences teachers’ responses to students, it is necessary to discuss how impactful teacher perceptions are on students in the educational system. Because teachers have a powerful position in students’ daily lives, they likely have an effect on student learning as well as their self-efficacy. Students from minority cultures are …

Negotiating Strategies: An Effective Way For Parents Of Children With Disabilities To Communicate For Services, Dorothea Cartwright Dec 2018

Negotiating Strategies: An Effective Way For Parents Of Children With Disabilities To Communicate For Services, Dorothea Cartwright

Electronic Theses, Projects, and Dissertations

The purpose of this project was to examine and explore negotiating strategies for parents with children with disabilities. The research showed there were insufficient materials for teaching negotiating strategies to parents to assist them in obtaining critical or basic services for their special needs children. Many families lack financial resources, have English-language barriers, and have educational challenges when facing school administrators that possess these vital resources. These circumstances mean that parents may feel intimidated and disempowered when meeting with school officials. By providing a simple and easy-to-use guide of Negotiating Strategies, parents can be empowered and encouraged to use their …

The public’s awareness of domestic sex trafficking and perceptions of domestic sex trafficking victims were examined through the utilization of a 31 closed-ended question survey. The survey included questions about domestic sex trafficking and prostitution myths, domestic sex trafficking victim characteristics, domestic sex trafficking legislation, law enforcement’s involvement in domestic sex trafficking cases, and demographics. The sample consisted of 195 Criminal Justice …

The Multiple Justifications Of Occupational Licensing, Nick Robinson Dec 2018

The Multiple Justifications Of Occupational Licensing, Nick Robinson

Washington Law Review

Nearly a quarter of all workers in the United States are currently in a job that requires an occupational license. As the prevalence of occupational licensing has grown, so have claims that its overuse is causing increased consumer costs and impairing labor mobility and economic freedom. To address these concerns, many policymakers and academics argue that licensing restrictions should be more closely tailored to the goal of protecting the public from harm and that, to guard against capture, practitioners should not regulate their own licensing. Federal courts, in turn, have drawn on this vision of the proper role of occupational …

Role Of The Physical Environment On Team-Based Primary Care In The Military Health System, William B. Lewis Dec 2018

Role Of The Physical Environment On Team-Based Primary Care In The Military Health System, William B. Lewis

All Dissertations

Primary care in the United States has shifted from a physician-centered care approach to a multidisciplinary, team-based care approach. This shift has resulted in many day-to-day changes in the care delivery process including how clinical staff collaborate; interact with patients; and use space, equipment, and various technologies. Team-based approaches, such as the Patient-Centered Medical Home (PCMH) model, are demonstrating improvements in patient health outcomes. The U.S. Military Health System, one of the largest healthcare organizations in the world, has adopted the PCMH model for primary care clinics. To support this new care model, a team-based clinical module is emerging as …

“Bringing Your Whole Self To Research”: The Power Of The Researcher's Body, Emotions, And Identities In Ethnography, Elizabeth Hordge-Freeman

Sociology Faculty and Staff Publications

Despite advancements, there remains relatively little research about how researchers navigate their bodies and emotions in the context of field research. Perhaps because it represents a threat to ideas about objective or value-free research, qualitative researchers may receive the least amount of practical training about how their bodies and emotions matter in the field. The prevailing assumption is that researchers will eventually find their way or organically develop the pivotal relationships that they need to conduct their work. This uncertainty can be a tremendous source of anxiety for researchers new to the field and even for those seasoned researchers initiating …

Application Of Data Analytics For Prediction Of Suicide Rates At The State And National Levels, Derek Benson Dec 2018

Application Of Data Analytics For Prediction Of Suicide Rates At The State And National Levels, Derek Benson

Master's Theses

The increasing suicide rate in the United States has amplified the need to assure that regions with high suicide risk receive adequate funding for programs and related resources for prevention methods. The way in which organizations dedicated to preventing suicides distribute funding could be improved with the development of predictive models for suicide rates. In this study, a multiple linear regression model at a national level was developed to identify relevant factors associated with suicide. The national level model was developed in two phases; the first using response variable data and explanatory variable data from the same time period, and …

A sample of 318 students from two Iranian universities was employed to conduct a test of Gottfredson and Hirschi’s self-control theory and elements of Akers’ social learning theory. Specifically, we sought to determine whether these theories are capable of explaining the decision to cyber bully members and fans of rival sports teams. Structural equation modeling was used to analyze these data. Findings suggest that individuals with low levels of self-control are more likely to engage in cyber bullying perpetration. Similarly, those who associate with delinquent peers are more likely to engage in cyber bullying perpetration. Additionally, we found that ineffective …
