The Forgotten Income-Attribution Power, Alex Zhang Jan 2026

The Forgotten Income-Attribution Power, Alex Zhang

Faculty Articles

Economic inequality stands at record levels, and constitutional law haunts egalitarian reform. In 2024, the Supreme Court decided the latest contest. Moore v. United States rebuffed an attempt to sharply limit the federal taxing power, as a razor-thin majority upheld Congress’s attribution of foreign corporations’ income to domestic shareholders. But four Justices criticized the reasoning of the majority, faulting its use of a fabricated doctrine.

This Feature provides a systematic account of Congress’s income-attribution power. It excavates overlooked litigation materials and case law from the infancy of the current federal income tax. In the 1920s and 1930s, litigants attacked, on …

Disconsents, Daryl J. Levinson, David E. Pozen Jan 2026

Disconsents, Daryl J. Levinson, David E. Pozen

Faculty Scholarship

Consent is an indispensable standard and organizing principle in any liberal legal order that prizes self-directed autonomy, self-identified preferences, and collective agreement. Yet consent’s capacity to advance those values has become increasingly uncertain in a society beset by power imbalances, information asymmetries, and multiple forms of polarization. In this Article, we document how the rise of neoliberalism has led to greater reliance on consent throughout U.S. law, while at the same time leading to greater doubts about its moral efficacy and empirical feasibility. Connecting and generalizing pathologies of consent-based regulation that have been identified within myriad domains, the Article identifies …

Character Judgements Of Rap Music Fans, Kaila C. Putter, Dan J. Miller, Amy M. Belfi, James Rees, Amanda E. Krause

Psychological Science Faculty Research & Creative Works

Extending Fischoff, we used vignettes to examine people's perceptions of a hypothetical rap fan accused of murder. Study 1 (N = 300) used a 2 (murder accusation) x 2 (inclusion of rap lyrics) x 2 (fan gender) experiment, asking participants to judge how capable of murder and sexually aggressive they found the fan. The presentation of lyrics and murder accusation were associated with the fan being more capable of murder, while rap lyrics and participants' rap attitudes were associated with the fan being more sexually aggressive. Thematic analysis revealed that, in conditions containing both the lyrics and the murder accusation, …

Beauty Isn't Always Better: How Salesperson Attractiveness Affects Consumers' Approach Behaviors, Veronica L. Thomas, Stephanie M. Mangus, Dora E. Bock Jan 2026

Beauty Isn't Always Better: How Salesperson Attractiveness Affects Consumers' Approach Behaviors, Veronica L. Thomas, Stephanie M. Mangus, Dora E. Bock

Marketing Faculty Publications

This research examines how a consumer's committed romantic relationship influences their decision to approach an attractive salesperson in a retail environment. To date, the majority of research espouses the benefits of salesperson attractiveness in enhancing consumers' perceptions of the salesperson and the represented retailer. This is problematic because it creates a managerial bias toward attractive salespeople and, as we propose, provides an incomplete view of the effect of salesperson attractiveness on consumers' behavior. Drawing on the interpersonal relationship literature on commitment, we propose that consumers in committed relationships activate relationship-maintenance motives that override the beauty bias when a salesperson's attractiveness …

Career and Technical Education (CTE) research has advanced knowledge, strengthened communities, informed policy, and expanded pathways to opportunity for decades. As ACTER begins a new chapter, we are invited to imagine the future of our field beyond a linear pipeline. We can embrace a view of CTE research as a living ecosystem that grows talent, supports collaboration, and sustains discovery over time. This presidential address emphasizes three priorities for that future: applied research that reaches practice, mentorship that nurtures the next generation of scholars, and partnerships that ensure knowledge becomes action. By centering learners and communities in our work, we …

Resistance, Collaboration, And Ethnic Bias: Evidence On Social Cohesion In Wartime Ukraine, Janina Dill, Marnie Howlett, Carl Müller-Crepon, Mara Revkin Jan 2026

Resistance, Collaboration, And Ethnic Bias: Evidence On Social Cohesion In Wartime Ukraine, Janina Dill, Marnie Howlett, Carl Müller-Crepon, Mara Revkin

Faculty Scholarship

Interstate wars can rally societies around the flag, but they can also divide them based on individuals’ behavior and identities. Building on fieldwork in wartime Ukraine, we study the importance of collaboration and resistance, ethnic identity, and the interaction between behavior and identity. We examine how such divisions affect Ukrainians’ attitudes toward each other with two conjoint experiments (N=2,513). When choosing among potential neighbors, respondents prefer individuals who resisted over collaborators. However, two identity attributes—ethnic descent and exposure to Russian occupation of Ukrainian territory—activate biases that behavior alone does not fully overcome. Furthermore, we find that respondents value resistance less …

Eat With Understanding: A Um Student Guide To Food Systems, James Deacon, Cora Johnson, Lucas Dymit, Kaeli Rackham, Elsie Danyo

Undergraduate Theses, Professional Papers, and Capstone Artifacts

The industrialized food system creates environmental harm, reduces food sovereignty, and contributes to growing food insecurity. These problems oftentimes are overlooked in higher education. To address this gap, our project examines how access to sustainable food education and campus-community partnerships can improve well-being and informed decision-making amongst University of Montana students. This collaborative project connects partners within UM Wellness, PEAS Farm, the Missoula Food Bank and Community Center, and the Big Sky Culinary Institute. Our research includes applied learning with these organizations by hosting a variety of speaker series presentations and coordinating a cooking workshop. We collected quantitative and qualitative …

The Lithic Assemblage From The 700,000 Year-Old Butchery Site Of Kalinga (Luzon Island, Philippines): New Insights Into Technological Variability In The Early Palaeolithic In Island Southeast Asia, Alfred F. Pawlik, Justin Guilbert, Jean-Baptiste Lambard, Gerald Palaya, Jackie Despriee, Xavier Gallet, John De Vos, Andrea Dominique Cosalan, Maria G. Chacon

Archaeology

Despite a long history of archaeological and paleoanthropological research, our understanding of the Early Palaeolithic in Island Southeast Asia remains limited, as only a few sites with clear stratigraphic contexts - Mata Menge (Flores Island), Ngebung 2 (Java Island), Calio and Talepu (Sulawesi Island) - have been documented. This scarcity of well-stratified assemblages has led to a poor characterisation of technological variability and cultural sequences, which mainly rely on surface collections and early typological classifications/facies (e.g., Pacitanian, Cabengian, Cabalwanian, Liwanian, Arubian, etc). These classifications mostly based on a handful of cobble artefacts, have long obscured the technological diversity of early …

Partisipasi Pendidikan Menengah Atas Dan Perkawinan Remaja Perempuan 16–18 Tahun Di Indonesia, Herjuno Bagus Wicaksono, Diahhadi Setyonaluri

Jurnal Ekonomi dan Pembangunan Indonesia

This study examines the relationship between upper secondary education participation and early marriage among women aged 16–18 in Indonesia. Using district-level panel data for 2014–2023, the analysis applies a fixed effects regression to estimate the association between the female net enrollment rate and marriage prevalence among adolescent women. The results indicate that higher participation in upper secondary education is associated with lower early marriage rates. Socioeconomic factors and the implementation of the Marriage Law Reform are also relevant contributors. These findings suggest the importance of expanding access to upper secondary education as part of broader efforts to reduce early marriage.

Criminal Data Function Creep, Sarah E. Lageson Jan 2026

Criminal Data Function Creep, Sarah E. Lageson

Journal of Criminal Law and Criminology

Automated, data-driven decision-making can create unfair outcomes and lead to discrimination. This Article considers a relatively ubiquitous part of modern life that is increasingly automated: the criminal background check. This Article, with contributions at the intersection of law and technology, antidiscrimination and consumer protection law, and sociological theory, makes the central claim that criminal record data is characterized by function creep—the unintended use of data for another purpose—which leads to a specific set of harms. This Article makes three central contributions. First, it offers an empirical assessment of contemporary, data-driven background screening using data based on in-depth interviews and systematic …

This article draws on concepts of speculative design and responsible innovation to examine the possible impacts of data-driven precision agriculture on farmers and farm work. We use an innovative mixed-method approach to research design. Using artistic depiction of futures of precision agriculture in design workshop and in-depth semistructured interviews conducted with the farmers in Vermont and South Dakota, we explain how farmers perceive different futures of precision agriculture. Specifically, in our design workshop, we combined visual arts and social science methods, namely Q-method, to explore existing and new relationships between humans, technologies, and environment in the design, deployment, and use …

The Influence Of Adverse Childhood Experiences On Female Violent Offending: A Scoping Systematic Review, Alexis M. Wolgemuth

Theses, Dissertations and Capstones

Female-perpetrated violence has exhibited concerning data trends in recent years. Prior scholarship indicates that past victimization and trauma in childhood, known as adverse childhood experiences (ACEs), are highly prevalent among women offenders. However, the research concerning ACEs and violent females is scattered. This thesis provides a scoping literature review using the Preferred Reporting Items for Systematic Reviews and Meta-Analyses (PRISMA) updated 2020 guidelines. A systematic database search was conducted using Academic Search Complete, SAGE Journals, Springer Nature Link, and HeinOnline to identify relevant peer-reviewed journal articles. Inclusion and exclusion criteria are established, focusing on studies published after January 2015. These …

The Social Role And Significance Of Religion For Ukraine Today – Historical Dynamics And Current Contributions, Olena Svysiuk Jan 2026

The Social Role And Significance Of Religion For Ukraine Today – Historical Dynamics And Current Contributions, Olena Svysiuk

Occasional Papers on Religion in Eastern Europe

The paper delivers an analysis of Ukrainians’ religious worldview, tracing its development and transformation under historical, social and political influences. The contribution of the main Christian denominations − Orthodoxy, Greek-Catholicism and Protestantism − to national identity-building, the shaping of moral values, social cohesion and civic engagement is outlined. The work highlights how religion is deeply entwined with Ukrainian traditions, spirituality, and political life, serving as both a moral compass and a catalyst for social change. It also points to the churches’ social ministry − humanitarian, educational and psychological support − during the full-scale war. The involvement of religious institutions as …

Preservation Of Architectural-Religious Heritage In Modern Ukraine, Olga Gold, Maksym Vasalatiy, Olga Dobrodum Jan 2026

Preservation Of Architectural-Religious Heritage In Modern Ukraine, Olga Gold, Maksym Vasalatiy, Olga Dobrodum

Occasional Papers on Religion in Eastern Europe

This article examines answers to a number of pressing questions regarding the preservation of architectural heritage in the modern world: what philosophical views underlie the preservation of world heritage; and what is unique about the protection of religious architectural heritage. The architectural philosophy of religious buildings represents a complex of original concepts, both material and spiritual. The hypothesis consists of constructing an algorithm and mechanism for protecting cultural heritage from the perspective of the philosophy of architecture in post-war Ukraine. The preservation of historical and cultural heritage sites is one of the most complex areas of activity in the fields …

Religious And Cultural Dimension Of The "Ringing Cedars Of Russia" Movement In The Context Of Hybrid Warfare, Oleksandr Lukyanenko, Vitaly Dmytrenko, Vita Dmytrenko

Occasional Papers on Religion in Eastern Europe

The article is devoted to a comprehensive religious analysis of the neo-religious movement “The Ringing Cedars of Russia,” based on the works of Vladimir Megre and the image of the prophetess Anastasia. The study covers the ideological and doctrinal foundations of the movement, its socio-cultural practices, the functioning of tribal settlements, as well as mechanisms of influence on individual and collective consciousness. Particular attention is paid to the concepts of “Vedrussia”, the sacralization of “Russian space” and the mythologization of Russia’s calling to revive the “primitive civilization of harmony.” The analysis shows that the movement, while declaring ecological and humanistic …

Social Engagement Moderates The Relationship Between Cognitive Functioning, Depressive Symptoms, And Restless Sleep In Older Black Adults, Sunkanmi Folorunsho, Olufunmilola Abraham, Darlingtina K. Esiaka

Pharmacy Practice and Science Faculty Publications

INTRODUCTION: Older Black adults face higher dementia risk, but it is unclear whether social engagement offsets the effects of depression and restless sleep.

METHODS: We analyzed 1,905 Black adults aged 50+ from the 2016-2020 Health and Retirement Study (HRS). Linear mixed-effects models tested how depressive symptoms, restless sleep, and social engagement predicted baseline cognition and cognitive decline.

RESULTS: Higher depressive symptoms and restless sleep were associated with lower baseline cognition (about 0.2 and 0.5 points lower) and faster decline (β×time ≈ −0.07 and −0.05). Greater social engagement predicted higher baseline cognition (about 0.6 points higher) and slower decline (β×time ≈ …

Understanding Workplace Psychological Safety Among Latina Professionals: An Exploration Of Intersectional Experiences, Michal Tapia Jan 2026

Understanding Workplace Psychological Safety Among Latina Professionals: An Exploration Of Intersectional Experiences, Michal Tapia

Theses and Dissertations

Latina professionals represent one of the fastest-growing segments of the U.S. workforce, yet they remain disproportionately underrepresented in executive and C-suite roles. This disparity reflects structural conditions that shape access to voice, support, advancement, and decision-making authority.

This mixed-methods study examined psychological safety among 145 Latina professionals across the United States, defined as the belief that one can speak up, ask for help, disagree, or raise concerns without fear of negative consequences (Edmondson, 1999, 2019). The study explored how identity, relationships, leadership, workplace support, inclusion, mentorship, and structural barriers shape psychological safety at work.

Quantitative analyses showed that workplace support …

Fragments & Formations, Charles D. Schluckebier Jan 2026

Fragments & Formations, Charles D. Schluckebier

Master's Theses or Doctor of Nursing Practice

My work begins with an idea, but is driven by curiosity as it develops, often arriving somewhere different than initially planned. I maintain control over the direction while allowing decisions to shift in response to what emerges. Creating artwork becomes a space where ideas are not illustrated by worked through – physically and mentally at the same time. I approach making as problem-solving, where each sculpture functions as a puzzle resolved through construction. I push materials beyond their intended function, forcing them into new conditions where form emerges through resistance, constraint, and play. Material behavior informs the outcome but does …

Mythology Of Whiteness: Constructing Black Girls As A Bully, Kathleen O'Brien, Pamela Twyman Hoff Jan 2026

Mythology Of Whiteness: Constructing Black Girls As A Bully, Kathleen O'Brien, Pamela Twyman Hoff

Faculty Publications - College of Education

This analytical essay uses data from a qualitative study by O’Brien (2017) that explored the social construction of bullying. O’Brien interviewed 16 high school students enrolled in alternative and college-preparatory high schools. Although the study did not focus specifically on Black girls, their narratives surfaced a distinctly different story—one that exposed how whiteness, intersectional power, and cultural ways of knowing construct Black girls as quintessential bullies in schools. This re-analysis explores how Black girls are cast within the mythology of whiteness as archfoes—not merely as disruptive, but as symbolic antagonists whose existence threatens the normative order of whiteness …

The Impact Of School Climate On Student Achievement, Tonia L. Schiro

All Electronic Theses and Dissertations

This literature review explores the relationship between school climate and student achievement by examining research from education, psychology, and school improvement literature. School climate encompasses many aspects of the educational environment, including perceptions of safety, the quality of relationships among students and staff, levels of engagement, and students’ sense of belonging within the school community. The review investigates how these factors contribute to academic success and influence students’ overall educational experiences. Findings across the literature consistently demonstrate that positive school climates are associated with higher levels of student achievement, stronger engagement, improved attendance, and greater social-emotional well-being. The review also …

This study evaluated the effects of a class-wide self-monitoring (SM) intervention delivered via the I-Connect app and paired with an interdependent group contingency, on whole-group engagement in a general fourth grade classroom. Participants included 23 students during a 30-min instructional period. The researcher measured group engagement using momentary time sampling (MTS) with planned activity check (PLACHECK) with a fixed rotation schedule in 30-s intervals and recorded the percentage of students on-task per session. A withdrawal (ABAB) design was used to examine the effects across the baseline and intervention phases. Results indicated a slight increase in group engagement during the intervention …

Decline Of Male Enrollment In Higher Education, Oscar Valenzuela Jan 2026

Decline Of Male Enrollment In Higher Education, Oscar Valenzuela

Theses and Dissertations

The study examined the decline in male enrollment and completion in higher education, aiming to identify the reasons for the decline and to propose possible solutions. Using a qualitative phenomenological design, the study employed semi-structured interviews to collect data from males aged 18 to 40. The findings indicate that numerous factors contribute to why males are not enrolling in or completing higher education, and reveal key thematic groups, including Early Work Life, Home Life, Support Systems, Challenges, and Choices and Decisions. These results suggest that cultural background, socioeconomic status, and gender norms affect the decisions males make concerning higher education. …

Geography Of Erasure: Manufactured Housing, Heat Exposure, And State Neglect In Florida, Gianna M. Hutton

Pomona Senior Theses

This thesis examines Florida's manufactured housing communities through the intersecting frameworks of energy justice, critical heat studies, and housing displacement scholarship, centering how structural, political, and economic forces shape uneven exposure to thermal insecurity and housing precarity. Using a mixed-methods approach combining statistical regression analysis of American Community Survey microdata (2019-2023) and spatial case study of Miami-Dade County's heat governance and The Li'l Abner Mobile Home Community’s displacement, this research investigates how manufactured housing residents experience compounded exclusions across energy systems, urban heat governance, and housing security. The findings reveal that manufactured home residents face a 26% higher energy burden …

Embodied Women’S Health In The Pacific: Biocultural Pathways Of Hormones, Immunity, And Reproduction, Courtney Callidora Manthey Jan 2026

Embodied Women’S Health In The Pacific: Biocultural Pathways Of Hormones, Immunity, And Reproduction, Courtney Callidora Manthey

Graduate Student Theses, Dissertations, & Professional Papers

This dissertation examines women’s health through a biocultural framework that integrates biological anthropology, medical anthropology, and public health, with a central focus on the Pacific. It advances embodiment theory as a unifying approach for understanding how lived experience becomes biologically incorporated across the life course, shaping reproductive, endocrine, and immune outcomes. Grounded in research in Sāmoa and situated within broader comparative contexts in the United States and Amazonian populations, this work argues that women’s health cannot be fully understood through biomedical indicators alone, but must instead be interpreted within historically, culturally, and environmentally embedded Pacific contexts and beyond. The dissertation …

Lake As Body: Ecofeminism And Animacy At The Great Salt Lake, Shae Barber Jan 2026

Lake As Body: Ecofeminism And Animacy At The Great Salt Lake, Shae Barber

Graduate Student Theses, Dissertations, & Professional Papers

Water shapes cultural, social, and ecological systems. Yet, dominant economic, political, and academic frameworks often treat water as a backdrop or passive resource, ignoring it as an active participant in meaning-making and relationship-building. Viewing water as “nonliving” obscures how it participates in and co-creates relationships, limiting understanding about impacts of and responses to climate change and environmental degradation.

This thesis takes a mixed-methods and participatory approach including semi-structured interview, photovoice, and participatory mapping to examine relational practices between environmental advocates and the Great Salt Lake, a desiccating saline lake in Utah, U.S. As the lake continues to decline, dominant Western …
