What We Ask Of Law, Aziz Z. Huq Jan 2022

What We Ask Of Law, Aziz Z. Huq

Public Law and Legal Theory Working Papers

A minimal, reasonably uncontroversial, demand of a legal system is that it should stabilize a polity against the chance hazards of ordinary violence and soften the blows of extraordinary, destabilizing misfortune. Law in the contemporary United States, however, has not abated the lethal toll of violent crime, the serial mass shootings of children, the endless flow of racialized police violence, or even the toll of insurrectionary violence that shadows democratic politics. The gap between law’s operation in practice and its ultimate aspirations toward social order offers a hint that something in our dominant working model of law, and its relation …

Managing The Police Emergency, Adam Davidson Jan 2022

Managing The Police Emergency, Adam Davidson

Public Law and Legal Theory Working Papers

There is a policing emergency in the United States. Police across the country cause massive, widespread, and unpredictable physical harm—killings, beatings; psychological harm—negative stress-related birth and educational outcomes, general worsened mental health; and sociological harm—advancing the racial, gender, and economic hierarchies that undermine our work towards an equal society. Even after the largest protest movement in U.S. history in summer 2020, the traditional political process has failed to make significant inroads against this emergency.

This Article begins to explore in depth the legal ramifications of recognizing the policing emergency. It suggests that among the most important ramifications is unlocking a …

Pensar El Límite: El Símbolo Indígena En Los Proyectos Políticos Cubanos De Principios Del Siglo Xix, Jorge L. Camacho

The Coastal Review

This article investigates the way in which Cuban literature reflected on indigenous people during the early half of the nineteenth century and uses the symbol of the Amerindians to demonstrate a moral disjuncture between them and the colonizer. In this article, I call attention to the way Cuban independentists and Spanish nationalists used this figure to support their views and thus created a split in the Cuban creole imagination. I start by pointing out that these appropriations started at the end of the 18th century when historian José Martín Félix de Arrate, and poets such as Miguel González and Manuel …

Technology, Gender And Organizations: A Systematic Mapping Study, Gonzalo Valdes, Bobbi Thomason, Andrea Bentancor, Isidora Jeria, Constanza Troncoso

All Faculty Open Access Publications

In this article, we employed a systematic mapping methodology to examine the existing literature at the intersection of technology, gender and organizations. While much has been written about gender in organizations, the research has not consistently considered that modern organizations are increasingly technology-driven - in technology may lie an underexplored lever that could help expand our understanding of gender issues at the workplace. By analyzing a final sample of 168 research papers, we found that two main forms of conceptualizing technology emerged: technology as culture and technology as tools. Papers in the first category are concerned with environments in which …

Archiving Feminist Truth In Trump’S Wake Of Lies, Julie Shayne Jan 2022

Archiving Feminist Truth In Trump’S Wake Of Lies, Julie Shayne

Humboldt Journal of Social Relations

This article is about an assignment I do in one of my Gender, Women, and Sexuality Studies social movement classes. I revised the assignment the first time teaching the class after Trump lost the 2020 election. For the assignment, students work in groups to research local feminist and gender justice organizations and deposit all of their original materials – recordings, photos, flyers, etc. – into a digital, open access archive I co-created several years ago with librarians and staff on my campus. In 2021 I had my students do the “post-Trump” edition where they researched local organizations about how their …

Female Military Sexual Trauma: A Critical And Comprehensive Literature Review, Anna Stanton Jan 2022

Female Military Sexual Trauma: A Critical And Comprehensive Literature Review, Anna Stanton

Psychology Doctoral Specialization Projects

Military Sexual Trauma (MST) refers to a psychological trauma that resulted from any sexual assault or threatening sexual harassment that a military member experienced during his or her military service. Military sexual trauma is a significant problem within the United States military that threatens the strength, readiness, and morale of the military, and has devastating personal effects on survivors and their families. During 2006, the military began taking steps to understand the prevalence of MST and implement programs to help prevent it. Despite some of the progress these programs have shown, there are still barriers that impede an MST survivor’s …

Cannibalizing The Constitution: On Terrorism, The Second Amendment, And The Threat To Civil Liberties, Francesca Laguardia Jan 2022

Cannibalizing The Constitution: On Terrorism, The Second Amendment, And The Threat To Civil Liberties, Francesca Laguardia

Department of Justice Studies Faculty Scholarship and Creative Works

This article explores the links between internet radicalization, access to weapons, and the current threat from terrorists who have been radicalized online. The prevalence of domestic terrorism, domestic hate groups, and online incitement and radicalization have led to considerable focus on the tension between counterterror efforts and the First Amendment. Many scholars recommend rethinking the extent of First Amendment protection, as well as Fourth, Fifth, and Sixth Amendment protections, and some judges appear to be listening. Yet the Second Amendment has avoided this consideration, despite the fact that easy access to weapons is a necessary ingredient for the level of …

Truth, Lies, And Audio Files A Conflict Across Reputational And Convivial Domains, Maisa C. Taha

Conviviality (convivencia), a rubric for peaceable coexistence across cultural and ethnoracial differences, has been promoted as a multifaceted educational priority in contemporary Spain, although the stakes of tolerance and civility mean quite different things for pupils of autochthonous and immigrant backgrounds. For some Moroccan youth attending school in the agricultural southeast, experiences with xenophobia and racialized exclusion have made them both fierce critics and defenders of convivial precepts. At one secondary school, questions about convivial protocols became especially pressing in the wake of accusations against several Moroccan girls for stealing sandwiches from a disabled peer. A confrontation between three of …

Pain That Only She Must Bear: On The Invisibility Of Women In Judicial Abortion Rhetoric, Francesca Laguardia Jan 2022

Pain That Only She Must Bear: On The Invisibility Of Women In Judicial Abortion Rhetoric, Francesca Laguardia

Department of Justice Studies Faculty Scholarship and Creative Works

The graphic and bodily facts of a legal question of rights are relevant to the courts, particularly in questions that directly implicate physical bodies and pain, such as right to die cases, or what level of search may be allowable and when. However, in the case of abortion, or more specifically the bodily ramifications of pregnancy and childbirth, this detail is conspicuously absent. This article, relying on a content analysis of over 220 legal opinions on abortion rights, documents this absence of rhetoric. Particularly in the context of other discussions of pain and physical health risks in these very same …

Introducing Justicecraft: Political Change Across Space And Time, Lauren Balasco, Bea Ciordia, Eliza Garnsey, Sarine Karajerjian, Arnaud Kurze, Christopher K. Lamont, Nomzamo Ntombela

Department of Justice Studies Faculty Scholarship and Creative Works

Scholarship has often compartmentalised issues associated with injustice, political violence, and past wrongdoings. To contextualise questions of political change and justice across time and space, we introduce a dynamic, layered and transversal understanding of these processes. Drawing on Inés Valdez's notion of "justice as a political craft,"we explore situated struggles for change and justice. Coping with injustice is contingent on context-specific conceptual and practical understandings of justice and grounded in particular experiences. Drawing on symbolic sites-the Uprising, the Audience, the Body, the Affect, the Island, and the Map-we highlight a variety of struggles against past, present and future injustices. Struggles …

Restorative Justice In Cases Of Sexual Harm, Alexa Sardina, Alissa R. Ackerman Jan 2022

Restorative Justice In Cases Of Sexual Harm, Alexa Sardina, Alissa R. Ackerman

City University of New York Law Review

Restorative justice for cases of sexual harm offers a trauma-informed and evidence-based approach to healing and prevention that current criminal legal options do not. The literature is clear that current sex crimes policies and practices have been ineffective at reducing rates of sexual violence. Similarly, current criminal legal practices fail to hold people accountable for the sexual harms they’ve caused and do little to support survivors who come forward. Unlike the criminal legal system, restorative justice provides survivors with a safe platform within which to talk about their experience(s) of sexual harm on their terms and voice their individual needs …

The Color Of Local Government: Observations Of A Brown Buffalo On Racial Impact Statements In The Movement For Water Justice, Tom I. Romero Ii

City University of New York Law Review

Industrialized animal agriculture—concentrated animal feeding operations (“CAFOs”) and slaughterhouses—is inherently oppressive of both nonhumans and humans. This Article seeks to expose the human side of that exploitation, specifically examining how industrial animal agriculture was built upon and continues to propagate racism. The harms to humans of color perpetuated by this system are myriad and serious, ranging from physical to psychological and from troubling to life-threatening. This Article first examines how the animal agribusiness industry has harmed farmers and ranchers of color since the early 20th century through government-sponsored racist policies and practices. Second, the Article studies harms to workers, from …

Fractal Dimension As A Predictor Of Organizational Change Success, Thomas Anthony Seitz Jan 2022

Fractal Dimension As A Predictor Of Organizational Change Success, Thomas Anthony Seitz

Walden Dissertations and Doctoral Studies

As many as two thirds of organizational change (OC) initiatives fail to achieve their outcome objectives. Researchers have demonstrated that successful change requires alignment among all levels of an organization. However, contemporary OC models do not quantify the degree of hierarchical alignment during the change process. The purpose of this quantitative, correlational study was to examine whether the fractal dimension of hierarchical alignment (predictor variable) was associated with OC success (criterion variable) as described by the self-organizing fractal theory (SOFT). The research question addressed the association between the fractal dimension related to the alignment of OC beliefs and behavioral intentions …

Exploring The Significance Of Digital Skills Training For Accountants, Limin Zhu Jan 2022

Exploring The Significance Of Digital Skills Training For Accountants, Limin Zhu

Walden Dissertations and Doctoral Studies

Accounting firm leaders face a challenge with employees who lack digital skills. Employees without relevant digital skills put the accounting firm at a competitive disadvantage. Grounded in human capital theory, the purpose of this qualitative multiple case study was to explore strategies regional accounting firm leaders used to help employees improve digital skills. Data were collected from six semistructured interviews with partners, directors, and managers with three years or more of experience who participated in the training and professional development process at four regional accounting firms in the Houston, Texas area. The review of company documents and company website postings …

Rising Cost Of Medicare And Its Effect On Recipients 65 And Older, Williesa Toomer Jan 2022

Rising Cost Of Medicare And Its Effect On Recipients 65 And Older, Williesa Toomer

Walden Dissertations and Doctoral Studies

The rising cost of Medicare is a growing concern for recipients. Beneficiaries are often forced to implement a host of strategies to meet rising out-of-pocket expenses. This qualitative study was conducted to address a research gap in methods used by senior citizens to manage rising Medicare coverage costs. Garmezy’s resilience theory was used to contextualize the rising costs of Medicare premiums and copays and strategies used to manage healthcare needs. The purposive sample of 12 socioeconomically diverse respondents included eight women and four men ranging in age between 65 and 77, for an average age of 70.2 years. Participants completed …

Isolation, Cohesion And Contingent Network Effects: The Case Of School Attachment And Engagement, G. Robin Gauthier, Jeffrey A. Smith, Sela Harcey, Kelly Markowski Jan 2022

Isolation, Cohesion And Contingent Network Effects: The Case Of School Attachment And Engagement, G. Robin Gauthier, Jeffrey A. Smith, Sela Harcey, Kelly Markowski

Department of Sociology: Faculty Publications

Isolation and cohesion are two key network features, often used to predict outcomes like mental health and deviance. More cohesive settings tend to have better outcomes, while isolates tend to fare worse than their more integrated peers. A common assumption of past work is that the effect of cohesion is universal, so that all actors get the same benefits of being in a socially cohesive environment. Here, we suggest that the effect of cohesion is universal only for specific types of outcomes. For other outcomes, experiencing the benefits of cohesion depends on an individual’s position in the network, such as …

Time-varying covariates included year of the study, pain, functional ability, household work disability, parental status, marital status, employment status, and social support. The time-invariant covariates included years since diagnosis, education, race/ ethnicity, and gender. Multivariate multilevel-model analyses were used to estimate associations within people over time.

Results. Patients with RA experience considerable change in …

Pandemic, Politics, And Public Opinion About Crime, Lisa Kort-Butler Jan 2022

Pandemic, Politics, And Public Opinion About Crime, Lisa Kort-Butler

Department of Sociology: Faculty Publications

Prior scholarship links ontological insecurities, racial tensions, and health issues to public opinion about crime. This project examined these forces in the context of the 2020 pandemic, racial justice demonstrations, and politics using data from the Nebraska 2020 survey (N=2775). Pandemicrelated insecurities and racial animus were associated with avoiding places in the community, worry about crime, and the belief that police in one’s community are underfunded. Trusting politicians but distrusting health leaders, and viewing COVID as an economic threat but not a health threat were associated with the belief police are underfunded. Results suggest that the politicization of the pandemic …

A Message From The Editors Of Journal Of Survey Statistics And Methodology, Kristen Olson, Katherine Jenny Thompson

Department of Sociology: Faculty Publications

In June 2021, JSSAM received its opening impact factor (1.957 for 2020), ranking JSSAM as 46/125 in Statistics and Probability and 29/52 in Social Sciences Mathematical Methods. This ranking is especially gratifying given the relative youth of this journal, and credit should be shared among the dedicated editors (present and emeritus), associate editors, contributing authors, and readership. Truly, the past few years have brought about personal and professional challenges thanks to the coronavirus disease pandemic. Despite this, JSSAM has maintained its high standards, continuing to make great inroads toward its objective of being “the flagship journal for research on survey …
