Every 66 Hours. Dead Or Disappeared. A Colonial Gendered Lens On Genocide: Case Study On Canada's Genocide Against Indigenous Women, Girls, And 2slgbtqqia People, Megan Uren
Denver Journal of International Law & Policy
Genocide is happening today, and it will be happening tomorrow. It is not yet time to tell volunteers to stop dredging the Red River for dead bodies of Indigenous women and girls nor time for red dresses to stop being hung on the Highway of Tears. There are dead bodies in the water. There are missing bodies who were taken along wooded highways...
This article evaluates the current rates of violence against Indigenous women in Canada within (1) the greater context of an ongoing colonial genocide against Indigenous peoples and (2) with a narrow-gendered lens on women. First, I will …

Theorizing Failed Prosecutions, Jon B. Gould, Victoria M. Smiegocki, Richard A. Leo
Theorizing Failed Prosecutions, Jon B. Gould, Victoria M. Smiegocki, Richard A. Leo
Journal of Criminal Law and Criminology
Over the last twenty years, the scholarly field of erroneous convictions has skyrocketed, with multiple articles and books exploring the failures that convict the innocent. However, there has been comparatively little attention to the other side of the coin, failed prosecutions, when the criminal justice system falls short in convicting the likely perpetrator. In this Article, we take up an analysis of failed prosecutions, simultaneously seeking to define its breadth and explain its relation to erroneous convictions. We explore potential hypotheses for the existence of failed prosecutions and then compare those theories to a set of failed prosecutions compiled from …
U.S. Hate Crime Trends: What Disaggregation Of Three Decades Of Data Reveals About A Changing Threat And An Invisible Record, Brian Levin, James Nolan, Kiana Perst
U.S. Hate Crime Trends: What Disaggregation Of Three Decades Of Data Reveals About A Changing Threat And An Invisible Record, Brian Levin, James Nolan, Kiana Perst
Journal of Criminal Law and Criminology
When prejudice-related data are combined and analyzed over time, critical information is uncovered about overall trends, related intermittent spikes, and less common sharp inflectional shifts in aggression. These shifts impact social cohesion and grievously harm specific sub-groups when aggression escalates and is redirected or mainstreamed. These data, so critical to public policy formation, show that we are in such a historic inflection period now. Moreover, analysis of the latest, though partial Federal Bureau of Investigation hate crime data release, when overlaid with available data from excluded large jurisdictions, reveals hate crimes hit a record high in 2021 in the United …

Historically, the art market has been shrouded in opaqueness and exclusivity, permissioned access and asymmetry of information that rivals the systemic ills of legacy financial markets that led to the Great Recession. Moreover, legacy art market stakeholders have, through the centuries, been entrenched in elitist and inequitable notions of art that excluded Black artists. These legacy intermediaries have also consistently demonstrated a deep and enduring disdain for any art connected to the digital world. That is, until the age of COVID-19 and the dramatically increasing value and dominance of the non-fungible token (NFT) market.

Peace And Nuclear-Free Advocacy Revisited: Lessons From New Zealand And Implications For Japan, Pinar Temocin
Peace And Nuclear-Free Advocacy Revisited: Lessons From New Zealand And Implications For Japan, Pinar Temocin
International Journal of Nuclear Security
Although there are multiple pathways of conditions leading to desired policy outcomes, the viability of peace and nuclear-free advocacy can be related to the convergence of a strong, diverse, and active civil society, where leadership and a responsive political environment are well-integrated. We discuss that sociopolitical mobilizations (e.g. peace and nuclear-free advocacy), active civil society, and democratic institutions are not only linked to each other but are also co-existent. In this essay, we look at the case of New Zealand (Aotearoa) with its unique nuclear-free peace movement and find some implications for contemporary Japan, which is the only country which …
The Conundrums Of Hate Crime Prevention, Shirin Sinnar
The Conundrums Of Hate Crime Prevention, Shirin Sinnar
Journal of Criminal Law and Criminology
The recent surge in hate crimes alongside persistent concerns over policing and prisons has catalyzed new interest in hate crime prevention outside the criminal legal system. While policymakers, civil rights groups, and people in targeted communities internally disagree on the value of hate crime laws and law enforcement responses to hate crimes, they often converge in advocating measures that could prevent hate crimes from occurring in the first place. Those measures potentially include educational initiatives, conflict resolution programs, political reforms, social services, or other proactive efforts aimed at the root causes of hate crimes.

The article deals with the religious contexts of the modern civilizational crisis caused by Russia’s war of aggression against Ukraine. Among the multitude of thematic lines of this set of problems, the article’s authors focus their attention precisely on the position of the world Orthodox Churches regarding this war. The concentration of such attention is objectively determined by the fact that the majority of Ukrainian citizens position themselves as Orthodox by faith, and therefore, are particularly sensitive to the opinion of the leaders of the Orthodox Churches of the world. The article examines the value aspects of the problem of …

According to research by AHEAD (2021), students with specific learning difficulties are accessing third level education in greater numbers than ever before. My research has shown this to be the case also, however, my research, alongside a larger body of research (Clouder 2020; O’Brien, 2019; McCullagh, 2018) have highlighted that student with dyslexia tend not to access the support services. Within the body of research conducted in third level education in Ireland, few have focused on the overall experiences of students with dyslexia studying in third level education. My study addresses this gap in knowledge as it provides an insight …

Purpose of Review: The differential impact of the COVID-19 and HIV pandemics on marginalized communities has renewed calls for more robust and deeper investigation into structural and social causes of health inequities contributing to these infections, including underlying factors related to systematic racism. Using the Social Determinants of Health (SDOH) framework, we analyzed parallel and divergent factors associated with COVID-19 and HIV/AIDS and the prevalence of disparate disease in diverse communities. We utilized PRISMA guidelines to identify relevant literature (N = 210 articles) that resulted in a review of 125 articles included in our synthesis. Recent Findings: With racial health …

Evaluating The Effectiveness Of Mindfulness-Based Group Interventions On Reducing Externalizing Behaviors In Adolescent Populations, Erica Montgomery
Electronic Theses and Dissertations
This study explores the extent of the impact that mindfulness-based interventions, such as mindfulness-based stress reduction techniques, have on externalizing behaviors in adolescents. Specifically, the intended population receiving the intervention will be minority adolescents, ages 9-15, in rural Mississippi who have received disciplinary action from the school or community based on acting out and aggression. The Ohio Youth Rating Scale will be used to collect information from three primary sources: parents, teachers, and participants. Data will be collected at multiple points in the intervention. Based on previous research with similar age groups, outcomes should be favorable for reducing unwanted behaviors.
Program Evaluation Of Music Teacher Education In Ghana: Implications For Practice, Policy, And Research, George Blankson
Program Evaluation Of Music Teacher Education In Ghana: Implications For Practice, Policy, And Research, George Blankson
Electronic Theses and Dissertations
The improvement of music teacher education programs is inevitably tied to improvement of the quality of music instruction in schools. As such, one of the essential avenues for improving educational programs is conducting regular program evaluations. Given the ever-evolving national standards for school music, along with the changing socio-cultural dynamics in Ghana, a corresponding review of the music teacher education programs is needed. Accordingly, the purpose of this study was to evaluate the effectiveness of the music teacher education programs in Ghana. By overlaying the Content, Input, Process, and Product (CIPP) evaluation model as a conceptual framework, I sought the …
Sportisation And Values Of Competition : The Case Of Yo-Yoing, Ho Wang, Danny Kwong
Sportisation And Values Of Competition : The Case Of Yo-Yoing, Ho Wang, Danny Kwong
Bachelor of Social Sciences – Senior Theses
Yo-yoing was a popular pastime in the 90s. It has now developed as a sport with standard rules. This research locates competitive yo-yoing within the sociology of sports, specifically, it builds on the lifestyle sports literature. I understand yo-yoing as a lifestyle sport, serious leisure, and subculture. I argue that competition is a site of meaning-making in competitive yo-yoing and delineate the community’s response to sportisation through interviews with 15 yo-yo players in Hong Kong and an examination of a Netflix documentary on yo-yo. The findings suggest 2 implications: a re-visit to the anti-competition discourse among lifestyle sports, and, a …

Religious Leadership And Critical Junctures In The 2022 Russian Invasion Of Ukraine: 104 War Days Of Metropolitan Hilarion, Alar Kilp, Jerry G. Pankhurst
Occasional Papers on Religion in Eastern Europe
The chairman of the Department for External Church Relations (DECR) of the Russian Orthodox Church (ROC) Metropolitan Hilarion (Alfeyev) was dismissed from his office on the 104th day (June 7, 2022) of the Russian invasion of Ukraine. Was Hilarion dismissed because of his ‘silence’ on the Russian invasion? We study the 104 ‘war days’ of Metropolitan Hilarion from four dimensions: leadership as position; leadership as process; leadership as result; and leadership as person. Our findings are multivocal: the Russian invasion of Ukraine did become a leadership challenge for Hilarion the way that previous military interventions (in Ukraine and Syria) and …

Project Spraoi: The Implementation And Outcomes Of A Process Evaluation Of A School-Based Health Promotion Intervention, Yvonne Larrissa O’Byrne
Theses
Large multi-site school-based interventions are challenging to implement and difficult to evaluate due to the complex adaptive nature of schools as a research setting. This study focused on implementing a comprehensive process evaluation of a multicomponent primary school-based health promotion called Project Spraoi (PS), alongside intervention delivery, to aid the translation of outcomes and understand the moderating role of contextual factors on intervention delivery. PS is led by a physical activity (PA) specialist known as an Energizer and aims to improve children’s PA levels and reduce sedentary time by delivering 20 minutes extra daily moderate to vigorous PA (MVPA) during …
Federal Fashion: Uniform Modification, Self-Expression, And The Union Infantry Officer Of The American Civil War, Clayton Davis
Federal Fashion: Uniform Modification, Self-Expression, And The Union Infantry Officer Of The American Civil War, Clayton Davis
Theses
The military uniforms of the American Civil War, particularly on the Union side, varied tremendously through time and location. There were an endless number of combinationsmyriad boots and hats, coats and jackets, insignias, and trousers. That was true for officers, especially commissioned officers, who exercised the greatest aesthetic freedom. Scattered works have broached the topic of officer uniforms, especially those of Confederate officers, though their Union counterparts have gone under the microscope also. Invariably, these works include non-regulation uniforms, either compiled by officers from separate pieces or handmade by one of the hundreds of tailors working across the nation. However, …

"You Wanna Play Rough?": The Unlikely Partnership Of The Italian Mafia And Butch Lesbians In Greenwich Village, 1945-1968, Alison Jean Helget
Master's Theses or Doctor of Nursing Practice
During economic and political upheaval in Europe beginning in the late-1910s and dramatically progressing throughout the 1920s, young Italian men emigrated to the United States to earn decent salaries to bring back to their families across the ocean. However, some single men embraced the opportunities of New York City and its diversified neighborhoods. Since xenophobic sanctions forced disenfranchised minorities into confined spaces and immigrants tended to find comfort settling in neighborhoods with well-established ethnic enclaves, this pushed Italian immigrants into the same space as butch lesbians in a counterculture place referred to as Greenwich Village on the west side of …

Regulatory Diffusion, Jennifer Nou, Julian Nyarko
Regulatory Diffusion, Jennifer Nou, Julian Nyarko
Public Law and Legal Theory Working Papers
Regulatory diffusion occurs when an agency adopts a substantially similar rule to that of another agency. Indeed, regulatory texts proliferate just like other forms of law like constitutions, statutes, and contracts do. While this insight has been explored across countries, this dynamic also occurs closer to home: American administrative agencies regularly borrow language from one another. By our measure, in recent years, agencies reused one out of every ten paragraphs of the Code of Federal Regulations from another rulemaking. These insights are timely given a recent Supreme Court decision calling for judges to engage in less deferential regulatory interpretation. As …

A History Of Freed Slaves' Homes In Northern Nigeria, 1900-1926, Ajibola A. Abdulrahman
Electronic Theses and Dissertations
This dissertation is about the children rescued from slave traders by the British colonial government in Northern Nigeria in the early twentieth century. The children were first settled in state-owned Freed Slaves Homes located at Zungeru and Borno provinces in 1904. After the state-owned Homes were abolished in 1909, they were moved to the privately-owned Lucy Memorial Freed Slaves’ Home. The study focuses on the experiences of these liberated children within the premises of the Freed Slaves' Homes and in settings outside of these institutions in Northern Nigeria. Drawing on previously unused archival materials obtained from various parts of the …
The Relationship Between Ethnicity, Immigrant Generation, & Delinquency: Examining Youth In Child Protective Services., Erin Leigh Geist
The Relationship Between Ethnicity, Immigrant Generation, & Delinquency: Examining Youth In Child Protective Services., Erin Leigh Geist
Electronic Theses and Dissertations
Although minority youth are overrepresented in the makeup of the welfare and juvenile justice system, there is a lack of research that examines dually-involved youth. In recent years, there has been an escalation in the number of Hispanic youth that have become involved in the child welfare system, including youth that identify as Hispanic immigrants. This study uses nationally representative data of children receiving welfare services to examine the relationship between ethnicity, immigrant generation, and delinquency. The results of binomial regression models illustrated that there was no effect of Hispanic ethnicity or immigrant generation on delinquency. However, the analysis provided …

The Democratic (Il)Legitimacy Of Assembly-Line Litigation, Jessica Steinberg, Colleen F. Shanahan, Anna E. Carpenter, Alyx Mark
GW Law Faculty Publications & Other Works
In response to Daniel Wilf-Townsend’s Assembly-Line Plaintiffs we take a panoramic picture of state civil courts, and debt cases in particular, and name specific features of the courts that must be taken into account in crafting reform prescriptions. In doing so, we question both the democratic legitimacy of debt collection courts and the adequacy of incremental reform that targets the structure of litigation. Part I contributes two critical components to Wilf-Townsend’s rich description of consumer debt cases: pervasive intersectional inequality among pro se defendants and a record of fraud among top filers. We add a sharper focus on the racial, …
