This practice as research presents a case study of leadership in interdisciplinary settings, considering choreographic collaboration within technology, visual art, music and dance, alongside models used in teaching dance. I define leadership as influencing others to act towards a shared intention by holding space for psychological safety and peak performance. I synthesise leadership models relevant to my practice in a figurative ‘tree of transformation’, illustrating how Jim Collins’ Level 5 leadership, Robert K. Greenleaf’s servant leadership and C. Otto Scharmer’s Theory U model branch out from transformational leadership.

The Pro Se Gender Gap, Roger Michalski

This article is the first to identify, name, and empirically measure the pro se gender gap. Drawing on a massive dataset of all federal civil dockets spanning 10 years, it finds a 2-to-1 gender imbalance. For every federal female pro se litigant there are two males. This finding is robust and stable. It holds true for plaintiffs, defendants, and other parties. It is also true across most subject areas, across time, across length of litigation, and across states, districts, and circuits. The study excludes prisoner-rights and habeas petitions (including them would widen the gender gap even further). This gender gap …

This Article calls upon Congress to protect its citizens where state and local legislators will not. Although Congress is limited in its ability to regulate local policing, the United States Constitution does provide authority for some congressional reform and oversight into matters of state and local law enforcement through Article 1, Section 8. Congress can (and has before) conditioned the receipt of federal funds over states' conformity to federal standards or programs. Post-Covid-19 Travel Intentions To Kenya From Hong Kong By Applying The Extended Theory Of Planned Behavior (Etpb), Monica W.C. Choy

Purpose – This paper examines the post-COVID-19 travel intentions to Kenya among Hong Kong outbound travelers using the theory of planned behavior (TPB) over three different time horizons of 1, 5, and 10 years. Design/methodology/approach – An extension was made by including two new constructs of perceived destination image and travel constraints. A cross-sectional sample of Hongkongers was surveyed. Data were collected using a self-administrated bilingual (English and Chinese) online survey. Exploratory factor analysis, linear regression and mediation analysis were conducted to test the research model. An Exploration Of Human And Platform Intra-Actions In A Digital Teaching And Learning Environment, Sarah Julia Calderwood

This study uses a sociomaterial critical posthuman paradigm to examine possibilities, constraints, and tensions that come into view in the ‘intra-action’ between teachers and a digital environment. It considers how teacher subjectivities may be reimagined in new digitised visuospatial environments. This qualitative study utilises reflective interviews with things to illuminate general issues of subjectivities in human/digital contexts in a newly adopted Virtual Learning Environment (VLE) at a university in the Middle East. วัณโรค เป็นโรคที่อยู่กับสังคมมาอย่างยาวนาน ในปัจจุบันวัณโรค เป็นสาเหตุของการเสียชีวิตจากการติดเชื้อเป็นอันดับสองของโลกตามรายงานสถานการณ์วัณโรคโดยองค์กรอนามัยโลกปี 2023 (WHO, 2023) โดยประเทศไทยและประเทศเมียนมาร์ยังคงเป็นประเทศที่ถูกจัดอันดับ 30 ประเทศที่มีภาระวัณโรคสูงอย่างต่อเนื่อง วิทยานิพนธ์นี้ นำเสนอประเด็นวัณโรคข้ามแดน เพื่อแสดงให้เห็นความสัมพันธ์ที่ซับซ้อนระหว่างมนุษย์และสิ่งที่ไม่ใช่มนุษย์ภายในเครือข่ายการทำงานของวัณโรคกับแรงงานข้ามชาติชาวเมียนมาร์ โดยวิเคราะห์ความสัมพันธ์ของตัวแสดงที่อยู่ภายในเครือข่ายวัณโรคแรงงานข้ามชาติชาวเมียนมาร์ที่ต่างมีผลและส่งผลต่อกันและกัน เนื่องจากการทำงานวัณโรคในแรงงานข้ามชาติชาวเมียนมาร์มีหลายแง่มุมที่จำเป็นต้องให้ความสำคัญอย่างรอบด้านในทุกมิติ ไม่ว่าจะเป็น ชีวิตของแรงงานข้ามชาติในฐานะผู้ป่วย การให้ความช่วยเหลือตามมนุษยธรรม การเมืองของการให้ความช่วยเหลือ และการรักษาเพื่อให้หายจากความเจ็บป่วยที่ทุกมิติมีความเชื่อมโยงกันเป็นห่วงโซ่ในการทำความเข้าใจวัณโรคให้ครอบคลุมมากยิ่งขึ้นเพื่อเผยให้เห็นช่องว่างที่สำคัญบางประการในการทำงานวัณโรคที่ยังคงเป็นปัญหาในปัจจุบัน โดยการติดตามชีวิตผู้ป่วยวัณโรคแรงงานข้ามชาติชาวเมียนมาร์และการทำงานขององค์กรที่เกี่ยวข้องกับวัณโรคใน 2 พื้นที่หลัก ได้แก่ อำเภอแม่สอด จังหวัดตาก และจังหวัดสมุทรสาคร ด้วยวิธีวิทยาการติดตาม (Following Method) เพื่อทำความเข้าใจเครือข่ายความสัมพันธ์ของตัวแสดงที่เกี่ยวข้อง ไม่ว่าจะเป็น แรงงานข้ามชาติชาวเมียนมาร์ มนุษยธรรม ความเจ็บป่วย ยารักษา เชื้อโรค วิเคราะห์ด้วยกรอบทฤษฎีเครือข่าย-ผู้กระทำการเป็นแนวคิดหลักเพื่อนําเสนอข้อค้นพบสำคัญของการศึกษาที่ว่าด้วยประเด็นความสัมพันธ์ระหว่างมนุษยธรรม ความเจ็บป่วย และแรงงานข้ามชาติชาวเมียนมาร์ในประเทศไทย ข้อค้นพบของการศึกษานี้ เป็นการอธิบายความสัมพันธ์ของเครือข่ายและตัวแสดงที่เกี่ยวข้องกับวัณโรคในลักษณะของห่วงโซ่ที่เชื่อมโยงกันตั้งแต่ระดับปัจเจก ระดับท้องถิ่น ระดับประเทศ และระดับโลก ที่สะท้อนให้เห็นถึงความซับซ้อนและเปราะบางมากไปกว่าการควบคุมโรคในทางการแพทย์และกฎหมายแรงงาน แต่จำเป็นต้องความเข้าใจในทุกมิติเพื่อขยายไปสู่การทำงานวัณโรคในมิติใหม่ต่อไปได้

การบัญชีนิติวิทยา : กลไกป้องกันและปราบปรามอาชญากรรมทางเศรษฐกิจ, อิฐฐนันธ์ ปุรณะพรรค์

การวิจัยเรื่อง “การบัญชีนิติวิทยา : กลไกการป้องกันและปราบปรามอาชญากรรมทางเศรษฐกิจ เพื่อศึกษาถึงการใช้การบัญชีนิติวิทยามาต่อสู้กับอาชญากรรมทางเศรษฐกิจ และเสนอ แนวทางการเพิ่มประสิทธิภาพของการบัญชีนิติวิทยา โดยใช้ระเบียบวิธีวิจัยเชิงคุณภาพด้วยการสัมภาษณ์เชิงลึกจากผู้ให้ข้อมูลสำคัญ จำนวน 17 ท่าน และสังเคราะห์ข้อมูลเป็นข้อเสนอแนะที่สามารถนำไปปฏิบัติได้ ผลการวิจัยที่สำคัญ พบว่า การบัญชีนิติวิทยา คือ การรวบรวมหลักฐานการก่ออาชญากรรมทางเศรษฐกิจและการทุจริตไปสำแดงในชั้นศาล โดยใช้เทคนิคการสืบสวนทางการเงินและการบัญชี กลไกการป้องกันและปราบปรามอาชญากรรมทางเศรษฐกิจด้วยการใช้การบัญชีนิติวิทยา ประกอบด้วย (1) การป้องกันอาชญากรรม (Prevention) (2) การตรวจจับเฝ้าระวัง (Detection) (3) การสืบสวน (Investigation) เก็บรวบรวมหลักฐานขึ้นสู่ชั้นศาลหรือไกล่เกลี่ย และ (4) การเยียวยาชดใช้ผู้เสียหาย เทคนิคการบัญชีนิติวิทยาแบ่งเป็น 2 กลุ่ม ได้แก่ (1) Collection Forensic คือ การตรวจสอบเอกสารและไฟล์เอกสาร (2) Digital Forensic คือ การสืบหาหลักฐานจากอุปกรณ์และแพลตฟอร์มดิจิทัลต่างๆ ปัญหาและอุปสรรคของการใช้บัญชีนิติวิทยาในการป้องกันและปราบปรามอาชญากรรมทางเศรษฐกิจที่สำคัญ เช่น ประเทศไทยยังไม่มีการกำหนดมาตรฐานการบัญชีนิติวิทยาและจรรยาบรรณของนักบัญชีนิติวิทยา จึงควรจัดตั้ง “สมาคมนักบัญชีนิติวิทยาแห่งประเทศไทย” หรือกำหนดให้เป็นสาขาวิชาชีพแขนงหนึ่งใน “สภาวิชาชีพบัญชี” นักบัญชีนิติวิทยาภาคเอกชนถูกจำกัดการเข้าถึงฐานข้อมูลทางการเงิน ขณะที่หน่วยงานภาครัฐสามารถเข้าถึงฐานข้อมูลได้เต็มที่ จึงอาจจำเป็นต้องมีกฎหมายพิเศษ เช่น “ประมวลกฎหมายวิธีพิจารณาคดีอาชญากรรมทางเศรษฐกิจ” และการจัดตั้งองค์กรกลางที่เป็น “Single of Command” เช่น “กระทรวงความมั่นคงภายใน” หรือ “คณะกรรมการป้องกันและปราบปรามอาชญากรรมทางเศรษฐกิจ (ปป.อศ.)” หรือเพิ่มบทบาทหน้าที่ของ “คณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาติ (ป.ป.ช.)” นอกจากนี้ยังพบว่า ปัญหาด้านความรู้ความสามารถเกิดจาก “ระบบอุปถัมภ์” ผู้ตรวจสอบภาครัฐมักขาดทักษะด้านการบัญชีนิติวิทยาซึ่งเป็นพหุวิทยาการ (Multidisciplinary) เพื่อแก้ไขปัญหาเหล่านี้ การพัฒนาหลักสูตรการบัญชีนิติวิทยาจึงจำเป็นอย่างยิ่ง โดยอาศัยความร่วมมือแบบสหวิทยาการ (Interdisciplinary) และการฝึกอบรมร่วมกับสภาวิชาชีพบัญชี

บทบาทสตรีมุสลิมในการพัฒนาวิสาหกิจชุมชนอย่างยั่งยืน: กรณีศึกษาวิสาหกิจชุมชนดารุ้ลอิบาดะห์, ธิดาศิลป์ เปลี่ยนละออ

การศึกษาในครั้งนี้มีวัตถุประสงค์เพื่อทำความเข้าใจบทบาทสตรีมุสลิมในการพัฒนาวิสาหกิจชุมชน ตลอดจนการรวมกลุ่ม ความสัมพันธ์ระหว่างภายในและภายนอกชุมชน และผลกระทบที่เกิดขึ้นใน 3 ด้าน คือด้านเศรษฐกิจ ด้านสังคม และด้านสิ่งแวดล้อม โดยศึกษาผ่านกลุ่มตัวอย่างที่เป็นสตรีมุสลิมในกลุ่มวิสาหกิจชุมชน จำนวน 10 คน ภายใต้ทฤษฎีสตรีนิยมอิสลาม ร่วมกับแนวคิดเครือข่ายทางสังคม หลักการเศรษฐกิจหมุนเวียน และเป้าหมายการพัฒนาอย่างยั่งยืน ผลการศึกษาได้แสดงให้เห็นว่ากลุ่มสตรีมุสลิมพยายามธำรงบทบาทตามที่พระมหาคัมภีร์อัลกุรอานได้ระบุไว้อย่างชัดเจนในด้านบทบาทและสิทธิที่สตรีมุสลิมพึงปฏิบัติที่มากกว่าโลกส่วนตัว หากแต่กลุ่มสตรีมุสลิมได้ก้าวออกมาสู่โลกสาธารณะ การรวมกลุ่มสตรีเพื่อหารายได้และการก้าวขึ้นมาสู่บทบาทของผู้พัฒนาชุมชนที่ได้รับการยอมรับจากคนในชุมชน นอกจากนี้กลุ่มสตรีมุสลิมยังมีการเพิ่มพูนความรู้อยู่อย่างสม่ำเสมอเพื่อพัฒนาทักษะและความสามารถของตนเอง อีกทั้งยังมีการสร้างเครือข่ายทางสังคมทั้งกับคนภายในชุมชนและหน่วยงานภายนอก โดยการปฏิสัมพันธ์กับคนในชุมชนนั้นเป็นความสัมพันธ์ที่เข้มแข็ง มีความเรียบง่าย สนิทสนมและความเป็นเครือญาติกัน จึงให้ความช่วยเหลือซึ่งกันและกันอยู่อย่างเสมอ สำหรับหน่วยงานภายนอกจะทำหน้าที่แจ้งข้อมูลข่าวสารต่างๆ รวมไปถึงการให้ความช่วยเหลือสนับสนุนด้านงบประมาณในการพัฒนาวิสาหกิจชุมชนให้มีศักยภาพมากยิ่งขึ้น ทั้งนี้การเติบโตอย่างมั่นคงและการพัฒนาวิสาหกิจชุมชนอย่างยั่งยืนมีความสอดคล้องกับหลักการเศรษฐกิจหมุนเวียนโดยเมื่อนำมาประยุกต์ใช้กับการพัฒนาวิสาหกิจชุมชนพบว่าได้ก่อให้เกิดผลกระทบต่อชุมชนใน 3 ด้าน ประกอบไปด้วย ด้านเศรษฐกิจคือวิสาหกิจชุมชนมีบทบาทในการส่งเสริมการจ้างงาน การเพิ่มการกระจายรายได้ให้แก่คนในชุมชน การเลือกใช้วัตถุดิบท้องถิ่นมาเพิ่มมูลค่าด้วยการแปรรูป ด้านสังคมมีการดึงการมีส่วนร่วมจากคนในชุมชนอย่างเป็นรูปธรรม และด้านสิ่งแวดล้อมคือลดปัญหาการเกิดขยะ การพยายามอนุรักษ์น้ำ และส่งเสริมความตระหนักด้านสิ่งแวดล้อมแก่คนในชุมชน ซึ่งเป็นไปในทิศทางเดียวกับเป้าหมายการพัฒนาอย่างยั่งยืนจำนวน 6 ข้อด้วยกัน ประกอบไปด้วย ข้อที่ 1 ขจัดความยากจน ข้อที่ 2 ขจัดความหิวโหย ข้อที่ 4 การศึกษาที่มีคุณภาพ ข้อที่ 5 ความเท่าเทียมทางเพศ ข้อที่ 8 การจ้างงานที่มีคุณค่าและการเติบโตทางเศรษฐกิจ และข้อที่ 13 การรับมือกับการเปลี่ยนแปลงสภาพภูมิอากาศ

การศึกษาวิจัยเรื่อง ปัญหาและอุปสรรคในการสืบสวนสอบสวนคดีความผิดเกี่ยวกับการแสวงหาผลประโยชน์ทางเพศจากเด็กและเยาวชนออนไลน์ มีวัตถุประสงค์ 1) เพื่อศึกษาถึงปัญหาและอุปสรรคในการสืบสวนสอบสวนคดีความผิดเกี่ยวกับการแสวงหาผลประโยชน์ทางเพศจากเด็กและเยาวชนออนไลน์ 2) เพื่อเสนอแนะแนวทางการแก้ไขปัญหาและอุปสรรค การสืบสวนสอบสวนคดีความผิดเกี่ยวกับการแสวงหาผลประโยชน์ทางเพศจากเด็กและเยาวชนออนไลน์ เป็นการวิจัยเชิงคุณภาพ (Qualitative Research) ที่มุ่งเน้นศึกษาผู้ที่มีหน้าที่ในการสืบสวน สอบสวน นักกฎหมาย ในคดีที่ผู้เสียหายเป็นเด็กในคดีออนไลน์ ผลการศึกษา พบว่า จากแบบสัมภาษณ์ทั้งหมด 9 คน โดยมีบทบาทหน้าที่ดังนี้ เจ้าหน้าที่ตำรวจ TICAC จำนวน 5 คน นักจิตวิทยา จำนวน 1 คน พนักงานอัยการ จำนวน 1 คน NGO จำนวน 1 คน และนักสังคมสงเคราะห์ จำนวน 1 คน ปัญหาและอุปสรรค ข้อมูลที่เด็กไม่เต็มใจให้ข้อมูลกับเจ้าหน้าที่เนื่องจากว่าเด็กเป็นผู้เสียหาย เด็กอาย และไม่ต้องการให้เจ้าหน้าที่ทราบหรือให้บุคคลอื่นทราบ ก็จะปกปิดเป็นความลับ และเกี่ยวกับเรื่องของพ่อแม่ผู้ปกครองผู้เสียหายที่ไม่เข้าใจบทบาทของเจ้าหน้าที่ว่าเข้าไปช่วยเหลือ ไม่ได้เปิดเผยข้อมูลแต่ต้องการหาพยานหลักฐานเพื่อจับคนร้ายมาดำเนินคดีตามกฎหมายให้ได้ เพราะไม่งั้นก็จะไปหลอกคนอื่นต่อ และที่เจอเป็นฝั่งของผู้เสียหาย เกี่ยวกับเรื่องของสภาพแวดล้อม และชุมชนของบ้านผู้เสียหาย ซึ่งปัญหาส่วนใหญ่ที่เกิดมาจากปัญหาครอบครัวที่บ้าน ปัญหาภายในครอบครัว และเป็นเรื่องของการเยาว์วัยของฝั่งผู้เสียหายคือสติปัญญาของเด็กยังไม่ก้าวทันภัยในส่วนของคนร้าย และปัญหาของการสืบสวนคือคนร้ายปิดบังอำพรางตัวตน บางทีสามารถขอข้อมูลจากทาง Facebook, Twitter ผู้ให้บริการในประเทศอย่างการขอ IP Address การขอหมายเลขโทรศัพท์มันต้องใช้เวลายุ่งยาก มันทำให้เป็นอุปสรรคในการสืบสวน ข้อเสนอแนะ เน้นในเรื่องของกระบวนการสืบสวนสอบสวนให้ละเอียดรอบคอบอย่างเดียว จะทำให้การประสานงานระหว่างหน่วยงานจะง่ายขึ้น แล้วก็รวดเร็วขึ้น และทุกอย่างให้มองเห็นประโยชน์ของเด็กเป็นสำคัญมากกว่าผลประโยชน์ของหน่วยงานตัวเอง และปัญหาเกี่ยวกับเรื่องของการตรวจ เพราะมาพร้อมกับเทคโนโลยีสมัยใหม่ ปัญหาที่เจอคือเรื่องการตรวจพยานหลักฐานทาง Computer เพราะส่วนใหญ่ผู้ต้องหามีการปิดล็อกพาสเวิร์ดทาง Computer และมือถือทำให้ยากขึ้นตามเทคโนโลยีสมัยใหม่ เจ้าหน้าที่มีความรู้ความเข้าใจอย่างเพียงพอหรือยังที่ต้องเก็บพยานหลักฐานคือให้เจ้าหน้าที่ผู้รับแจ้งมีความรู้มีสกิลในการแนะนำเบื้องต้น ไม่ว่าจะเป็นการเก็บพยานหลักฐาน และกระบวนการยุติธรรมที่เป็นมิตรสำหรับเด็ก ซึ่งมันขยายได้ว่าปัจจุบันมันยังไม่เป็นมิตรสำหรับเด็ก คือกระบวนการสืบสวนสอบสวนมันเหมือนการกระทำซ้ำกับเด็กด้วย พนักงานสืบสวนเองในหลายๆ พื้นที่โดยเฉพาะพื้นที่ห่างไกล พื้นที่ที่ยังไม่ค่อยใช้สื่อ Online ตำรวจก็มีข้อจำกัดในการใช้เครื่องมือในการสืบสวน หรือบางแอพตำรวจยังไม่รู้จักเลย บางทีก็มีการใช้ถ้อยคำที่ทำร้ายจิตใจไม่เหมาะสม และการเก็บพยานหลักฐาน และขอเพิ่มเติมข้อเสนอแนะในด้านของกระบวนการยุติธรรมที่เป็นมิตรสำหรับเด็กสำคัญมากในเรื่องความเป็นส่วนตัวแล้ววิธีการในการพูดคุยกับผู้เสียหาย ให้มีการเพิ่มจำนวนพนักงานสอบสวนหญิง แล้วก็พนักงานอัยการผู้หญิง ปัญหาการค้ามนุษย์ ปัญหาปัจจุบันก็ที่เค้าเน้นหนักคือพวกบัญชีม้า เพราะทำให้ไม่สามารถพิสูจน์ทราบได้ว่าใครเป็นคนกระทำความผิดจริง และข้อเสนอแนะไว้เรื่องเกี่ยวกับการเรื่องทางเพศ ซึ่งเกี่ยวข้องกับการปฏิบัติงานในการปราบปรามอาชญากรรมทางเพศ
