Principles On Effective Investigative Interviews: A New Instrument Of International Law, Juan E. Mendez, Matthew Ilsley Jan 2023

Principles On Effective Investigative Interviews: A New Instrument Of International Law, Juan E. Mendez, Matthew Ilsley

Human Rights Brief

International law absolutely prohibits torture and ill-treatment, yet such abuses remain prevalent and widespread. It most frequently occurs in the questioning of individuals by law enforcement, intelligence officials, and military personnel in the context of “fighting crime,” obtaining confessions, controlling detainees, and “counterterrorism.” The “Torture Memorandums,” exemplifying the deeply misguided practices used in the global fight against terror following the attacks of September 11, 2001, illuminated the pervasiveness of these practices.

The American Founding Documents And Democratic Social Change: A Constructivist Grounded Theory, A I. Forde

A post hoc polytheoretical framework including Foucault’s, Bourdieu’s, and Marx and Engels’s theories of power was used to understand power dynamics. The research question focused on understanding the process of …

Administrative Use Of Prior Review In High School Journalism Programs, Pedro J. Cabrera Jan 2023

Administrative Use Of Prior Review In High School Journalism Programs, Pedro J. Cabrera

Walden Dissertations and Doctoral Studies

In Hazelwood v. Kuhlmeier (1988), the U.S. Supreme Court established that school administrators have the right to review, change, or remove student-created media if the school sponsors it and if the school administrator has a “legitimate pedagogical interest,” which has been inconsistent across high school student-created media in a metro area of a southern region in a southwestern state. Because of the vagueness, the administration can review, change, or remove student-created media based on personal social, cultural, ethical, or political beliefs. The purpose of this basic qualitative research was to examine how campus administrators determined “legitimate pedagogical interest.” Gatekeeping theory …

Black Land: Research Note On The Heirs’ Property To Poverty Pipeline In Louisiana, Lauren Hall, Ifeyinwa F. Davis Jan 2023

Black Land: Research Note On The Heirs’ Property To Poverty Pipeline In Louisiana, Lauren Hall, Ifeyinwa F. Davis

Heirs' Property

Successful heirs’ property reform – the Uniform Partition Heirs’ Property Act (UPHPA) – is widespread in the U.S. Despite these advancements, Louisiana falls behind. Louisiana is the only state in the Deep South that has not enacted legal reform to protect heirs’ property owners. Heirs’ property locks many Black Americans into persistent poverty and economic oppression, eliminating generations of Black American wealth. This research note describes and examines these issues. Articulating the history of systemic legal oppression of Black land ownership, this article demonstrates how the current legal state shuns Black Americans economically and socio-politically disadvantages them and examines how …

Tilting It Forward: The Transparency Model Of Assessment As A Scaffold For Secondary Teacher Education, Nancy L. Remler

International Journal for the Scholarship of Teaching & Learning

Even though K-12 educators must assess student learning and adjust instruction based on learning data, many teachers lack confidence in their ability to assess. Because low confidence levels may be due to inadequate teacher preparation, this study invokes the pivotal SoTL project, Transparency in Learning and Teaching (TILT), as it examines TILT’s impact on twelve undergraduate ELA teacher candidates (TCs). The hypothesis was that TILT would not only enhance undergraduate TCs’ learning outcomes in an ELA methods course, but also scaffold their early development of assessment literacy. Findings support the hypothesis but indicate that TCs would benefit from additional instruction …

White Cities, White Schools, Erika K. Wilson Jan 2023

White Cities, White Schools, Erika K. Wilson

Faculty Articles

Across the country, violent tactics were employed to create and maintain all-white municipalities. The legacy of that violence endures today. An underexamined space in which that violence endures is within school districts. Many school district boundary lines encompass geographic areas that were created as whites-only municipalities through both physical violence and law. Yet principles that inform how school district boundary lines are drawn fail to account for the harms engendered by geographic spaces that are formerly whites-only municipalities. Legal doctrine and public policies also fail to capture the significance of the historical violence in considering the constitutionality and normative propriety …

The Adjudicative State, Adam B. Cox, Emma Kaufman Jan 2023

The Adjudicative State, Adam B. Cox, Emma Kaufman

Faculty Articles

Over the last decade, the Supreme Court has advanced a new vision of the administrative state. The two commandments of administrative law in the Roberts Court are to give the President control over the executive branch and to separate government functions into their proper branches. Scholars often describe these two principles as related pieces of a broader effort to shift policymaking toward elected officials and strip power from the civil service. In the standard account, unitary executive theory and separation-of-powers formalism are complementary ideas, which reflect the Court’s skepticism about bureaucratic governance. This Feature questions that consensus. It argues that …
