The Rule Of Interlegality, Nicole Roughan
The Rule Of Interlegality, Nicole Roughan
Buffalo Law Review
A “recognition model of legality” grounds legality upon the normative significance of recognition of the role of the official of law, and the requirements of a moral relation of recognition between law’s officials and subjects. On this model, plural overlapping claims to legality can undermine the rule of law by disrupting recognition of both the role of the official and the moral relation of legality between officials and subjects. This Essay examines the legality deficits that arise from conflicting recognitions of officiality and subjection in contexts of overlapping state and Indigenous legal orders. In such contexts of plural overlapping claims …
The Workings Of Legal Exceptionalism: Arbitration As A Portal To Stateless Law-In-Action Regimes, Thomas Schultz
The Workings Of Legal Exceptionalism: Arbitration As A Portal To Stateless Law-In-Action Regimes, Thomas Schultz
Buffalo Law Review
This Essay seeks to explores the fertility of thinking about arbitration as a portal to stateless legal regimes. Using the distinction between law in books and law in action, as well as the concepts of social and political disembeddedness and quiet politics, it argues that under the current paradigm of arbitration, it operates as a porous portal, getting corporate and natural citizens to escape into stateless law-in-action legal regimes (though in practice not into a law-in-books stateless legal regime). This raises questions of control of and accountability for the political effects of such stateless law-inaction legal regimes on the rest …
When European State Courts Face Post-Colonial Legality: A Private International Law Approach Inspired By Decolonial Theory, Sandrine Brachotte
When European State Courts Face Post-Colonial Legality: A Private International Law Approach Inspired By Decolonial Theory, Sandrine Brachotte
Buffalo Law Review
This Essay develops avenues for private international law (PIL) to deal with cases involving the interaction between Western state law and distinctive forms of law that citizens from post-colonial states, especially African states, bring with them to Europe. Laws of the second type, which I call “postcolonial legality,” incorporate both traditional forms of legality usually dubbed “religious” and “customary” law along with state law that originates from colonial law. Drawing on some lessons from decolonial theory, I try to apply to this particular context a “less colonial” PIL theory and subsequent PIL rules and reasoning. The argument builds on the …
The Priority Of International Law, Pavlos Eleftheriadis
The Priority Of International Law, Pavlos Eleftheriadis
Buffalo Law Review
What is international law? Any theory of international law must explain both its technical nature and its moral force and must also show how the two come together in practice in order to give it the priority that it claims. For example, the genocide cases before the International Court of Justice exhibit a puzzling dedication to procedure. The Court is invited to examine the war in Gaza strictly on the basis of the Genocide Convention, without assessing any allegations of war crimes or other alleged violations of international law. The reason is a well-known procedural rule—namely that states have to …
Ephemeral Legacy, Allison Hall
Ephemeral Legacy, Allison Hall
Master's Theses
Recently, my thoughts have centered on the problem of legacy. How do we forge bonds with other humans? What happens on an interpersonal level when these humans pass away, or when we pass, and they continue in life? How do queer spaces consistently offer deeper phenomena of interpersonal legacies; how does death operate as generational catalyst? I am particularly interested in putting these questions in the context of queer spaces. In queer culture, kinship is formed in ways that break from typical western notions of kinship. Despite being incoherent to western notions of family, queer bonds are extremely strong (Bradway …
Exploring The Interactive Effects Of Officer, Subject, And Encounter Factors On Police Use Of Force Outcomes, Jeremy David Barnum
Exploring The Interactive Effects Of Officer, Subject, And Encounter Factors On Police Use Of Force Outcomes, Jeremy David Barnum
UNLV Theses, Dissertations, Professional Papers, and Capstones
Police use of force incidents are highly complex events that can be characterized by factors pertaining to the officers, subjects, and immediate encounter. These factors and the dynamic interrelationships between them encompass the situational context of use of force and have been widely studied in the criminological literature (Bolger, 2015). However, extant research has almost exclusively focused on identifying the main effects of situational factors on use of force with little consideration of how effects may vary across specific situational contexts. This limits our understanding of police use of force and complicates efforts to develop policy or training that ensures …
Social Network Analysis: How Social Media Groups Can Influence Policies Among Hispanic Families, Valeria Gurr
Social Network Analysis: How Social Media Groups Can Influence Policies Among Hispanic Families, Valeria Gurr
UNLV Theses, Dissertations, Professional Papers, and Capstones
The COVID-19 pandemic in March 2020 impacted the entire world in various ways. On March 15, 2020, education in Nevada was significantly impacted when the Governor announced the closure of public schools due to the pandemic. When the schools were closed, students were forced to stay home and receive their education through virtual instruction. This transition to distance education affected the Hispanic/Latino(a) communities in pronounced ways and highlighted issues such as limited access to the Internet, technology, lack of hardware devices, as well as language barriers and more. This study uses social networking analysis techniques to examine the nature of …

Before Ministry, Education Is Important (Bmei): A Comprehensive Enquiry About The Impact Of Education On Ministry, Mcclintock Acsmhour
Electronic Theses and Dissertations
Ministry has a variety of fields ranging from churches, social nonprofit organizations, and government ministries in agriculture, health, education, lands, and many more. While this study did not focus on other ministries apart from Christian non profit ministries like church, to some extent, all leaders in these ministries avow that one requires some level of education to be in leading positions in these ministries. In other words, the qualified individual must have been trained in a particular field within the ministry of interest. This indicates the importance of education in ministry. Therefore, this study was conducted to uncover the impact …

Opioid Knowledge And Experiences In Nebraska College Students, Natalie Holding
Theses/Capstones/Creative Projects
This study investigated opioid-related knowledge and experiences among 83 Nebraska college students, with an emphasis on awareness, perceived risks, and educational needs regarding opioids and the overdose-reversing drug, naloxone. For participants who have used opioids outside of a doctor’s orders, questions were asked regarding motivations, comorbidities, coping mechanisms, and treatment experiences. Data were collected via an anonymous survey featuring closed- and open-ended questions. Results showed that 41% of participants reported feeling moderately knowledgeable about opioid risks, while 34% felt only slightly knowledgeable. Although 80.7% of participants were aware of naloxone, most were uncertain either about (22.9%) or did not know …

A program to provide supplementary support for the mental health and wellness of students at a midsize Southern University by providing a centrally located “relaxation space” for students on campus during the last two weeks of the semester is proposed and tested. A central location was found on campus to host the space. The researcher also developed an online survey for students to review the space. The trial was run for two weeks, and participants were able to access the online survey throughout those weeks. The results of the survey were analyzed to better understand the students’ responses to the …
Barriers In Reporting Sexual Violence On College Campuses, Amber Hartman
Barriers In Reporting Sexual Violence On College Campuses, Amber Hartman
Honors Theses
This thesis is designed to examine the underreporting of sexual violence on college campuses by exploring the systemic, cultural, and logistical barriers that hinder victims from disclosing their assault. Using both qualitative and quantitative methodologies, the research identifies three overarching influences for non-reporting. Fear, shame, and lack of resources are presented as the basis of the decision that victims make to not report. Meta-analysis of the research concludes that there is a profound impact of internalized victim-blaming narratives, fear of repercussions and institutional deficiencies in providing accessible support. Recommendations for solutions emphasize creating trauma-informed policies, improving communication and accessibility of …

Beauty Beyond Barbed Wire: Chiura Obata’S Perspective Of The Horizon, Bri Carlson
Beauty Beyond Barbed Wire: Chiura Obata’S Perspective Of The Horizon, Bri Carlson
Theses
Depictions of the environment are an integral part of American art history because they convey cultural relationships of all who inhabited the land. The environment is often a stagnant force that harbors lifetimes of human history. One of these histories is the incarceration of about 120,000 Japanese immigrants and American citizens in 1942 after the bombing of Pearl Harbor. They were forced to evacuate their homes, lives, and families to live in detention centers and prison camps where living conditions were subpar. Many turned to art making to cope, and some artists used their work to silently protest and visually …
Heritagutopia: A New Utopian Paradigm, Luca Donner, Francesca Sorcinelli
Heritagutopia: A New Utopian Paradigm, Luca Donner, Francesca Sorcinelli
All Works
The progress of humanity has always, and sometimes even unconsciously, been confronted with the concept of utopia at the social, economic, political, and urban level. The strength of every utopian vision lies in the disruptive factor inherent in the idea of metamorphosis of the status quo. In the urban context, it represents the pillar on which the vision of modern society and its city are based and understood as potential and progress for mankind. Authors such as Bauman, Bloch, Calvino, More, Mumford, Tafuri, and others, have formed the theoretical framework of the dialectic on which this study is based. As …
Exploring The Influence Of Black Male Graduates’ Cross-Racial Relationships On Social Engagement During Their Undergraduate Years At A Predominantly White Institution, Dominique Fowler
Education Doctoral
With a sample of 12 Black male college graduates, the purpose of this study was to explore the factors that influenced the participants’ cross-racial relationships with their peers at a predominantly White institution (PWI), how stereotypes and biases affected their relationships and social engagements, and how the participants navigated power dynamics and the microaggressions that occurred within their formed and maintained cross-racial relationships during their undergraduate years. The theoretical frameworks for this study were social identity theory and contact hypothesis, which provided a foundation for examining how stereotypes, biases, power dynamics, and microaggressions affect cross-racial relationships. The findings from this …
From Pages To Pixels: Library Workers’ Perceptions Of Power In The Digital Era, Sean Gaffney
From Pages To Pixels: Library Workers’ Perceptions Of Power In The Digital Era, Sean Gaffney
Dissertations
This work explores how library workers experience power during the era of digital transformation. As libraries transition from traditional knowledge repositories to dynamic, technology-driven information centers, power structures within these institutions are undergoing significant change. Despite the extensive implementation of digital transformation initiatives, there is a critical gap in understanding how digitalization is impacting employees’ experiences of power within the library context.
Drawing on French and Raven’s Bases of Social Power model, this study investigates how digital tools, platforms, and processes influence how power is perceived among library workers and its distribution and sources. A qualitative survey study was conducted …
They Can't Know I Wanna Kiss Robots: Stigma And Audience Segregation In Fanfiction, Micah Arrow Callin
They Can't Know I Wanna Kiss Robots: Stigma And Audience Segregation In Fanfiction, Micah Arrow Callin
Master's Theses
Fanfiction writers have long faced public stigma, which emerged with the rise of fandom and, according to recent claims, may be lessening as fandom identities gain wider acceptance. However, the practice of fanfiction writers intentionally segregating their audiences remains a deeply embedded aspect of fandom culture, with limited understanding of its underlying motivations. The purpose of this study was to analyze the audience segregation employed by online fanfiction authors in order to understand why they choose to segregate their audiences, and specifically to determine the influence of social stigma on these choices, answering these main questions: Is there segregation between …

CASEL’s (Collaborative for Academic, Social, and Emotional Learning) theoretical framework of the five core competencies of self-awareness, self-management, social awareness, relationship skills, and responsible decision-making (2024) guided the research. The literature review analyzed studies conducted related to social-emotional learning (SEL) and professional development. It focused on the themes of SEL policy and legislation, teachers’ perception of SEL, the impact of SEL on students, methodology, potential barriers to SEL, professional development, teaching experience, and gaps in the research that pertain to teachers’ …
Frédéric Ozanam’S Lay Vision Of Reform: The Transformation Of His Church And His World, Raymond L. Sickinger
Frédéric Ozanam’S Lay Vision Of Reform: The Transformation Of His Church And His World, Raymond L. Sickinger
Vincentian Studies
Ahead of his time, Frédéric Ozanam believed that the laity should play an essential role in what he termed the regeneration of the Church, which would lead to the regeneration of society. This would “occur only if Catholic laypersons understood that they had an obligation to transform themselves and then to use their talents to better their Church and their world.” Transformation was to touch all the religious, social, economic, and political aspects of life. In this spirit, he founded the Society of Saint Vincent de Paul: “the transformation of the individual members, and thereby the transformation of the society …

The Disconnect Between Spanish-Speaking Communities And Law Enforcement And The Detrimental Effect It Has On Both, Belma Kurpejovic
Honors Theses
The increase of Latino communities in mid-sized and smaller cities, along with the impact of language competency and lack of programs for law enforcement, has been sufficiently explored, yet issues persist. This study examines the disconnect between Spanish-speaking communities and law enforcement, which has created significant distrust and communication issues. Examining these communities is important because there is still a need to mend these relationships. This study explores the effects of this divide and how to help fix it. Information obtained from law enforcement officers at the Chattanooga Police Department, highlights key issues, including the lack of community-based policing, cultural …

The Dynamic Effects Of Transformational Leadership On Employee Retention And Employability Over Time: An Agent-Based Model, Sophia R. Thomas, S. R. Aurora
Management Faculty Publications
Employee retention is a problem for organizations of all sizes. Research has shown that transformational leaders improve retention and reduce turnover; however, there has been little research on the effects of transformational leadership on retention over time while also considering employees’ changing employability. We use agent-based modeling to demonstrate these changing relationships while considering the nature of modern organizations. Our model looks at the relationships between transformational leaders, individual employability, and retention. The model uses data from earlier research to define parameters for these variables, showing how workers and leaders interact and affect employability and retention and how these effects …

When Is It Convenient For Indigenous Women To Influence State Policies?, Alaide Vences Estudillo, Norma Don Juan Pérez, Patricia Torres Sandoval, Fabiola Del Jurado Mendoza
Peace and Conflict Studies
This paper examines the difficulties that a network of Indigenous women in Mexico deal with when they seek peace for their people under a hybrid political structure. This paper discusses some distinctive aspects of the politics that these women engage in, how they conceive their political ideas, and how they use these ideas to structurally transform the colonial relationship that the liberal state maintains toward their people. They devise various strategies to influence state policies and to withstand the discrimination they face whenever they participate in democratic affairs.

Mothering, Leadership, And Career: A Narrative Analysis, Joanne Susan Roehm
Dissertations
In March 2020, much of the world was “sent home” from work and periods of lockdown began. In West Michigan, Friday, March 13 was the day that most workplaces closed their doors and employees began working from home for what was assumed to be a period of weeks. In the spring of 2020 between March and April, some million mothers living with school-age children left active work—either shifting into paid or unpaid leave, losing their job, or exiting the labor market all together.
The stories of mothers who experienced the “balancing act” of mothering and working at home during the …
Violence In The Administrative State, Emily R. Chertoff
Violence In The Administrative State, Emily R. Chertoff
Georgetown Law Faculty Publications and Other Works
Drawing on an original, interview-based case study of Immigration and Customs Enforcement (ICE) and a synthesis of six decades of social science literature, this Article offers a theory of physical violence in the administrative state that challenges foundational assumptions about administrative law. Approximately one-fifth of federal employees work for administrative agencies that police, fight wars, enforce immigration law, or incarcerate people—in other words, agencies that use force to execute the laws. These agencies are saturated with administrative law that obligates front-line administrators to confer due process, give notice, behave non-arbitrarily, and comply with law. Yet this law often fails to …

America At A Glance: Rural Transit Funding Through The Covid-19 Pandemic, Andrew Myers, Luke Santore
Independent Living and Community Participation
While all people need transportation to meet their basic needs, rural people with disabilities face barriers due to lack of public transportation and not driving. Federal transit funds to improve public transportation doubled during the COVID-19 pandemic, but most went to metropolitan and micropolitan counties, with many rural counties receiving no transit funds from 2018-2022. This factsheet explores and illustrates these differences in transit funds received in urban and rural counties.
