Abolish What?, Benjamin Levin
Abolish What?, Benjamin Levin
Scholarship@WashULaw
From leading academic journals to popular press outlets, abolitionist activism and scholarship have earned airtime in national debates about criminal justice reform. But what is "abolition?" When scholars, lawyers, and activists talk about abolition, they seem to mean very different, even conflicting, things. In this Essay, I focus on a core question that might divide different abolitionists-and different critics of abolition: what is to be abolished? Abolitionists argue that it's critically important to abolish something, while critics of abolition insist that something is necessary to a well-functioning society. Yet, it's not always clear what that something is-both for abolitionists and …
The Curiously Minor Role Of Minor V. Happersett (Foreword), Susan Frelich Appleton, Travis Crum, Hannah Keidan
The Curiously Minor Role Of Minor V. Happersett (Foreword), Susan Frelich Appleton, Travis Crum, Hannah Keidan
Scholarship@WashULaw
This Foreword introduces a symposium marking the 150th anniversary of Minor v. Happersett, a Supreme Court decision unanimously holding that the Fourteenth Amendment's Privileges or Immunities Clause did not enfranchise women. Notwithstanding its impact on the women's suffrage movement and the subsequent ratification of the Nineteenth Amendment, Minor presents a puzzle: it is a relatively obscure precedent that remains deeply relevant to contemporary legal debates. To elucidate this point, this Foreword juxtaposes Minor with two notorious Supreme Court decisions: Dred Scott and Dobbs.
Like Dred Scott, Minor pairs a morally repugnant result with legalistic reasoning. But whereas …
A Liberty-Balancing Approach To Crime, Sheldon Evans
A Liberty-Balancing Approach To Crime, Sheldon Evans
Scholarship@WashULaw
At its core, the criminal legal system is an ecosystem of institutions that seek to balance liberty interests. The insightful theories and complex practices of crime policy coalesce around questions on how crime impacts the liberties of individuals and communities to be safe, and how this correlates with the deprivation of liberty from offenders through our punishment system. But modern criminal policy, most often associated with the problems of overcriminalization and mass incarceration, has wholly abandoned any such delicate and nuanced balancing. Instead, the system thrives on sacrificing the liberties of offenders in a perverse and ineffective regime that leads …
The Practice Of Executive Constitutionalism, Conor Clarke, Daniel Epps
The Practice Of Executive Constitutionalism, Conor Clarke, Daniel Epps
Scholarship@WashULaw
The Executive Branch must inevitably interpret the Constitution. Although departmentalists and judicial supremacists disagree about the scope of the Executive’s constitutional authority, few believe the Constitution is only for the courts. But what are the practices through which the Executive Branch interprets the Constitution and translates those interpretations into concrete decisions? What is their history? And what, if anything, is distinctive about them? While a rich and growing literature has examined some aspects of these questions, scholars have not broadly canvased the most central tools by which the Executive Branch shapes and implements constitutional law, or considered what makes them …
Auditing Criminal Justice Minimalism, Trevor George Gardner
Auditing Criminal Justice Minimalism, Trevor George Gardner
Scholarship@WashULaw
If criminal justice minimalism is a shared principle among criminal law scholars, it can help to clarify the quality of our disagreements. Every normative proposal in the criminal legal literature can be held to the minimalist standard—audited, so to speak, to account for the policy author’s minimalist claims. To this end, this Essay proposes a four-step framework by which to evaluate adherence to the minimalist principle, where each step serves as a hub for pointed scholarly debate regarding the path to minimalist criminal justice.
Urban Isolation In The Digital Age- Examining The Sociological Impact Of The Digital Divide On Civic Life In U.S. Cities, Delante Clark
Urban Isolation In The Digital Age- Examining The Sociological Impact Of The Digital Divide On Civic Life In U.S. Cities, Delante Clark
Graduate Scholarship and Creative Works
The digital divide remains a persistent barrier to civic participation and social inclusion in urban America, particularly in historically underserved communities. This mixed-methods study investigates how digital lack of access affects civic engagement, social capital, and community cohesion in U.S. cities, with a focus on Chicago’s South Side, Harlem New York, St. Louis, and Orlando. Drawing on quantitative data from recent surveys and qualitative insights from peer-reviewed literature, the research applies four sociological frameworks, Urban Sociology, Social Capital Theory, Critical Race Theory, and Symbolic Interactionism. These were used to examine the structural and interpretive aspects of digital isolation. Findings reveal …

Learning Positive Deviance Techniques: How Non-Conformity To Vote-Buying Is Practiced And Its Outcomes, The Ugandan Context, Collins Kwarisima
Electronic Theses and Dissertations
This research has investigated the use of positive deviance or exemplary behavior as an innovative approach to addressing political corruption, specifically the vote-buying practice in Uganda. To understand the techniques of positive deviance in vote-buying, this study was guided by the main research question: How is non-conformity to vote-buying practiced, and what are its outcomes? Individual and focus group interviews were utilized to collect qualitative data from 40 respondents (voters and political leaders) who deter the vote-buying practice in Rukungiri District, Western Uganda. With the help of community gatekeepers, the study followed the inclusion criteria to identify voters and political …
Cover Cropping Strategies For Improving Weed Suppression, Yashar Askarzadeh
Cover Cropping Strategies For Improving Weed Suppression, Yashar Askarzadeh
Electronic Theses and Dissertations
Cover crops (CCs) play an essential role in sustainable agriculture by providing multiple ecosystem services. However, adoption remains low due to concerns about economic returns, management complexity, and potential yield reductions in cash crops. Applying CCs uniformly across fields without accounting for spatial variability can result in inconsistent outcomes. A precision cover cropping system (PCCS), which incorporates site-specific management zones (MZs), offers a more targeted approach to improving performance while minimizing costs and uncertainties. This study explores the interaction between CCs and field variability through complementary field and greenhouse experiments. The field experiment demonstrates that field heterogeneity significantly influences CC …

This study investigated the prevalence, causes, and impact of sexual and gender-based violence (SGBV) against women in sports across Kenya, Uganda, and Tanzania. Employing a mixed-methods approach, the study combined quantitative surveys with qualitative interviews to explore the scale of SGBV, its root causes, and the lived experiences of female athletes. A cross-sectional descriptive design was adopted, with data collected from athletes, coaches, administrators, and sports officials from federations and associations in the three countries. Stratified and purposive sampling techniques at the federations, clubs and within the clubs was used and this ensured representation at multiple levels of the sports …

Policy Brief. Media Framing Of Sexual And Gender-Based Violence And Femicide: An Analysis Of News Stories In Select Kenyan, Ugandan And Tanzanian Media, Nancy Achieng' Booker, Hesbon Owilla, George Nyabuga, Olivia Sayani, Liz Awino, Rose Kimani, David Aduda
Graduate School of Media and Communications
This policy brief presents the findings of a regional study on media coverage of femicide and sexual and gender-based violence (SGBV) in Kenya, Uganda, and Tanzania. The study analysed coverage of femicide and SGBV between January 2024 and April 2025, from major digital platforms, supported by interviews with editors. It sought to understand how media frames femicide and SGBV, which actors are most visible, and what implications these patterns have for accountability, justice, and deterrence. The findings show that while victims of femicide are given extensive sympathetic coverage, with very high salience, perpetrators are almost entirely absent from media narratives. …
Poor Little Woman And Sybil Of The Rhine: Code Switching In Hildegard Of Bingen’S Writing, Bridgett Meskis
Poor Little Woman And Sybil Of The Rhine: Code Switching In Hildegard Of Bingen’S Writing, Bridgett Meskis
Undergraduate Theses, Professional Papers, and Capstone Artifacts
Hildegard of Bingen (1098- 1179) was a twelfth century German Benedictine abbess, mystic, author, composer, and theologian. Despite the heavily patriarchal and restrictive culture of her day, Hildegard managed to gain autonomy and authority within her community. She benefited from a boom in popularity in the mid-1990s, which saw a broadening of research subjects, including focus on the gender dynamics at play in Hildegard’s life. This scholarship has died down significantly since. Given the breadth and depth of her work, Hildegard of Bingen’s work deserves to be revisited through more recent theoretical lenses that can provide significant insights into her …

Racial socialization, a process in which parents communicate beliefs and values about children’s race and cultural backgrounds to help children prepare for their current and future social interactions, has lasting effects on child development. Understanding the extent to which children understand race in the context of racialized violence, and the extent to which parents are willing to engage their children in such conversations, is critical for professionals who work with and support families through these challenging contexts. Existing evidence suggests parents in racially minoritized groups often put more conscious efforts into racial socialization than their White parent peers. Although recent …

Interdependence And Identity: Moral Relation In An Historical World, Bennett B. Gilbert
History Faculty Publications and Presentations
The twin concepts in the title will be introduced in the contexts of the philosophy of history and of philosophical personalism, as distinct from (though related to) their uses as logical and metaphysical categories. Overviews of varieties of philosophy of history and of basic principles I employ are foundations of the argument. Concepts, or ideas, in general have, I argue, real existence through the way that personal agents use them in creating the histories of human relations. I introduce a Personalist account, which has a more thoroughly diachronic character. Further remarks on the power of ideas to create relations expands …
Framing Legal Systems In New And Emerging Statelets: Autonomous Projects Of The Zapatistas Of Chiapas And The Democratic Autonomous Administration Of Northern And Eastern Syria, Samuel Wolff
Emory International Law Review Recent Developments
Autonomous movements within states are disruptions in the normal order and control that a state exerts over its territories. While there are some groups that aim to achieve autonomy and recognition while staying within the structure of the existing state, other groups seek to succeed and establish their own autonomous area completely succeeding and divorcing from the state. For a variety of reasons- from mistrust of a corrupt central government to violent repression of ethnic minorities- movements arise offering an alternative to the existing state. As these movements break, sometimes violently, from the state, they also break from the legal …

Comparative Federalism In The Us And The Eu — The Winemaker's Legal Perspective, Clement Xu
Emory International Law Review Recent Developments
In our lives, many of us will intersect with wine at some point, be it an aged bordeaux presented in elaborate fashion, or a box of nondescript cooler doled out at a backyard cookout. Beyond analyzing a wine for the complexity of its bouquet, or the strength of its tannins, the wine market as a whole beckons a nuanced study from the perspective of comparative law. The radical differences in business models, consumer base, and even expectations, between the “old world” and the “new world” give rise to a number of topics ranging from authenticity, legal protection, and government regulatory …

“Fixing” Settler Capitalism: Un/Sustainability In The Former Fort Ord, Clare M. Beer, Sara Salazar Hughes
Urban and Environmental Studies Faculty Works
California's former Fort Ord Army Base is located on the unceded Indigenous territory of the Ohlone Costanoan Esselen Nation. After seven decades as a training ground for foreign wars, the decommissioning of the base triggered an economic, demographic, and cultural crisis for greater Monterey. The solution to this crisis, the Fort Ord Base Reuse Plan, promised sustainable development in the form of local environmental protection, public higher education, and economic growth. We argue that the Fort Ord Base Reuse Plan illustrates a settler sustainability fix, which the state deploys to secure settler capitalist futurity on the Monterey Peninsula at the …

Ready, Set, Resistance: A Dual Continuum Approach To Organizational Change Acceptance, Alexandria Bohn
Browse all Theses and Dissertations
With organizations operating in increasingly dynamic and competitive landscapes, organizations need to be able to get their employees to adapt to system-wide changes that are needed. However, research has suggested a 70% failure rate for organizational change initiatives (Hughes, 2011). Prior research has produced mixed research results when examining resistance and readiness to organizational change on either a single dimension (e.g., Kaplan, 1972) or two dimensions (e.g., Repovs, Drnovsek, & Kase, 2019). I extended prior research by examining resistance versus readiness as residing on a single continuum and whether effects on outcomes were moderated by change orientations. Research has suggested …

The Normative Porosity Of The Un Convention On The Law Of The Sea: From "Human Rights At Sea" To The "Ocean-Climate Nexus", Eduardo Cavalcanti De Mello Filho
Minnesota Journal of International Law, Vols. 28:2 onward (2019-present)
This article delves into the nexus between the 1982 U.N. Convention on the Law of the Sea (“UNCLOS”) and the broader international legal order, focusing on UNCLOS Article 287 tribunals with jurisdiction limited to disputes related to the Convention. The study categorizes three gateways through which external rules of international law influence the interpretation and application of UNCLOS: Renvoi provisions, systemic interpretation mechanisms, and systemic integration via Article 293(1). Considering recent studies highlighting UNCLOS as a “springboard for interaction,” this research synthesizes legal dogmatics with insights from the sociology of law and international relations theory. Mindful of the momentum experienced …

Explaining Constitutional Copying As An Idealogy: Argentina's "Yankee-Mania" Under President Domingo Sarmiento (1868-1874), Jonathan M. Miller
Minnesota Journal of International Law, Vols. 28:2 onward (2019-present)
Foreign constitutional models can transform a country thanks to the power of ideology. The comparative constitutional literature maintains that successful constitutionalism requires credible commitments to essential rules by all major political actors so that those out of power can avoid persecution that will drive them into rebellion, and those in power can feel assured that if they relinquish power, the opposition will respect their core interests. The literature also assumes that the process of reaching credible commitments is a slow one, but that over time civil society, courts and government bureaucracies will strengthen the commitments and act against unconstitutional power …

Inventions Without Inventors: The Need To Recognize Ai Systems As Inventors, Niloufer Selvadurai
Inventions Without Inventors: The Need To Recognize Ai Systems As Inventors, Niloufer Selvadurai
Journal of Law, Technology, & the Internet
As AI systems increasingly generate innovative products and processes, a critical issue to address is the nature and extent of the patent protection that is conferred upon such outputs. The overarching objective of patent law is the support of innovation and progress. In determining applications, the clear focus of patent judgments is whether the claimed invention satisfies the required standards of inventiveness, novelty, and non-obviousness. It is hence curious that incidental references to “individuals” and “persons,” variously scattered through patent statutes, operate to deny recognition of AI inventors. This is the result of the global test litigation instigated by Dr. …

Organizations play significant roles in society by providing goods and services and contributing to the economies of communities, globally. Amid the predicted increase in the frequency and impact of disasters, which will invariably lead to higher disaster costs, there is an urgent need to ameliorate disaster impact on society and organizations. Disaster mitigation and preparedness are strategies for stemming disaster impact and losses within organizations. Cognizant of the importance of disaster mitigation and preparedness, researchers have conducted a myriad of studies on both concepts at the organizational level. To advance knowledge on this topic, this study conducted a comprehensive systematic …
