The Supreme Court’S Old Habits In A New Era? Native Nations, Statehood, And An Indigenous-Led Future For Natural Resources, Monte Mills
Articles
art I of this essay looks back and, relying on Winans and Winters, illustrates the Court’s longstanding commitment to a recognition of tribally reserved rights while requiring a collaborative approach that acknowledges some state interest and authority. Part II then briefly assesses the modern era of Indigenous leadership in natural resources, reviewing the ways in which Native Nations are implementing a new framework of collaborative stewardship for lands, waters, wildlife, and other ecological systems. Finally, Part III considers how the lessons or impacts of this broader movement might be relevant in future conflicts raising questions of statehood and tribal …

Democratic Lawyering: Upending The "Hidden Curriculum" To Prepare New Lawyers For A New World, Eduardo R.C. Capulong, Andrew King-Ries, Monte Mills

Multiple heightening crises reveal the deficiencies and contradictions of legal education, in particular the values it imparts. Perpetuating myths about U.S. democracy and rule of law, the enduring formalist, liberal legalist cast of law school is increasingly at odds with students’ lived experiences. As liberal democracy and the rule of law falter, no longer is relying on the “hidden curriculum” or the historically nebulous and mythical narratives of the law and our legal system sufficient to prepare tomorrow’s lawyers for the challenges faced by our profession. Instead, with a boost from ABA Standard 303, this article draws on the tradition …

Recent research on advanced theory of mind (ToM) has questioned the extent to which existing ToM measures capture a single construct, particularly for groups understudied in developmental research. The present study examined the factor structure of one of the most commonly used advanced ToM measures, the Strange Stories task, in samples of low- and middle-income children in dual-language Spanish-English schools in US–Mexico border communities and in Mexico (N = 237 children, n = 108 male, n = 129 female, Mage = 10.05 years, SD = 1.15 years; 96.3% Hispanic/Latine). No clear factor structure emerged for the Strange Stories …

Dentistry And The Law: Can I Use Patient Information To Respond To Internet Criticism?, Daniel Schulte J.D.
Dentistry And The Law: Can I Use Patient Information To Respond To Internet Criticism?, Daniel Schulte J.D.
The Journal of the Michigan Dental Association
This legal guidance addresses dentists' inability to respond to negative online reviews using patient information. The article explains that HIPAA and Michigan's Dentist-Patient Privilege Statute prohibit healthcare professionals from disclosing patient information without authorization, even when defending against false or defamatory online posts. Unlike patients who can freely share information about their treatment, dentists face significant legal restrictions. The author notes that legal recourse is often difficult due to challenges in proving poster identity, distinguishing factual statements from opinions, and demonstrating specific damages. The recommended approach is to avoid responding to negative posts and instead focus on reputation management through …

Water Quality Assessment: Endotoxin Brings Real-Time Measurements And Non-Faecally Transmitted Bacteria To The Table, Christian Good, João Brandão, Christopher Seymour, Simon K. Jackson
School of Biomedical Sciences
We have used a rapid, portable assay (Bacterisk) to determine the bacterial water quality along several inland waters in SW England. Water samples were compared by a conventional membrane filter and culture methods for faecal indicator bacteria (FIB; E. coli and enterococci) and endotoxin measurement by Bacterisk. The Bacterisk data, measured in near-real-time, correlate well with both E. coli and enterococci, but also allow the presence of potential pathogens of a non-faecal origin to be detected. The sensitivity was calculated to be 92.96% with a specificity of 46.3% for E. coli with an expanded uncertainty of 22.07% and an Endotoxin …

Price Coordination Under List Pricing And Discounting: Experimental Evidence, Roberto Hernán González, Praveen Kujal, Miguel Angel Ropero-García, Román Fossati

List-pricing and discounting is common in both retail and wholesale markets. Its interpretation amongst competition authorities varies from being procompetitive to collusion facilitating. We experimentally test how list pricing and discounting impact prices in a capacity constrained Bertrand-Edgeworth duopoly with symmetric and asymmetric firms facing constant marginal costs. We find that, relative to the symmetric baseline experiments, list pricing and discounting generate higher equilibrium prices for (symmetric) firms. Prices in the asymmetric-list price duopoly are also higher, however, the effect is much smaller than under symmetry. The introduction of asymmetry results in higher prices. The smaller firms gain more from …

The United States (U.S.), China, and the European Union (EU) are engaged in a national security-driven economic competition over advanced technology. Many scholars and commentators focus on the external dimension of this geopolitical contest; that is, they describe the strategic choices by each actor in terms of geopolitical realities, threat perceptions, and relative power. However, this Article brings to the fore the internal dimension of the global tech war. We argue that each player’s strategy in the tech war is a function of its internal features, including basic constitutional powers, domestic legal institutions, and the relationships between the government and …

The Federal Trade Commission (FTC) has long served as America’s default privacy enforcer. Yet for much of its history, the agency relied on self-regulation through a “notice and choice” framework that left the public vulnerable in an era of rampant data collection and digital surveillance. Businesses overwhelmed users with dense privacy notices while amassing and exploiting vast troves of personal data. The agency’s historical approach, rooted in outdated assumptions about self-correcting markets and an ideologically cramped view of the FTC’s authorities and mandate, helped usher in a digital economy where data abuses became routine.
During the Biden Administration, the FTC …

From one dispute between 1948 and 1994, there have now been 14 requests for a panel establishment (based on the General Agreement on Tariffs and Trade (GATT), Article XXI – the exception for national security) during the World Trade Organization (WTO) era (1995–now). The majority of them ended up in the issuance of a panel report, all of which were issued after 5 April 2019. As the WTO Appellate Body has been dysfunctional as of November 2019, no appellate report has been issued. Appeals have been lodged, but as there is no Appellate Body to entertain them, they were lodged …

You can’t question a secret you haven’t been told. The criminal legal system depends on fair and open proceedings to expose and regulate unlawful and unconstitutional police conduct through the courts. If police can use claims of secrecy to systematically thwart criminal defendants’ access to evidence, judicial review will fail. And yet that is exactly what is happening under a common-law doctrine called the “law enforcement privilege.” The privilege empowers police and prosecutors to rely on the results of secret investigative methods while withholding information from the defense about how those methods work. It risks perpetuating unconstitutional conduct, enabling wrongful …

Chinese courts routinely ask defendants to pay damages without evidence of negligence while relying on concepts such as fairness, substantive justice, or discretion. This chapter examines how Chinese courts arrive at decisions that feel fair or just in cases where they refer to those ideas. Analysis of a dataset of 10,000 judicial decisions in personal injury cases suggests that Chinese courts refer to these concepts when they impose liability on two types of parties: (1) participants in a shared activity and (2) those who control a physical space. By assigning legal responsibility in these cases, Chinese courts acknowledge traumatic harm, …

Trust has always been vital to the healthy functioning of financial markets and the stability of the financial institutions. The mix of public and private institutions that undergird this trust, however, can vary. Often these forces are ignored or taken for granted until something goes wrong. With a marked turn toward deregulation taking hold on both sides of the Atlantic, against a backdrop of central banks having played a very active role intervening to allay distress, it is a good time to revisit these fundamentals. This essay examines the importance of trust, how it is created, how it can be …

Victims of sexual harassment report facing barriers and retaliation for reporting their sexual harassment. The current study assessed one potential reason for these issues: perceptions of sexual harassment events. Participants (N = 427) read about different sexual harassment events and were told that the woman in the event worked with a masculine (e.g., EMT, school police officer, plumber) or feminine job (e.g., nurse, teacher, cleaning staff). Across three different sexual harassment claims (e.g., unwanted romantic attention, physical groping, being shown sexually explicit images), participants reported that women in masculine jobs were less prototypical women than women in feminine jobs. Furthermore, …
Do Resiliency And Coping Skills Moderate The Relationship Between Mood Disorders And Parenting Styles Due To Parental Relationship Distress?, Tiffany Burks
Electronic Theses and Dissertations
Parental relationship dynamics such as intimate partner violence (IPV), interpersonal distress (IPD), and parental alienation (PA) can significantly affect both mental health and parenting practices. This study examined whether personal strengths, specifically resilience and problem-focused coping, could help buffer these negative outcomes. Correlational analyses showed that IPV, IPD, and PA were positively associated with symptoms of depression and anxiety. IPV and PA were also negatively associated with the use of an authoritative parenting style. In contrast, resilience and problem-focused coping were linked to fewer mood-related symptoms and greater use of authoritative parenting. Multiple regression analyses revealed that IPV significantly predicted …
Performance Comparison Of Learning With Errors Cryptosystems, Gabriel Johnson
Performance Comparison Of Learning With Errors Cryptosystems, Gabriel Johnson
Theses
Due to recent advancements in quantum computing, there has been great interest in finding quantum-resistant public key encryption algorithms. Much focus has been given to lattice-based cryptosystems, as certain lattice problems appear difficult even in the quantum setting. In particular, the Learning with Errors (LWE) problem, introduced by Regev, gives a means for constructing numerous public key cryptosystems with very strong proofs of security based on the hardness of finding a short vector in a lattice. We analyze and compare the performance, in terms of memory usage and speed, of four different Learning with Errors cryptosystems: basic LWE, normal-form LWE, …

Parsing Of Math Formulas And Chemical Diagrams Using Graph-Based Representation And Attention Models, Ayush Kumar Shah
Theses
Mathematical formulas and chemical diagrams appear frequently in scientific documents but are often embedded as visual content, either rasterized or vector-based images, limiting their accessibility and automated analysis. This thesis aims to bridge this gap by presenting a graph-based visual parsing framework that recognizes and parses these notations from both vector and raster image inputs in digital documents. For mathematical formulas in born-digital PDFs, we construct Symbol Layout Trees (SLTs) using a graph defined over vector-based primitives, capturing spatial relationships, avoiding relying on OCR. For born-digital chemical diagrams, we introduce a Minimum Spanning Tree (MST)-based technique that extracts molecular structure …

Isang pananaginip na napagtatagumpayan, sa kabila ng mga pagsubok at suliranin, sa pamamagitan ng sama-samang pagtutulungan ng mga artista sa paghango ng inspirasyon mula sa lalawigan. Sinusuri niya rito ang My Simple Dreams of Life Belong to Them (2000) ni Allan Balisi na maituturing na isang juvenilia, na matatagpuan sa Isabela Museum and Library. The valorisation of underutilized male layer-type chickens offers a sustainable and ethically aligned opportunity for the poultry industry. This study evaluated the feasibility of male layer-type chicken meat in the production of chicken pâtés and compared the effects of different meat sources—commercial broiler (CP), and 5 (5wP) and 9-week-old (9wP) male layer-type chickens—on product quality during refrigerated storage using the general linear model with the Tukey–Kramer post-hoc test. Pâtés made from 5wP meat exhibited the most favourable technological properties, including the lowest (p < 0.05) total expressible fluid (TEF), highest (p < 0.05) water retention (TEFWater), and lowest (p < 0.05) fat content (TEFFat) than CP and 9wP indicating superior emulsion stability. Analyzing Player Difficulty Perception In Platformers Through Procedural Level Generation, Sasank Madineni
Master's Theses
Games utilizing Procedural Level Generation (PLG), such as Roguelikes, are becoming increasingly popular in today's gaming sphere. In games employing PLG, levels are generated randomly or pseudo-randomly, and aim to retain player attention through variance in levels between playthroughs. However, when generating levels with variance in structure and design, player enjoyment is often a mixed bag. With low enjoyment, player retention for these games can dwindle. This study explores the efficacy of real-time difficulty adjustment in procedurally generated platformers, as a method for maintaining stable player enjoyment without causing frustration. This thesis focuses on creating a short user experience, MIMEVA, …
