Studying Religious Symbols And Bias In Court Proceedings, Nicholas A.R. Fraser, Colton Fehr

Osgoode Hall Law Journal

MOCK JURY STUDIES INVESTIGATING the impact of religious symbols on jurors have produced conflicting findings, raising questions about how religious bias should be studied in judicial settings. Our study adds to the literature in three ways. First, we develop a clear theoretical framework which identifies dispositional and situational triggers allowing researchers to more precisely define and measure religiously motivated bias. Second, we show that mock jury experiments with video-based treatments simulating audio-visual cues are more likely to produce reliable findings relative to text-based studies. Third, we present the first empirical evidence of how mock jurors react to courtroom oaths. Our …

Does Lady Justice Need A Sword? Indictment: The Criminal Justice System On Trial By Benjamin Perrin, Noel Semple Jul 2025

Does Lady Justice Need A Sword? Indictment: The Criminal Justice System On Trial By Benjamin Perrin, Noel Semple

Osgoode Hall Law Journal

LADY JUSTICE CAN OFTEN BE FOUND, in statue form, in or near courthouses. This symbol of the Western justice system is blindfolded to show neutrality. She carries a scale to weigh facts and arguments fairly. Sometimes, she also holds an olive leaf to symbolize mercy and healing. A sword is the other accessory that Lady Justice invariably carries. The sword is a ubiquitous part of this symbol because most people believe that justice in general, and criminal justice in particular, necessarily involves inflicting pain upon wrongdoers.

Christian Identity And Commercialization: A Rhetorical Case Study Of Faith-Based Nil Branding In College Athletics, Santiago Diaz Finochietto

All HCAS Student Capstones, Theses, and Dissertations

This project, “Christian Identity and Commercialization: A Rhetorical Case Study of Faith-Based NIL Branding in College Athletics," explores the intersection of faith, personal branding, and commercialization in the era of Name, Image, and Likeness (NIL) in collegiate athletics, with a specific focus on Christian student-athletes. Since the NCAA's 2021 policy change allowing athletes to profit from NIL, student-athletes have been thrust into a complex landscape of sponsorships, digital branding, and entrepreneurial identity. While this shift offers unprecedented opportunities, it also presents ethical and spiritual dilemmas, particularly for Christian athletes seeking to integrate their faith into their public and commercial presence …

The present hermeneutic phenomenological study aims to fill a gap in the literature by exploring the lived experiences of Kenyan helping professionals as they care for survivors of trauma in their country of origin. A previous data set was used, consisting of interviews from four Kenyan helping professionals in 2019, all whom worked actively with survivors of trauma at …

School Counselors’ Perceptions On Providing Mental Health Services In Schools, Kimberly Davis Jul 2025

School Counselors’ Perceptions On Providing Mental Health Services In Schools, Kimberly Davis

Walden Dissertations and Doctoral Studies

The increasing prevalence of mental health concerns among students in the United States has amplified the demand for comprehensive school-based mental health services. School counselors are often positioned as frontline providers of this support, yet research suggests they face numerous systemic and role-related challenges. This qualitative phenomenological study was conducted to explore school counselors’ perceptions of their roles in providing mental health services, the barriers they encounter, and the ways in which self-efficacy is shaped by these experiences. Ten school counselors from diverse school settings participated in semistructured interviews. Thematic analysis revealed five central themes: (a) roles and responsibilities, (b) …

Expatriate Educators' Perspectives Of Transformational Leadership Practices In International Schools In Kuwait, Stacey Howe Jul 2025

Expatriate Educators' Perspectives Of Transformational Leadership Practices In International Schools In Kuwait, Stacey Howe

Walden Dissertations and Doctoral Studies

Effective leadership is crucial for educational success, yet its definition varies across cultures, which may cause communication issues, especially in culturally diverse environments like international schools. The purpose of this quantitative study was to explore differing perceptions of transformational leadership (TL) between 68 expatriate teachers and 27 administrators, representing response rates of 22% and 47%, respectively, in three Kuwait international schools. Grounded in Bass's TL theory, the Global Transformational Leadership survey, an anonymous online survey with each of seven leadership domains represented by one item, was used in the study. Data collected on a 5-point frequency scale were analyzed using …

Three-Stage Latent Dynamics Forecasting (T-Ldf) Framework For Shenzhen Metro Passenger Flow Prediction, Tianze Zhang Jul 2025

Three-Stage Latent Dynamics Forecasting (T-Ldf) Framework For Shenzhen Metro Passenger Flow Prediction, Tianze Zhang

Lingnan Theses (MPhil & PhD)

Accurate forecasting of metro passenger flow is vital for efficient urban transportation management and optimal resource allocation in modern cities. Traditional ARIMA-based models effectively capture regular, cyclical patterns but struggle with sudden, nonlinear fluctuations caused by random events such as weather disruptions, special events, or service interruptions. Moreover, existing research predominantly focuses on individual stations, overlooking the complex cross-station interactions inherent in networked metro systems where passenger flows are interconnected across the entire network.

To address these critical limitations, we propose the Three-Stage Latent Dynamics Forecasting (T-LDF) Framework, a novel approach that systematically integrates temporal decomposition, latent dynamics extraction, and …

Mythprint Book Reviews

At first glance, the concept of looking at the works of Tolkien through the prism of Classical studies may strike one as eccentric, even misguided. After all, he dedicated his academic life to the study of medieval literature, teach-ing courses in early English poetry as well as Norse myths and sagas. Likewise in his literary oeuvre, the majority of Tolkien’s inspirations are of indisputably medieval character, from the more topical concerns, such as the quest to reclaim the lost treasure in The Hobbit, to the recurrent puns and word-plays in Farmer Giles of Ham.

Simple Summary

Periodontitis is a common disease that affects the gums and the bone supporting the teeth, often leading to tooth loss. It results from a complex interaction between bacteria and the body’s immune response. Some people are more susceptible than others, and genetics may play a role. In this study, we focused on a genetic variation (called a polymorphism) in a gene known as TLR4, which helps the immune system recognize harmful bacteria. We examined over 1400 individuals from different populations and found that people carrying this specific variation, known as Asp299Gly, were less likely to develop severe periodontal …

Health literacy is a critical determinant of health outcomes, yet it is often overlooked, particularly among marginalized groups. This paper explores the significance of health literacy, with a particular focus on low-income African American and Black (AA/B) men, a population that faces unique challenges due to intersecting factors such as race, gender, socioeconomic status, and educational disparities. We examine how these factors contribute to health literacy gaps, highlighting adverse effects on health outcomes for AA/B men compared to the general population. Additionally, we stress the growing importance of digital literacy in an increasingly technology-driven world. Not actively addressing digital health …

Dosimetric Comparisons For Determining Optimal Arc Geometry In Multi Target Thoracic Vmat Sbrt Treatment Plans For Patients With Locally Advanced Inoperable Nsclc, Alexandrea M. Reeves

Masters Projects

Non-coplanar beam arrangements have been used for many years in radiation treatment planning. Their use has been known to show an increase in target conformity and gradient index. However, by using non-coplanar beam arrangements, the treatment planning time as well as the treatment delivery time can increase. Despite the increase in treatment planning and delivery complexity and time, previous studies have shown a decrease in OAR doses resulting in a desire to use non-coplanar beams. Previous studies have looked at various body sites and target locations, though no research has been found specifically studying non-coplanar beam arrangement in multi-target treatment …

Fundamental Exploration Of Soot Formation And Morphology From A Molecular Modeling Perspective, Khaled Mosharraf Mukut Jul 2025

Fundamental Exploration Of Soot Formation And Morphology From A Molecular Modeling Perspective, Khaled Mosharraf Mukut

Dissertations (1934 -)

Soot formation remains one of the least understood phenomena in combustion science, posing significant challenges due to its complex physicochemical nature and considerable environmental and health impacts. This dissertation presents a comprehensive molecular-level investigation into the fundamental mechanisms governing soot inception, particle growth, and morphological evolution through state-of-the-art reactive molecular dynamics (RMD) simulations of acetylene pyrolysis. A novel computational analysis utility, Molecular Arrangement and Fringe Identification and Analysis from Molecular Dynamics (MAFIA-MD), was developed to accurately characterize soot particle formation, providing detailed insights into chemical composition, internal structure, and surface characteristics. Critical physicochemical markers defining the boundary between gas-phase species …

From Glory To Glory: The Analogy Of Being In The Thought Of Karl Barth And Hans Urs Von Balthasar, Philip Micele

Seton Hall University Dissertations and Theses (ETDs)

In response to Karl Barth’s rejection of the analogia entis as “the invention of the Antichrist,” Erich Przywara insists that the great Protestant theologian’s criticisms are essentially of no avail, “because for him this biblical Christianity came, in fact, to assume the shape of a system of ‘ever greater dissimilarity,’ which is to say it fell under the spell of the very analogy he sought to flee.”[1] Przywara further stresses that “it is precisely in the analogy, understood as the ‘analogy of ever greater dissimilarity,’ that God is mighty and declares himself – the God who, ‘if you comprehend …

Recognizing The Charter Value Of Employee Freedom Of Association At Common Law, Kevin Banks

Osgoode Hall Law Journal

This article systematically explores, for the first time in the published literature, how the development of the common law of employment could advance in light of the Charter values doctrine, focusing on freedom of association. It contends that courts must scrutinize the common law’s impairments of that freedom, and unless they are necessary to similarly important common law values, eliminate them where it is possible to do so within courts’ powers to incrementally change it. A number of such paths are open. If asked to do so, courts probably can and should provide Canadians with a common law of employment …

Allocative Justice As A Constraint On Fiscal Imperialism In International Tax, Okanga Ogbu Okanga, Kim Brooks Jul 2025

Allocative Justice As A Constraint On Fiscal Imperialism In International Tax, Okanga Ogbu Okanga, Kim Brooks

Osgoode Hall Law Journal

Taxpayers’ cross-border activities often result in two (or more) states claiming the right to tax their income. To address concerns about how those tax liabilities might aggregate and suppress international activities, states typically agree to split the tax base between them. But how can states fairly share tax revenue from cross-border activities? Tax scholars and policymakers offer different normative perspectives to address this inter-nation equity conundrum. In this article, we conceptualize these normative perspectives into two types. One centres on identifying where the economic factors that lead to the ability to produce the income are located (and uses that determination …

The Enduring Significance Of Nuanced Ideological Voting In The Supreme Court Of Canada, C. L. Ostberg, Matthew E. Wetstein Jul 2025

The Enduring Significance Of Nuanced Ideological Voting In The Supreme Court Of Canada, C. L. Ostberg, Matthew E. Wetstein

Osgoode Hall Law Journal

THE CHARTER REVOLUTION IN CANADA has ushered in a new era of politics on the Supreme Court of Canada that places the Court at the centre of controversial policy questions that are fundamental to a democratic society. Through its early Charter rulings, the Court advanced a host of rights and liberties claims resulting in the charge that it had become far more activist. This shift exemplifies a broader pattern occurring across high courts around the world in the late twentieth century that some scholars describe as the growing judicialization of politics. The Court’s increased role in reviewing government policy has …

A Culture Of Justification: Vavilov And The Future Of Administrative Law By Paul Daly, Jordana Borzellino

Osgoode Hall Law Journal

ON DECEMBER 19TH, 2019, the Supreme Court of Canada (SCC) handed down one of the most influential cases of the decade in Canada (Minister of Citizenship and Immigration) v Vavilov. From an FBI raid to uncovering secret Russian spies, it is not often that Canadian administrative law deals with such an exhilarating situation. However, for the respondent, Alexander Vavilov, this was the situation that jolted him into the throes of administrative legal reform in Canada.

A History Of Law In Canada, Volume Two: Law For The New Dominion 1867–1914 By Jim Phillips, Philip Girard, And R. Blake Brown, Johnathon Cruickshank

Osgoode Hall Law Journal

DID YOU HEAR THE ONE about the Supreme Court of Canada justice owing the Prime Minister five thousand dollars? No, this is not the set-up of a cheesy law school joke nervously told at a pub night mixer. Rather, it was a shockingly true occurrence in the Laurier era that goes to show how drastically different (and a tad more corrupt) our legal system was over one hundred years ago. While not all the historical points of interest are juicy revelations concerning public officials, A History of Law in Canada, Volume Two: Law for the New Dominion 1867–1914 wraps an …

What Happened To The Creative In The Creative Curriculum?, Lacey Peters, Mark K. Nagasawa, Maria Mavrides Calderon, Abigail Kerlin, Helen Frazier, Beth Ferholt, Erica Clarke Yardy, Margie Brickley, Alisa Algava

Straus Institute for Thriving Children & Families

This empirically-grounded commentary questions the basis for New York City Public Schools’ (NYCPS) adoption of the Teaching Strategies products—the Creative Curriculum (CC) and Teaching Strategies GOLD—as the mandated curriculum and assessment systems for early childhood education (ECE) programs administered by the New York City Public Schools. In an analysis shaped by our hybrid positionalities as early childhood educators, parents, policy makers, and researchers, we argue that this decision is a local case of neoliberalism’s simultaneous narrowing of educational quality and a transfer of public funding into private hands under the guise of the free market. Our commentary, …

This paper analyses how Big Tech and global consultancy firms are asserting control over carbon removal certification and governance through infrastructure solutions and technical standards. We argue that defining gaps in the underground constitutes a global takeover of material sovereignty, encompassing both knowledge and geological formations. We unearth Big Tech’s strategies of infra-solutionism to demonstrate, drawing on the work of inhuman geographer Kathryn Yusoff, how this takeover reinforces geological grammars and essentialises racialised and sexualised categories that disconnect us from the Earth. Drawing on queer poetry together with work of Marxist agronomist Amílcal Cabral we advocate for resistance to dominant …

Bold New Bioweapons: Part 1 — The Burdens Of Detection And Attribution, James Giordano

Strategic Insights

This commentary, Pt. 1 of the Bold New Bioweapons series, examines how advances in gene editing, synthetic biology, and artificial intelligence are reshaping the biological weapons threat landscape and challenging the effectiveness of the Biological Weapons Convention (BWC). Dr. Giordano argues that decentralized research ecosystems, AI-enabled pathogen design, and dual-use biotechnology complicate detection, attribution, and deterrence. Emerging techniques can produce synthetic or modified biological agents that evade traditional surveillance systems and blur distinctions between legitimate research and weaponization. The absence of clear adjudication mechanisms within the BWC creates governance gaps exploitable by state and non-state actors. The article emphasizes that …

Shari’A, Inshallah: Finding God In Somali Legal Politics By Mark Fathi Massoud, Danyal Maqbool

Osgoode Hall Law Journal

Shari’a, InshAllah: Finding God in Somali Legal Politics (“Shari’a InshAllah”), written by Mark Fathi Massoud, professor of politics and legal studies at the University of California, Santa Cruz, is a compelling and fascinating work chronicling the relationship between law, religion, and politics in the context of Somalia’s recent history. In this book, Massoud explores the inextricability of religion from Somali legal politics as the country grapples with its colonial and post-colonial legacies and relationships to power in a society where God serves as a conduit for both faith and aspirations of self-determination. In a region where distrust of Western institutions …
