Defending Rule-Of-Law Minimalism, Ashraf Ahmed Aug 2025

Defending Rule-Of-Law Minimalism, Ashraf Ahmed

Faculty Scholarship

The rule of law is a political idea that counts only allies and no enemies. As a popular concept, the rule of law inspires broad rhetorical support. In the United States, for instance, liberals and conservatives alike invoke the “rule of law” as a normative lodestar in political conflicts. Liberals targeting the Trump administration cast their lawsuits as a defense of the rule of law. In parallel fashion, conservatives often charge creative readings of old statutes and ambitious administrative action as departures from the rule of law. It seems that any viable political venture must defend, advance, or at least …

The Origins Of "The Rule Of Law", Jeremy K. Kessler Aug 2025

The Origins Of "The Rule Of Law", Jeremy K. Kessler

Faculty Scholarship

This Article offers a novel account of the origins of “the rule of law” in the English-speaking world. The phrase itself likely entered the language as a literal translation of the Latin regula juris. Prior to the early seventeenth century, however, the phrase appears to have been used exclusively to refer to the specific legal rule or maxim most relevant to the resolution of a particular kind of dispute. The more general and abstract use of the phrase – to refer to an ideal of political morality or an ideal type of governance – first appeared in the public …

Evaluation Of A Forest Restoration Strategy On Small Mammals In Southern Pine Ecosystems, Gage R. Grantham, Jessica L. Glasscock, Christopher M. Schalk, Kathryn R. Kiid, Reuber Antoniazzi Aug 2025

Evaluation Of A Forest Restoration Strategy On Small Mammals In Southern Pine Ecosystems, Gage R. Grantham, Jessica L. Glasscock, Christopher M. Schalk, Kathryn R. Kiid, Reuber Antoniazzi

Electronic Theses and Dissertations

Industrial forestry replanted historic native pine forests (e.g., longleaf pine [Pinus palustris] and shortleaf pine [Pinus echinata]) to homogenous, high-density plantations consisting of native off-site species (e.g., loblolly pine [Pinus taeda]) after intensive harvesting for wood products. The contemporary forest structure that remains, consisting of off-site overstory compositions, can potentially serve as an ecological bridge to facilitate a gradual transition to a more desirable canopy species, thereby conserving biodiversity and ecosystem function. Understanding disturbance-sensitive small mammal communities from restoration strategies (retention) can help achieve long-term management goals for ecosystem conservation across larger scales. I …

Evidence On The Quality Of Segment Profit/Loss Disclosures And Its Determinants, Hiba A. Abu Sammour Aug 2025

Evidence On The Quality Of Segment Profit/Loss Disclosures And Its Determinants, Hiba A. Abu Sammour

Graduate Theses and Dissertations

Investors have recently indicated that disclosed descriptions of segment profit/loss measures are useful, but insufficient. Clear and detailed descriptions are essential for helping investors understand the segment profit/loss measure employed, especially since these measures may not align with measures from the consolidated income statement under the “management approach.” To better understand investors’ concerns, I hand-collect data from segment profit/loss disclosures and develop a measure that captures a dimension of disclosure quality specific to this setting: the extent to which segment profit/loss disclosures effectively describe the segment profit/loss measure employed. The measure considers the level of detail provided and the ease …

For graduate students, capstone writing is often a stressful process that involves significant obstacles to progress. This dissertation presents an exploratory multi-case study of four graduate capstone writers to examine how institutional contexts and rhetoric shape students’ beliefs and related emotions and behaviors during the high-stakes, low-structure settings of capstone research projects. Data for this study was collected through interviews and reflexively compared with reflections from the principal researcher. To gather insights into the relationship between writers’ internal beliefs and institutional contexts, interview excerpts were analyzed according to both cognitive behavioral coaching and institutional critique frameworks. Findings indicated that students …

A Pastoral River: Reimagining The Narrative Of Buffalo National River, Thomas Andrew Medford Aug 2025

A Pastoral River: Reimagining The Narrative Of Buffalo National River, Thomas Andrew Medford

Graduate Theses and Dissertations

This thesis examines the creation of Buffalo National River (BNR) from the perspective of dispossessed landowners. A unit of the National Park Service in the Arkansas Ozarks, BNR has garnered little scholarly attention in this light, despite present-day resentment of the federal government by locals. The park was signed into law in 1972, capping a years-long debate about the fate of the river. Some had supported a tenacious U.S. Army Corps of Engineers effort to dam the river, others backed a well-organized, preservationist-led campaign to create a park, while on-the-river landowners typically preferred the status quo of private ownership. Many …

Exercising Sovereignty In The Theater Of Court: How Performative Punishments Has Substitute Law Implementation In The Islamic Republic Of Iran, Nina Maziar Aug 2025

Exercising Sovereignty In The Theater Of Court: How Performative Punishments Has Substitute Law Implementation In The Islamic Republic Of Iran, Nina Maziar

Graduate Theses and Dissertations

Abstract Legality is a modern infrastructure, but when it is combined with the jurisprudence, which is very interpretive and subjective, an amorphous content is merged, which can be shaped for utilitarian purposes; and this is how the arbitrary legal system of Islamic Republic is staged. This unshaped legal system, courts/trials and penal codes, especially political charges are ambiguous contents, baffling the mindsets. This unclear setting is deterministically vague to scare the victim, and the audience with the stagecraft of the court. Sovereignty is defined both in the international affairs regarding the capability of one state ruling a country, but it …

Polymer-Enhanced Nanopore Sensing, Eugene Gyasi Agyemang Aug 2025

Polymer-Enhanced Nanopore Sensing, Eugene Gyasi Agyemang

Graduate Theses and Dissertations

The resistive pulse technique characterizes single analytes by detecting fluctuations in the ion current as they pass through a narrow orifice connecting two electrolyte-filled chambers, each containing a single electrode. The amplitude, shape, frequency, and duration of these fluctuations primarily provide information about the analyte’s size, shape, concentration, and net surface charge, respectively. One configuration for resistive pulse measurements is of an electrolyte-filled nanopipette immersed in a bath, where the nanopipette tip acts as the nanoscale orifice. It was previously shown that incorporating the large quantities polymer polyethylene glycol (PEG 8K, 50% w/v) into the external electrolyte bath dramatically enhanced …

How To Do Things With Little Talking Tubes: Nonideal Speech Acts In The Digital Age, Anthony Holdier Aug 2025

How To Do Things With Little Talking Tubes: Nonideal Speech Acts In The Digital Age, Anthony Holdier

Graduate Theses and Dissertations

In this work, I develop a view about what it means to share a social or conversational context with others, as well as what is normatively entailed by doing so. Working from a broadly Austinian perspective about the moral foundations of language use and how we use words to position ourselves within social space, as well as from a generally Stalnakerian social ontology (demarcating groups by dint of aligned or overlapping sets of commitments), I present three papers demonstrating how nonidealized, ordinary language philosophy can make sense of complex, real-world phenomena. Through analyses of heretical utterances, context collapse, and chatbot …

Controlling Electroless Deposition On Polymer Interfaces Towards Discrete Functional Particle Synthesis, Grecia Pierina Alvarado Munoz Aug 2025

Controlling Electroless Deposition On Polymer Interfaces Towards Discrete Functional Particle Synthesis, Grecia Pierina Alvarado Munoz

Graduate Theses and Dissertations

Electroless deposition is a process that facilitates the formation of metal layers on surfaces through the reduction of metal ions onto a surface in the presence of a sacrificial reducing agent. This process can be applied to synthesize conductive metal layers on insulators such as glass or polymers. The kinetics of heterogeneous deposition depend on the interfacial surface chemistry, including the presence of added catalyst materials, as well as the bulk chemical environment, such as the concentration of metal ions and sacrificial reductants. Furthermore, the homogeneous formation of metal nanoparticles may compete with the deposition reaction, adversely affecting the control …

From Stem Cells To Smooth Muscle Cells: Characterizing Secretome Profiles And Evaluating Regenerative Potentials, Christofer Baldwin

Graduate Theses and Dissertations

This dissertation examines the role of vascular smooth muscle cells (VSMCs) in vascular disease and the potential of stem cell-derived VSMCs (SC-SMCs) for regenerative medicine. VSMCs are crucial for maintaining function; however, their dysregulation contributes to the progression of diseases like atherosclerosis, vascular calcification, and aneurysms. Disease progression is influenced by various environmental factors, prompting VSMCs to switch phenotypes, leading to adverse vascular remodeling. This research focuses on adult bone marrow mesenchymal stem cells (BM-MSCs) and adipose-derived stem cells (ADSCs) as sources for generating reparative VSMCs. Through comparative analysis, it investigates the effects of SC-SMCs on VSMC biomarker expression and …

End Times: American Mortality, Death Materiality, And Social Death In The 1990s, Jordan A. Savage

Graduate Theses and Dissertations

The United States in the 1990s was marked by pervasive representations of death in popular culture. As death imagery became increasingly visible in entertainment, there was a growing detachment from the embodied, biological realities of death, a tension intensified by the ongoing AIDS crisis. This project explores how death is politicized and how decisions about who lives and dies are shaped by power. I draw on a constellation of theoretical frameworks that collectively illuminate the operations of state-sanctioned death and social abandonment. These include Michel Foucault’s concept of biopolitics, which examines the management of life by state power; Giorgio Agamben’s …

Firm Disclosures And Retail Investor Behavior: The Role Of Information Type, Disagreement, And Social Networks, Hansol Yoon Aug 2025

Firm Disclosures And Retail Investor Behavior: The Role Of Information Type, Disagreement, And Social Networks, Hansol Yoon

Graduate Theses and Dissertations

This paper examines whether disclosure characteristics–specifically hard versus soft information–influence disagreement among retail investors, whether due to differences in information sets or interpretation, and how such disagreement subsequently affects trading volume. Using a sample of 85,050 earnings conference calls and StockTwits disagreement data from 2010 to 2021, I find that hard information (i.e., earnings figures) is negatively associated with investor disagreement, while soft information (i.e., forward-looking statements) is positively associated with it. Further analysis reveals that the disclosure characteristics impact trading activity only indirectly, through their influence on investor disagreement. Additionally, I examine the moderating role of social network centrality, …
