Impacts Of U.S. Environmental Regulations On Industry, Xiao Ji, Mengyu Wang, Tianyi Zhang

This paper analyzes the impacts of U.S. environmental regulations on industry, focusing on command-and-control environmental regulations (CCER) and market-based environmental regulations (MBER). Drawing on empirical data from the Environmental Protection Agency (EPA) spanning over four decades, we examine key legislation such as the Clean Water Act (CWA), Clean Air Act (CAA), and the Resource Conservation and Recovery Act (RCRA), while also discussing more recent frameworks like the Inflation Reduction Act (IRA). Our findings suggest that although penalties under CCER contribute to immediate compliance, they often fail to elicit long-term changes in corporate behavior. Background: COVID-19 pandemic has raised global concern regarding maternal and neonatal health owing to physiological and immunological changes that may heighten disease severity. Despite the global evidence linking COVID-19 infection with unfavorable pregnancy outcomes, data from Sub-Saharan Africa remain limited. This leaves an essential vacuum in our understanding of how COVID-19 status affects maternal and neonatal outcomes in counties like Mombasa, where health-care system problems may alter risks. Vertical transmission remains a puzzle to be solved.

Eliminating The Malice Requirement For Fourth Amendment Malicious Prosecution Plaintiffs, Sabrina Huang

Someone who has been wrongfully prosecuted in violation of their Fourth Amendment rights can sue a government actor, such as a police officer, for malicious prosecution under 42 U.S.C. § 1983. Malicious prosecution arises when a government actor initiates a criminal case without probable cause, the prosecution leads to the accused’s seizure, and the accused is ultimately not convicted. Fourth Amendment malicious prosecution claims are critical to holding officers and prosecutors accountable for misconduct. Official misconduct is common: more than half of the people exonerated since 1989 were incarcerated due in part to misconduct by the police or prosecutors.

Time Series Changes Of Surficial Sediments On Eastern Ship Shoal, Louisiana Shelf, Adam Gartelman, Kehui Xu, Brian J. Roberts, David Samuel Johnson, Madison Liotta

Ship Shoal, a large transgressive sand body on the Louisiana continental shelf, is a critical sediment source for coastal restoration. This study evaluates spatial and temporal variability in sediment grain size, percents organic matter (%OM), and carbonate (%CO3) across the shoal crest (REF), Caminada Dredge Pit (CAM), and Terrebonne Dredge Pit (TER). Sediment samples were collected between 2020 and 2022 using box cores and analyzed for grain size, %OM, and %CO3, with temporal and spatial patterns assessed through statistical comparisons, correlation analyses, and random forest regression models. Due to high sedimentation rate up to ~1 m/year, mud-capped dredge pits (MCDP) are often considered natural laboratories for studying sedimentary processes, slope stability and the impacts of dredging activities on marine environments. Although many studies have been performed on the Louisiana shelf, there is a lack of high spatial resolution research covering the eastern, central and western Louisiana shelf to comprehensively investigate sediment infilling. Public wildlife law is clear: wild animals exist and are managed for the public writ large. This is a mistake. Wild animals are beings of moral concern; their lives can be good or bad, better or worse, and they should be treated accordingly. This article explores a novel legal instrument which can account for wild animals' unique interests and circumstances: private wildlife trusts, in which wild animals are the trust beneficiaries. Wildlife trusts pose distinctive management and implementation challenges. The practice of permitting a third party, other than a settlor or a trustee, to give guidance to the trustee over some aspect of trust management reflects the trend of granting settlors increasing control over their transfers of wealth. In decades past, a few states enacted legislation permitting what is known as directed trusts, but in 2017, the Uniform Directed Trust Act was promulgated, seeking to provide a modicum of uniformity among the states, as wealth is now increasingly both interstate and international. Modern scholars of American wealth transfer taxation underappreciate the system’s history—characterized at its incipience by a broad patchwork of state inheritance taxes rather than current law’s federal estate tax. Moreover, this history is not only neglected but incompletely recounted; in the last four decades of the twentieth century, a majority of states in all parts of the country suddenly and voluntarily dispensed with their inheritance taxes. Football Spending For Success: Analyzing Investment And Team Performance In Ncaa Fbs Programs, Keunsu Han, Jin Dong Park, Kyungeun (Karry) Kwon

Journal of Applied Sport Management

This study examines the relationship between financial investment and team performance in NCAA Division I Football Bowl Subdivision (FBS) football programs from 2010 to 2023. Key variables include total football spending, head coach salaries and bonuses, and win-loss records. Ordinary Least Squares (OLS) regression models were used to examine these associations, controlling for conference affiliation by distinguishing between the so-called power and non-power conferences. The results indicate that greater investment in football operations and coaching compensation is significantly associated with higher win percentages, particularly within power conference programs. The International Olympic Committee generated $7.6 billion in revenue from 2017-2021, with 30% coming from The Olympic Partnership (TOP) Program marketing rights, which has grown from $96 million to $2.3 billion since 1985. In addition to the direct sponsorship costs, additional activation costs are incurred by the organization as they market, advertise, and highlight their product during the event they sponsor to achieve a financial return. The purpose of this study is to assess whether TOP partners outperform a matched non-partner during the 2024 Paris Olympic Games.

State departments of transportation use bridge deck overlay systems to prolong bridge deck service lives. Consisting of a thin layer of material applied to a concrete bridge deck surface, overlays form a protective barrier that improves ride quality, protects embedded reinforcement from harsh environmental conditions, enhances structure durability, and improves deck drainage. Over the past 20 years, the Kentucky Transportation Cabinet has made significant investments in overlays, rehabilitating nearly 5,000 bridge decks with them — roughly 1/3 of all bridges statewide. The University of Nebraska Omaha Early Literacy Workshop aims to train 7,000 teachers in the “Science of Reading” by 2030, strengthening Nebraska educators’ knowledge and skills in evidence-based literacy instruction. This study examines the relationship between full participation in the five-session workshop and teachers’ self-reported efficacy. A total of 356 educators completed Pre and Post Surveys, enabling analysis of growth in knowledge and practice and highlighting sessions with the greatest impact. Open-ended responses further revealed areas of development. A distinctive feature of this model is its flexibility. Acceptance and commitment therapy (ACT) is a behaviorally derived treatment approach with broad application to psychological distress. A key outcome for an ACT-based intervention is psychological flexibility, derived from six core processes known as the hexaflex. (present moment, identification of values, committed action, defusion, acceptance, and self-as-context). ACT is a process-based approach with strong literature support, though it is unknown which, if any, of the six core processes are differentially protective against stress and burnout. Under the federal Indian Gaming Regulatory Act (IGRA), a tribe may conduct Class III or casino-style gaming only in a state that “permits such gaming” and in accordance with an approved compact between the tribe and the state. But the appropriate interpretation of IGRA’s “permits such gaming” requirement and how it relates to the state’s duty to negotiate gaming compacts in good faith remain murky more than 35 years after IGRA was enacted, hindering both compact negotiations between individual states and tribes and the entire tribal gaming industry.
