Crypto In The Courtroom: A Legislative Framework For Managing Crypto Assets In Bankruptcy, Katelyn E. Barker Oct 2025

Crypto In The Courtroom: A Legislative Framework For Managing Crypto Assets In Bankruptcy, Katelyn E. Barker

University of Miami Law Review

The rapid rise and subsequent collapse of the cryptocurrency market exposed a critical shortcoming of bankruptcy law: the absence of clear guidelines for the treatment of crypto assets. The Bankruptcy Code—which predates the invention of crypto—fails to account for the unique complexities of crypto assets. Although several crypto bills have been introduced, they fall short of adequately confronting the complex and evolving challenges of crypto bankruptcies. The lack of guidance has forced courts to make consequential decisions with no clear direction, leading to inconsistent outcomes in areas such as crypto asset ownership, valuation, and customer protections.

This Note examines bankruptcy …

Brewbaker And The Undermining Of Criminal Antitrust Enforcement, Itiel J. Wainer Oct 2025

Brewbaker And The Undermining Of Criminal Antitrust Enforcement, Itiel J. Wainer

University of Miami Law Review

In United States v. Brewbaker, a Fourth Circuit panel overturned a criminal conviction under § 1 of the Sherman Act, holding that a bid-rigging conspiracy between direct competitors constituted a hybrid “dual distribution” arrangement subject to the rule of reason rather than per se illegality. The court’s rationale rested on the existence of a separate vertical relationship between the parties, even though that relationship served only as consideration for the horizontal agreement to rig bids.

This Comment argues that Brewbaker rests on three doctrinal errors: misclassifying established bid-rigging tactics as a “new” restraint simply because the payoff took a …

Gas Station Heroin: A Case Report Of Tianeptine Use Disorder And A Literature Review., Kalyan Kandra, Raghavendran Gajagowni, Gabriela A Fernandez, Natalie Polechonski, Brandon P Blewett

Articles

Tianeptine, an atypical antidepressant prescribed in several countries, is not approved for medical use in the United States. Despite this, it is widely available as an unregulated supplement, popularly known as "gas station heroin," contributing to a growing public health crisis characterized by dependence, severe withdrawal, and overdose. We present the case of a 22-year-old male with major depressive disorder who developed severe tianeptine use disorder. He presented with worsening depression and suicidal ideation, with his psychiatric symptoms substantially exacerbated by cycles of intoxication and withdrawal. The patient declined referral to medication-assisted treatment, highlighting ongoing barriers to care. This case …

Research On Optimization Of Electric Vehicle Charging Scheduling In Rainy Season Based On Peak Valley Difference Electricity Price Model, Zhikun Luo, Wenhao Ye, Yaohong Chen, Qin Yan, Shusheng Wu, Jinxin Wang

Journal of Electric Power Science and Technology

To address the issues of increased energy consumption of electric vehicles, grid load, and peak valley difference caused by high humidity and temperature in the rainy season in Southern China,a charging price model based on peak valley difference is proposed to stimulate electric vehicles to participate in demand response,so as to stabilize the peak valley difference of grid load and improve the economic benefits of electric vehicle users.Firstly, the Monte Carlo simulation is used to analyze and predict the disordered charging load of electric vehicles, considering factors such as high temperature and humidity during the rainy season in Southern China. Then,a peak-valley differential charging price …

Tetanus And Diphtheria Vaccination Coverage And Electronic Health Record Alerts For Immigrants And Refugees At Three United States Health Systems, 2017-2023, Abigail Steiner, Ann Settgast, Malini Desilva, Colleen Payton, Kristine Knuti Rodrigues, Margaret Nolan, Ella Chrenka, Mateo Frumholtz, Jeremy J Michel, Amy Stein, Blain Mamo, Janine Young

Department of Medicine Faculty Papers

Tetanus and diphtheria (tetanus/diphtheria) infections are rare in the United States (U.S.), but adequate vaccination is essential to prevent disease and associated morbidity and mortality. Compared with U.S.-born persons, immigrant and refugee adults have lower completion rates for tetanus/diphtheria vaccination series. However, most electronic health record (EHR)-generated recommendations only advise tetanus/diphtheria vaccines every 10 years for persons ≥18 years. This analysis compared documented completion of tetanus/diphtheria 3-dose vaccination series with EHR-generated recommendations for immigrant and refugee patients at three U.S. health systems seen during 2017-2022. The EHR documented complete 3-dose tetanus/diphtheria vaccine series for 28 % of 50,829 adult immigrant …

Wherever Spanish or Castilian was spoken, romances were sung, from Tierra del Fuego …

The New Nil Deals In College Sports, Anna Mestel Oct 2025

The New Nil Deals In College Sports, Anna Mestel

Cardozo Journal of Conflict Resolution (CJCR) Blog

The world of college sports is undergoing a major transformation with the introduction of new rules governing Name, Image, and Likeness (“NIL”) deals. NIL refers to a college athlete’s right to profit from the commercial use of their name, image, and likeness as part of their personal brand. Prior to 2021, student-athletes were prohibited from entering into agreements that allowed them to profit from their fame. That changed in 2021, when athletes were granted NIL rights and permitted to monetize their athletic ability. Today, athletes sign major contracts not only with traditional sports brands such as Nike and Adidas, but …

Associations Between Occupation Of World Trade Center Responders And Ptsd Prevalence And Symptom Expression, Jonah K. Luby Oct 2025

Associations Between Occupation Of World Trade Center Responders And Ptsd Prevalence And Symptom Expression, Jonah K. Luby

Master's Theses or Doctor of Nursing Practice

The World Trade Center attacks on September 11th, 2001, had a drastic impact on American culture across many different mediums. Among those impacted, first responders experienced intense responsibilities beyond the bounds of typical expectation and training, putting them particularly at risk for Post Traumatic Stress Disorder. PTSD in first responders is often examined on a wide scale, where all types of responder roles are compared to the general population or within their individual groups. This study examined the association between occupation of responders at the time of the 9/11 terrorist attacks and PTSD prevalence and symptom expression. Patterns of symptoms …

Manuscripts, Articles, Book Chapters and Other Papers

BACKGROUND: Incorporating people who use substances into a community-engaged research process can support the implementation and evaluation of evidence-based harm reduction programs. Attending to their voice ensures those who need these programs will use them. Yet, ongoing co-learning with people who use substances, often the ideal for community engaged research, poses a challenge for recruitment, ongoing participation, and obtaining diverse perspectives. We need novel strategies to support flexibility among populations experiencing legal and social instability so that community engaged work includes more diverse perspectives. In this paper, we describe a novel community engagement approach called Effective Adaptable and Sustainable in …

Identity Styles Moderate The Role Of Insecure Attachment Dimensions On Internalizing Behaviors, Hans Saint-Eloi Cadely, William Vega, Joe F. Pittman, Sue K. Adams

Human Development and Family Science Faculty Publications

The present study examined how identity styles and romantic attachment dimensions predict internalizing problems among 456 college students. Results indicated that the diffuse-avoidant identity style was positively associated with depressive symptoms, whereas the normative identity style was negatively related to generalized anxiety. Anxious attachment was positively related to both internalizing problems, and avoidant attachment was related positively only to depressive symptoms. Interaction results revealed that a stronger diffuse-avoidant identity style strengthened the relationship between anxious attachment and depressive symptoms. A stronger informational identity style led to a significant association between the avoidant dimension and both internalizing behaviors. Lastly, for those …

Look, up the lectern! It’s a bird, it’s a plane, no, it’s Super Professor! Super Professor is the charismatic guy in a tweed jacket who appears onscreen whenever a film or TV show depicts a college educator at work. Super Professor usually fulfills gendered, racialized, and other stereotypes about academic expertise, and his lectures are so entertaining that students effortlessly learn just by sitting there in the lecture hall. Super Professor never fumbles, fails, or fouls up because he’s perfected the art and science of teaching. But in real life real-world classrooms, teaching is never a perfectible undertaking. Every educator, …

Just Cause Protection Under Manager Discrimination, Joseph Pickens, Aaron Sojourner Oct 2025

Just Cause Protection Under Manager Discrimination, Joseph Pickens, Aaron Sojourner

Upjohn Institute Working Papers

“Just cause” policies aim to discourage the arbitrary firing of employees. Recent efforts at passing such laws in the U.S. have been motivated by deterring discrimination. This paper presents a framework to study the effects of just cause when managers engage in taste-based discrimination. The framework generates predictions on whether just cause will ease achievement and retention of stable employment by exploiting the timing of separations around a probationary period. Since probationary periods are a typical feature of protections, the approach is generalizable. We test predictions using New York City’s 2021 just cause law for fast-food employees. Using a synthetic …

Smoke plume dynamics involve various smoke processes and mechanics in the atmosphere and provide the scientific foundation for the development of tools to simulate and predict smoke and its environmental and human impacts. The increasing occurrence of wildfires and the demands for more extensive application of prescribed fires in the U.S. have posed great challenges and immediate actions for advancing smoke plume dynamics and improving smoke predictions and impact assessments to mitigate smoke impacts. Numerous efforts have been made recently to address these needs and challenges. This paper synthesizes advances in smoke plume dynamics research mainly conducted in the U.S. …

A Formidable Female Network: The Role Of Women In William Henry Fox Talbot’S Establishment Of Early Photography, Rose Teanby Phd Oct 2025

A Formidable Female Network: The Role Of Women In William Henry Fox Talbot’S Establishment Of Early Photography, Rose Teanby Phd

Art Inquiries

This paper explores how women assisted William Henry Fox Talbot (1800-1877) to establish his Photogenic Drawing and Calotype photographic processes in Great Britain and Europe. Utilising preserved contemporary correspondence as a primary source of unedited transcribed conversations, the genesis of photography can be revisited from an alternative viewpoint of extensive familial collaboration. Letters between Talbot and his female relatives exposed a sophisticated network of interconnected mid 19th century social elite, providing multiple opportunities for informal advocacy and timely dissemination of the new scientific art.

Epistolary exchanges from 1839 to 1858 provide new insights into women’s subtle, less visible influence …

Review: The Visionary Art Of Minnie Evans, Cynthia Fowler

Art Inquiries

The Visionary Art of Minnie Evans was a small exhibition of 16 drawings and paintings by Minnie Evans (1892-1987) on loan to the Museum of Fine Arts, Boston (MFA) from the Cameron Art Museum in Wilmington, North Carolina, which holds a significant collection of her work. Evans was born in North Carolina and spent most of her life in Wilmington. Her artworks are colorful compositions rich with decorative details that illustrate her dreams and visions. But the exhibition attempted to expand our understanding of Evans’s work beyond them. Divided into three categories — “Wilmington Landscapes,” “Spiritual Nature,” and “Visual Culture” …

Exhibition Review - Sung Tieu: 1992, 2025, Lina Alam

Art Inquiries

Over the last decade, we have witnessed the ascendancy, consolidation and mobilization of far-right movements around the world – not least in Germany. The Vietnamese-German artist Sung Tieu lives there and produces mixed-media work on recent histories of state violence, racism, migration and surveillance. In her solo show 1992, 2025 at the KW (Kunst Werke) Institute for Contemporary Art in Berlin, Tieu expanded on her previous projects about the 1980 labor recruitment agreement between the German Democratic Republic (GDR) and the Socialist Republic of Vietnam that resulted in nearly 70,000 Vietnamese workers relocating to Germany. Her new body of work …

An Early Female Daguerreotypist In Spain: Marie-Agnès-Anastasie Clemandot, Madame Fritz, Maria De Los Santos García Felguera, Gregorio Escalada Sardina

Art Inquiries

Research on women who have worked in the field of photography in Spain is recent and has developed mostly in the 21st century. Still in 2025, we don’t have a book that includes them all. Outside Spain, they are completely unknown.

Here we present, as a case of study, a French woman who doesn’t fit into the rules of her time: Marie-Agnèse-Anastasie Clemandot (Le Puy-en-Velay, Haute-Loire, 1807 – Paris, 1876). She was a bookseller in Zurich, a ribbon merchant in Paris, a travelling daguerreotypist in France, Spain and Portugal and seller of leather for surgical instruments. She also had a …

The British Photographic Industry And The Roles Of Women 1840-1920: A Survey, Michael Pritchard

Art Inquiries

This essay surveys the role of women within the British photographic industry to 1920 and attempts to quantify the numbers involved, their roles and how they were perceived by contemporary commentators. In common with so much of nineteenth century arts and sciences women are rarely present having been excluded by legal constraints on wealth and property, from the membership of professional bodies, and by being ignored by the contemporary press, this essay provides substantive numbers emphasising their significance.

Review: 60th October Salon - What’S Left?, Rachel Klipa

Art Inquiries

Spread across nine venues and public spaces in Belgrade, Serbia, the 60th October Salon’s concept posed a pressing question: What’s Left? In a moment marked by oppressive capitalism, cultural erasure, and the slow dismantling of socialist ideals, this year’s biennial resisted nostalgia and nationalism. Instead, it probed the emotional and political residues of systems in flux, examining how art can sustain memory, provoke continuity, and imagine new futures in uncertain times.

Redefining Gender And Rural Life In The Pampas: Alessandra Sanguinetti’S The Adventures Of Guille And Belinda Series, Alejandra López-Oliveros

Art Inquiries

At the time of Argentina’s independence, the gauchos (nomadic horsemen) had become the symbol of the nation in its purest form. Celebrated as independent, heroic and strong, and usually portrayed as the sole inhabitants of the Pampa, the idealized image of the gaucho has flooded popular culture and art even today, to the detriment of flesh-and-bone wage laborers of all genders. As opposed to this static image, I propose to examine Alessandra Sanguinetti’s photographic series, The Adventures of Guille and Belinda (ongoing since 1999), which focuses on girls and women in the countryside, pointedly highlights their previous absence. By contrasting …
