Sovereign Power Constitutionalism, Curtis A. Bradley Nov 2025

Sovereign Power Constitutionalism, Curtis A. Bradley

University of Chicago Law Review

The text of the U.S. Constitution seems to be missing a host of governmental powers that we take for granted, including powers relating to immigration, Indian affairs, acquisition of territory and resources, and the regulation and protection of U.S. citizens abroad. The Supreme Court suggested an explanation for these and other missing powers in its famous 1936 decision, United States v. Curtiss-Wright Export Corp. Upon becoming a nation, the Court contended, the United States automatically acquired powers “equal to the right and power of the other members of the international family”—powers that inhered in the government “as necessary concomitants of …

The Contractualization Of Disability Rights Law, Yaron Covo Nov 2025

The Contractualization Of Disability Rights Law, Yaron Covo

University of Chicago Law Review

What body of law determines the content and scope of disability rights in the United States? The conventional wisdom is that the rights of disabled individuals are enshrined in and shaped by an array of civil rights statutes. While this answer is correct, it is incomplete. As this Article shows, U.S. disability rights are also built upon contract law concepts and doctrines. For example, in interpreting disability rights statutes, courts have turned to the parol evidence rule, the duty of good faith, and the doctrines of impossibility, materiality, duress, and mistake. Although not explicitly enumerated in disability rights statutes, these …

Legal Realignment, Richard Re Nov 2025

Legal Realignment, Richard Re

University of Chicago Law Review

The United States is undergoing a legal realignment, in that salient legal views recently associated with the right are now being espoused by the left, and vice versa. The clearest example involves Chevron deference: a doctrine once championed by conservatives like Justice Antonin Scalia has now been overruled in Loper Bright v. Raimondo—over dissenting votes by all three of the Court’s liberals. Similar points can be made about standing, stare decisis, textualism, positivism, and more. The basic reason for this transformation is straightforward: legal ideologies in power favor discretion, whereas those out of power favor constraint. Conservatives now firmly control …

The Progression Of Deinstitutionalization And Its Effects On The American South: A Judicial Analysis Of 20th-Century United States Supreme Court Decisions, Eva-Marie V. Jones Nov 2025

The Progression Of Deinstitutionalization And Its Effects On The American South: A Judicial Analysis Of 20th-Century United States Supreme Court Decisions, Eva-Marie V. Jones

Honors College Theses

This thesis explores the effects of four landmark Supreme Court cases on the deinstitutionalization movement in the American south. Previous literature frequently discusses the legislative implications of this era; however, no law is applicable without the interpretation and application of the judiciary, which so often contextualizes the greater public perspective. Rarely has an analysis of judicial decisions involving psychiatric care merged with regional focus, and certainly not in a format accessible to the average individual.

From unmarked graves to abandoned infrastructure, the legacy of historic psychiatric care in the United States has been largely obscured – yet its consequences continue …

When Deep Learning Meets Information Retrieval-Based Bug Localization: A Survey, Feifei Niu, Chuanyi Li, Kui Liu, Xin Xia, David Lo

Research Collection School Of Computing and Information Systems

Bug localization is a crucial aspect of software maintenance, running through the entire software lifecycle. Information retrieval-based bug localization (IRBL) identifies buggy code based on bug reports, expediting the bug resolution process for developers. Recent years have witnessed significant achievements in IRBL, propelled by the widespread adoption of deep learning (DL). To provide a comprehensive overview of the current state of the art and delve into key issues, we conduct a survey encompassing 61 IRBL studies leveraging DL. We summarize best practices in each phase of the IRBL workflow, undertake a meta-analysis of prior studies, and suggest future research directions. …

Do Code Semantics Help? A Comprehensive Study On Execution Trace-Based Information For Code Large Language Models, Jian Wang, Xiaofei Xie, Qiang Hu, Shangqing Liu, Yi Li Nov 2025

Do Code Semantics Help? A Comprehensive Study On Execution Trace-Based Information For Code Large Language Models, Jian Wang, Xiaofei Xie, Qiang Hu, Shangqing Liu, Yi Li

Research Collection School Of Computing and Information Systems

Code Large Language Models (Code LLMs) have opened a new era in programming with their impressive capabilities. However, recent research has revealed critical limitations in their ability to reason about runtime behavior and understand the actual functionality of programs, which poses significant challenges for their post-training and practical deployment. Specifically, Code LLMs encounter two principal issues: (1) a lack of proficiency in reasoning about program execution behavior, as they struggle to interpret what programs actually do during runtime, and (2) inconsistent and fragmented representation of semantic information, such as execution traces, across existing methods, which hinders their ability to generalize …

Chimeric Contacts And Consent: The Ill-Reasoned Expansion Of Corporate Jurisdictional Exposure, James Paul George Nov 2025

Chimeric Contacts And Consent: The Ill-Reasoned Expansion Of Corporate Jurisdictional Exposure, James Paul George

Faculty Scholarship

Two recent Supreme Court decisions have imposed aspects of general jurisdiction in a way that exposes corporations and possibly other legal actors to litigation in spuriously connected forums. One case-Ford Motor Company v. Montana-reached a fair result but with strained reasoning that will support unfair results. The second case-Mallory v. Norfolk Southern Railroad Company-was wrong on the facts and the law, imposing general jurisdiction based on a vaguely worded corporate registration statute validated by a more than century-old precedent based on Pennoyer v. Neff's limited territorial model. Both decisions were the result of conceptual corners the Supreme Court has created …

Trips And Its Futures, Peter K. Yu Nov 2025

Trips And Its Futures, Peter K. Yu

Faculty Scholarship

The Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS Agreement) was adopted on 15 April 1994, along with the estab-lishment of the World Trade Organization (WTO). With the WTO’s recent celebration of its thirtieth anniversary, it is high time we explore what the future will hold for this agreement. This chapter begins by revisiting the past to examine whether the TRIPS Agreement would be adopted if it were negotiated today. The chapter then discusses whether WTO members will undertake a major overhaul of this agreement in the future. Taking note of the fast-evolving international norm-setting environment and …

Assembly-Line Public Defense, David S. Abrams, Priyanka Goonetilleke Nov 2025

Assembly-Line Public Defense, David S. Abrams, Priyanka Goonetilleke

Faculty Scholarship

Each year, millions of Americans rely on public defenders to fulfill their Sixth Amendment right to counsel. Despite being the linchpin of the criminal justice system, public defense remains both underfunded and understudied. This Article provides empirical analysis to contribute to a critical question: How should public defender systems be structured?

Criminal justice advocates, scholars, and the American Bar Association strongly favor vertical representation in public defense. Under this model, a single public defender represents a defendant throughout their case, from their initial appearance through sentencing. The alternative approach—horizontal representation—operates like an assembly line: Different attorneys handle each stage of …

Consumers Stabilize Grassland Ecosystem Functions By Destabilizing Belowground Communities Under Abiotic Stress, Jane M. Lucas, Michelle L. Budny, Nathan P. Lemoine Nov 2025

Consumers Stabilize Grassland Ecosystem Functions By Destabilizing Belowground Communities Under Abiotic Stress, Jane M. Lucas, Michelle L. Budny, Nathan P. Lemoine

Biological Sciences Faculty Research and Publications

Consumers play a critical role in mediating plant and ecosystem responses to abiotic stress, yet their influence on belowground processes under changing environmental conditions remains underexplored. Insect consumers are vital components of grassland ecosystems that can shape ecosystem function and stability by mitigating how plant and microbial communities respond to abiotic stress, like drought. This study investigates how small-bodied consumers influence the magnitude and stability of grassland belowground functions across gradients of abiotic stress. We conducted a fully factorial field experiment manipulating consumer presence and induced drought over a growing season. Our results reveal that the presence of consumers stabilizes …

Student Publications [Scholarly]

Background Unprecedented, forced displacement, especially from conflict and war areas, requires addressing resultant mental health issues. Aim Refugees experience mental and physical health problems due to post-displacement stressors, and the pervasive stigma associated with refugee status can exacerbate these difficulties, highlighting the need for a comprehensive assessment tool to understand various facets of refugee stigma. Method We developed the refugee stigma scale (RSS), consisting of 43 items informed by the literature, qualitative and quantitative data. The scale includes four theoretical dimensions of stigma: perceived community stigma, experienced stigma, anticipated stigma and internalised stigma. To examine convergent validity, validated self-report measures …

The Forgotten Weapon: Section 891 And The Origins Of U.S. Retaliatory Tax Policy, Reuven S. Avi-Yonah, Gianluca Mazzoni Nov 2025

The Forgotten Weapon: Section 891 And The Origins Of U.S. Retaliatory Tax Policy, Reuven S. Avi-Yonah, Gianluca Mazzoni

Articles

The original version of the One Big Beautiful Bill Act (P.L. 119-21) included section 899, which would have imposed retaliatory taxes on individuals and corporations from countries that apply “discriminatory or extraterritorial” taxes to U.S. corporations, defined specifically to include digital services taxes and the undertaxed profits rule of pillar 2.

However, on June 26 Treasury Secretary Scott Bessent announced that a compromise was reached on the UTPR, and as a result, section 899 was removed from the OBBBA. Now that section 899 is gone, section 891 is the most important part of the United States’ legislative armory against “discriminatory …

Do Sports Develop Leadership? The Impact Of College Varsity Sports On Leadership Capacity And Self-Efficacy, Benjamin Correia-Harker, Lindsey M. Clark, Jacob J. Capin Nov 2025

Do Sports Develop Leadership? The Impact Of College Varsity Sports On Leadership Capacity And Self-Efficacy, Benjamin Correia-Harker, Lindsey M. Clark, Jacob J. Capin

College of Education Faculty Research and Publications

Introduction: Effective leadership in sports is associated with better team functioning, physical and psychosocial wellbeing, and reduced incidence of severe injuries. In spite of widespread anecdotal support, few studies have empirically evaluated leadership development in athletes. The purpose of this study was to investigate socially responsible leadership capacity and self-efficacy in college varsity athletes and determine the impact of competitive sports participation on leadership capacity and self-efficacy. We hypothesized that college varsity athletes would (1) exhibit greater leadership capacity and self-efficacy than nonathletes and (2) demonstrate greater growth in leadership capacity and self-efficacy than nonathletes.

Methods: The Multi-Institutional Study of …

Generally file formats on modern systems are single byte streams, and there are many tools available to help identify and determine what software is needed to make use of the format. When dealing with formats born on Macintosh systems, a single byte stream is often not all that is needed to make use of the formats. On older Macintosh systems a Type/Creator code and a resource fork are often needed, and on more modern systems there are other challenges that need to be addressed. This paper explores some popular formats and tools that are needed to properly assess and capture …

Critical Approaches To Jurisdiction: The Struggle For Control Of Indigenous Lands And Resources, Dayna Scott Nov 2025

Critical Approaches To Jurisdiction: The Struggle For Control Of Indigenous Lands And Resources, Dayna Scott

Articles & Book Chapters

This chapter questions the starting assumptions in thinking through questions of “jurisdiction” in public law, specifically in relation to assertions of inherent Indigenous territorial governing authority. It reviews the common conceptual images of jurisdiction we employ in law schools and offers resources from critical interdisciplinary theory for new conceptions. In highlighting examples of the present exercise of Indigenous territorial jurisdiction, such as the Kunst'aa guu— Kunst'aayah Reconciliation Protocol and the Tsleil-Waututh Sacred Trust Assessment of the Trans Mountain Expansion (TMX) project, the chapter urges public law scholars to adopt an orientation of prefiguration in order to bring into being conceptualizations …

A New View Of Formal Equality And A Case For Predistribution, Alex Raskolnikov Nov 2025

A New View Of Formal Equality And A Case For Predistribution, Alex Raskolnikov

Faculty Scholarship

A long-held egalitarian view is that formal equality — the absence of formal legal distinctions based on the material resources of individuals — is regressive. If legal rules are the same for the rich and the poor, the rich benefit and the poor suffer. This Essay argues that this view is mistaken. Far from being synonymous with laissez-faire, a commitment to formal equality provides a counterweight to the key neoliberal maxim that regulation of the market economy should focus on efficiency alone. Moreover, a new view of formal equality offered here reveals a key advantage of predistribution over redistribution: Explicit …

Fisheries Research Report No. 355: Recreational Fishing For Western Rock Lobster In 2024/25: Estimates Of Participation, Effort And Catch, Claire B. Smallwood, Karina L. Ryan, Alissa Tate Nov 2025

Fisheries Research Report No. 355: Recreational Fishing For Western Rock Lobster In 2024/25: Estimates Of Participation, Effort And Catch, Claire B. Smallwood, Karina L. Ryan, Alissa Tate

Fisheries Research Reports

The Western Rock Lobster (WRL) (Panulirus cygnus) is the most commonly caught Rock Lobster (RL) species in Australia. Catches from the commercial and recreational sectors are required to determine and monitor Total Allowable Commercial Catch (TACC), Total Allowable Recreational Catch (TARC) and the proportion of Allowable Harvest Level (AHL) achieved. The TARC is evaluated annually based on a 5-year average.

Data for the recreational sector are obtained using phone-recall surveys to provide annual estimates of participation, fishing effort and retained catch (by numbers) from recreational fishers who hold a RL licence. Average weight, obtained from boat ramp surveys, are used …

Paediatrics and Child Health, East Africa

The Children’s Hospitals in Africa Mapping Project (CHAMP) survey was developed and implemented to assess the capabilities of some of the best resourced sub-Saharan African hospitals serving children. The aim was to evaluate hospital facilities, infrastructure, equipment, supplies, services, staffing, and readiness to care for children amid public health emergencies. This report analysed a subset of survey questions that characterised the hospitals and assessed facilities, equipment, supplies, infrastructure and capacity to respond to emergencies and outbreaks. Twenty-four sites were recruited. Twenty hospitals from 15 countries completed the survey from 2018 to 2019. This portion of the CHAMP study identified issues …

A Cross-National Study Of Female Fertility Intention And Family Welfare Policies In China And South Korea, Jingshuang Gao Nov 2025

A Cross-National Study Of Female Fertility Intention And Family Welfare Policies In China And South Korea, Jingshuang Gao

SOC 605 Comparative Social Policy Research Project - Student Works

Against the backdrop of chronically low fertility rates in China and South Korea, this study investigates the relationship between female fertility intentions and family welfare policies in these two East Asian societies. It aims to identify the multidimensional challenges women face, analyze the disjuncture between existing fertility support policies and women's fundamental needs, and propose pathways for policy optimization. Employing a mixed-methods approach including online observation, critical discourse analysis of policy texts, and small-scale semi-structured interviews, the research reveals that women's fertility intentions are constrained by physiological risks, economic pressures, the cultural expectations of "motherhood," and conflicts with personal development. …

The Impact Of Chinese And British Marital Property Division Mechanism On Chinese Women's Post-Divorce Economic Security Research, Diyin Su Nov 2025

The Impact Of Chinese And British Marital Property Division Mechanism On Chinese Women's Post-Divorce Economic Security Research, Diyin Su

SOC 605 Comparative Social Policy Research Project - Student Works

In 2025, the Civil Code Interpretation (II) of the Marriage and Family Section was released to refine the rules for dividing property in divorce and add new quantitative standards for compensation for non-economic contributions, but the traditional gender division of labor and judicial practice bias still result in women's non-economic contributions, such as household work, being neglected and insufficient financial protection after divorce. The British property division system adheres to the principle of dynamic fairness, namely, the implementation of a separate property system for the couple's property within marriage and a common property system after marriage, with more emphasis on …

Balancing Act: Addressing Child Quantity-Quality Trade-Off In The Philippine Households With Educational And Health Social Programs, John Andrew A. Alsol, Marie Carroline Magante

Economics Department Faculty Publications

The child quantity-quality (CQQ) trade-off has been extensively studied in economic research since it was first introduced by Becker and Lewis in 1973. Studies have argued that the current economic circumstances and the presence of government aid in education and health determine the existence and extent of the CQQ trade-off. However, there is a dearth of empirically tested research on the possible decreasing effects of social programs on the CQQ trade-off. Using the 2019 Annual Poverty Indicators Survey, this paper seeks to determine the effect of education and health social programs on the CQQ trade-off in the Philippines. Probit models …
