These periods include Colonial, Antebellum, Civil War years, Reconstruction and late nineteenth century, early twentieth century, and finally …

Torts, Kelly Cahill Timmons Dec 2025

Torts, Kelly Cahill Timmons

Mercer Law Review

2024–2025 was a big year for tort law in Georgia, particularly on the legislative side. Governor Brian Kemp achieved his primary goal for the 2025 legislative session, working with the Georgia General Assembly to enact significant tort reform measures. These measures change Georgia law on the collateral source rule, the relevance of seatbelt evidence, and—most notably—in the area of negligent security. All of these changes benefit tort defendants. The Supreme Court of Georgia also made its mark on tort law during the Survey period, deciding several cases involving the liability of professionals and adopting rules that— more often than not—benefited …

Insurance, Jessica M. Phillips, Rebecca E. Strickland, Kori E. Wagner

Mercer Law Review

During this Survey period, the courts in Georgia issued several meaningful decisions in the area of insurance. In the first party context, the court reinforced its disfavor for litigants taking inconsistent legal positions to their benefit by reinforcing the robust application of the doctrine of judicial estoppel. In addition, Georgia courts revisited the propriety of the manner in which an insurance carrier evaluates actual cash value for the purposes of determining recovery for diminution in value in property claims involving damage to automobiles. Finally, courts expanded the ability of plaintiffs to recover damages for claims other than breach of contract …

A Return To Roots: Guy V. Housing Authority Of Augusta And The Revival Of Common Law Sovereign Immunity, Macyn L. Nasser Dec 2025

A Return To Roots: Guy V. Housing Authority Of Augusta And The Revival Of Common Law Sovereign Immunity, Macyn L. Nasser

Mercer Law Review

In late 2021, a shooting at a housing complex reignited a centuries-old question: when may a municipality claim the sovereign’s shield? In Guy v. Housing Authority of the City of Augusta (“Guy II”), the Supreme Court of Georgia vacated a court of appeals decision that had analogized a housing authority to a state agency and thus found it immune from suit. In its decision, the supreme court explained that such questions must be resolved by examining whether the entity would have been immune under English common law as it existed in 1776. The case was remanded for the lower court …

I Can’T Even With This Thesis: A Syntactic And Pragmatic Analysis, Ester Luna

Yale Working Papers in Grammatical Diversity

This project focuses on the construction I can’t even, a sentence coined in the early 2000s that expresses a speaker’s strong emotion to the point where they are lost for words. The most typical emotion conveyed using I can’t even is exasperation, as in example (1), but it can also be an indication of extreme happiness, like in (2).

  • (1) He tried to get my number AGAIN. I can’t even.
  • (2) You came all the way from New York to watch me perform? I can’t even.

While the modal can and the adverb even normally require the …

How Design Law Is Taking Shape In The United States And European Union, Christine Haight Farley Dec 2025

How Design Law Is Taking Shape In The United States And European Union, Christine Haight Farley

Scholarly Articles in Law Reviews & Journals

This Essay uses a comparative framework to show that sophisticated design rights holders in both the United States (U.S.) and the European Union (EU) increasingly sidestep specialized design regimes in favor of more expansive trademark and copyright doctrines. Although both jurisdictions now operate cumulative intellectual property (IP) systems for industrial design, they have taken sharply divergent paths in confronting the proliferation of “design dupes”—replicas that trade on the appeal of sought-after designs. In the United States, rights holders rely chiefly on trademark law, and especially trade dress, to convert cultural recognition into legally cognizable source indication, a move facilitated by …

Substantial Contribution Of Woody Components To Rainfall Interception In Chinese Forests: Insights From A Refined Analytical Model, Zhi-Ang Chen, Zhi-Yun Jiang, Wei He, John T. Van Stan Ii, Et. Al. Dec 2025

Substantial Contribution Of Woody Components To Rainfall Interception In Chinese Forests: Insights From A Refined Analytical Model, Zhi-Ang Chen, Zhi-Yun Jiang, Wei He, John T. Van Stan Ii, Et. Al.

Biological, Geological, and Environmental Faculty Publications

Assessing rainfall interception (I-R) is a critical yet uncertain aspect in hydrological cycle, particularly the quantification of relative contributions from leaves and woody components (e.g., branches, stems, and trunks) to I-R. Nevertheless, the role of woody components in I-R estimation remains largely unexplored and thereby has been constantly overlooked. This study addressed this challenge and refined the widely-used Gash model to distinguish woody interception (I-W) from leaf interception (I-L). We incorporated the spatial variability of vegetation traits alongside satellite data in 2019 into the refined model, and spanned China's major forest types. The refined model showed a strong agreement with …

Control Techniques And Design Of Load-Side Controls For The Mitigation Of Late-Time High-Altitude Electromagnetic Pulse, Connor A. Lehman, Rush Robinett, Wayne Weaver, David G. Wilson Dec 2025

Control Techniques And Design Of Load-Side Controls For The Mitigation Of Late-Time High-Altitude Electromagnetic Pulse, Connor A. Lehman, Rush Robinett, Wayne Weaver, David G. Wilson

Michigan Tech Publications

This paper introduces a novel control archetype designed to mitigate high-altitude electromagnetic pulse (HEMP) (Formula presented.) disturbances on the power grid, as well as information on performance and specifications of different control laws for the controller archetype. This method of protection has been overlooked in the literature until now. A controlled voltage supply is placed on the load-side of a transformer, diverting unwanted power from the transformer core to prevent saturation. The controlled voltage source is modeled using four control laws: an integral controller (capacitor), Linear Quadratic Regulator (LQR), an energy storage minimized feedforward control law, and a Hamiltonian feedback …

Structural Framework And Tectonic Implications From Field Investigations In The Ramelau Mountains, Timor-Leste, Tanner A. Nielsen Dec 2025

Structural Framework And Tectonic Implications From Field Investigations In The Ramelau Mountains, Timor-Leste, Tanner A. Nielsen

Theses and Dissertations

Recent advances in petroleum exploration off the southern coast of Timor-Leste and emerging mineral discoveries onshore have underscored the need for a more comprehensive structural understanding of the nation's geology. Although new structural models have been proposed for other parts of Timor, limited progress has been made toward developing detailed models for the Ramelau Mountains, which presents the highest structural relief of the Timor Ranges. Previous mapping in this area has been largely reconnaissance in nature and focused primarily on surface bedrock geology. This study presents a new 1:62,500-scale geologic map and a geometric structural analysis of the Ramelau region …

Brief Of Lindsay And Matt Moroun Religious Liberty Clinic As Amicus Curiae In Support Of Appellants, John A. Meiser, Meredith Holland Kessler

Court Briefs

Nos. 25-2575, 25-2662
Commonwealth of Pennsylvania v. President United States of America

On Appeal from the U.S. District Court for the Eastern District of Pennsylvania
No. 2:17-cv-04540-WB (Hon. Wendy Bettlestone)

From the Summary of the Argument

The agencies’ promulgation of the Religious and Moral Rules challenged in this case was neither arbitrary nor capricious. Widespread litigation against the agencies’ contraceptive mandate under the Religious Freedom Restoration Act— and multiple trips to the Supreme Court—made clear that the mandate violates the federally protected rights of organizations like the Little Sisters of the Poor. After years of failed efforts to alleviate that …

Sleep Menus: A Personalized Approach To Enhancing Patient Rest And Improving Sleep Quality, Justin W. Dorman Dec 2025

Sleep Menus: A Personalized Approach To Enhancing Patient Rest And Improving Sleep Quality, Justin W. Dorman

Doctor of Nursing Practice (DNP) Manuscripts

Sleep disruptions among hospitalized patients can negatively impact healing, recovery, and patient satisfaction. Hospital noise remains a persistent barrier to restful sleep, yet previous hospital-based noise reduction strategies have shown limited sustained success. This quality improvement project aimed to enhance patient-perceived sleep quality by implementing a patient-centered Sleep Menu offering patients earplugs or sound machines. A pre-post design was employed, using the Richard-Campbell Sleep Questionnaire (RCSQ) to assess patients' sleep quality before and after the Sleep Menu intervention. Sixty patients were approached; 25 chose earplugs, and 7 selected the sound machine. Despite environmental decibel levels remaining above the WHO recommendations …
