Sexual Politics Of The Anglo-American Relationship In 1942: A Case Study Of The United States V. Travis Hammond Court-Martial, Catherine Campbell
Sexual Politics Of The Anglo-American Relationship In 1942: A Case Study Of The United States V. Travis Hammond Court-Martial, Catherine Campbell
Honors Theses
On August 10, 1942, American private, Travis B. Hammond, was on trial for accusations of rape against a 16-year-old British girl, Maureen Thomson. This would mark the first American court martial case tried on British soil. This trial was preceded by the issuing of the United States (Visiting Forces) Act of 1942 (VFA) on August 6, 1942, which granted the United States military exclusive jurisdiction over their soldiers. When the Act was first given to Parliament, it was looked at in disdain as being wholly without precedent and antithetical to the norms within Britain. However, the importance of maintaining a …
Pay Gaps At The Top: How Ceo–Executive Compensation Disparity Affect Firm Performance, Anh Que Diep
Pay Gaps At The Top: How Ceo–Executive Compensation Disparity Affect Firm Performance, Anh Que Diep
Honors Theses
This paper examines the relationship between executive compensation disparity and firm performance using S&P 500 firms. CEO Pay Slice (CPS) is used to measure pay disparity, and firm performance is measured by Tobin’s Q and ROA. The results from fixed effects models show an inverted U-shaped relationship between CPS and firm performance, with performance maximized at approximately a 60% CEO Pay Slice. Further analysis decomposes CPS into fixed and performance-based components. The results show that fixed compensation disparity is positively and consistently associated with firm performance, while performance-based disparity has weaker and less robust effects. Taken together, the findings suggest …
A Critical Discourse Analysis Of Racial Justice In Virginia Higher Education, Abigail Green
A Critical Discourse Analysis Of Racial Justice In Virginia Higher Education, Abigail Green
Honors Theses
This honors thesis examines the extent to which public Virginia higher education institutions engage their institutional histories in leadership rhetoric when responding to the Trump administration’s anti-diversity, equity, and inclusion (DEI) policies. Employing a Critical Discourse Analysis (CDA) following Mullet’s (2018) seven-step framework with an inductive coding approach and grounded in rhetorical history theory, this study analyzes official statements from the Offices of the President and Provost across four case study institutions: the University of Virginia (UVA), George Mason University (GMU), the College of William & Mary (W&M), and Longwood University (LU). Data sources span two time periods: May 2020 …
Crafting The “Greatest Classics” Of Girlhood: Advice Columns, Diaries, And The Emotional Lives Of American Teenage Girls, 1918-1939, Kylee Violet King
Crafting The “Greatest Classics” Of Girlhood: Advice Columns, Diaries, And The Emotional Lives Of American Teenage Girls, 1918-1939, Kylee Violet King
Honors Theses
“Crafting the ‘Greatest Classics’ of Girlhood: Advice Columns, Diaries, and the Emotional Lives of American Teenage Girls, 1918-1939” explores how American teenage girls who came of age between 1918 and 1939 used writing as a form of expression. As a response to the heightened anxieties—the “storm and the stress”—that was caused by the social structure of the era, teenage girls used writing in advice column letters and diaries as a form of self-fashioning, self-reflection, and self-therapy to discuss courtship, dating, and romantic relationships. Additionally, depending on the medium, writing acted as a form of advice seeking and community support. Writing …
From Shock To Routine: The Evolving Impact Of Shutdown-Related Sentiment On Stock Markets, Yiran Shao
From Shock To Routine: The Evolving Impact Of Shutdown-Related Sentiment On Stock Markets, Yiran Shao
Honors Theses
To address gaps in existing research, this paper selects two U.S. government shutdown periods, 2018-2019 and 2025, as research samples to explore the effect of policy uncertainty on sentiment. This paper primarily analyzes the following two research questions.
First, what is the correlation between government shutdown-related sentiment during the shutdown period and daily market fluctuations? Specifically, can the sentiment index constructed from shutdown-related news effectively predict the next-day stock return during the event period?
Second, does the market have a learning effect? That is, between 2018-2019 and 2025, has the relationship between shutdown-related emotions and market outcomes weakened, shortened the …
Borrowing By Committee: An Analysis Of The Link Between Government Type And Sovereign Debt, René Polanco
Borrowing By Committee: An Analysis Of The Link Between Government Type And Sovereign Debt, René Polanco
Honors Theses
Previous literature is divided about the impact of democracy on sovereign debt. In the context of the third wave of autocratization (Lührmann & Lindberg, 2019), this paper uses a new dataset (the Episodes of Regime Transformation) focused on regime transitions to analyze the impact of democracy and regime change on the levels of sovereign debt for a panel of 167 nations between 2008 and 2024. I examine how democracy impacts debt level, borrowing, and debt service and dovetail these results with analogous ones regarding how states of transition impact the same measures. By including this extra wrinkle of government transition, …
How To Evaluate Non-Majority Control: What History And Statutes Tell Us—Part Ii: The Definitional Consensus, J. Travis Laster
How To Evaluate Non-Majority Control: What History And Statutes Tell Us—Part Ii: The Definitional Consensus, J. Travis Laster
Fordham Journal of Corporate & Financial Law
This Article and a companion piece explore the claim that the functional school was novel and anomalous. The companion article examines the approaches that courts have historically taken when evaluating non-majority control (the “Historical Article”). The Historical Article demonstrates that functionalism has been the dominant approach since at least 1912, while the formal school is a recent innovation. Its tenets emerged in 2006 and coalesced in a recognizable framework around 2014. The Historical Article identifies the core claims of the two schools.
This Article examines statutory definitions of control. It focuses on statutory regimes that use the concept of control …
Reevaluating Consumer Debt Enforcement: Why We Don’T Need Courts To Enforce Consumer Debt Contracts, Adam Toobin
Reevaluating Consumer Debt Enforcement: Why We Don’T Need Courts To Enforce Consumer Debt Contracts, Adam Toobin
Fordham Journal of Corporate & Financial Law
Enforcing consumer debt contracts against low- and middle-income borrowers, rather than making consumer debt markets work better, is inefficient and exacerbates consumer protection concerns. While consumer debt litigation—and enforcement of consumer debt contracts through wage and bank account garnishment—may have once strengthened nascent consumer debt markets, consumer credit scoring now effectively structures consumers’ incentives to repay their debt obligations. Debt enforcement is not necessary to encourage consumers to repay their debts and tends to drive borrowers into bankruptcy. Debt enforcement also undermines efforts to provide consumer protection in these markets by raising the stakes of any debt contract—where any default …
Insider Trading In Crypto Assets—Back To First Principles?, Katja Langenbucher
Insider Trading In Crypto Assets—Back To First Principles?, Katja Langenbucher
Fordham Journal of Corporate & Financial Law
This Essay examines whether the traditional rationales for prohibiting insider trading, which were developed for securities markets that facilitate capital formation, translate meaningfully to the emerging regulatory landscape for crypto assets. It contrasts the U.S. duty-based regime, grounded in fraud and fiduciary or confidential relationships under Rule 10b-5, with the EU’s information-based approach under the Market Abuse Regulation, which links trading prohibitions to mandatory disclosure of inside information. The former has proven underinclusive—prompting prosecutors to rely on wire fraud in recent crypto cases such as Wahi and Chastain while the latter tends toward overinclusivity.
Turning to the newly emerging regimes …

Directors’ Fiduciary Duties In The Likelihood Of Insolvency, Miguel Martínez Muñoz
Fordham Journal of Corporate & Financial Law
The purpose of this Essay is to analyze the Directive and its interaction with American law in order to establish some considerations in coordinating the provisions of insolvency and corporate law. This Essay focuses on the configuration of a new framework of directors’ liability in which, among other aspects, the identity of the parties subject to the duties is expressly defined, as well as the application of the rules regulating the protection of corporate discretion as well as the application of the rules regulating the business judgment rule. In turn, the Essay puts forward some proposals for a solution to …
Antitrust And Tech Giants: Learning From United States V. Google Llc, Marcus D’Agostino
Antitrust And Tech Giants: Learning From United States V. Google Llc, Marcus D’Agostino
Fordham Journal of Corporate & Financial Law
This Note addresses the evolution of antitrust regulation and enforcement in the United States, with a focus on the recent case of United States v. Google LLC. That case is used to frame the broader problem of insufficient remedies being implemented against large technology firms. The mild remedies granted to the government in Google reinforce the findings of the 2020 Congressional Report on Digital Competition. The Report recommended changes to the antitrust laws that would revive structural separation as a remedy. This Note argues that the body of evidence presented compels structural separation to be used more frequently as the …
Zero Tolerance Or Strong Cultural Diversity: The Hard Case Of Female Genital Surgery, James M. Donovan, Christiane Canant
Zero Tolerance Or Strong Cultural Diversity: The Hard Case Of Female Genital Surgery, James M. Donovan, Christiane Canant
Law Faculty Scholarly Articles
This article applies a thesis favoring strong cultural diversity to defend a subject-centered policy regarding female genital surgeries (FGS). That idea posits that cultural variation holds an intrinsic value that should be presumptively respected when setting policy and creating law. Correlatively, cultural homogenization, especially by force, should be resisted.
Taking as a starting point the recent celebration of the United Nation’s Day of Zero-Tolerance for Female Genital Mutilation, the paper reviews the context of FGS practices in various societies and critiques the inconsistencies of U.N. arguments to advance its goal of total elimination by 2030. Especially problematic for the U.N. …

Rewwild: Reimagining Environmental And Wildlife Wellbeing Through Innovative Lawn Design, Morgan J. Sandau, Maiya G. Roelen, Katia E. Chavez, Lydia K. Niedermeyer
Undergraduate Theses, Professional Papers, and Capstone Artifacts
Manicured, monoculture lawns often dominate private land in urban areas for aesthetic organization. Colonialist roots are embedded in the history of turfgrass lawns and white-picket fences intended to suppress Indigenous knowledge and ways of caring for the diverse land around us. Private land misuse and homogenous lawns are not limited to the United States; the modern lawn contributes to biodiversity loss on a global scale. Humans are concentrated in cities across the world, and urban areas are known to have negative implications for wildlife and habitat, human health, and sustainable resource use. Management of private land in urban settings is …
A Ministry Manual For Supporting Pastoral Transitions: Addressing The Emotional And Spiritual Needs Of Clergy And Their Families, John Tucker
Dissertations
Pastoral transitions represent spiritually significant yet often under-supported moments in the life of clergy, congregations, and ministry networks. While leadership change is frequently framed in theological language emphasizing divine calling and institutional continuity, insufficient attention is given to the emotional, relational, and familial dimensions of these transitions. This Doctor of Ministry project examines the spiritual and emotional impact of pastoral transitions within African American church contexts, with particular attention to clergy wellbeing and systems of care.
This study employed a mixed-methods research design integrating quantitative survey data with qualitative semi-structured interviews. Survey instruments were distributed to pastors affiliated with The …
No More Ieepa Tariffs? The Legal Bases Of An Alternative Regime, Lawrence J. Liu
No More Ieepa Tariffs? The Legal Bases Of An Alternative Regime, Lawrence J. Liu
Minnesota Law Review Headnotes, Vols. 107 onward (2022-present)
Since retaking office in January 2025, President Trump has accelerated and expanded his use of tariffs. Although many of these actions had been taken pursuant to a novel application of the International Emergency Economic Powers Act (IEEPA), the Supreme Court held in Learning Resources, Inc. v. Trump that IEEPA does not authorize the President to impose tariffs. This adverse decision notwithstanding, the administration continues to signal that its tariff regime will continue under different legal authorities.
This Essay thus trains attention on the likely legal bases of that alternative regime. I focus on six tools that have been or could …
Managing Deportation: How Docket Control Replaced Substantive Relief In Immigration Courts, Linus Chan
Managing Deportation: How Docket Control Replaced Substantive Relief In Immigration Courts, Linus Chan
Articles
In the modern deportation era, immigration courts saw their ability to grant relief from deportation undergo significant restrictions, constraining individualized discretion in favor of "categorical" denials. Congress dramatically curtailed the discretionary tools available to immigration judges, with the latest being the pair of immigration reforms from 1996, shifting the locus of individualized decision-making away from the courts and toward enforcement officers and prosecutors. Immigration courts lost discretion in being able to decide who could formally be granted status and stay in the United States when facing deportation through various restrictive eligibility requirements written into the law.
This Article argues that …

No One Told Their Story: Acculturation, Faith Formation, And Belonging In Multicultural Congregations Led By African American Pastors, Alicia L. Partee
No One Told Their Story: Acculturation, Faith Formation, And Belonging In Multicultural Congregations Led By African American Pastors, Alicia L. Partee
Doctor of Ministry
The search for meaning, identity coherence, and belonging often intensifies when individuals cross cultural boundaries. Faith communities can serve as sanctuaries for identity renegotiation, but congregations may also reproduce the social distance and exclusion found in the broader society. This dissertation addresses a scholarly and pastoral gap at the intersection of acculturation and Christian faith formation, and more specifically how identity, belonging, and spiritual formation are negotiated within multicultural congregations led by African American pastors in San Jose, California, and similar contexts.
Drawing on acculturation research in psychology, sociology, and anthropology, this study examines how culturally diverse newcomers experience culture …
Binding The Strongman: Understanding And Disarming Society's Anxious Systems, Jacob Eugene Osborne
Binding The Strongman: Understanding And Disarming Society's Anxious Systems, Jacob Eugene Osborne
Doctor of Ministry
Binding the Strongman seeks to address an underlying problem at the heart of western evangelicalism, an idolatry which contemporary Christianity has become enmeshed in as it relates to political figures, cultural influencers, and unhealthy spiritual leaders. The NPO examines how evangelicals engaged in politics are encountering barriers to spiritual growth largely due to systemic social and spiritual leadership issues caused by their position in a relational system that is experiencing chronic anxiety.
Binding the Strongman addresses underlying dynamics at the heart of every Christian, such as the unhealthy emotional systems they are prone to rely on as systems of truth, …
The New, New Song: Answering Decline In Mainline Communities Of Faith, Daniel Garrett Kuckuck
The New, New Song: Answering Decline In Mainline Communities Of Faith, Daniel Garrett Kuckuck
Doctor of Ministry
This project addresses the NPO Statement: “The practical theology of mainline congregations in decline is no longer speaking at all.” Research conducted across congregational contexts revealed that many communities of faith still believe deeply, but have lost the confidence and practice of articulating their faith story aloud. Decline is not only a matter of resources and worship size, but also of a congregation’s ability to name who they are, what God is doing among them, and why their story matters now.
The project emerges directly from my vocational context as a pastor and judicatory leader accompanying 130 worshipping communities across …
Cultivating Belonging In Church Communities: A Repeatable Model For Small Groups, Clancy Z. Kiener
Cultivating Belonging In Church Communities: A Repeatable Model For Small Groups, Clancy Z. Kiener
Doctor of Ministry
NPO Statement for this project is as follows:
Many individuals experience a diminished sense of belonging within religious environments. This lack of belonging can lead to disengagement and limit opportunities for authentic spiritual and communal formation. Structured, repeatable, moderator-led small groups— guided by trained moderators—offer a practical approach for fostering connection and strengthening a sense of belonging within church communities.
A key insight from this project is that many people in church communities experience a persistent sense of not belonging, even when they attend, serve, and believe alongside others. The research shows that belonging is not automatically created by shared …
Silent Struggles: The Hidden Burden Of Depression Among Black Single Mothers In Ghana, Sonja Brown
Silent Struggles: The Hidden Burden Of Depression Among Black Single Mothers In Ghana, Sonja Brown
Doctor of Ministry
Reflections Through the Single Mothers of the Bible examines depression among Black single mothers in Ghana as an overlooked yet urgent mental, physical, economic, social, and Spiritual concern, highlighting the need for integrated Faith-based and community-centered responses. While global attention to maternal mental health has increased, the lived experiences of Black single mothers, particularly within faith-shaped, patriarchal, and economically constrained Ghanaian contexts, remain underrepresented in scholarly research, theological discourse, and public policy. This gap presents a problem and an opportunity to develop holistic, culturally responsive, and faith-informed approaches to care and advocacy.
This dissertation argues that depression among Black single …
Embracing God's Call: The Case For The Ordination Of Black Female Pastors Within The Church Of God In Christ, Luquanda Hawkins
Embracing God's Call: The Case For The Ordination Of Black Female Pastors Within The Church Of God In Christ, Luquanda Hawkins
Doctor of Ministry
This dissertation explores the intersection of social justice and the ministry journey of Black women within the Church of God in Christ (COGIC), the most prominent Black religious denomination in the United States. It examines the historical and theological foundations of COGIC, with a focus on the systemic devaluation of Black women, the suppression of their leadership roles, and the antiquated policies that confine them to subservient positions. This study argues that the denial of leadership opportunities to women constitutes unequal treatment and represents a critical social justice issue.
The research highlights how many Black religious organizations, including COGIC, have …

Generative Ai Professional Development Program For Higher Education Instructors, Sheena Bahra
Dissertations
As technology progresses and brings enhanced forms of artificial intelligence (AI), such as generative AI (Gen AI), it continues to affect education by introducing opportunities and challenges in its application to higher education teaching. Advances in technology can make instructors reluctant to use applications, leading to missed learning and skill-development opportunities for higher-order thinking skills. This study investigates how AI professional development (PD) training can influence higher education instructors’ willingness to use Gen AI in the classroom. This study employed a qualitative instrumental case study design informed by an exploratory lens. The study investigated instructors’ use of Gen AI in …
Imagining South Korean Nationhood Through Remembering And Forgetting The South Korean Military In The Vietnam War, Robinson P. Lee
Imagining South Korean Nationhood Through Remembering And Forgetting The South Korean Military In The Vietnam War, Robinson P. Lee
Pitzer Senior Theses
Little more than a decade after being victimized by the devastating Korean War, South Korea fought in another devastating civil war in Asia, the Vietnam War. How is South Korean nationhood and political identity understood and articulated in the face of existential national questions presented by the Vietnam War? This thesis uses social and oral history approaches to put a myriad of primary and secondary sources in conversation with one another, building on the existing, limited English-language literature on South Korean military involvement in the Vietnam War. These approaches include examining narratives of Vietnam War atrocities, of an organized group …

Unspoken Loving: Depictions Of Brown Latina Motherhood & Mothering Onscreen, Jennifer L. Florencio
CMC Senior Theses
This senior thesis focuses on the depictions of intergenerational relationships between Latina Mothers and daughters on film, more specifically through analyzing Spanglish (2004) and Real Women Have Curves(2002). Additionally, emphasizing the lack of healthy communication and loving presence missing from said depictions of Latina mothering. The method follows the use of a plática, as a Chicana Feminist framework in holding space for communal dialogue and sharing knowledge as a means for having a conversation about the impacts and importance of having healthy representations of Latina Motherhood and Mothering in film media.
Testing The Governance Premium: Board Gender Diversity And Crisis-Period Returns During The Pandemic, Rhea Kulkarni
Testing The Governance Premium: Board Gender Diversity And Crisis-Period Returns During The Pandemic, Rhea Kulkarni
CMC Senior Theses
This paper examines whether board gender diversity predicts cumulative abnormal returns for S&P 1500 firms during the COVID-19 pandemic. Motivated by prior evidence linking board gender diversity to crisis-period stock performance and the broader question of whether governance quality is priced during periods of acute market stress, this study estimates cumulative abnormal returns across three economically distinct event windows covering the crash, recovery, and post-recovery periods using the Carhart (1997) four-factor model to test whether board composition translated into divergent outcomes across firms. The results fail to find evidence that board gender diversity predicts cumulative abnormal returns across any of …
